This is being issued with the prior concurrence of the Finance Department obtained vide No. Fin (c)B(7)-1/2013-53200307, dated the 14th July, 2015.

No.1-537/2008-Fin(LA)Vol-II-4005-4014.—In pursuance of Finance (Regulation) Department Office Memorandum No. Fin- (C)--G(1)-7/94 Loose dated 30.03.2015 and subsequent Office Memorandum No. Fin (C)-B(15)6/94 date 11.06.2015 vide which actual Travel Expenditure and Daily Allowance have been allowed to the staff engaged in the state on outsourced basis, the Governor, Himachal Pradesh is pleased to allow the above payments to the Article Assistants of Local Audit Department as per above OMs and subsequent revision/ instructions that may be ordered by the Finance Department in this regard, from time to time. As such the Condition No. 8 of the Terms and Conditions of engagement of Article Assistants as contained in Annexure-A of the scheme as was framed vide this office Notification of even No. dated 27-11-2008, which prohibited the payment of TA/ DA to these personel, is also hereby deleted.

The Headquarter of the Article Assistants for the purpose of above payment shall be the same as the Headquarter of the officer they are attached with.

No. PLG-B(4)1/2015.—The Governor, Himachal Pradesh, on the recommendation of the Departmental Promotion Committee is pleased to order the promotion of Shri Jaishi Ram, Computer Operator to the post of Programme Planning Officer Class-II in the pay scale of Rs. 10300-34800+4200 Grade Pay on regular basis with immediate effect.

The officer will remain on probation for a period of two years from the date of promotion and will also exercise option for fixation of pay under the provision of F.R. 22 within a period of one month from the date of issue of this order.

Consequent upon the promotion of above officer, the Governor, Himachal Pradesh is further pleased to post him as Proramme Planning Officer against vacancy shown as under with immediate effect in the public interest :—

The above Officer is directed to join the duties at the respective place of posting and send the joining report through proper channel.

संख्याः स्वास्थ्य-ए-एच(1)2013-लूज-II.--खाद्य सुरक्षा एवं मानक अधिनियम, 2006 (2006 का केन्द्रीय अधिनियम संख्यांक 34) की धारा 26 के साथ पठित धारा 92 की उपधारा (2) के खण्ड (झ) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण द्वारा बनाए गए खाद्य सुरक्षा एवं मानक (विक्रय पर प्रतिषेध और निर्बधन) विनियम, 2011 के विनियम 2.3.4, किसी खाद्य उत्पाद में संघटकों के रूप में तम्बाकू और निकोटीन का उपयोग प्रतिषिद्ध करता है;

किसी भी नाम से ज्ञात तम्बाकू युक्त गुटका या पान मसाला सुगंधित/चवर्ण पान मसाला या तम्बाकू, सुपारी, खैनी, मशेरी, ज़र्दा आदि स्वास्थ्य के लिए हानिकारक है;

गुटका एक खाद्य पदार्थ है, जिसमें तम्बाकू होता है और आजकल इसमें तम्बाकू, निकोटीन और मैग्नीशियम कार्बोनेट संघटक के रूप में सम्मिलित होते हैं; और इस प्रकार इससे खाद्य सुरक्षा एवं मानक विनियम, 2011 के विनियम 2.3.4 के साथ-साथ खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 के विनियम 3.1.7 का भी उल्लंघन होता है;

पान मसाला एक खाद्य पदार्थ है, जिसमें मैग्नीशियम कार्बोनेट संघटक के रूप में सम्मिलित होता है; और इससे खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 के विनियम 3. 1.7 का उल्लंघन होता है;

अतः ऐसे संघटकों से युक्त अंतिम उत्पादों के रूप में नामतः गुटका या पान मसाला, सुगंधित/ चवर्ण पान मसाला या तम्बाकू, सुपारी, खैनी, मशेरी, जर्दा का विनिर्माण, भण्डारण, विक्रय और वितरण प्रतिषिद्ध करना समीचीन है;

2494 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 अतः मैं, खाद्य सुरक्षा आयुक्त, हिमाचल प्रदेश, पूर्वोक्त विनियमों के विनियम 2.3.4 और 3.1.7 के साथ पठित पूर्वोक्त अधिनियम की धारा 30 (2)(क) के उपबन्धों द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, किसी भी नाम से ज्ञात अंतिम उत्पाद के रूप में गुटका या पान मसाला, सुगंधित/चवर्ण पान मसाला या तम्बाकू, सुपारी, खैनी, मशेरी, जर्दा आदि को निर्मिंत करने के लिए पृथकतः विपणित किसी अन्य उत्पाद को इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से एक वर्ष की अवधि के लिए सम्पूर्ण हिमाचल प्रदेश राज्य में प्रतिषिद्ध करता हूं और निदेश देता हूं कि यदि ऐसे उत्पादों का हिमाचल प्रदेश राज्य में विनिर्माण, भण्डारण, विक्रय/वितरण किया जाता है, तो ऐसा करने वाले व्यक्ति के विरूद्ध पूर्वोक्त अधिनियम के उपबन्धों के अनुसार कार्रवाई की जाएगी/उसे दण्डित किया जाएगा।

FOOD SAFETY & STANDARDS AUTHORITY

NOTIFICATION

Shimla-2, the 20th July, 2015

No. Health-A-H(1)-1/2013-Loose-II .—WHEREAS, regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011 made by the Food Safety and Standard Authority of India, in exercise of the powers conferred by Clause (I) of sub-section (2) of Section 92 of the Food Safety and Standards Act, 2006 (Central Act 34 of 2006) read with section 26 thereof, prohibits the use of tobacco and nicotine as ingredients in any food products.

And Whereas, Tobacco, containing Gutka or Pan Masala, Scented/Chewing Pan Masala or Tobacco, Supari, Khaini, Masheri, Zarda etc. known by any names are injurious to health.

And Whereas Gutka is an article of food which contains tobacco and now a days contains Tobacco, Nicotine and Magnesium Carbonate as ingredients; and thus contravenes regulation 2.3.4 of Food Safety and Standards (Prohibitionand Restrictions on sales) Regulations, 2011 as well as Regulation 3.1.7 of Food Safety and Standards (Food Products Standards and Food Additives) Regulation 2011.

And whereas, Pan Masala is an article of food which contains Magnesium, Carbonate as an ingredient and thus contravenes Regulations 3.1.7 of the Food Safety and Standards (Food Products Standards and Food Additives) Regulation, 2001.

And whereas it is expedient to prohibit the manufacture, storage, sale, distribution of products namely Gutka or Pan Masala, Scented/Chewing Pan Masala or Tobacco, Supari, Khaini, Masheri, Zarda as final products containing such ingredients.

Now therefore, I, the Food Safety Commissioner, Himachal Pradesh State in exercise of the powers conferred by provision of section 30(2)(a)of the Act ibid read with regulation 2.3.4 and 3.1.7 of the aforesaid regulations prohibit any other product marketed separately to constitute Gutka or Pan Masala, Scented/Chewing Pan Masala or Tobacco, Supari, Khaini, Masheri, Zarda2495 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 etc. by whatever name these are called as final products in the whole of the State of Himachal Pradesh for a period of one year from the date of publication of this notification in the Rajpatra, Himachal Pradesh and directed that if the said products are manufactured, stored, sold/distributed in the State of Himachal Pradesh, the persons doing so, will be proceeded/penalized against as per the provisions of the Act ibid.

NOTICE OF ADOPTION OF EXISTING LANDUSE MAP

No. HIM/TP/PJT/PA Kamand/2009/Vol-I/4062-79.—Whereas, objection and suggestions were invited vide Notice No. HIM/TP/PJT/PA Kamand/2009/Vol-I/13764-13825 dated17.2.2015 with respect to the Existing Land Use Map for Kamand Planning Area under sub-section (1) of Section 15 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977); and

Whereas, objections and suggestions were received and the modifications have been made in the said Existing Land Use Map, wherever required.

Now, therefore, in exercise of the powers vested under sub-section (3) of Section 15 of the Act ibid, Notice is given that the Existing Land Use Map for Kamand Planning Area is hereby 2496 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 adopted with modifications and a copy thereof is available for inspection during office hours in the following offices:—

1. Director, Town and Country Planning Department, Himachal Pradesh, Shimla.

2. Town and Country Planner, Divisional Town Planning Office, Mandi.

The said Existing Land Use Map shall come into operation with effect from the date of publication of this Notice in the Official Gazette of Himachal Pradesh and it shall be conclusive evidence of the fact that the Map has been duly prepared and adopted.

(2) State Programme Officer- One post to be filled on secondment basis from a College lecturers.

(3) Consultant- Two (On Secondment basis)

(4) Two Computer Data Operator- On outsourcing mode.

The expenditure on these posts of this State Project Directorate will be made from RUSA funds.

No. EDN-A-Cha (2)-1/2015.—In compliance with the direction of Hon'ble Supreme Court of India order dated 20.04.2015 in Special Leave to Appeal ( C ) Nos 11462-11463 of 2013- titled as Regional Director, C.B.I Vs. V.P. Ahluwalia & Ors. arising out of impugned final judgment and order dated 09/08/2011 in CWP No. 6454/2010, 05/09/2012 in CMP No. 8422/2012, 05/09/2012 in CWP No. 6454/2010 passed by the Hon'ble High Court of Himachal Pradesh and in consultation with Director, C.B.I. the Governor, Himachal Pradesh is pleased to order to constitute a Special Investigating Team (SIT) comprising of the following:—

2498 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 2. The Hon'ble Supreme Court has further ordered that :" For the purpose of investigation of this case, the above mentioned Committee is entrusted with all the powers of the superior officers contemplated under section 36 of the Criminal Procedure Code."

1. The Special Investigation Team (SIT) shall periodically report the progress of the investigation to the High Court of Himachal Pradesh and seek appropriate guidance in the matter.

2. The remuneration of the Chairperson SIT Sh. A.C. Verma, IPS Retired DGP for the task would be Rs. 1,25,000/-per month. The remuneration of other member's i.e. Sh. A.K. Malhotra, retired DIG (CBI) Rs. 90,000/-, Sh. P.C. Sharma, retired SSP (CBI) and Sh. Vijay Kumar retired Sr. SP CBI Rs. 70,000/- each, Sh. Ajay Kumar Mehra and Dr. Parminderjit Singh, Academicians Rs. 70,000/- each per month.

3. TA/DA and other allowances will be paid to the members of the SIT as are admissible to the rank of Secretary to the Government of Himachal Pradesh to both the candidates' i.e. retired and in-service members.

4. The Head quarter of Special Investigation Team (SIT) will be at Shimla.

5. The Director of Higher Education, Himachal Pradesh is required to render assistance to the SIT to complete the task expeditiously.

(i) The Director of Higher Education will also arrange accommodation, transportation, Secretarial Assistance and logical support etc. for the period to the SIT.

(ii) The Director of Higher Education will engage One Superintendant G-ll, Two Senior Assistants, One Clerk and Two Peons for this period for providing Secretarial Assistance to the SIT.

6. Sh. Ghanshyam Chand Additional Director of Higher Education will be the Nodal Officer of this inquiry Committee.

7. After Completion of the inquiry, the balance record if any, will be transferred to the Nodal Officer by the SIT.

संख्याःटी.एस.एम-एफ(6)-3/2001-II.—हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) संशोधन नियम, 2015 के प्रारूप को हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 की उपधारा (2) के खण्ड (च) और (छ) की अपेक्षा के अनुसार जन साधारण से आक्षेप(पों) और सुझाव (वों) आमन्त्रित करने के लिए इस विभाग की समसंख्यांक अधिसूचना तारीख 22-4-2015 द्वारा राजपत्र, हिमाचल प्रदेश में तारीख 23-4-2015 को प्रकाशित किया गया था;

और नियत अवधि के दौरान इस बावत निदेशक, पर्यटन एवं नागरिक उड्‌डयन के माध्यम से जनसाधारण से सुझाव प्राप्त हुए हैं और उन पर सम्यक्‌ रूप से विचार किया गया तथा उन्हें प्रारूप नियमों में सम्मिलित कर लिया गया है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संख्यांक 15) की धारा 64 की उपधारा (2) के खण्ड (च) और (छ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) संशोधन नियम, 2015 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. नियम 2 का संशोधन.--हिमाचल प्रदेश वायु क्रीड़ा (एअरो स्पोर्टस) नियम, 2004 (जिन्हे इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) के नियम 2 में , -

(i) खण्ड (ख) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

''(ख) ''संगम'' से, हिमाचल प्रदेश सहकारी सोसाइटी अधिनियम, 1968 या हिमाचल प्रदेश सोसाइटी रजिस्ट्रीकरण अधिनियम, 2006 के अधीन रजिस्ट्रीकृत सोसाइटी अभिप्रेत है;'';

(ii) खण्ड (ङ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

''(ङ) ''ऑपरेटर'' से साहसिक खेल-कूद ऑपरेटर अभिप्रेत है, जो इस रूप में वाणिज्यक आधार पर अर्थात्‌ प्रशिक्षण, मनोरंजन या क्रीड़ा के प्रयोजन के लिए वायु क्रीड़ा के कार्यान्वयन के लिए या नियोजन या नियोजन की प्रस्थापना के लिए अधिनियम के अधीन रजिस्ट्री—त है;''; और

(iii) खण्ड (ञ) का लोप किया जाएगा।

3. नियम 3 का संशोधन.--उक्त नियमों के नियम 3 के उप नियम (3) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्‌ :-

''(3) यथास्थिति, उस/उन ऑपरेटर (रों) या संगमों जिनके पास रजिस्ट्रीकरण से पूर्व स्थानीय कार्यालय है, को हिमाचल प्रदेश पर्यटन विभाग के पास रजिस्ट्री—त किया जाएगा।'' 4. नियम 4 का संशोधन.--उक्त नियमों के नियम 4 में, -

(क) उप-नियम (1) में, ''100'' अंकों के स्थान पर ''2000'' अंक रखे जाएंगे। ; और (ख) उप-नियम (2) में, ''एक वर्ष'' शब्दोेंं के स्थान पर ''तीन वर्ष'' शब्द रखे जाएंगे । 5. नियम 5 का प्रतिस्थापन.--उक्त नियमों के नियम 5 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ :-

''5. पायलट/गाइड/अनुदेशक/एकल पायलट/टैनडम पायलट का रजिस्ट्रीकरण और अर्हताएं- वायु क्रीड़ा प्रचालन में पायलट/गाइड/ अनुदेशक / एकल पायलट/टैनडम पायलट के रूप में भाग लेने के लिए आशयित कोई व्यक्ति, यथास्थिति, जिला पर्यटन विकास अधिकारी/ सहायक पर्यटन विकास अधिकारी के पक्ष में संदेय 500/- रुपए के मांगदेय ड्राफ्ट2500 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 सहित, यथास्थिति, सम्बद्ध जिला पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी को आवेदन कर सकेगा, जो अपना समाधान होने पर कि रजिस्ट्रीकरण के लिए आवेदन करने वाला व्यक्ति रजिस्ट्रीकरण के लिए अपेक्षित अर्हताओं और स्तरमानों को पूर्ण करता है और तत्पश्चात्‌ तकनीकी समिति के अनुमोदन से तीन वर्ष की अवधि के लिए रजिस्ट्रीकरण प्रमाण-पत्र जारी करेगा ।''।

6. नियम 7 का संशोधन.--उक्त नियमों के नियम 7 में, -

(i) खण्ड (घ) में, ''11'' अंक के स्थान पर ''15'' अंक रखा जाएगा। ; और

(ii) खण्ड (ङ) में, ''को अधिसूचित'' शब्दों के स्थान पर ''की पहचान'' शब्द रखे जाएंगे। 7. नियम 9 का संशोधन.--उक्त नियमों के नियम 9 के उप-नियम (3) में, ''जनरल'' शब्द के स्थान पर ''ग्लोबल'' शब्द रखा जाएगा।

8. नियम 11 का संशोधन.--उक्त नियमों के नियम 11 में , -

(क) खण्ड (झ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ :-

''(झ) उसने प्रत्येक एयर राफ्ट की लॉगबुक अनुरक्षित न की हो, जो उसके द्वारा किए जाने वाले प्रयोग, निरीक्षण, मरम्मत और सुरक्षा उपायों का अभिलेख होगी जिसे ड्‌यूटी पर संगम के सदस्य द्वारा पाक्षिकतः प्रतिहस्ताक्षरित किया जाएगा और इसे निरीक्षण प्राधिकारी द्वारा भी निरीक्षण की तारीख के प्रति-हस्ताक्षरित किया जाएगा तथा वह अपनी टिप्पणियां अभिलिखित करेगा ; '' और (ख) खण्ड (ञ) में ''विमान'' शब्द के स्थान पर ''एयर राफ्ट'' शब्द रखे जाएंगे।

9. नियम 17 का संशोधन.--उक्त नियमों के नियम 17 के खण्ड (क) में, ''विमानन (एअर क्राफ्ट)'' शब्दों और कोष्ठक के स्थान ''एअर राफ्ट'' शब्द रखे जाएंगे।

No.Tsm-F(6)-3/2001-II.—Whereas, the draft Himachal Pradesh Aero Sports (Amendment) Rules, 2015 was published in the Rajpatra, Himachal Pradesh dated 23-4-2015 vide this Department notification of even number dated 22-4-2015 for inviting objection(s) and suggestion(s) from the general public, as required under clauses (f) and (g) of sub-section (2) of section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002);

And whereas, suggestions have been received from the general public through Director, Tourism & Civil Aviation in this behalf during the stipulated period and the same have been duly considered and incorporated in the draft rules;

Now, therefore, in exercise of the powers conferred by clauses (f) and (g) of sub-section (2) of section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No.15 of 2002), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Aero Sports (Amendment) Rules, 2015.

(2) They shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of rule 2.—In rule 2 of the Himachal Pradesh Aero Sports Rules, 2004 (hereinafter referred to as the 'said rules'),—

(i) for clause (b), the following clause shall be substituted, namely:—

"(b) "Association" means a society registered under the Himachal Pradesh Co- operative Societies Act, 1968 or the Himachal Pradesh Societies Registration Act, 2006;" ;

(ii) for clause (e), the following clause shall be substituted, namely:—

"(e) "Operator" means an Adventure Sports Operator who is registered as such under the Act for carrying out or engaged in or offering to engage the Aero sports on commercial basis i.e. for the purpose of training, recreation or sport;" ; and

(iii) clause (j) shall be omitted.

3. Amendment of rule 3.—In rule 3 of the said rules, for sub-rule(3), the following sub- rule shall be substituted, namely :—

"(3) The operator (s) or associations, as the case may be, who have local office prior to registration, shall be registered with the Tourism Department, Himachal Pradesh." 4. Amendment of rule 4.—In rule 4 of the said rules,—

(a) in sub-rule (1), for the figure "100", the figure "2000" shall be substituted. ; and (b) in sub-rule (2), for the words "one year", the words "three years" shall be substituted.

5. Substitution of rule 5.—For rule 5 of the said rules, the following rule shall be substituted, namely :—

"5. Registration and Qualifications of Pilot / Guide / Instructor / Solo Pilot / Tandem Pilot.- Any person who intend to participate in an aero sports operation as a pilot/guide/instructor / Solo Pilot / Tandem Pilot may make an application to the concerned District Tourism Development Officer or Assistant Tourism Development Officer, as the case may be, alongwith a demand draft of Rs.500/- payable in favour of District Tourism Development Officer/ Assistant Tourism Development Officer, as the2502 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2015/31 आषाढ़, 1937 case may be, who, on being satisfied that the person applying for registration fulfils the requisite qualifications and standards for registration and after with the approval of the Technical Committee, shall issue a certificate of registration for a period of three years."

6. Amendment of rule 7.—In rule 7 of the said rules,—

(i) in clause (d), for the figures "11", the figures "15" shall be substituted. ; and (ii) in clause (e), for the word "notify", the word "identify" shall be substituted.

7. Amendment of rule 9.—In rule 9 of the said rules, in sub-rule (3), for the word "General", the word "Global" shall be substituted.

8. Amendment of rule 11.—In rule 11 of the said rules,—

(a) for clause (i), the following clause shall be substituted, namely :—

"(i) he maintains a log book of each air raft, which shall be a record of usage, inspection, repairs and safety measures to be undertaken by him which shall be countersigned by the member of the association on duty fortnightly and it shall also be countersigned by the inspecting authority on the date of visit and record his remarks." ; and

(b) in clause (j), for the word "aircraft", the word "air raft" shall be substituted.

9. Amendment of rule 12.—In rule 12 of the said rules, in sub-rule (4), for the word "ad- hearing", the word "adhering" shall be substituted.

10. Amendment of rule 17.— In rule 17 of the said rules, in clause (a), for the word "aircraft", the word "air raft" shall be substituted.
