संख्याः ई0एक्स0एन0-एफ(10)-20/2014-लूज़.--हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) से संलग्न अनुसूची-'क' और 'ख' में संशोधनों के प्रारूप को हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 की धारा 6 की उपधारा(1) और धारा 9 के साथ पठित 84-राजपत्र/2015-28-07-2015 (2591) 2592 राजपत्र, हिमाचल प्रदेश, 28 जुलाई, 2015/6 श्रावण, 1937 धारा 10 की अपेक्षानुसार इस विभाग की अधिसूचना संख्याःई0एक्स0एन0-एफ(10)-20/2014-लूज़, तारीख 24 जून,2015 द्वारा जनसाधारण से आक्षेप(पों)/सुझाव(वों) को आमंत्रित करने के लिए राजपत्र, हिमाचल प्रदेश में तारीख 25 जून,2015 को प्रकाशित किया गया था;

और, नियत अवधि के भीतर इस निमित्त कोई भी आक्षेप/सुझाव प्राप्त नहीं हुए हैं;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 6 की उपधारा(1) और धारा 9 के साथ पठित धारा 10 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पूर्वोक्त अधिनियम से संलग्न अनुसूची-'क' और अनुसूची-'ख' में तारीख 25-07-2015 से निम्नलिखित संशोधन करते हैं; अर्थात्‌ः--

1. अनुसूची-'क' का संशोधन.--हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की अनुसूची-'क' के भाग-2-'क' में, मद संख्याः 37 और 66 के पश्चात्‌ क्रमशः निम्नलिखित मदें 37-क और 66-क अन्तःस्थापित की जाएंगी, अर्थात्‌ः--

"37-क ट्रकों और बसों के ढांचों का निर्माण

66-क एल.ई.डी. बल्ब ।"।

2. अनुसूची-'ख' का संशोधन.--उक्त अधिनियम की अनुसूची-'ख' में मद संख्याः18 के पश्चात्‌ निम्नलिखित मद 18-क अन्तःस्थापित की जाएगी, अर्थातः-

"18-क ऊर्जा और संसाधन संस्थान(टेरी) द्वारा प्रमाणित या नवीन और नवीकरणीय ऊर्जा मन्त्रालय (एम.एन.आरई.) द्वारा अनुमोदित ऊर्जा उन्नत चूल्हे ।"।

No.EXN-F(10)-20/2014-Loose.—Whereas, the draft amendments in SCHEDULES 'A' and 'B' appended to the Himachal Pradesh Value Added Tax Act,2005( Act No.12 of 2005) was published in the Rajpatra, Himachal Pradesh dated 25th June,2015 for inviting objection(s)/suggestion(s) from the general public, vide this department notification No. EXN- F(10)-20/2014-Loose dated 24th June, 2015 as required under section 10 of the Himachal Pradesh Value Added Tax Act, 2005;

And whereas, no objection(s)/suggestion(s) has been received within the stipulated period in this behalf;

Now, therefore, the Governor, Himachal Pradesh in exercise of the powers conferred by section 10 read with sub section(1) of section 6 and section 9 of the Himachal Pradesh Value Added Tax Act,2005(Act No.12 of 2005) is pleased to make the following amendments in SCHEDULE-'A' and SCHEDULE-'B' appended to the Act ibid, with effect from 25-07-2015, namely:—

1. AMENDMENT OF SCHEDULE 'A'.—In the Himachal Pradesh Value Added Tax Act, 2005 (hereinafter referred to as the said Act), in SCHEDULE 'A', in Part-II-'A', after items No. 37 and 66, the following items 37-A and 66-A shall respectively be inserted, namely:—

"37-A Fabrication of body of trucks and buses

66-A LED bulbs.".

2. AMENDMENT OF SCHEDULE 'B'.—In the said Act, in SCHEDULE 'B', after item No.18, the following item 18-A shall be inserted, namely:—

"18-A Energy Efficient Chulhahs certified by the Energy & Resources Institute (TERI) or approved by the Ministry of New & Renewable Energy(MNRE).".

No. Home-B (B) 15-10/2006-HC .—In exercise of the powers vested in him under Sub- Section (1) of the Section 20 of the Code of Criminal Procedure, 1973, the Governor, Himachal Pradesh is pleased to confer the powers of Executive Magistrates upon the Naib Tehsildar/Tehsildars in the State of Himachal Pradesh, under the said Code to be exercised within the local limits of their respective jurisdictions for performing the functions enlisted at Sr. No. 2 to 8 of this Department's letters No. Home-B (B)-12-5/84 dated 4-12-84 and 28.12.84 (Copies enclosed).

The function enlisted at Sr. No. 1 (cases under Criminal Procedure Code) of above letters shall be performed by the Sub Divisional Magistrates, who either belong to the IAS or HPAS. They will not transfer such cases to other Executive Magistrate except in rare and exceptional case and for pressing reasons. When the cases under Criminal Procedure Code are required to be transferred, the same will be transferred to such Executive Magistrates, who have passed the Departmental examination in Criminal Law and Procedure prescribed for them and possess requisite educational qualifications which would be atleast Graduate in case of direct recruits and Matriculation in case of promotees with atleast 5 years of experience by recording reasons for transfer on the case file as well as in the periodical returns submitted by the Executive Magistrates to the High Court.

This is in supersession of this department notification of even number dated 11.3.2011.

Judicial Academy, Shimla as Additional District & Sessions Judge with immediate effect in the cadre of District Judges/Additional District Judges on adhoc basis with the condition that he will not claim any seniority or any right in the aforesaid cadre.

उपरोक्त अनवान मुकद्दमा सायल श्री राकेेश कुमार पुत्र सुन्दर पुत्र सालिगराम उर्फ सलगर, गांव किलोड, परगना किहार, तहसील सलूणी, जिला चम्बा, हि0 प्र0 ने इस न्यायालय में एक प्रार्थना-पत्र ब्राए वसीयतनामा को तहसील कार्यालय में पंजीकृत करवाने वारा गुजारा है। जिसमें सायल ने व्यक्त किया है कि श्रीमती सीता पुत्री सालिगराम उर्फ सलगर, निवासी गांव किलोड, परगना किहार, तहसील सलूणी, जिला चम्बा सायल की सगी बुआ थी जोकि वफात पा चुकी है। श्रीमती सीता सगी बुआ ने अपने मायके वाक्या महाल किलोड परगना किहार तहसील सलूणी जिला चम्बा की अपनी अचल सम्पति की वसीयत दिनांक 30.11.2003 को सायल के नाम समान भाग में तहरीर करवा रखी है। सायल की बुआ वृद्धावस्था होने व चलने फिरने में असमर्थ होने के कारण तहसील हजा में उक्त वसीयत नामा को पंजीकृत न करवा सकी। अतः अब सायल रजिस्ट्रेशन ऐक्ट 1908 की धारा 40-41 के तहत उक्त वसीयत को तहसील हजा में पंजीकृत करवाना चाहते हैं।

अतः सर्वसाधारण को इस ईश्तहार के माध्यम से सूचित किया जाता है कि यदि किसी व्यक्ति को उक्त वसीयतनामा को पंजीकृत करवाने वारा कोई उजर व ऐतराज हो तो दिनांक 31-07-2015 को प्रातः 2596 राजपत्र, हिमाचल प्रदेश, 28 जुलाई, 2015/6 श्रावण, 1937 10.00 बजे या इससे पहले प्रातः 10.00 बजे से सायं 5.00 बजे तक किसी भी कार्य दिवस में असालतन या वकालतन हाजिर आकर अपना उजर व ऐतराज लिखित रुप में इस अदालत में पेश करे अन्यथा अदम पैरवी एकतरफा कार्यवाही अमल में लाई जायेगी। इसके उपरान्त कोई भी उजर व ऐतराज काबिले समायत न होगा व सायलान की वसीयत को पंजीकृत करने के आदेश पारित कर दिये जायेंगे।

Shri Hira Nand Sharma R/o Sharda Sadan Sangti, Sanjauli, Shimla, Himachal Pradesh has filed an application along with affidavit in the court of undersigned under section 13(3) of the Births & Deaths Registration Act, 1969 to enter date of death of his paternal Aunt named—Smt. Shanta Devi W/o Lt. Shri Diwan Chand R/o Village Chamrog P.O. Tara Devi, Gram Panchayat Rajhana, Tehsil & District Shimla, Himachal Pradesh in the record of Birth and Death, Gram Panchayat Rajhana. Gram Panchayat Rajhana issued the non-availability certificate vide No. nil dated 10.06.2015.

Hence, this proclamation is issued to the general public if they have any objection/claim regarding entry of the date of death of above named in the record of Gram Panchayat Rajhana, may file their claims/objections on or before one month of publication of this notice in Govt. Gazette in this court, failing which necessary orders will be passed.

श्री राजू पुत्र श्री भूपेन्द्र, गांव ठारू नाग (शिवान) तहसील कुमारसैन का आवेदन-पत्र अति0 जिला रजिस्ट्रार जन्म एवं मृत्यु शिमला हि0प्र0 के माध्यम से इस न्यायालय में प्राप्त हुआ है जिसमें जिक्र किया गया है कि इनके पुत्र रवि कुमार की जन्म तिथि 13-06-1994 है, नकल परिवार रजिस्टर में दर्ज है, परन्तु जन्म पंजीकरण रजिस्टर में रवि कुमार पंजीकृत नहीं है। पुष्टि हेतू शपथ पत्र व परिवार रजिस्टर की नकल संलग्न कर रखी है।

अतः इस नोटिस के माध्यम से आम जनता व खास को सूचित किया जाता है कि यदि उनके बेटे रवि कुमार की जन्म तिथि दर्ज करने बारे कोई उजर व ऐतराज हो तो वह असालतन व वकालतन दिनांक 19/8/2015 को सुबह 10.00 बजे इस न्यायालय में पेश कर सकता है। अन्यथा नाम व जन्म तिथि पंजीकृत करने के आदेश सम्बन्धित सचिव को नियमानुसार पारित कर दिये जायेंगे।

उपरोक्त मुकदमा में श्री प्यार सिंह पुत्र श्री पोहलो राम, वासी गांव धुन्दला, तहसील बंगाणा, जिला ऊना (हि0 प्र0) ने इस न्यायालय में आवेदन पत्र प्रस्तुत किया है कि उसका दरुस्त नाम प्यार सिंह है परन्तु कागजात माल में उसका नाम प्यारा सिंह गलत दर्ज हुआ है। जिसकी दरुस्ती कागजात माल में करने बारे आदेश पारित किये जायें।
