NOTIFICATION

Shimla, the 31st August, 2015

No. HPERC/414/(Security Deposit).—In exercise of the powers conferred by clause(v) and (w) of sub-section (2), of section 181, read with section 47 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling it in this behalf, the Himachal Pradesh Electricity Regulatory Commission (hereinafter called "the Commission" or "the HPERC") proposes to amend the 112-राजपत्र/2015-1-09-2015 (3429) 3430 राजपत्र, हिमाचल प्रदेश, 1 सितम्बर, 2015/10 भाद्रपद, 1937 Himachal Pradesh Electricity Regulatory Commission (Security Deposit) Regulations, 2005, published in the Rajpatra, Himachal Pradesh, dated 30th March, 2005 and hereby publishes the proposed draft amendment regulations, as required by sub-section(3) of section 181 of the said Act, read with rule 3 of the Electricity (Procedure for Previous Publication) Rules,,2005, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft amendment regulations will be taken into consideration after the expiry of 30 days from the date of their publication in the Rajpatra, Himachal Pradesh, together with any objections or suggestions which may, within the aforesaid period, be received in respect thereto. The draft of proposed amendments is also available on the HPERC website www.hperc.org.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations shall be called the Himachal Pradesh Electricity Regulatory Commission (Security Deposit) (Second Amendment) Regulations, 2015.

(2) These regulations shall come into force with effect from 1st December, 2015.

2. Amendment of regulation 3.—In sub- regulation (1) of regulation 3 of said regulation, the following proviso shall be added, namely:—

"Provided that the licensee may not obtain such security in case where the supply of electricity is required for its own use."

3. Amendment of regulation 4.—The sub-regulation (4) of regulation 4 of said regulation shall be substituted, namely:—

"4 (a) the consumer gets or causes to get, one month before the expiry of the validity period, the Bank Guarantee extended for a minimum period of next three years at a time. (b) where there is any subsequent increase in the security deposit, the consumer shall pay the additional amount towards security in the form of cash/demand draft (DD) drawn in favour of the licensee or any other mode of payment acceptable to the licensee.

"Provided that the consumer who, prior to the 1st December, 2015, has opted and is continuing to avail the facility to pay the security deposit, in the form of Bank Guarantee, shall continue to avail of the said facility."

4. Amendment of regulation 6.—For sub-regulation (1) of regulation 6 of the said regulations, the following sub-regulations (1) shall be substituted, namely:

"(1) In respect of the consumers credit–rated as poor under regulation 9, the adequacy of the amount of security deposit viz- a-viz the charges for the period equivalent to summation of the billing cycle and additional one month, shall be reviewed by the licensee generally once in every year (preferably after revision of tariff for the respective year), based on the average consumption for the period representing 12 (twelve) months from April to March of the previous year."3431 राजपत्र, हिमाचल प्रदेश, 1 सितम्बर, 2015/10 भाद्रपद, 1937 5. Amendment of regulation 7.—In sub-regulation (1) of regulation 7 of the said regulations, for the words and figures "Bank Rate (as on 1st April of every year)", the words "weighted average of actual Bank Rate(s) for the previous year" shall be substituted.

6. Amendment of regulation 9.—For sub-regulation (1) of regulation 9 of the said regulations, the following sub-regulation (1) shall be substituted, namely:—

"(1) Every year, the licensee shall, of its own, carryout the credit rating of its existing consumers by applying uniform criteria, which shall be hosted on its website, for such credit rating in respect of each category of consumers."
