NOTIFICATION

No. HHC/Rules/22(24)83-II.—In exercise of the powers conferred by Section 139(b) of Code of Civil Procedure, 1908 read with Section 29 of the Himachal Pradesh Courts Act, 1976 and Section 297 of Code of Criminal Procedure the High Court of Himachal Pradesh makes the following amendments in the Himachal Pradesh Oath Commissioners (Appointment & Control) Rules, 2007:—

1. Short Title.—These Rules shall be called, "The Himachal Pradesh Oath Commissioners (Appointment & Control) (4th Amendment-2015) Rules,2007".

2. Commencement.—These Rules shall come into force with immediate effect.

3. Amendment.—After definition clause 3(b), the following clauses 3(b)(i) and 3(b)(ii) shall be inserted as follows:—

3(b)(i) "Administrative Tribunal" means "The Himachal Pradesh Administrative

Tribunal".

Commission, Shimla".

As a consequence of insertion of new clause 3(b)(ii), the definition clause 3(d)(i) in the Original Rules shall stand deleted.

After definition clause 3(c) in the Original Rules, the following clause 3(c)(i) shall be inserted and as a consequence thereof, definition clause d(ii) in the Original Rules shall stand deleted.

(c)(i) "Consumer Forum" means, "District Consumer Disputes Redressal Forum,

Shimla or other Consumer Disputes Redressal Fora in the State of H.P."

In the original Rule 3(d) the words "Registrar (Inspection)" occurring in 3rd line shall stand deleted and substituted by the words "Registrar (Judicial),Registrar(Administration)" before the words of "The High Court of Himachal Pradesh" and immediately after the words "the High Court of Himachal Pradesh" the words "the Registrar, Administrative Tribunal" shall be added.

After amendment this definition clause 3(d) shall read as under:—

3(d) Registrar means and includes the Registrar General, Registrar (Rules),

Registrar (Vigilance), Registrar (Judicial),

Registrar (Administration) of the High Court of Himachal Pradesh, Registrar,

Administrative Tribunal and the Registrar, Consumer Disputes Redressal

Commission, Shimla.

4. Strength of Oath Commissioners at each place.—In Original Rule-4 "regarding strength of Oath Commissioners at each place", after words, "The High Court" occurring in the second line and before words, "Consumer Disputes Redressal Commission", the words "Administrative Tribunal" shall be inserted.

After amendment this Rule shall read as under:

The number of Oath Commissioners for the High Court, Administrative Tribunal,

Consumer Disputes Redressal Commission, District Consumer Fora in HP as well as

at each District, Sub Divisional and Tehsil/Sub Tehsil Headquarters shall be

determined by the High Court from time to time.

5. Mode of Appointment.—In Original Rule-5 clauses(ii) to (v) shall stand deleted and substituted as under:—

`Clause-(ii)' when a vacancy of Oath Commissioner is likely to occur in the Administrative Tribunal/Consumer Commission/District Consumer Forum, the Registrar(s)/ President(s), shall invite applications at least 45 days before the expiry of the term of the serving Oath Commissioner(s) for filling up the vacancy from amongst the Advocates practicing in the Administrative Tribunal/Consumer Commission/Consumer Forum on the prescribed form annexed as Appendix-A to these Rules.

`Clause-(iii)', when a vacancy of Oath Commissioner is likely to occur within his jurisdiction, the District and Sessions Judge shall invite applications in respect of the Sessions Division, Headquarter direct, while in case of a place other than the Sessions3502 राजपत्र, हिमाचल प्रदेश, 7 सितम्बर, 2015/16 भाद्रपद, 1937 Division Headquarter through the Civil Judge (Senior Division)/Civil Judge(Junior Division) of the area concerned atleast 45 days prior to the expiry of the term(s) of serving Oath Commissioner(s) for filling the vacancy from amongst the advocates of the local Bar in the prescribed form annexed as Appendix-A to these Rules.

`Clause-(iv)', the District and Sessions Judge, the Registrar(s) Administrative Tribunal/ Consumer Commission/President(s),Consumer Forum in H.P. shall scrutinize the applications received from desirous candidates and in case an application is found to be not in order, the same shall be returned to the applicant with objections in writing and such applicant may file the application afresh, if he so desires, within the time to be specified by the District and Sessions Judge or Registrar(s) Administrative Tribunal/Consumer Commission/ President(s) Consumer Forum while returning the application.

`Clause-(v), in case the application(s) are found in order or are so found after removal of objections within the stipulated period, the District and Sessions Judge, the Registrar, Administrative Tribunal/Consumer Commission/ the President, Consumer Forum, as the case may be shall forward the applications to the Registrar General of the High Court at least ten days prior to the expiry of the term of the Oath Commissioner(s) alongwith his recommendations, if any, with the following information relating to the applicant:—

(a) Standing at the Bar;

(b) Whether lady/Schedule Caste/ Schedule Tribe/OBC/ Physically handicapped;

(c) Reputation of the applicant with regard to his integrity and honesty;

(d) Whether he has acted previously as Oath Commissioner, if so, the period thereof ?

(e) Whether he indulges in any malpractice like touting etc.?

(f) General behavior with public.

10. Periodical Inspection of the Registers maintained by Oath Commissioner.—In Rule-10 "regarding periodical inspection of the registers maintained by Oath Commissioner", the `clauses 10(i) and 10(ii)' stand deleted and substituted as under:—

`clause-10(i)' inspection of registers of Oath Commissioner(s) at the High

Court/Administrative Tribunal/Consumer Commission shall be conducted quarterly

by the Registrar or his nominee and at the Consumer Forum by its President and the

report shall be placed before Hon'ble the Chief Justice for perusal and orders.

'Clause10(ii)' The inspection of the Registers of the Oath Commissioners shall be

conducted quarterly at the headquarters of the District and Sessions Divisions by the

Civil Judge (Sr. Division) and at the Sub-Divisional headquarters by the Civil Judge

and if there are more than one Civil Judges, than by the Senior most Civil Judge. A

copy of the inspection note shall be sent to the respective District and Sessions Judge

by the Inspecting Officer by the 10th of the month and the consolidated statement of

the Division shall be sent by the District and Sessions Judge to the Registrar General

of the High Court by the 15th of the month following the month of the inspection.

12. Consignment.—In original Rule 12 (i) after the words "Registrar General of the High Court" and before the words "Registrar, State Consumer Disputes Redressal Commission", the words, "Registrar, Administrative Tribunal" shall be inserted.

After amendment this clause 12(i) shall read as under;-

"When the terms of the appointment of an Oath Commissioner expires and he is not

appointed for any other term he/she shall deposit the register of affidavit with the

Registrar General of the High Court, Registrar, Administrative Tribunal, Registrar,

State Consumer Dispute Redressal Commission, President Consumer Dispute

Redressal Forum, District and Sessions Judge or Senior most Civil Judge in the Sub-

divisional headquarter (where he was appointed as Oath Commissioner).

HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION, SHIMLA

NOTIFICATION

Shimla, the 29th August, 2015

No. HPERC/419.—WHEREAS the Himachal Pradesh Electricity Regulatory Commission (hereinafter referred as "the Commission") notified the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, which were published in the Rajpatra, Himachal Pradesh, dated 23rd May, 2012 (hereinafter called "the said Regulations)";

AND WHEREAS during the interaction with the association of Industrial Consumers, they have expressed that in the situations involving restoration of supply after permanent disconnection, even though certain rebate in the infrastructural development charges is allowed at the rates and as per timelines specified in the said Regulations but the some are too inadequate and infrastructural development charges should not be charged at all in such situations, keeping in view the recession being faced by the Industries and in the interest of promotion of industrial development in the State.

AND WHEREAS the Commission has also observed that the timelines given in clause (ii) of sub-regulation (2) of regulation 7 of the said Regulations and those as per the third proviso to regulation 10 of the said Regulations need to be harmonised even though these timelines are otherwise applicable under different situations.

AND WHEREAS to address the such complexity and hardships expressed by consumers, the Commission recognizes the need for liberlising the provisions by way of amendment in the relevant regulation of the said Regulations;

AND WHEREAS the Commission also feels that liberlisation of the timelines and of the rates for rebate under the regulation 10 of the said Regulations shall not only rationalize the existing provisions but shall also catalyze broadening of the consumer base, leading to gains to the distribution licensee by way of increase in the volume of business.

NOW, THEREFORE, in exercise of the powers conferred by section 46, read with section 181, of the Electricity Act,2003 (36 of 2003), read with section 21 of the General Clauses Act,1897 (10 of 1897), and all other powers enabling it in this behalf, the Commission proposes to make the following draft regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the said draft regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of twenty one (21) days from the date of notification together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

The text of the aforesaid draft regulations alongwith Explanatory Memorandum is also available on the website of the Commission i.e. http.//www.hperc.org. The objections or suggestions in this behalf should be addressed to the Secretary, Himachal Pradesh Electricity Regulatory Commission, Keonthal Commercial Complex, Khalini, Shimla- 171002.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) (Second Amendment) Regulations, 2015.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 10.—In the regulation 10 of the said regulations; for the third and fourth proviso, the following shall be substituted:—

"Provided further that if –

(i) the application for such new connection is for a similar connected load or contract demand and supply voltage, as had been sanctioned for the original connection;

(ii) the application from the new applicant is received simultaneously or within 365 days from the date on which the original connection was permanently disconnected;

(iii) the provisions of sub-regulation (3) of regulation 5 are not attracted; and

(iv) the applicant clears all outstanding dues, if any, against such previous connection, also including these relating to the infrastructure development charges, for such original connection which has been permanently disconnected;

the amount of infrastructural development charges and other costs payable by the applicant for the connected load or contract demand applied for, as per the provisions of regulation 5 shall be reduced by 100% of the amount of the infrastructural development charges worked out at the normative rates, as applicable at the time of receipt of application for new connection, under sub- regulation (2) of regulation 5 for the connected load/contract demand originally sanctioned or for the same applied for by the new applicant, whichever of the two is lower:

Provided further that if—

(i) the application from the new applicant is received after a period of 365 days from the date on which original connection is permanently disconnected; and

(ii) all other conditions, other than condition (ii) as per the third proviso to this regulation are fulfilled:

the percentage rate of such rebate as per the third proviso of this regulation shall be reduced by 5% for every period of 90 days or part thereof after the expiry of initial period of 365 days:

Explanation.—If the application for the new connection is received by the licensee on or after 366th day but upto and inclusive of 455th day from the date of permanent disconnection, the rebate under the fourth proviso to this regulation shall be allowed @ 95% of infrastructural development charges worked out at the normative rate, as applicable at the time of receipt of application for new connection, as per sub-regulation (2) of regulation 5 for the connected load/contract demand originally sanctioned or for the same applied for by the new applicant, which ever of the two is lower, and so on for every subsequent block of 90 days till such time, the rate of rebate becomes zero."

उपरोक्त उनवान मुकदमा में बावत कुमारी मीना पुत्री श्री परगन सिंह, गांव सुरंगाणी, परगना मन्जीर, तहसील सलूणी, जिला चम्बा (हि0 प्र0) ने एक दरख्वास्त पंजीकाध्यक्ष जन्म व मृत्यु जिला चम्बा के माध्यम से अदालत हजा में गुजारी है। जिसमें सायला ने व्यक्त किया है कि मेरी जन्म तिथि 06-06-1990 है। परन्तु अज्ञानता के कारणवश मैं अपनी जन्म तिथि ग्राम पंचायत ब्याणा के परिवार रजिस्टर में दर्ज नहीं करवा सकी। जिस कारण मुझे भारी परेशानी का सामना करना पड रहा है तथा सायला ग्राम पंचायत ब्याणा के परिवार रजिस्टर में अपनी जन्म तिथि दर्ज करवाने के आदेश जारी करवाना चाहती है। सायला ने प्रार्थना पत्र के साथ पंजीकाध्यक्ष जन्म एवम्‌ मृत्यु चम्बा का आज्ञा पत्र, ब्यान हल्फी, अप्राप्यता प्रमाण-पत्र, जन्म सूचना प्रपत्र व दो गवाहान के ब्यान हल्फी संलग्न किये हैं।

उपरोक्त उनवान मुकद्दमा सायलान श्री ओम प्रकाश पुत्र श्री सुरेन्द्र, निवासी गांव सूरी, परगना किहार, तहसील सलूणी, जिला चम्बा (हि0 प्र0) ने इस न्यायालय में एक प्रार्थना-पत्र बराए वसीयतनामा को तहसील कार्यालय में पंजीकृत करवाने वारा गुजारा है। जिसमें सायल ने व्यक्त किया है कि श्री प्यार चन्द सुपुत्र श्री श्रीधर, निवासी गांव सूरी, परगना किहार, तहसील सलूणी, जिला चम्बा, हि0 प्र0 मेरा सगा ताया थे जो दिनांक 19-05-2015 को वफात पा चुके है उनके परिवार में उनकी विधवा श्रीमती विलासो व एक बेटी कामना देवी है। चूंकि उक्त प्यार चन्द ताया खुद उम्र दराज थे व उनकी पत्नी विलासो ताई भी खुद उम्रदराज है व बेटी कामना देवी अभी नाबालिग है इसलिये मैं ओम प्रकाश अपने ताया श्री प्यार चन्द के परिवार की देखभाल करता आ रहा हूं। इसलिये श्री प्यार चन्द ताया खुद ने अपनी समस्त चल व अचल सम्पाि मेरे नाम घर पर अपने पूरे होश हवास व बिना किसी दबाव के दिनांक 10-05-2015 को लिखवा दी थी परन्तु सायल के ताया वृद्धावस्था होने व चलने फिरने में असमर्थ होने के कारण तहसील हजा में उक्त वसीयत नामा को पंजीकृत न करवा सके। अतः अब सायल रजिस्ट्रेशन ऐक्ट, 1908 की धारा 40-41 के तहत उक्त वसीयत को तहसील हजा में पंजीकृत करवाना चाहता है।
