संख्याः श्रम (ए) 4-8/2006-पार्ट फाईल.--न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) की धारा 2 (छ) द्वारा यथा अपेक्षित के अनुसार अनुसूची में जोड़े जाने वाले अनुसूचित नियोजनों की बाबत प्रारुप अधिसूचना को, राजपत्र हिमाचल प्रदेश में, इसके प्रकाशन की तारीख से तीन मास की अवधि के भीतर इससे सम्भाव्य प्रभावित होने वाले व्यक्तियों से आक्षेप या सुझाव आमन्त्रित करने के लिए, तारीख 25-04-2015 को प्रकशित किया गया था;

और उपर्युक्त नियत अवधि के भीतर जनसाधारण से कोई भी आक्षेप या सुझाव प्राप्त नहीं हुआ है/हुए हैं ।

अतः हिमाचल प्रदेश के राज्यपाल, न्यूनतम मजदूरी अधिनियम, 1948 (1948 का अधिनियम संख्याक 11) की धारा 27 के अधीन उनमें निहित शक्तियों का प्रयोग करते हुए, कर्मकारों के निम्न प्रकार से श्रेणीकरण सहित अनुसूची में अनिसूचित नियोजनों अर्थातः (1) हाइड्रो विद्युत परियोजनाओं (2) फार्मास्यूटिकल उद्योगाें (3) अस्पतालाें, नर्सिंग होम और क्लीनिकों (4) घरेलू कामगाराें (5) सफाई कर्मचारी नियोजन(6) सुरक्षा सेवाओं (7) मन्दिर और धार्मिक स्थानों/धर्मशालाओं (8) टोल टैक्स बैरिअरों में कार्यरत कामगारों को जोडते हैः-

(3) उच्च कुशल.-सुपरवाईजर, सुपरिन्टेन्डेंट, स्टेनो ग्राफर, एकाउन्टेन्ट ।

अकुशल/ अर्द्ध-कुशल/कुशल/उच्च-कुशल की परिभाषा निम्न प्रकार से होगी :-

(1) अकुशल.-अकुशल कर्मचारी वह कर्मचारी है जो ऐसे कार्य करता है जिसमें सामान्य कर्तव्यों के अनुपालन अन्तर्वलित है जिसमें कम अनुभव या कोई स्वतन्त्र निर्णय या पूर्व अनुभव की बहुत आवश्यकता नहीं पड़ती, यद्यपि व्यवसायिक परिस्थितियों से परिचित होना आवश्यक है । उसका कार्य शारीरिक परिश्रम (प्रयास) के अलावा, उसका विभिन्न वस्तुओं या माल से भी परिचित होना अपेक्षित है ।

(2) अर्द्ध-कुशल.-अर्द्ध-कुशल कर्मकार वह कर्मकार है जो सामान्यतः रोजमर्रा का निश्चित स्वरूप का काम करता हो जिसमें उससे निर्णय बुद्धि कशलता की अपेक्षा नही है किन्तु सौपें गए कर्तव्यो या उसके सापेक्ष अल्प सीमित कार्यो के उचित निर्वहन की है और जहां महत्वर्पूण निर्णय अन्य द्वारा लिये जाते है । इस प्रकार उसका कार्य क्षेत्र सीमित रोजमर्रा के कार्यो को करने तक ही सीमित रहेगा ।

(3) कुशल.-कशल कर्मचारी वह कर्मचारी है जो विचारणीय स्वतन्त्र निर्णयों का प्रयोग दक्षतापूर्ण कार्य करने में सक्षम हो और अपने कर्तव्यों का जिम्मेदारी से पालन कर सके। वह व्यवसाय, शिल्प या उद्योग जिसमें, वह नियोजित किया गया हो, का पूर्ण एवं विस्तृत ज्ञान रखता हो ।

(4) उच्च-कुशल.-उच्च-कुशल कामगार वह कामगार है जो कार्य को दक्षतापूर्ण करने में सक्षम हो और जो कुशल कर्मचारियों के कार्य का दक्षतापूर्ण पर्यवेक्षण कर सके।

No.Shram (A) 4-8/2006-Part-File.—Whereas, the draft notification regarding more Scheduled Employments to be added to the schedule as required by Section 2 (g) of the Minimum Wages Act, 1948 (11 of the 1948) was published in the Rajpatra, Himachal Pradesh on 25-04-2015 for inviting objection (s) or suggestion (s) fromthe persons likely to be affected thereby, within a period of three months from the date of its publication.

And, whereas; no objection (s) or suggestion (s) have been received within the above stipulated period from the general public;

No. KNR-IX-27(MLC)/2014.—Whereas, Apple season in lower parts of Kinnaur District has set in and the horticulturists have started marketing their apple products in various markets in the country. There is apprehension of causing great inconvenience/harassment by arbitrary charging of freights by the transporters from the horticulturists.

And Whereas, the Sub Divisional Officer (C), Nichar Sub Division, Kinnaur District after convening a meeting of Truck Operators Union, Apple growers/Horticulturists and Pradhan Gram Panchayats of Nichar Sub Division has proposed freight rate of per apple box & fright rate(s) of Campers single & double cabin from various places/points/locations of Nichar Sub Division of this district to various markets of the country.

Now Therefore, I, Dr. N. K. Lath, IAS, Deputy Commissioner, Kinnaur District taking into consideration the above proposal of Sub Divisional Officer (C) Nichar, do hereby notify the freight rates as per "Annexure-A" for Nichar Sub Division of Kinnaur District for carrying of apple boxes for current apple season, 2015, as per H.P. Ordinance No.1 of 2015.

Any attempt to overcharge can result in legal action against defaulter Truck Operator/Truck Union.
