Shimla-2, the 18th September, 2015

No.Fin-2-C-(12)-1/2015.—Government of Himachal Pradesh hereby notifies the sale of Himachal Pradesh Government Stock (securities) of 10-year tenure for an aggregate amount of 124-राजपत्र/2015-19-09-2015 (3873) 3874 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2015/28 भाद्रपद, 1937 ` 200.00 crore (Nominal). The sale will be subject to the terms and conditions spelt out in this notification (called Specific Notification) as also the terms and conditions specified in the General Notification No.Fin-2-C(12)-11/2003 dated July 20, 2007 of Government of Himachal Pradesh.

Object of the loan

1. (i) The proceeds of the State Government Securities will be utilized for the development programme of the Government of Himachal Pradesh.

(ii) Consent of Central Government has been obtained to the floatation of this loan as required by Article 293 (3) of the Constitution of India.

Method of Issue

2. Government Stock will be sold through the Reserve Bank of India, Mumbai Office (PDO) Fort, Mumbai-400 001 by auction in the manner as prescribed in paragraph 6.1 of the General Notification No.Fin-2-C(12)-11/2003, dated July 20, 2007 at a coupon rate to be determined by the Reserve Bank of India at the yield based auction under multiple price formats.

Allotment to Non-Competitive Bidders

3. The Government Stock upto 10% of the notified amount of the sale will be allotted to eligible individuals and institutions subject to a maximum limit of 1% of the notified amount for a single bid as per the Revised Scheme for Non-Competitive Bidding Facility in the Auctions of State Government Securities of the General Notification (Annexure-II).

Place and Date of Auction

4. The auction will be conducted by the Reserve Bank of India, at its Mumbai Office, Fort, Mumbai-400 001 on September 22, 2015. Bids for the auction should be submitted in electronic format on the Reserve Bank of India Core Banking Solution (E-Kuber) System as stated below on September 22, 2015.

(a) The competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10:30AM and 12:00 PM.

(b) The non-competitive bids shall be submitted electronically on the Reserve Bank of India Core Banking Solution (E-Kuber) System between 10:30 AM and 11:30 AM.

Result of the Auction

5. The result of the auction shall be displayed by the Reserve Bank of India on its website on the same day. The payment by successful bidders will be on September 23, 2015.

Method of Payment

6. Successful bidders will make payments on September 23, 2015 before close of banking hours by means of cash, bankers' cheque/pay order, demand draft payable at Reserve Bank of India, Mumbai/New Delhi or a cheque drawn on their account with Reserve Bank of India, Mumbai (Fort)/New Delhi.

Tenure

7. The Stock will be of 10-year tenure. The tenure of the Stock will commence on September 23, 2015.

Date of Repayment

8. The loan will be repaid at par on September 23, 2025.

Rate of Interest

9. The cut-off yield determined at the auction will be the coupon rate percent per annum on the Stock sold at the auction. The interest will be paid on March 23 and September 23.

Eligibility of Securities

10. The investment in Government Stock will be reckoned as an eligible investment in Government Securities by banks for the purpose of Statutory Liquidity Ratio (SLR) under Section 24 of the Banking Regulation Act, 1949. The stocks will qualify for the ready forward facility.

No. HPERC/419.—WHEREAS the Himachal Pradesh Electricity Regulatory Commission (hereinafter referred as "the Commission") notified the Himachal Pradesh Electricity Regulatory 3876 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2015/28 भाद्रपद, 1937 Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, which were published in the Rajpatra, Himachal Pradesh, dated 23rd May, 2012 (hereinafter called "the said Regulations)";

AND WHEREAS it has been suggested by some of the consumers that Infrastructure Development Charges should not be charged in cases where the existing electricity connection for domestic supply in the name of an individual person is to be transferred in the name of some relative of such person due to inheritance or on specific request of such existing consumer.

AND WHEREAS to address the such complexity and hardships expressed by consumers, the Commission recognizes the need for liberlising the provisions by way of amendment in the relevant regulation of the said Regulations;

NOW, THEREFORE, in exercise of the powers conferred by section 46, read with section 181, of the Electricity Act,2003 (36 of 2003), read with section 21 of the General Clauses Act,1897 (10 of 1897), and all other powers enabling it in this behalf, the Commission proposes to amend the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) Regulations, 2012, and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the draft regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of twenty one (21) days from the date of notification together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

The text of the aforesaid draft regulations is also available on the website of the Commission i.e. http.//www.hperc.org.

The objections or suggestions in this behalf should be addressed to the Secretary, Himachal Pradesh Electricity Regulatory Commission, Keonthal Commercial Complex, Khalini, Shimla- 171002.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Recovery of Expenditure for Supply of Electricity) (Third Amendment) Regulations, 2015.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 5.—In sub-regulation (2) of regulation 5 of the said Regulations, the following shall be added as fourth proviso i.e. immediately after the third proviso already existing therein:-

"Provided further that the Infrastructure Development Charges shall not be recovered in cases where the electricity connection for domestic supply existing in the name of an individual person is to be transferred, for similar purpose, in the name of any relative of such person owing to inheritance or on specific request of existing consumer;

Explanation.—For this purpose, the term "relative" shall include the following:—

(i) Spouse of the individual;

(iii) Brother or sister of the spouse of the individual;

(iv) Brother or sister of either of the parents of the individual;

(v) Any lineal ascendant or descendant of the individual;

(vi) Any lineal ascendant or descendant of the spouse of the individual;

(vii) Spouse of the person referred to in (i) to (vii):"
