संख्याः पसीएच-एचए(1)2/2014-पुनर्गठन शिमला.--इस विभाग की अधिसूचना संख्या पीसीएच- एचए(1)2/2014-15071-90 दिनांक 1 अगस्त 2015 के अन्तर्गत, जिला शिमला में ग्राम सभा क्षेत्रों के पुनर्गठित करने हेतु प्रस्तावना द्वारा सम्बन्धित ग्राम सभा सदस्यों से आक्षेप एवं सुझाव आमंत्रित किए गए थे 138-राजपत्र/2015-08-10-2015 (4411) 4412 राजपत्र, हिमाचल प्रदेश, 8 अक्तूबर, 2015/16 आश्विन, 1937 तथा उपायुक्त, जिला शिमला को इस सम्बन्ध में आक्षेप/सुझाव प्राप्त करने और उन पर विचार करने के उपरान्त अन्तिम सिफारिश प्रस्तुत करने के लिए प्राधिकृत किया गया था।

और क्योंकि उपरोक्त अधिसूचना में निर्दिष्ट अवधि के भीतर कोई भी आक्षेपों/सुझाव प्राप्त नही हुआ है।

अतः जिला शिमला की निम्नलिखित ग्राम सभा क्षेत्रों के पुनर्गठन से सम्बन्धित पूर्व में जारी अधिसूचना कोे, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (वर्ष 1994 का अधिनियम संख्यांक 4) की धारा 3 की उप-धारा (2) द्वारा प्रदत्त शक्तियों के अधीन, राज्यपाल, हिमाचल प्रदेश, जिला ंिशमला के निम्न अनुसूचि में वर्णित ग्राम सभा क्षेत्र को पुनर्गठित करने के सहर्ष आदेश प्रदान करते हैं। इन आदेशों के अन्तर्गत ग्राम सभा क्षेत्रों का पुनर्गठन, विद्यमान पंचायतों के निर्वाचित पदाधिकारियों की पदावधि को प्रभावित नहीं करेगाः-

संख्याः आई.पी.एच.-ए.-ए(3)2/2014.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से इस विभाग की अधिसूचना संख्याः आई.पी.एच.-ए.-ए.(3)-5/2010 तारीख 30-11-2012 द्वारा अधिसूचित हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, कनिष्ठ तकनीशियन (कार्य निरीक्षक), वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम 2012 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, कनिष्ठ तकनीशियन (कार्य निरीक्षक), वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2015 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. उपाबन्ध "क" का संशोधन.--हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, कनिष्ठ तकनीशियन (कार्य निरीक्षक), (वर्ग-III अराजपत्रित) भर्ती और प्रोन्नति नियम, 2012 से संलग्न उपाबन्ध "क" में,

(क) स्तम्भ संख्या 11 (i), (ii) और (iii) के विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

"(i) पन्द्रह प्रतिशत, बेलदार/हैल्परों/मेट/लस्कर में से प्रोन्नति द्वारा, जो किसी मान्यता प्राप्त विश्वविद्यालयया हिमाचल प्रदेश/केन्द्रीय सरकार से द्वारा सम्यक्‌रूप से मान्यता प्राप्त किसी संस्थान से नियमित आधार पर सिविल इंजीनियरिंग में डिप्लोमा/उपाधि रखते हों और जिनका तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा यदि कोई हो, को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल हो;

(ii) पन्द्रह प्रतिशत बेलदार/हैल्परों/मेट/लस्कर में से प्रोन्नति द्वारा, जो किसी मान्यता प्राप्त विश्वविद्यालयया हिमाचल प्रदेश/केन्द्रीय सरकार से सम्यक्‌ रूप से मान्यता प्राप्त किसी संस्थान से नियमित आधार पर भवन निर्माण/सर्वेयर/ड्राफ्टसमैंन (सिविल) के4416 राजपत्र, हिमाचल प्रदेश, 8 अक्तूबर, 2015/16 आश्विन, 1937 टे्रड में आई.टी.आई. प्रमाण पत्र रखते हों और जिनका पांच वर्ष का नियमित सेवाकाल या ग्रे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो;

(iii) दस प्रतिशत बेलदार/हैल्परों/मेट/लस्कर में से प्रोन्नति द्वारा, जो किसी मान्यता प्राप्त स्कूल शिक्षा बोर्ड से दसवी पास हों या इसके समतुल्य हो तथा जो जलापूर्ति एवं सिंचाई स्कीमों में कार्यरत हैं तथा जो पम्प ऑपरेटर और फिटर आदि के साथ सम्बद्ध न किए गए हों और जिनका कम से कम दस वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके दस वर्ष का नियमित सेवाकाल हो।

प्रोन्नति के प्रयोजन के लिए पात्र वर्ग-IV कर्मचारियों की उनके सेवाकाल के आधार पर, उनकी संवर्गवार पारस्परिक वरिष्ठता को छेड़े बिना संयुक्त वरिष्ठता सूची तैयार की जाएगी ;

परन्तु कनिश्ठ तकनीशियन (कार्य निरीक्षक) के पदों को भरने के लिए निम्नलिखित "पद" आधारित 20 बिन्दु रोस्टर का अनुसरण किया जाएगाः-

टिप्पण.-रोस्टर प्रत्येक बीसवें बिन्दु के पश्चात्‌ तब तक दोहराया जाता रहेगा, जब तक समस्त प्रवर्गों को दी गई प्रतिशतता तक प्रतिनिधित्व प्राप्त नहीें हो जाता और तत्पश्चात्‌ पद को उसी प्रवर्ग से भरा जाएगा, जिससे पद रिक्त हुआ हो "।

(ख) स्तम्भ संख्या 15-क (1) (क) के विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(I) संकल्पना.--(क) इस पॉलिसी के अधीन हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग में कनिश्ठ तकनीशियन (कार्य निरीक्षक) को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध अधीक्षण अभियन्ता यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/ विस्तारित की जाएगी।4417 राजपत्र, हिमाचल प्रदेश, 8 अक्तूबर, 2015/16 आश्विन, 1937 (ग) स्तम्भ संख्या 15-क (VII) (ग), (घ) और (ङ) के विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल.टी.सी आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य (डयूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा तथापि आपवादिक मामलों में जहां चिकित्सा आधार पर कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों, तो नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति, कत्र्तव्य से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा;

(ङ) संविदा पर नियुक्त व्यक्ति जिसने तैनाती के एक स्थान पर तीन वर्ष का सेवाकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण के लिए पात्र होगा, जहां भी प्रशासनिक कारणों से ऐसा करना अपेक्षित हो।

3. उपाबन्ध "ख" का संशोधन.--उपाबन्ध-"ख" में क्रम संख्याः 4, 5 और 6 के विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"4 संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी सोलह सप्ताह के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी। वह चिकित्सा प्रतिपूर्ति और एल.टी.सी आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त कनिष्ठ तकनीशियन (कार्य निरीक्षक) को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगाः

NOTIFICATION

Shimla 171002, the 8th October, 2015

No.IPH A-A (3)2/2014.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following rules to amend Himachal Pradesh Department of Irrigation and Public Health, Junior Technician (Work Inspector) Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2012, notified vide this department notification number No.IPH-A-A(3)-5/2010 dated 30-11-2012, namely:-

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Irrigation & Public Health Department, Junior Technician (Work Inspector) Class-III (Non-Gazetted) Recruitment and Promotion (First Amendment) Rules, 2015.

(2) These rules shall come into force from the date of the publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-A.—In ANNEXURE "A" to the Himachal Pradesh Irrigation & Public Health Department, Junior Technician (Work Inspector) Class-III (Non- Gazetted) Recruitment and Promotion Rules, 2012.

(a) For the existing provisions in Column Number-11 (i) (ii) and (iii) the following shall be substituted namely:-

(i) 15% by promotion from amongst Beldar/ Helpers/Mate/ Lusker who possess diploma/degree in Civil Engineering on regular basis from a recognized University or Institute duly recognized by the H.P./ Central Government with three years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

(ii) 15% by promotion from amongst Beldar/ Helpers/Mate/ Lusker who possess ITI certificate in the trade of Building Construction/Surveyor/Draughtsman(Civil) on regular basis from a recognized University or Institute duly recognized by the H.P./Central Government with five years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

(iii) 10% by promotion from amongst Beldar/ Helpers/ Mate/ Lusker who are Matriculate or its equivalent from a recognized Board of School Education and working on Water Supply & Irrigation schemes and have not been attached with Pump Operator and Fitter etc. and having ten years regular service or regular combined with continuous adhoc service rendered, if any, in the grade.

For the purpose of promotion, a combined seniority list of eligible Class-IV officials on the basis of length of service without disbursing their cadre-wise inter-se-seniority shall be prescribed.

Provided that for filling up the posts of Junior Technician (Work Inspector) the following 20 points "post" based roster shall be followed:-

Note.— The roster will be repeated after every 20th point till the representation to all the categories is achieved by the given percentage and thereafter the posts shall be filled up from the category which vacates the post.

(b) For the existing provisions in Column Number-15-A(I) (a) the following shall be substituted, namely:-

Notwithstanding anything contained in these Rules, contract appointments to the post will be made subject to the terms and conditions given below:-

CONCEPT.— (a) Under this policy, the Junior Technician (Work Inspector) in Department of Irrigation & Public Health, will be engaged on contract basis initially for one year; which may be extendable on year-to-year basis.

Provided that for extension/ renewal of contract period on year to year basis the concerned Superintending Engineer shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/ extended.

(c) For the existing provision in Column Number-15-A(VII) (c) (d) and (e), the following shall be substituted, namely:-

4420 राजपत्र, हिमाचल प्रदेश, 8 अक्तूबर, 2015/16 आश्विन, 1937 (c) Contract appointee will be entitled for one-day's casual leave after putting one- month service. However, the contract employee will also be entitled for 16 weeks Maternity Leave, 10 day's Medical Leave & 5 days' special leave. He/ She shall not be entitled for Medical Reimbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the un-availed Casual Leave, Medical Leave & Special Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/ her control on medical grounds, such period shall not be excluded while considering his/ her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that he/ she shall submit the certificate of illness/ fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

3. Amendment of Annexure "B".—For the existing provisions clause No. 4, 5 and 6 in Annexure-.Amendment of Annexure-"B", the following shall be substituted, namely:-

संख्याः आई.पी.एच.(ए.)(3)-10/94.--हिमाचल प्रदेश की राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग की अधिसूचना संख्या आई.पी.एच.(ए.)(3)-10/94, तारीख 23-04-1996 द्वारा अधिसूचित हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, योजना सहायक, वर्ग-II (राजपत्रित) भर्ती एवं प्रोन्नति नियम, 1996 का और संशोधन करने के लिए निम्नलिखत नियम बनाती हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, योजना अधिकारी, वर्ग-1 (राजपत्रित) भर्ती और प्रोन्नति (द्वितीय संशोधन) नियम, 2015 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे । 2. संक्षिप्त नाम का संशोधन.--हिमाचल प्रदेश सिंचाई एवं जनस्वास्थ्य विभाग, योजना सहायक वर्ग-।। (राजपत्रित) भर्ती एवं प्रोन्नति नियम, 1996 (जिन्हें इसमें इसके पश्चात "उक्त नियम" कहा गया है) के संक्षिप्त नाम में, "योजना सहायक, वर्ग-।। (राजपत्रित)" शब्दों, चिन्हों, रोमन अंक और कोष्ठक के स्थान "योजना अधिकारी, वर्ग-1 (राजपत्रित)" शब्द, चिन्ह, रोमन अंक और कोष्ठक रखे जाएंगे ।

3. उपाबन्ध "।" का संशोधन.--(क) उक्त नियमों के उपाबन्ध "।" के स्तम्भ संख्या-।, के सामने विद्यमान उपाबन्धों के स्थान पर निम्नलिखत रखा जाएगा, अर्थात :-

"योजना अधिकारी"

(ख) स्तम्भ संख्या-4 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखत रखा जाएग, अर्थात्‌ः- " पे बैंड रूपए 10300-34800 रूपए 5000/-ग्रेड पे "

No. IPH(A)(3)-10/94.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Irrigation & Public Health Department, Planning Assistant, Class-II(Gazetted) Recruitment and Promotion Rules, 1996 notified vide this department notification No. IPH-A(3) 10/94, dated 23-04-96 and further amended vide this department notification of even number, dated 14-11-2003, namely:-

1. Short title & Commencement.—(1) These Rules may be called the Himachal Pradesh, Irrigation & Public Health Department, Planning Officer, Class-I, (Gazetted) Recruitment and Promotion(Second Amendment), Rules, 2015.

(2) These Rules shall come into force from the date of Publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Short title.—In short title of Himachal Pradesh, Irrigation and Public Health Department Planning Assistant, Class-II (Gazetted) Recruitment and Promotion Rules, 1996 (hereinafter referred to as the "said rules") for the words, symbol, Roman figures and brackets "Planning Assistant, Class-I (Gazetted)" the words, symbol, Roman figures and brackets "Planning Officer, Class-I (Gazetted)" shall be substituted.

3. Amendment in Annexur-"I".—(a) In Annexure-"I" to the "said rules", for existing provisions against Column No-1, the following shall be substituted , namely;

"Planning Officer"

(b) For the existing provisions against Column No.4, the following shall be substituted, namely:-

"Pay Band ` 10300-34800 + ` 5000/-Grade Pay"
