संख्याः एल.सी.डी.-एफ (8)-1/2015.--राज्यपाल, हिमाचल प्रदेश, भाषा, कला एवं संस्—ति विभाग की पुरातन स्मारकों/धार्मिक संस्थानों के जीणोद्धार की विभागीय परियोजना-17 अनुबंध-''क'' को अधिसूचित करने हेतु अपनी सहर्ष स्वी—ति प्रदान करते हैं । इस सम्बंध में जारी पूर्व अधिसूचना संख्याः भाषा-क(3) 141-राजपत्र/2015-14-10-2015 (4471) 4472 राजपत्र, हिमाचल प्रदेश, 14 अक्तूबर, 2015/22 आश्विन, 1937 10/80 दिनांकः 11-10-1985 तथा संशोधनः एल.सी. डी.सी.(10)-10/2012 दिनांक 20-08-2013 को निरस्त किया जाता है ।

परियोजना-17

पुरातन स्मारकों/धार्मिक संस्थानों के जीर्णोद्धार की योजना

1. योजना :

भाषा एवं संस्कृति विभाग सहायतानुदान नियम 1981 के अन्तर्गत धार्मिक संस्थानों/स्मारकों को अनुदान दिये जाने का प्रावधान रखा गया है ।

2. उद्देश्य :

(क) कोई भी धार्मिक संस्थान/स्मारक, जो हिमाचली संस्कृति को दर्शाता हो और उसका भवन लगभग 100 वर्ष पुराना हो, उसके पुरातन स्वरुप को बनाये रखने के लिए धनराशि सहायतानुदान के रुप में दी जायेगी ।

(ख) नव-निर्माण कार्य के लिए धनराशि नहीं दी जायेगी ।

(ग) धार्मिक संस्थानों अथवा स्मारकाें में अवैध कब्जा रोकने के लिए उसके परिसर में चारदीवारी तथा इसे गिरने से रोकने के लिए प्रतिधारण दीवार लगाना तथा आंगन में स्थानीय पत्थर के चक्कों से चक्कातलाई व जल निकासी प्रबंधन कार्यों को नव-निर्माण नहीं माना जायेगा ।

(घ) यदि र्धार्मिक संस्थान/स्मारक, किसी व्यक्ति की निजी सम्पत्ति है तो उसे कोई अनुदान नहीं दिया जायेगा । अनुदान केवल सार्वजनिक सम्पत्ति के लिए ही दिया जायेगा।

3. प्रक्रिया :

(क) सहायतानुदान उपमण्डलाधिकारी (नागरिक) की सिफारिश पर दिया जायेगा ।

(ख) आवेदक को प्रथमतः निम्नलिखित दस्तावेज भाषा एवं संस्—ति निदेशालय को भिजवाने होंगे, जिससे कि सुनिश्चित किया जा सके कि यह धार्मिक संस्थान/स्मारक इस योजना में विहित उद्देश्यों व प्रारंभिक शर्तों को पूर्ण करता है :

(1) धार्मिक संस्थान/स्मारक के चार छायाचित्र (पोस्ट कार्ड आकार व रंगीन) जो कि भवन के आगे, पीछे, दायें, बायें से लिए गए हों और जिनमें कि भवन, उपर से नीचे तक स्पष्ट रूप से नजर आता हो, भिजवाएंगे। ये छायाचित्र प्रपत्र-4 पर चिपका कर संमबंधित क्षेत्र के पटरवरी से सत्यापित होने चाहिएं ।

(2) जिस भूमि पर धार्मिक संस्थान/स्मारक का भवन है, उसकी नकल जमाबंदी व अक्स ततीमा।4473 राजपत्र, हिमाचल प्रदेश, 14 अक्तूबर, 2015/22 आश्विन, 1937 (3) जिस भूमि पर धार्मिक संस्थान/स्मारक का भवन है यदि वह आबादी देह में है तो प्रपत्र-3 जो कि सार्वजनिक सम्पत्ति सम्बंधी है को सम्बंधित क्षेत्र के पटवारी से हस्ताक्षिरित करवाएंगे।

(4) भवन में कौन से कार्य किए जाने का प्रस्ताव है का विवरण संलग्न करें ।

(5) प्रपत्र-2 भरा हुआ ।

(ग) विभाग अपने स्तर पर भी धार्मिक संस्थान/स्मारक के पुराने स्वरूप को बरकरार रखने का काम कर सकता है ।

(घ) इनके प्राप्त होने पर विभाग की पुरातत्त्व शाखा इन दस्तावेजों के आधार पर पात्रता की जांच करेगी और यदि धार्मिक संस्स्थान/स्मारक की पात्रता होगी तो ही प्रकरण मंगवाया जाएगा अन्यथा आवेदक को इन्कार की सूचना दे दी जाएगी । भविष्य संदर्भ हेतु प्राप्त दस्तावेज, आवेदक को लौटाए नहीं जाऐंगे ।

(ङ) पात्रता सुनिश्चित होने के उपरांत.--धार्मिक संस्थान/स्मारक के लिए सहायतानुदान हेतु आवेदक, सम्बन्धित जिला भाषा अधिकारी को विभाग द्वारा निर्धारित प्रपत्र 1 से 5 और यदि मंदिर विशेष घटक का हो तो प्रपत्र 8 और प्राक्कलन व ड्राइंग सहित प्रकरण की चार प्रतियां प्रस्तुत करेंगे। इसके उपरांत जिला भाषा अधिकारी, इस प्रकरण को सम्बंधित उपमण्डलाधिकारी (नागरिक) से संस्तुत करवा कर निदेशक, भाषा एवं संस्—ति विभाग को भिजवाएंगे। मुरम्मत के प्राक्कलन एवं ड्रार्इंग, तैयार करने के लिए निम्नलिखित अभियंता/वास्तुकार द्वारा तैयार किए हुए ही स्वीकार्य होंगेः--

सरकार के किसी भी विभाग/अर्द्धसरकारी विभाग/उपक्रम/निगम/बोर्ड में कार्यरत कनिष्ठ अभियन्ता (सिविल) या सरकार के किसी विभाग/उपक्रम के तहत पंजी—त/लाईसेंसधारक वास्तुकार/इंजिनियर प्रतिधारण दीवार लगाने की दशा में सरकार के किसी भी विभाग/ अर्द्धसरकारी विभाग/उपक्रम/निगम/बोर्ड में कार्यरत सहायक अभियन्ता (सिविल) या उनके संवर्ग में उनसे वरिष्ठ अभियंता इसके अतिरिक्त सरकार के किसी विभाग/उपक्रम के तहत पंजी—त/लाईसेंसधारक इंजिनियर, जो सरकार के सहायक अभियंता (सिविल) के समकक्ष हो, का औचित्य प्रमाणपत्र आवश्यक होगा ।

4. निदेशालय स्तर पर निरीक्षण एवं राशि स्वी—ति :--

(क) विभाग के अभियांत्रिकी प्रभाग द्वारा प्रकरणों का निरीक्षण किया जाएगा ।

(ख) प्राक्कलन को पुरातत्त्व अभियन्ता अपने स्तर पर औचित्य देकर घटा भी सकेंगे ।

(ग) प्रत्येक मास के प्रथम सप्ताह में, पिछले मास में निरीक्षित प्रकरणों की समीक्षा एक समिति करेगी जिसमें पुरातत्त्व अभियंता, पंजीकरण अधिकारी/संग्रहालयाध्यक्ष तथा सम्बंधित जिला के जिला भाषा अधिकारी सदस्य होंगे।

(घ) समिति की समीक्षा के उपरांत ही प्रकरण स्वी—त्यार्थ निदेशक भाषा एवं संस्—ति विभाग को प्रस्तुत होंगे । अनुदान की राशि, समिति की समीक्षा के आधार पर, निदेशक, भाषा एवं संस्—ति विभाग द्वारा आवश्यकतानुसार एवं बजट अनुसार स्वी—त की जाएगी।

(ङ) निदेशक भाषा एवं संस्कृति की स्वीकृति के पश्चात्‌, सम्बन्धित आवेदक को जिला भाषा अधिकारी के माध्यम से सहायतानुदान प्रदान किया जाएगा। ऐसे प्रत्येक स्वी—त मामले में अनुमोदित प्राक्कलन की प्रति व प्रकरण की एक-एक प्रति सहित, स्वी—ति पत्र की प्रति सम्बन्द्यित जिला भाषा अधिकारी, पुरातत्त्व अभियंता तथा आवेदक को संदर्भित होगी । 4474 राजपत्र, हिमाचल प्रदेश, 14 अक्तूबर, 2015/22 आश्विन, 1937 (च) अनुदान तीन किस्तों में दिया जाएगा :

(1) 30 प्रतिशत अनुदान की मांग स्वी—ति होने पर

(2) 50 प्रतिशत आधा कार्य पूर्ण होने पर

(3) शेष 20 प्रतिशत कार्य सम्पूर्ण होने पर

(छ) अनुदान की राशि, एक वर्ष के भीतर व्यय करनी होगी अन्यथा भाषा विभाग, ऐसी राशि केा ब्याज सहित एक-मुश्त वापस लेने का हकदार होगा ।

(ज) निदेशक अपनी संतुष्टि पर इस अवधि को, विशेष कारणों को देखते हुए एक वर्ष तक और बढ़ाने में सक्षम होंगे ।

5. प्रमाण-पत्र :

(क) आधा कार्य पूर्ण होने पर तथा सम्पूर्ण कार्य हो जाने पर इस तथ्य के निर्धारित प्रमाण-पत्र, प्रपत्र-6 पर विभाग को भेजे जायेंगे, जिन्हेें जिला भाषा अधिकारी द्वारा सत्यापित किया जायेगा। (ख) इन निर्धारित प्रमाणपत्रों की प्राप्ति पर दूसरी तथा तीसरी/अंतिम किस्त दे दी जायेगी । (ग) कार्य पूर्ण होने पर निर्धारित प्रपत्र पर उपयोगिता प्रमाण-पत्र देना होगा जो सम्बन्धित जिला भाषा अधिकारी के द्वारा सत्यापित होगा ।

6. निरीक्षण एवं नियम उल्लंघनाः

(क) जीर्णोद्धार के कार्य को समय-समय पर भाषा एवं संस्कृति विभाग के अधिकारियों को देखने की खुली छूट होगी। ये अधिकारी पुरातत्त्व की महत्ता को देखते हुए, चल रहे कार्य में परिवर्तन भी मन्दिर समितियों को बतायेंगे, जो मन्दिर समितियों को मान्य होगा।

(ख) सहायतानुदान प्राक्कलन की जिन कार्य मदों के लिए दिया गया है उसी पर खर्च किया जाना होगा । ऐसा न करने पर सारी राशि ब्याज सहित वापस ली जा सकेगी ।

अभियंता/वास्तुकार को प्राक्कलन (Estimate) तैयार करने के लिए मार्ग-निर्देश

1. धार्मिक संस्थान / स्मारक की साइट पर धार्मिक संस्थान/स्मारक के भवन को माप कर उसकी To ScaleExisting Drawings तैयार करें और इसमें निम्नलिखित दर्शाएंः

2. प्राक्कलन (Estimate) चार प्रतियों में होना चाहिए ।

3. ड्राईंग अमोनिया प्रिंटस पर या CAD में बनी होने पर कम से कम A3 पेपर पर चार प्रतियों में होनी चाहिए ।

4. ड्राईंग में सभी माप सही और पढे़ जाने योग्य होने चाहिए ।

5. धार्मिक संस्थान/स्मारक (मन्दिर) को रंग-रोगन करना मान्य नहीं है।

6. धार्मिक संस्थान/स्मारक (मन्दिर) की मरम्मत उसी सामग्री से करें जिससे कि मूल भवन बना हुआ है। आधुनिक सामग्री का प्रयोग वर्जित हैं ।

7. प्राक्कलन में ये मदें (Items) ले सकते हैंः

1. Replacement of slates in roofing

2. Replacement of roof members like trusses, false ceiling etc;

3. Replacement of traditional wooden floors, ceiling etc;

उपरोक्त के साथ ये आईटमज भी ली जा सकती हैं ।

8. प्राक्कलन तैयार करने हेतु निम्नलिखित प्राधि—त हैं :

स्मारकों/धार्मिक संस्थानों के प्रकरण प्रस्तुत करने से पूर्व कृपया चैक करेंः

1. सहायतानुदान प्रपत्र व सर्वेक्षण प्रपत्र सही ढंग से भरे गए हैं या नहीं इसमें देखें कि कोई मद्‌ खाली तो नहीं है ?

2. प्रपत्र को उपमण्डल अधिकारी (नागरिक) से सिफारिशित/संस्तुत करवाएं।

यह भी प्रमाणित किया जाता है कि उपरोक्त मन्दिर किसी की निजी सम्पत्ति न हो कर सार्वजनिक सम्पत्ति है। 4482 राजपत्र, हिमाचल प्रदेश, 14 अक्तूबर, 2015/22 आश्विन, 1937 7. राजस्व रिकॉर्ड के अनुसार, यदि संस्थान निजि सम्पत्ति होगा तो अनुदान नहीं दिया जा सकेगा। इसके अतरिक्त यदि संस्थान 100 वर्ष से कम आयु का होगा तथा हिमाचली संस्कृति को नहीं दर्शाता होगा तो भी अनुदान नहीं दिया जाएगा ।
