संख्याः रैव डी (जी) 9-4/2008.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश ग्राम शामलात भूमि निधान और उपयोग अधिनियम, 1974 (1974 का अधिनियम संख्यांक 18) की धारा 8-बी द्वारा प्रदत शक्तियों का प्रयोग करते हुए, चकौतादारों को, जिन्हें पंजाब ग्राम शामलात भूमि (विनियमन) अधिनियम, 1961 के अधीन 142-राजपत्र/2015-15-10-2015 (4499) 4500 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2015/23 आश्विन, 1937 पंचायतों द्वारा चकौते के आधार पर भूमि पट्‌ान्तरित या आबन्टित की गई है, साम्पतिक अधिकार प्रदान करने हेतु उपबन्ध करने के लिए निम्नलिखित स्कीम विरचित करते है, अर्थातः-

स्कीम

1. संक्षिप्त नाम.-(1) इस स्कीम का संक्षिप्त नाम हिमाचल प्रदेश चकौतादारों को साम्पत्तिक अधिकार प्रदान करना स्कीम, 2015 है।

(2) यह स्कीम राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी।

2. परिभाषाए.-(1) इस स्कीम में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो-

(क) "अधिनियम" से हिमाचल प्रदेश ग्राम शामलात भूमि निधान और उपयोग अधिनियम, 1974 अभिप्रेत है;

(ख) "चकौतादार" से ऐसा व्यक्ति अभिप्रेत है जिसे पंजाब ग्राम शामलात भूमि (विनियमन) अधिनियम, 1961 के अधीन पंचायतों द्वारा चकौते के आधार पर भूमि पट्‌टान्तरित या आबन्टित की गई है और इसके अन्तर्गत उसके विधिक वारिस भी है;और

(ग) "सक्षम प्राधिकारी" से अपनी क्षेत्रीय अधिकारिता में सम्बद्व उपमण्डल अधिकारी (नागरिक) अभिप्रेत है।

(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त है किन्तु परिभाषित नहीं है, वही अर्थ होंगे जो अधिनियम में है।

3. पात्रता.-चकौतादार, जिन्हें पंजाब ग्राम शामलात भूमि (विनियमन) अधिनियम, 1961 के उपबन्धों के अधीन पंचायतों द्वारा चकौते के आधार पर भूमि पट्‌ान्तरित या आंबटित की गई है, ऐसी भूमि पर ऐसी सीमाओं, ऐसी शर्तों के अध्यधीन और ऐसी रकम के संदाय पर जैसी इस स्कीम के अधीन नियत की जाएं, साम्पतिक अधिकार प्रदान किए जाने के लिए पात्र होेंगे।

4. अधिकतम सीमा.-साम्पतिक अधिकार, ऐसे पात्र चकौतादार को 00-40-00 हैक्टेयर (5 बीघा/ 10 कनाल) की अधिकतम सीमा तक इस शर्त के अध्यधीन प्रदान किए जांएगे कि ऐसी पट्‌ान्तरित या आबंटित भूमि, जो राजस्व अभिलेख में किसी भी नाम से वर्गीकृत है, सहित उसकी समस्त अभिधृति ऐसे साम्पतिक अधिकारों को प्रदान किए जाने के पश्चात 1-50-00 हैक्टेयर (20 बीघा /40 कनाल) से अधिक न हो। 5. प्रतिफल रकम.-साम्पतिक अधिकार चकौतादार को 1000/- रूपए (एक हजार रूपए केवल) प्रति 0-07-52 हैक्टेयर (एक बीघा/दो कनाल) की प्रतिफल रकम के संदाय के पश्चात इस शर्त के अध्यधीन प्रदान किए जाएंगे कि वह सक्षम प्राधिकारी द्वारा पारित अनुदान के आदेश की तारीख से दस वर्ष की अवधि के लिए किसी भी रीति में ऐसी भूमि का अन्य संक्रामण नहीं करेगा।

6. अतिशेष भूमि का प्रबन्ध.-(1) उस भूमि जिस पर इस स्कीम के पैरा-4 के अधीन साम्पतिक अधिकार प्रदान किए गए हैं, सहित बीस बीघा की अधिकतम सीमा तक की अतिशेष भूमि को ऐसे चकौतादार के पक्ष में आगे प्रति 0-07-52 हैक्टेयर (एक बीघा/दो कनाल) 1000/-रूपऐ (एक हजार रूपए केवल) वार्षिक किराए के संदाय पर प्रारम्भ में दस वर्ष की अवधि के लिए पट्‌ान्तरित किया जाएगा तथा पट्‌टा अवधि के पूर्ण (समाप्त) होने पर आगामी दस वर्ष के लिए और इसी प्रकार प्रत्येक बार नवीकरण पर पट्‌टे की रकम के दस प्रतिशत की दर से बढौतरी के साथ जब तक वह भूमि धारित करता है, और नवीकरणीय होगा।4501 राजपत्र, हिमाचल प्रदेश, 15 अक्तूबर, 2015/23 आश्विन, 1937 (2) चकौतादार, यदि ऐसी बांछा रखता है, सम्बद्व सक्षम प्राधिकारी को पट्‌टे के नवीकरण के लिए, पट्‌टा अवधि के अवसान की तारीख से तीन मास पूर्व, आवेदन कर सकेगा :

परन्तु सक्षम प्राधिकारी आवेदन में अधिकथित कारणों पर विचार करने के पश्चात उपरोक्त विनिर्दिष्ट अवधि को शिथिल कर सकेगा।

(3) यदि चकौतेदार पट्‌टे का नवीकरण करवाने में असफल रहता है तो यह राज्य सरकार को प्रतिवर्तित हो जाएगी।

(4) इस स्कीम के पैरा-4 के अधीन साम्पत्तिक अधिकार प्रदान करने के पश्चात अतिशेष भूमि और इस पैरा के उप-पैरा (1) के अधीन प्रदान किया गया पट्‌टा सभी विल्लंगमों से रहित तुरन्त राज्य सरकार में निहित हो जाएगी/जाएगा।

7. पट्‌टे की रकम के संदाय की रीति.-यथास्थिति, प्रतिफल या पट्‌टे की रकम चकौतादार द्वारा सरकारी खजाना या उप-खजाना में ई-संदाय या चालान के माध्यम से जमा की जाएगी।

8. प्रक्रिया.-चकौतादार, सुसंगत ''जमाबन्दी'' की एक प्रति और अन्य समर्थित दस्तावेजों सहित सक्षम प्राधिकारी को साम्पतिक अधिकार प्रदान करने के लिए सादे कागज पर आवेदन कर सकेगा। सक्षम प्राधिकारी तत्पश्चात्‌ सम्बद्व राजस्व अधिकारी (पटवारी और काननूगो) के माध्यम से चकौतादार को हैसियत सत्यापित करवाएगा। सम्बद्व राजस्व अधिकारी की रिपोर्ट की प्राप्ति पर, सक्षम प्राधिकारी रिपोर्ट पर विचार करेगा अैार लिखित में आदेश द्वारा आवेदन को मंजूर या नांमजूर करेगा तथा इस प्रकार पारित आदेश की एक प्रति राजस्व अभिलेख को अद्यतन (updating) करने के लिए सम्बद्व राजस्व अधिकारी को अग्रेषित की जाएगीः "परन्तु ऐसे चकौतादार को, उसका आवेदन नामंजूर करने से पूवर्, सुनवाई का अवसर प्रदान किया जाएगा।

9. अपील.-इस स्कीम के किसी भी उपबन्ध के अधीन पारित सक्षम प्राधिकारी के किसी आदेश से व्यथित कोई चकौतादार, ऐसे आदेश की तारीख से तीस दिन की या ऐसी और अवधि, जैसी उपायुक्त कारणों को लिखित में अभिलिखित करके अनु़ज्ञात करें, के भीतर सम्बद्व उपायुक्त को अपील कर सकेगा जिस पर उसका विनिश्चय अंतिम होगा।

10. कतिपय मामलों में साम्पतिक अधिकारों का रद्‌दकरण.-यदि किसी भी समय किसी व्यक्ति द्वारा किए गए आवेदन पर या अन्यथा उपायुक्त के ध्यान (नोटिस) में आता है कि इस स्कीम के अधीन साम्पत्तिक अधिकार किसी ऐसे व्यक्ति को प्रदान किए गए थे जो पात्र नहीं था, तो वह मामले का अभिलेख मंगवा सकेगा और ऐसी जांच, जैसी वह उचित समझे, करने के पश्चात और सुनवाई का अवसर प्रदान करने के पश्चात साम्पतिक अधिकारों को रद्‌द कर सकेगा।

No.Rev.-D (G)9-4/2008.—In exercise of powers conferred by section 8-B of the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974, (Act No.18 of 1974), the Governor, Himachal Pradesh is pleased to frame the following Scheme providing for conferment of Proprietary rights on Chakotadars, who have been leased out or allotted lands on Chakota basis by the Panchayats under the Punjab Village Common Lands (Regulation) Act, 1961, namely:—

SCHEME

1. Short title.—(1) This Scheme may be called the Himachal Pradesh Conferment of Proprietary Rights on Chakotadars Scheme, 2015.

(2) It shall come into force on the date of its publication in the Official Gazette.

2. Definition.—(1) In this Scheme, unless the context otherwise requires,-

(a) "Act" means the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974;

(b) "Chakotadar" means a person who have been leased out or allotted land on Chakota basis by the Panchayats under the Punjab Village Common Lands (Regulation) Act, 1961, and includes his legal heirs ; and

(c) "Competent Authority" means the Sub-Divisional Officer (Civil) concerned within his territorial jurisdiction.

(2) All words and expressions used herein but not defined shall have the same meanings as are respectively assigned to them in the Act.

3. Eligibility.—The Chakotadars, who have been leased out or allotted lands on Chakota basis by the Panchayats under the provisions of the Punjab Village Common Lands (Regulation) Act, 1961, shall be eligible for conferment of proprietary rights over such lands subject to such limits, such conditions and on payment of such amount as fixed under this Scheme.

4. Maximum Limit.—The proprietary rights shall be conferred on such eligible Chakotadars to a maximum limit of 00-40-00 hectare (5 bigha/10 Kanal) subject to the condition that his entire holding, including such leased out or allotted lands, by whatever name classified in the revenue record, should not exceed 1-50-00 hectare (20 bigha/40 kanal) after conferment of such proprietary rights.

5. Consideration amount.—The proprietary rights shall be conferred on Chakotadars after payment of consideration amount of Rs.1000/- (One thousand only) per 0-07-52 hectare (one bigha/two kanal) subject to the condition that he shall not alienate such land in any manner for a period of ten years from the date of order of grant passed by the Competent Authority.

6. Treatment of remaining land.—(1) The remaining land to the extent of twenty Bighas including land on which proprietary rights to the extent specified in para-4 of this Scheme has been conferred shall further be granted to him on lease initially for a period of 10 years on payment of annual rent of Rs. 1000/- (One thousand only) per 0-07-52 hectare (One bigha/two kanal) and shall further be renewable, on completion of lease period, for next ten years and so on with an increase @ 10% of the lease amount every time on renewal till he holds the land.

(2) The Chakotadar may, if so desired, make application to the Competent Authority concerned before three months from the date of expiry of lease period for renewal of lease:

Provided that the Competent Authority may, after considering the reasons stated in the application, relax the above specified period.

(3) If Chakotadar fails to get the lease renewed, the same shall revert back to the State Government.

(4) The land remaining after conferment of proprietary rights under para-4 of this scheme and lease granted under subpara (1) of this para, shall immediately vest in the State Government free from all encumbrances.

7. Manner of payment of lease amount.—The consideration or lease amount, as the case may be, shall be deposited through e-payment or through challan into the Government Treasury or Sub-Treasury by the Chakotadar.

8. Procedure.—The Chakotadar may apply on plain paper for grant of proprietary rights to the Competent Authority alongwith a copy of relevant "Jamabandi" and other supporting documents. The Competent Authority shall, thereafter, got the status of the "Chakotadar" verified through the concerned Revenue Officer (Patwari and Kanungo).

On receipt of report of concerned Revenue Officer, the Competent Authority shall consider the report and shall, by order in writing, allow or reject the application and a copy of the order so passed shall be forwarded to the concerned Revenue Officer for updating the revenue record:

Provided that such Chakotadar shall be given an opportunity of being heard before rejection of his application.

9. Appeal.—2. Any Chakotadar aggrieved by an order of the Competent Authority passed under any of the provisions of this Scheme may, within thirty days from the date of such order or such further period as the Deputy Commissioner may allow, for reasons to be recorded in writing, prefer an appeal to the Deputy Commissioner concerned, whose decision thereon shall be final.

10. Cancellation of Proprietary rights in certain cases.—If at any time, it comes to the notice of the Deputy Commissioner, either on an application made by any person or otherwise, that the proprietary rights under this Scheme was conferred to a person who was not eligible, he may call for the record of the case, and after making such enquiry as he thinks fit, and after giving an opportunity of being heard, may cancel the proprietary rights.

No. 56/2015 (II)/PPS-III – In pursuance of sub-paragraph (2) of paragraph 17 of the Election Symbols (Reservation & Allotment) Order, 1968, the Election Commission of India hereby makes the following further amendments to its Notification No. 56/2015/PPS-II dated 13th January, 2015 as amended from time to time namely: -

1. In Table II (State Parties), appended to the said Notification -

(i) Against Sl. No. 12 in respect of the State of Manipur, the existing entry under column No. 3, 4, and 5 pertaining to 'Manipur State Congress Party, shall be deleted.
