Dated, the 9th November, 2015

No. SEC-16-36/2001-IV-4903-5030.—The State Election Commission in exercise of the powers vested in it under Article 243ZA of the Constitution of India, Section 281 of the HP 156-राजपत्र/2015-16-11-2015 (5275) 5276 राजपत्र, हिमाचल प्रदेश, 16 नवम्बर, 2015/25 कार्तिक, 1937 Municipal Act, 1994, read with Rule 14 of the HP Municipal Election Rules, 2015, do hereby directs that the electoral rolls in respect of all the Municipalities in Himachal Pradesh shall be prepared as per programme given below :

The qualifying date for inclusion of names of eligible electors in the said roll shall be 1.1.2015, as already notified by the Commission vide Notification No. SEC-16-2/2014-437-592 and 601-718 dated 10th April, 2015.

The claims, objections and appeals shall be received and decided even on holidays. Claims and Objections shall not be received from an individual in bulk. Any person aggrieved by the orders passed by the Revising Authority may file an appeal to the Electoral Registration Officer within seven days from the date of passing of the orders by the Revising Authority. The Electoral Registration Officer will decide the appeal within seven days.

After all the claims / objections and appeals received during the period have been decided, the Electoral Roll Registration Officer shall cause the draft electoral rolls to be corrected through ERMS software in accordance with the orders passed by the Revising Authorities or the orders passed by him on appeal as the case may be. Thereafter, the Electoral Roll Registration Officer shall issue notice of final publication of electoral rolls on Form-17 as per schedule fixed by the Commission. The finally published electoral rolls shall be uploaded on the official website.

As soon as the notice of final publication is issued by the Electoral Roll Registration Officer, the intimation of the same may be sent to the Commission immediately through E-mail followed by confirmation by post, so that Commission could provide the data of electoral rolls to the Printer for printing of these rolls. In all, twenty five sets of electoral rolls in respect of every municipality shall be printed by the printing firm to be supplied to the respective District Election Officers (Municipalities). These copies shall be used in the ensuing elections.

After the publication of electoral rolls in final, if any application is received under Rule 28 for inclusion of name and the Electoral Registration Officer after following the due process of law decides to include the name in the electoral roll such names shall be added to the main electoral rolls of the concerned constituency by adding supplementary list to the main electoral roll. Similar procedure will be followed, in case any action is taken under Rule-27 of the ibid Rules. In the case of addition, the serial number to the new electors in the list of the supplementary shall be the next number displayed in the end of main electoral roll. In case there is no addition, deletion and correction, as the case may be, supplement showing Nil shall be prepared and added. The copies of the electoral rolls be made available for sale at the cost of Rs.5/- per page to be paid in cash against receipt. However a person interested in purchasing of electoral roll shall have to purchase full set of electoral rolls of the concerned municipality.

Since the term of all the existing municipalities is due to expire between 17th January, 2016 to 15th March, 2016 and the elections to constitute new Urban Local Bodies has to be completed before 17th January, 2016 in pursuance to Article 243 U (3) (a) of the Constitution of India read with Section 14(2)(a) of the HP Municipal Act, 1994. Therefore, in accordance with the aforesaid programme the electoral shall be completed on or before 19th December, 2015 and thereafter about 30 days will be required for the conduct of elections, which means the election process could barely be completed by 17th January, 2016 in order to abide by the time limit prescribed under the relevant statute.

The relevant provisions of ibid Rules enshrined under Chapter-IV Electoral Rolls shall be adhered to strictly for the preparation of the said electoral rolls. Needless to say that the aforesaid programmed should be implemented in letter and spirit. If any violation of this programme is noticed, it will be in contravention of the mandate of the Constitution of India and the relevant statutory provisions, which may lead to serious consequences.

No. SEC-16-1/2011- I- 5042-5176.—Whereas Hon'ble Supreme Court of India in Writ Petition (Civil) No. 161 of 2004 titled as People's Union for Civil Liberties & Another, has directed the Election Commission to provide necessary provisions in ballot papers and EVMs for displaying a separate button for "None of the Above" (NOTA) "उपरोक्त में से कोई नहीं" so that the voters, who decide not to vote for any of the candidates in the election, are able to exercise their right not to vote while maintaining their right of secrecy;

Therefore, the State Election Commission, Himachal Pradesh in compliance to the directions passed by the Hon'ble Apex Court and in exercise of the powers vested in it under Article 243-K and ZA of the Constitution of India, Section 160 of the Himachal Pradesh Panchayati Raj Act, 1994 Section 281 of H.P. Municipal Act, 1994 and Section 9 of the H.P. Municipal Corporation Act, 1994 read with Rule 52 (1) of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994 Rule 58 (2) of the H.P.Municipal Election Rules, 2015 and Municipal Corporation Election Rules, 2012 and all other powers enabling it in this behalf, hereby orders that the option "None of the Above" (NOTA) "उपरोक्त में से कोई नहीं " shall be given in the ballot papers/EVMs, henceforth, in the last column/box after the names of all contesting candidates for the elections to PRIs/Municipalities. The number of votes polled to "None of the Above" (NOTA), "उपरोक्त में से कोई नहीं" shall be shown at the last in result sheet of counting and form of return along with the names of the candidates and number of votes polled in favour of each contesting candidate.

However, the effect of "None of the Above (NOTA)" "उपरोक्त में से कोई नहीं" shall be same as not voting in favour of any candidate. Therefore, even if, "None of the Above (NOTA)" "उपरोक्त में से कोई नहीं " gets maximum number of votes, the contesting candidate securing/ highest number of votes next to "None of the Above (NOTA)" "उपरोक्त में से कोई नहीं " shall be declared elected. Option of NOTA will be provided by affixing stamp "उपरोक्त में से कोई नहीं " on the last box of the ballot paper after the names of all contesting candidates, issued by the State Election Commission in respect of Panchayati Raj Institutions. However, in case of election in Municipalities the option "None of the above (NOTA)" will be printed in the last column/box of the ballot paper to be used in EVMs during Municipal Elections.

This is issued in supersession of earlier Notification No. SEC. 16-1/2011-2513-2623 dated 18th November, 2014.

No. SEC-13-4/2015-5032-42.—In exercise of the powers vested in it under Article 243 ZA of the Constitution of India, Section 9 (1) of the Himachal Pradesh Municipal Corporation Act, 1994 read with Rule 6(1) and 10 of the Himachal Pradesh Municipal Corporation Election Rules, 2012, the State Election Commission, Himachal Pradesh hereby directs that the delimitation and reservation of wards in respect Municipal Corporation Dharamshala shall be undertaken as per following programme:

If no objection is received or no appeal is filed, the Deputy Commissioner may issue final delimitation orders so as to save the time and start working on reservation of wards in accordance with the provisios enshrined under HP Municipal Corporation Act, 1994 and HP Municipal Corporation Election Rules, 2012.

As soon as the reservation of wards is finalized, the Deputy Commissioner, will ensure that it is delivered to the Government immediately so that the Government could provide the copy of final reservation orders to the State Election Commission under Rule 13 of the ibid Rules.
