संख्याः ई0एक्स0एन0-एफ(10)-2/2004-लूज-II.--प्रारूप दी हिमाचल प्रदेश पैस्‌इनजरॅज एण्ड गुडज़ टैक्सेशन (अमैन्डमैंट) रूल्ज, 2015 को, समसंख्यंक अधिसूचना तारीख 28.9.2015 द्वारा, हिमाचल प्रदेश में यात्रियों तथा सामान पर कर लगाने का अधिनियम, 1955 (1955 का अधिनियम संख्यांक 15) की धारा 22 158-राजपत्र/2015-18-11-2015 (5307) 5308 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2015/27 कार्तिक, 1937 के अधीन यथा अपेक्षित, इससे सम्भाव्य प्रभावित होने वाले व्यक्तियों से आक्षेपों और सुझावों को आमन्त्रित करने के लिए तारीख 28 सितम्बर, 2015 को राजपत्र हिमाचल प्रदेश में प्रकाशित किया गया था;

और नियत समयावधि के भीतर कोई भी आक्षेप और सुझाव प्राप्त नहीं हुए;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश में यात्रियों तथा समान पर कर लगाने का अधिनियम, 1955(1955 का अधिनियम संख्यांक 15) की धारा 22 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, दी हिमाचल प्रदेश पैस्‌इनजरॅज एण्ड़ गुडज़ टैक्सेशन रूल्ज, 1957 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम दी हिमाचल प्रदेश पैस्‌इनजरॅज एण्ड गुडज़ टैक्सेशन (अमैन्डमैंट) रूल्ज, 2015 है ।

(2) ये राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त हाेंगे ।

2. रूल 2 का संशोधन.--दी हिमाचल प्रदेश पैस्‌इनजरॅज एण्ड गुडज़ टैक्सेशन रूल्ज, 1957(जिन्हें इसमें इसके पश्चात्‌ 'उक्त रूल्ज' कहा गया है) के रूल 2 के क्लॉज (जी) के स्थान पर निम्नलिखित क्लाज रखा जाएगा, अर्थात्‌ः--

"(g) "treasury" means the Government treasury, sub-treasury or cyber treasury or such branch of the Bank authorized to conduct Government transaction in the State as may be notified by the State Government;".

3. रूल 9-डी का संशोधन.--उक्त रूल के रूल 9-डी के सब-रूल्ज 2,3,4 और 5 के स्थान पर निम्नलिखित सब रूल्ज रखे जाएंगें; अर्थात्‌ः--

"(2) The authorized person shall furnish a return in Form P.G.T.25-A electronically alongwith e-challan in Form P.G.T.9-A by uploading all the requisite information on the official website of the Department at such intervals as specified in rule 40 and rule 36(2)(ii) of the Himachal Pradesh Value Added Tax Rules, 2005.

(3) Where the payment of tax, demand or other sum has been made electronically, the authorized Bank shall generate e-challan in Form P.G.T.9-A through the computer network. The authorized Bank shall forward a statement of such e-challan (called e- payment scroll) daily in Form P.G.T.27 to the concerned treasury and the Accountant General, Himachal Pradesh. For the purpose of these rules the date of payment shall be the date of deposit recorded in the e-challan in Form P.G.T.9-A and for all accounting purposes the date of payment shall be the date of generation of e payment challan. The Bank shall mention the date of generation of e-payment challan in the daily statement.".

4. फार्म पी0जी0 टी0 9-ए का अन्तः स्थापन.--उक्त रूल से संलग्न विद्यमान फार्म पी0जी0टी0-9 के पश्चात्‌ निम्नलिखित नया फार्म पी0जी0टी0 9-ए अन्तःस्थापित किया जाएगा; अर्थात्‌ः--

No. EXN-F(10)-2/2004-I-Loose-II .—Whereas the draft the Himachal Pradesh Passengers and Goods Taxation (Amendment) Rules 2015 were published in the Rajpatra, Himachal Pradesh dated 28 September, 2015 vide notification of even No. dated 28.09.2015 for inviting objections 5312 राजपत्र, हिमाचल प्रदेश, 18 नवम्बर, 2015/27 कार्तिक, 1937 and suggestions from the persons likely to be affected thereby as required under section 22 of the Himachal Pradesh Passengers and Goods Taxation Act, 1955(Act No. 15 of 1955) ;

And whereas no objections and suggestions have been received within the stipulated time period;

Now, therefore, the Governor of Himachal Pradesh in exercise of the powers conferred by section 22 of the Himachal Pradesh Passengers and Goods Taxation Act, 1955 (Act No. 15 of 1955), is pleased to make the following rules further to amend the Himachal Pradesh Passenger and Goods Taxation Rules, 1957, namely:—

DRAFT RULES

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Passengers and Goods Taxation (Amendment) Rules, 2015.

(2) They shall come into force from the date of publication in the Official Gazette.

2. Amendment of rule 2.—In rule 2 of the Himachal Pradesh Passenger and Goods Taxation Rules, 1957(hereinafter referred to as the said rules), for clause(g), the following clause shall be substituted, namely:—

"(g) "treasury" means the Government treasury, sub-treasury or cyber treasury or such branch of the Bank authorized to conduct Government transaction in the State, as may be notified by the State Government;".

3. Amendment of rule 9-D.—In rule 9-D of the said rules, for sub-rules 2,3,4 and 5 the following sub-rules shall be substituted, namely:—

"(2) The authorized person shall furnish a return in Form P.G.T.25-A electronically alongwith e-challan in Form P.G.T.9-A by uploading all the requisite information on the official website of the Department at such intervals as specified in rule 40 and rule 36(2)(ii) of the Himachal Pradesh Value Added Tax Rules, 2005.

GAD-A(B)8-4/2001-II.—The Governor, Himachal Pradesh is pleased to declare 26th November, 2015 (Thursday) as public holiday (in case poll is held) in panchayats of Development Block Pangi & Development Block Bharmour of Chamba District; and Development Block Spiti at Kaza of Lahaul & Spiti District for the conduct of General Elections of PRIs. All Government Offices, Boards, Corporations, Educational Institutions and Industrial Establishments situated in the Himachal Pradesh under Industrial Disputes Act and shops will remain closed on the said date in the areas of above Institutions. This will also be a paid holiday to daily wages employees and also within the meaning of Section 25 of Negotiable Instrument Act 1881.

It is, however, clarified that special casual leave may be given to those employees who are working in different places in the State but have a right to vote in above Panchayati Raj Institutions, on the production of certificate from the concerned Presiding Officer that the employee has actually cast his/ her vote.

उनवान मुकदमाः--दरख्वास्त जेर धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के अन्तर्गत। इस कार्यालय में श्री किरपा राम पुत्र थामचु, निवासी बुठारा, तहसील रोहडू़, जिला शिमला, हि0 प्र0 ने प्रार्थना-पत्र गुजार कर निवेदन किया है कि उसके पुत्र विनोद कुमार का जन्म दिनांक 15-04-1992 को हुआ है परन्तु अज्ञानतावश उसका नाम व जन्म तिथि ग्राम पंचायत कुटाड़ा के जन्म रजिस्टर में आज तक पंजीकृत नहीं किया गया है तथा उसके नाम व जन्म-तिथि को दर्ज करने के आदेश ग्राम पंचायत कुटाड़ा को दिये जावे।

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी को भी उपरोक्त का नाम व जन्म तिथि ग्राम पंचायत कुटाड़ा में दर्ज करने में किसी भी प्रकार का एतराज व उजर हो तो वे दिनांक 30-11-2015 को असालतन व वकालतन हाजर हो कर लिखित व मौखिक प्रस्तुत करें। यदि उक्त तारीख तक कोई उजर/एतराज प्रस्तुत नहीं हुआ तो यह समझा जावेगा कि प्रार्थी का नाम व जन्म-तिथि ग्राम पंचायत में दर्ज करने हेतु कोई आपाि नहीं है तथा नाम व जन्म ग्राम पंचायत कुटाड़ा में दर्ज करने के आदेश पारित कर दिये जाएंगे।
