Shimla-2, the 23rd December, 2015

No. GAD-A(B)8-4/2001-II.—The Governor, Himachal Pradesh is pleased to declare 10th January, 2016 & 12th January, 2016 as public holiday in Himachal Pradesh on account of general election of Panchayati Raj Institutions of District Kangra and Municipal Committees in the State 186-राजपत्र/2015-26-12-2015 (6443) 6444 राजपत्र, हिमाचल प्रदेश, 26 दिसम्बर, 2015/5 पौष, 1937 (in the areas of those PRIs and Municipal Committees, where the elections are scheduled to be held) on the respective dates (in case poll is held). All Government Offices, Boards, Corporations, Educational Institutions and Industrial Establishments situated in the Himachal Pradesh under Industrial Disputes Act and shops will remain closed on the said date in the areas of above Institutions. This will also be a paid holiday to daily wages employees and also within the meaning of Section 25 of Negotiable Instrument Act 1881.

It is, however, clarified that special casual leave may be given to those employees who are working in different places in the State but have a right to vote in above Panchayati Raj Institutions/ Municipal Committees, on the production of certificate from the concerned Presiding Officer that the employee has actually cast his/her vote.

स्ांख्या आर0डी0डी0-III-(बी)-10/2014.-हिमाचल प्र्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना सं0 आर0डी0डी0-II-बी (16)-4/2004-तारिख 31-01-2008 द्वारा अधिसूचित हिमाचल प्रदेश ग्रामीण विकास विभाग में महिला ग्राम विकास संयोजिका (म0ग्रा0वि0सं0), वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम 2007 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है; अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.-1. (i)- इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश, ग्रामीण विकास विभाग, महिला ग्राम विकास संयोजिका, (म0ग्रा0वि0स0) वर्ग- III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन)

(ii) नियम, 2015 है।

ये नियम राजपत्र, (ई-गज़ट ) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होेंगें ।

2. उपाबन्ध "क" का संश्ाोंधन.-2. हिमाचल प्रदेश ग्रामीण विकास विभाग, महिला ग्राम विकास संयोजिका (म0ग्रा0वि0स0) वर्ग- III, (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2007 (जिन्हें इसमें इसके पश्चात्‌ (क) "उक्त नियम" कहा गया है) के उपाबन्ध "क" में,

स्तम्भ संख्या 2 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- (ख) "पदो की संख्या =176 (एक सौ छयहतर)"

स्तम्भ संख्याः 4 के समाने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "(i) नियमित पद्‌धारियों के लिए वेतनमानः-5910-20200 रूपए जमा 1900 रूपए ग्रेड पे ।6445 राजपत्र, हिमाचल प्रदेश, 26 दिसम्बर, 2015/5 पौष, 1937 (ii) 10300-34800 रूपए जमा 3200 रूपए ग्रेड पे (यह पे बैण्ड जमा ग्रेड पे दो वर्ष की नियमित सेवा के

(ग) पश्चात्‌ दिया जाएगा)

(iii) संविदा पर नियुक्त कर्मचारियों के लिए उपलब्धियांः-7810/-रूपए (समेकित नियत संविदात्मक रकम) प्रतिमास स्तम्भ संख्या 15-क में दिए गए व्यौरे के अनुसार ।"

स्तम्भ संख्या 15 क के सामने विद्यमान उपबन्धों के खण्ड (vii) के उपखण्ड (ग), (घ) और (ड) के स्थान पर निम्नलिखित रखा जाएगा अर्थात्‌ः-

"(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। तथापि संविदा पर नियुक्त कर्मचारी एक सौ पैंतीस दिन के प्रसूति अवकाश, दस दिन के चिक्त्सिा अवकाश और पांच दिन के विशेष अवकाश लिए भी हकदार होगा/होगी। वह चिक्तिसा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/ होगी । संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिक्त्सिा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा। (घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्तव्य से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा तथापि आपवादिक मामलों में जहां चिक्तिसा आधार पर कर्तव्य (डियूटि) से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हो तो नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पद्‌धारी को इस बावत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्तव्य (डियूटि) से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा/होगी :

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिक्त्सिा अधिकारी द्वारा जारी बीमारी/आरोग्य का प्रमाण-पत्र प्रस्तुत करना होगा ।

(ड.) संविदा पर नियुक्त व्यक्ति जिसने तैनाती के एक स्थान पर तीन वर्ष का सेवाकाल पूर्ण कर लिया है, आवश्यकता के आधार पर स्थानान्तरण के लिए पात्र होगा, जहां भी प्रशासनिक कारणों से ऐसा करना अपेक्षित हो।" आरै उक्त नियमों में निबन्धन और शर्तें संख्या 4, 5 और 6 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

NOTIFICATION

Shimla-171009, the 30th November, 2015

No. RDD-III-(B)-10/2014.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the Recruitment and Promotion Rules for the post of Lady Village Development Co-ordinator (LVDC), Class-III (Non-Gazetted), in the Rural Development Department Himachal Pradesh notified vide this Department's Notification No. RDD-II-B(16)4/2004- dated 31st Jan.2008, namely :-- 1. Short title and commencement.—1. (1) These rules may be called The Himachal Pradesh Rural Development Department Lady Village Development Co-ordinator (LVDC) Class- III (Non-Gazetted) Recruitment and Promotion (1st Amendment) Rules, 2015.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Amendments of Annexure-"A".–2.—In Annexure-"A" to the Himachal Pradesh Rural Development Department, Lady Village Development Co-ordinator (LVDC), Class-III (Non- Gazetted) Recruitment and Promotion Rules, 2008 (hereinafter referred to as the "said Rules") :-- (a) For the existing provisions against Column No-2 of the said rules , the following shall be substituted, namely:--

Number of posts = 176 ( One hundred seventy six)

(b) For the existing provisions against Column No-4, the following shall be substituted, namely:--6447 राजपत्र, हिमाचल प्रदेश, 26 दिसम्बर, 2015/5 पौष, 1937 (i) Pay Scale for Regular Incumbents.— Rs. 5910-20200 + 1900 Grade Pay. (ii) Rs. 10300-34800 + Rs. 3200 Grade Pay (this Pay Band + Grade Pay will be given after two years of regular service.

(iii) Emoluments for contractual Employees.—Rs. 7810/- (Consolidated fixed contractual amount) as per detail given in column No. 15-A

(c) For the existing provisions against clause (c), (d) and (e) of Column No-15 A, the following shall be substituted, namely:--

"(c) Contract appointee will be entitled for one day's Casual Leave after putting one month service. However, the contract appointee will also be entitled for 135 days Maternity Leave, 10 days Medical Leave and 5 days Special Leave. She shall not be entitled for Medical Reimbursement & LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Provided that the unavailed Casual Leave, Medical Leave and Special Leave can be accumulated up to the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorised absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for unauthorized absence from duty were beyond her control on medical grounds, such period shall not be excluded while considering her case for regularisation but the incumbent shall have to intimate the Controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty.

Provided that she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds." and

3. Amendment of ANNEXURE-"B".—In the said Rules for the terms & conditions No.4,5 and 6, the following shall be substituted namely:--

"4. Contract Appointee will be entitled for one day's Casual Leave after putting one month service. However, the contract appointee will also be entitled for 135 days Maternity Leave, 10 days Medical Leave and 5 days Special Leave. She shall not be entitled for Medical Reimbursement & LTC etc. No leave of any other kind except above is admissible to the contract appointee.

स्तम्भ संख्याः 4 के समाने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- (ग) "(i) नियमित पद्‌धारियों के लिए वेतनमानः-10300-34800 रूपए जमा 4200 रूपए ग्रेड पे ।6449 राजपत्र, हिमाचल प्रदेश, 26 दिसम्बर, 2015/5 पौष, 1937 (ii) संविदा पर नियुक्त कर्मचारियों के लिए उपलब्धियांः-स्तम्भ संख्या 15 क में दिए गए ब्यौरे अनुसार 14500/- रूपए प्रतिमास समेकित नियत (संविदात्मक रकम) ।

2.
