संख्याः रैव0 स्टाम्प (एफ)6-1/2009-II.--हिमाचल प्रदेश के राज्यपाल, इस विभाग की अधिसूचना संख्या रैव0स्टाम्प (एफ)6-1/2009 दिनांक 13-01-2012 के अधिक्रमण में हिमाचल प्रदेश लैण्ड रिकार्ड मैन्युल, 1992 के परिशिष्ट-XXI के अधीन विद्यमान नोट को निम्न प्रकार से प्रतिस्थापित करने के आदेश देते हैं; अर्थातः--

202-राजपत्र/2016-15-01-2016 (6827) 6828 राजपत्र, हिमाचल प्रदेश, 15 जनवरी, 2016/25 पौष, 1937 "(क) ग्रामीण एव शहरी क्षेत्र.--(I) मूल्यांकन के लिए भूमि की श्रेणीयॉ--किसी राजस्व सम्पदा में किसी सड़क से भूमि की अवस्थिति के अधार पर इस की निम्न प्रकार से पांच श्रेणीयॉ होंगीः--

(i) किसी राजस्व सम्पदा में किसी भी सडक से 25 मीटर की दूरी तक की भूमि;

(ii) किसी राजस्व सम्पदा में किसी भी सडक से 25 मीटर से अधिक व 50 मीटर की दूरी तक की भूमि;

(iii) किसी राजस्व सम्पदा में किसी भी सडक से 50 मीटर से अधिक व 100 मीटर की दूरी तक की भूमि;

(iv) किसी राजस्व सम्पदा में किसी भी सडक से 100 मीटर से अधिक व 1000 मीटर की दूरी तक की भूमि;

(v) किसी राजस्व सम्पदा में किसी भी सडक से 1000 मीटर की दूरी के बाहर अवस्थित भूमि। (II) भूमि की मूल दरें निम्न रीति में नियत की जाती हैंः--

(III) वह कारक जिनके द्वारा उपरोक्त मूल दरें गुणा की जाएंगीः--

भूमि की वृत (सर्कल) दरें (प्रति वर्ग मीटर/बीधा) बराबर है (=) भूमि की मूल दर (प्रति वर्ग मीटर/बीधा) X (गुणा) कारक-1

स्पष्टीकरण.--किसी राजस्व सम्पदा में सडकें निम्न रीति में राष्ट्रीय उच्च मार्ग, राज्य उच्च मार्ग और अन्य सडकों के रूप में श्रेणीकृत की जा सकेंगी :--

(क) संयुक्त रीति में उसके किसी भाग के विक्रय की दशा में सडक की किसी श्रेणी के समीपस्थ संयुक्त धृति के खसरा नम्बर को समुचित श्रेणी में वर्गीकरण के लिए लिया जाएगाः (ख) यदि निकटतम सडक किसी अन्य राजस्व सम्पदा में है तो उससे दूरी को समुचित श्रेणी में वर्गीकरण के लिए लिया जाएगाः

(ग) किसी एक से अधिक सडक से सामान समीप्य होने की दषा में मूल्य की संगणना अधिक मूल्य वाली सम्पति की सडक के अधार पर की जाएगीः6829 राजपत्र, हिमाचल प्रदेश, 15 जनवरी, 2016/25 पौष, 1937 परन्तु प्रत्येक राजस्व सम्पदा में सम्बद्व जिला उपायुक्त सम्पदा को सडकों की संख्या की बावत उन्हें राश्ट्रीय उच्च मार्ग, राज्य उच्च मार्ग और अन्य सडक के रूप में वर्गीकृत करेगा और जहां तक सम्भव हो राजस्व सम्पदा में सडक की उच्चत्तर श्रेणी को समनुदेकित की जा रही दर सहित प्रत्येक श्रेणी के लिए पृथकतरू दर की संगणना की जाएगीः

परन्तु यह और कि उपायुक्त आक्षेप आमन्त्रित करने और उन पर विचार करने के पश्चात्‌ किसी राजस्व सम्पदा में किसी श्रेणी के लिए इस नियमित आख्यापक आदेश पारित करके दरों में फेर बदल कर सकेगा।

(ख) दरों का संशोधन

उपायुक्त उसकी अधिकारिता में आने वाली प्रत्येक तहसील/उप-तहसील की प्रत्येक राजस्व सम्पदा में पूर्ववर्ती वर्ष के दौरान संव्यवहारों की रकम के आधार पर प्रत्येक वित्तीय वर्ष के लिए दरों में फेर बदल (बढौतरी, कमी या वही दरें) कर सकेगा और अन्य कारक जैसे की नई सडकों, परियोजनाओं का सन्निर्माण जिनके कारण भूमि की क्रय मूल्य आदि की दर में बढ़ौतरी हो जाए, जो ऐसी तहसील/उप-तहसील के ग्रामीण/ शहरी क्षेत्रों में भूमि की मूल्य की प्रास्थिति को प्रभवित करने के लिए उत्तरदायी है। भविष्य में भी दरें मार्च माह में नियत की जाएगी और वह उस वर्ष के प्रथम अप्रैल से अगामी वर्ष के 31 मार्च तक प्रभावी रहनी अधिसूचित की जाएंगीः

परन्तु दरों को जनसाधारण से आक्षेप(पों)/सूझाव(वों) को आमन्त्रित करने और उन पर सम्यक्‌ रूप से विचार करने के पष्चात्‌ अन्तिम रूप दिया जाएगा। जनसाधारण को उनकी आपत्तियोें/सुझावों को दायर करने के लिए कम से कम एक महीने की अवधि का अवसर दिया जावेगा।

(ग) विनिर्दिष्ट संव्यवहार के लिए भूमि की श्रेणी चिन्हित करने की प्रक्रिया

क्रेता को राज्य उच्च मार्ग और राष्ट्रीय उच्च मार्ग से सुसंगत भूमि की धृति की या ग्रामीण क्षेत्र की दषा में अन्य सडक या शहरी क्षेत्र में सड़क की सुसंगत श्रेणी से दूरी का वर्णन करते हुए शपथ पत्र दायर करना अपेक्षित होगा। यह स्टाम्प शुल्क की संगणना के लिए दर हेतू आधार होगा। परन्तु जहां बाद में शपथ पत्र में सूचना उच्चतर श्रेणी के लागू स्टाम्प शुल्क व रजिस्टे्रशन फीस का अपवंचन करने के आश्य से मिथ्या दर्शाई गई है को लागू स्टाम्प शुल्क/रजिस्ट्रीकरण के 50 प्रतिशत की शास्ति उद्‌गृहीत की जा सकेगी तथा शास्ति की वसूली और अतिशेष लागू शुल्क तथा फीस क्रेता से, यदि अपेक्षित हो, बकाया भू-राजस्व के रूप में बसूल की जाएगी''।

No. Rev. Stamp(F)6-1/2009-II.—In supersession of this department notification number Rev. Stamp(F)6-1/2009 dated on 13.01.2012, the Governor of Himachal Pradesh is pleased to 6830 राजपत्र, हिमाचल प्रदेश, 15 जनवरी, 2016/25 पौष, 1937 substitute the existing note appended to Appendix-XXI of H.P. Land Record Manual, 1992 as follows, namely:—

(A) Rural and Urban Areas

(I) Categories of land for valuation.—There will be five categories of land depending upon its location from any road in the Revenue Estate as follows:—

(i) Land, upto 25 meters from any road in the Revenue Estate.

(ii) Land situated at a distance of more than 25 meters to 50 meters distance from any road in the Revenue Estate.

(iii) Land, situated at a distance of more than 50 meters to 100 meters distance from any road in the Revenue Estate.

(iv) Land, situated at a distance of more than 100 meters to 1000 meters distance from any road in the Revenue Estate.

(v) Land, situated at a distance more than 1000 meters from any road in the Revenue Estate.

(II) Basic rates of land are fixed on the following manners.—

(III) Factors by which Base Rates arrived at above are to be multiplied:

Circle Rate of the land (per Square Meter/per Bigha) will be equal to(=) Base Rate of

land (per Square meter/per bigha) X Factor I.

Explanation.—The roads in any Revenue Estate may be categorised in the following manner as National Highway, State Highway and Other Roads:—

(a) In case of sale of share in a joint holding, Kh. No. of joint holding closest to any category of road will be taken for classification in the appropriate category;

(b) In case the nearest road is in another Revenue Estate, distance from that will be taken for the classification in the appropriate category;

(c) In case of equal proximity to more than one road, the value will be computed on the basis of the road with higher value property:

Provided that in each Revenue Estate, the Deputy Commissioner of the District concerned shall, by having regard to the number of roads in the estate, classify them in the NH, SH and OR and the rate shall be computed separately for each categories as far as possible, with the highest rate being assigned to the highest class of road in the estate;

Provided further that the Deputy Commissioner may, after inviting objections and considering the same, vary the rates for any of the categories in any revenue estate, by passing a speaking order in this behalf.

(B) Revision of rate

The Deputy Commissioner may vary (increase, decrease or stable) the rates in each Revenue Estate of every Tehsil/Sub-Tehsil, falling under his/her jurisdiction for each financial year depending upon the transactions amount during previous year and any other factor like construction of new road, projects which may lead to escalation to rate of land sale prices etc. which are responsible for affecting the status of value of land in rural/urban areas of such Tehsil/Sub-Tehsil. In future also the rates shall be fixed in the month of March and they would be notified to be effective w.e.f from 1st April of that year till 31st March of the next year:

Provided that the rates shall be finalized after inviting objection(s)/ suggestion(s) from the general public and duly considering the same. The opportunity of at least one month period may be given to general public to file their objection(s)/suggestion(s).

(C) Procedure for Identifying Category of land for a specific transaction

The purchaser will be required to file an affidavit stating the distance of the relevant land or holding from a State Highway and National Highway or Other Road in the case of a rural area or from relevant Class of Road in the urban area. This will be the basis for the rate to be used for stamp duty calculation. Provided that where the information in the affidavit is subsequently shown to have been false in order to evade the stamp duty, registration fee applicable to a higher category, then a penalty of up to 50% of the applicable stamp duty/ registration fee may be levied and the recovery of the penalty and balance applicable duty and fee may be recovered from the purchaser as an arrear of land revenue, if required.

संख्याःई0एक्स0एन0-एफ(10)-5/2015.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (2005 का अधिनियम संख्यांक 12) की धारा 10 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पूर्वोक्त अधिनियम से संलग्न अनुसूची 'क' और 'ख' का संशोधन करने का प्रस्ताव करते हैं, और इसे जनसाधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

सम्भाव्य प्रभावित होने वाले किसी हितबद्ध व्यक्ति को इन संशोधनों की बाबत, यदि कोई आक्षेप या सुझाव है/हैं, तोे वह उसे/उन्हें इस अधिसूचना के प्रकाशन की तारीख से दस दिन की अवधि के भीतर आयुक्त, आबकारी एवं कराधान, हिमाचल प्रदेश, शिमला-171009 को भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप (पों)/सुझाव (वों), यदि कोई है/हैंं, पर सरकार द्वारा इनको अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌्‌ :--

प्रारूप संशोधन

1. अनुसूची क का संशोधन.--हिमाचल प्रदेश मूल्य परिवर्धित कर अधिनियम, 2005 (जिसे इसमें इसके पश्चात्‌ "मूूल अधिनियम" कहा गया है) से संलग्न अनुसूची क में-

(क) भाग-2-क में,-

(i) प्रविष्टि संख्या 15 के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्‌्‌ः-

"15. फलाई ऐश ईंटों, अपवर्त्तक ईंटों (रिफ्रेक्टरी ब्रिक्स) और ऐसफैल्टिक रूफिंग, मिट्‌्‌टी की टाईलों सहित सभी प्रकार की ईंटें तथा ए ए सी ब्लॉकस (ऑटोक्लेवड एॅअरेटिड कॉनक्रीट ब्लॉकस) सहित सभी प्रकार के कॉनक्रीट ब्लॉकस ।";

(ii) प्रविष्टि संख्या 37, के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्‌्‌ः-

"37. लेखन उपकरण, रजिस्टर, लॉन्ग नोटबुक, ग्राफ नोटबुक, प्रयोगशाला नोटबुक, समस्त ये जब दो सौ रूपए के अधिकत्तम फुटकर कीमत से अधिक के हों ।";

(iii) विद्यमान प्रविष्टि संख्या 54 का लोप किया जाएगा ।;

(iv) प्रविष्टि संख्या 74 के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्‌ः-

"74. दो पहिया वाहनों सहित पुराने/उपयोग किए गए यान/पूर्व स्वाधिकृत यान (कर, पुराने/उपयोग किए गए यान के विक्रय मूल्य और क्रय मूल्य के बीच अन्तर पर उद्‌गृहीत किया जाएगा;

स्पष्टीकरण.--वास्तविक मूल्य अर्थात्‌ दो लाख रूपए पर निर्धारित/क्रय किए गए पुराने यान और यदि आगे पूरी तरह से मरम्मत करने (ओवर हालिंग) के पश्चात्‌ दो लाख पचास हजार रूपए के वास्तविक मूल्य पर विक्रीत किया जाता है तो, कर, पचास हजार रूपए पर उद्‌गृहीत किया जाएगा ।";

(v) विद्यमान प्रविष्टि संख्या 84 के पश्चात्‌ निम्नलिखित प्रविष्टियॉं अन्तःस्थापित की जाएंगी, अर्थात्‌ः- "84-क.-अनुसूची 'ख' की मद संख्या 16 में सम्मिलित से अन्यथा मक्खन, पनीर, टेबल स्प्रेड आदि सहित सभी प्रकार के प्रसंस्कृत और पैक किए हुए डेरी उत्पाद;

84-ख.-सोयाबीन बड़ी, न्यूट्री नगि्‌टॅस, अमृत्तसरी बड़ियॉं, कॉर्नफ्लैकस, हवीट ब्रॅानफ्लैकस, ओट्‌स आदि सहित सभी प्रकार के प्रसंस्कृत सीअरिअलस/ग्रेनस;"; और

(vi) विद्यमान प्रविष्टि संख्या 114 का लोप किया जाएगा ।

(ख) भाग 2-क क में, प्रविष्टि संख्या-। के पश्चात्‌ निम्नलिखित प्रविष्टि अन्तःस्थापित की जाएगी, अर्थात्‌ः-

"2. घरेलू विद्युत तारों (इलैक्ट्रिकलस वायर) और विद्युत केबिलज (इलैक्ट्रिकल केबिलज) सहित सभी प्रकार के केबिलज अर्थात्‌ औद्योगिक केबिलज, हाई वोल्टेज केबिलज, एक्स एल केबिलज, पी0एफ0 केबिलज, जैली चढ़ी हुई केबिलज, आप्टिकल फाइबर केबिलज ।"।

2. अनुसूची ख का संशोधन.--मूल अधिनियम से संलग्न अनुसूची ख में, प्रविष्टि संख्या 4 के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्‌ः-

"4. पशुदाना (ऐनीमल फीड) और दाना परिपूरक नामतः मूर्गीदाना, पशुदाना(कैटल फीड), सुअरदाना, मछलीदाना, मत्स्य भोजन, प्रॉन फीड, श्रिम्प फीड और दाना परिपूरक के रूप में विक्रीत प्रसंस्कृत वस्तु और घास, सूखी घास और भूसे, दालों और गेहूं की भूसी, ऐडडि्‌टिवस और डिऑयलड केक सहित दाना परिपूरकों के रूप में उपयोग के लिए आशयित खनिज मिश्रण सान्द्र ।

No. EXN-F(10)-5/2015.—In exercise of the powers conferred by section 10 of the Himachal Pradesh Value Added Tax Act, 2005 (Act No. 12 of 2005), the Governor of Himachal Pradesh proposes to amend SCHEDULES 'A' and 'B' appended to the Act ibid and the same are hereby published in the Official Gazette(e-gazette) Himachal Pradesh for the information of the general public;

If any interested person likely to be affected has any objection(s) or suggestion(s) with regard to these amendments, he may send the same to the Excise and Taxation Commissioner, Himachal Pradesh, Shimla-171009 within a period of 10 days from the date of publication of this notification;

DRAFT AMENDMENT

1. Amendment of Schedule A.—In Schedule A appended to the Himachal Pradesh Value Added Tax Act, 2005(hereinafter called the "principal Act")—

(a) in Part II-A,—

(i) for entry No.15, the following entry shall be substituted, namely:—

"15. Bricks of all kinds including fly ash bricks, refractory bricks and asphaltic roofing, earthen tiles and all kind of concrete blocks including AAC Blocks (Autoclaved Aerated Concrete Blocks).";

(ii) for entry No.37, the following entry shall be substituted, namely:—

"37. Writing instruments, register, long notebook, graph notebook, laboratory notebook all these when exceeding MRP of Rs. 200/-.";

(iii) the existing entry No.54, shall be omitted.;

(iv) for entry No.74, the following entry shall be substituted, namely:—

"74. Old/Used vehicle/ pre-owned vehicle including two wheelers (tax will be levied on the difference between the selling price and buying price of the old/used Vehicle);

Explanation.—Old Vehicle assessed/purchased at true value say at Rs. 2,00,000 and further after overhauling sold by true value at Rs. 2,50,000/- then tax shall be levied on Rs. 50,000/-.";

(v) after existing entry No. 84, the following entries shall be inserted, namely:—

"84-A.-All kinds of processed and packed dairy products including butter, cheese, table spreads etc. other than those covered by item No. 16 of Schedule 'B';

84-B.-All kinds of processed cereals/grains including soyabean bari, nutri nuggets, amritsari bariyan, cornflakes, wheat branflakes, oats etc;"; and

(vi) the existing entry No.114 shall be omitted.

(b) in Part II-AA, after entry No.1, the following entry shall be inserted, namely:—

"2. All types of cables viz Industrial cables, high voltage cables, XL cables, PF cables, jelly-filled cables, optical fibre cables including household electrical wires and electrical cables.".

2. Amendment of Schedule B.—In Schedule B appended to the principal Act, for entry No. 4, the following entry shall be substituted, namely:—

"4. Animal feed and feed supplements namely processed commodity sold as poultry feed, cattle feed, pig feed, fish feed, fish meal, prawn feed, shrimp feed and feed supplements and mineral mixture concentrates, intended for use as feed supplements including grass, hay and straw, husk of pulses and wheat, Additives and Deoiled cakes.".

श्रीमती सुर्दाश्ना देवी उपरोक्त ने इस न्यायालय में एक दरख्वास्त के साथ शपथ पत्र गुजार कर यह अनुरोध किया है कि उनका नाम ग्राम पंचायत सम्बन्धित में स्वर्णा देवी दर्ज है जबकि उनका सही नाम सुर्दाश्ना देवी जिसे वह ग्राम पंचायत सम्बन्धित में सही नाम सुर्दाश्ना देवी दर्ज करवाना चाहती है। अतः इस इश्तहार के माध्यम से सर्वसाधारण जनता को सूचित किया जाता है कि यदि उपरोक्त नाम की दरुस्ती बारे किसी भी व्यक्ति को कोई एतराज हो तो हमारी अदालत में दिनांक 31-01-2016 को या इससे पूर्व स्वयं या किसी प्राधिकृत एजेन्ट के द्वारा अपना एतराज पेश करें अन्यथा नियत तिथि तक किसी भी6845 राजपत्र, हिमाचल प्रदेश, 15 जनवरी, 2016/25 पौष, 1937 ओर सेे कोई उजर/एतराज प्राप्त न होने की सूरत में उपरोक्त सरनेम की दरुस्ती बारे आदेश जारी किये जायेंगे।

सुश्री सोनिया नेगी उपरोक्त ने इस न्यायालय में एक दरखास्त के साथ शपथ पत्र गुजार कर यह अनुरोध किया है कि उनका नाम ग्राम पंचायत सापनी में हेम लता गलती से दर्ज है लेकिन उनका सही नाम सोनिया नेगी है। इसलिए वे अपना नाम ग्राम पंचायत सापनी में हेम लता के स्थान पर सोनिया नेगी दर्ज करवाना चाहती है।
