संख्या राजस्व-डी0-(एफ)4-11/2015.--हिमाचल प्रदेश भू-अभिलेख नियमावली, 1992 के पैरा 3.17 एवम पैरा 3.18 मे वर्णित /निर्दिष्ट प्रावधानों/मानकों में छूट देते हुए राज्यपाल, हिमाचल प्रदेश, तहसील थुनाग तथा तहसील सदर, जिला मण्डी के वर्तमान पटवार वृतों का पुनर्गठन करते हुए दो नये पटवार वृत 237-राजपत्र/2016-02-03-2016 (8395) 8396 राजपत्र, हिमाचल प्रदेश, 02 मार्च, 2016/12 फाल्गुन, 1937 बरयोगी, तहसील थुनाग तथा नमलाये, तहसील सदर, जिला मण्डी, हि0 प्र0, में सम्बन्धित मुहालों की सूचि सहित परिशिष्ट "क" तथा "ख" के अनुसार सृजित करने के सहर्ष आदेश देते हैं ।

संख्या-एफ0एफ0ई0-बी0-ए (3) 4/2015.--हिमाचल प्रदेश वन (अधिकार धारकों को इमारती लकड़ी का वितरण) संशोधन नियम, 2015 के प्रारूप को, इस विभाग की समसंख्यक अधिसूचना तारीख 03-09-2015 द्वारा, इससे सम्भाव्य प्रभावित होने वाले व्यक्ति (व्यक्तियों) से, इनके प्रकाशित किए जाने की तारीख से तीस दिन की अवधि के भीतर आक्षेप (पाेंं) या सुझाव (वाें) आमन्त्रित करने के लिए तारीख 15.09. 2015 को राजपत्र, हिमाचल प्रदेश में प्रकाशित किया गया था;

उपरोक्त नियत अवधि के भीतर प्रधान मुख्य अरण्यपाल (होफ), द्वारा, किन्ही हितबद्ध व्यक्ति(यों) से, कोई आक्षेप(पों) या सुझाव(वों) प्राप्त नहीं हुए;

अतः हिमाचल प्रदेश के राज्यपाल, भारतीय वन अधिनियम, 1927 (1927 का 16) की धारा 32 के खण्ड (ठ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या एफ0 एफ0ई0-बी0-ई (3)43/2006- वाल-II, तारीख 26-12-2013 द्वारा अधिसूचित और तारीख 28-12-2013 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश वन ( अधिकार धारकों को इमारती लकड़ी का वितरण) नियम, 2013 में और संशोधन करने के लिए निम्नलिखित नियम बनाते है- अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश वन (अधिकार धारकों को ईमारती लकड़ी का वितरण) संशोधन नियम, 2016 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश मे इनके प्रकाशन की तारीख से प्रवृत होगें।

2. नियम-2 का स्ांशोधन.-हिमाचल प्रदेश वन (अधिकार धारकों को ईमारती लकड़ी वितरण) नियम, 2013 (जिन्हें इसमें इसके पश्चात्‌ " उक्त नियम " कहा गया है) के खण्ड (ड)़ के स्थान पर निम्नलिखित खण्ड रखा जाएगा, अर्थात्‌ः-

(ड) " ईमारती लकड़ी का वितरण अधिकार " से अधिकार धारक के जिसके पास केवल विरासत द्वारा अर्जित कृषि योग्य भूमि है, सम्बन्धित क्षेत्र की बन्दोबस्त रिपोर्ट में यथा अभिलिखित अधिकार धारक के वास्तविक घरेलू उपयोग हेतु आवासीय मकान एवं गौशाला आदि के निर्माण, मरम्मत और परिवर्धन या परिवर्तन हेतु इमारती लकड़ी मंजूर (प्रदान) करने के अधिकार अभिप्रेत हैं;

परन्तु कोई भी व्यक्ति, जिसने राजस्व सम्पदा में बाहर से बसने के लिए आवास के सन्निर्माण, कृषि या किसी अन्य सहबद्ध प्रयोजन हेतु भूमि क्रय की है, इमारती लकड़ी के अधिकार का हकदार नहीं होगा।" 3. नियम 3 का संशोधन.-उक्त नियमों के नियम 3 के खण्ड (ii) और (iv) के स्थान पर क्र्रमशः निम्नलिखित नए खण्ड ( ii) और (iv) रखे जाएंगे अर्थात्‌ः-

(ii) यदि अधिकार धारक के पास भू-धृति है जो उसे एक से अधिक स्थान पर इमारती लकड़ी को प्रदान किए जाने के लिए अर्हित करती है, तो उसे केवल एक स्थान पर, जहां पर वास्तव में वह रहता है, इमारती लकड़ी मंजूर की जा सकेगी;

(iv) यदि उस वन, जहां सम्बद्ध अधिकार धारकाें के पास इमारती लकड़ी वितरण अधिकार है, में इस प्रयोजन के लिए नाश रक्षित सालवेज वृक्ष उपलब्ध नहीं है तो अधिकार धारकों को इमारती लकड़ी मंजूर नहीं की जाएगी;।

4. नियम 4 का संशोधन.-उक्त नियमों के नियम 4 के उप नियम (2) के स्थान पर निम्नलिखित उप नियम रखा जाएगा, अर्थातः-

"(2) वृक्ष, नाश रक्षित (गिरे हुए, सूखे खड़े) वृक्षों में से दिए जाएंगे। अधिकार धारकों को कोई हरे खड़े वृक्ष मंजूर नहीं किए जाएंगे"।

5. नियम 5 का संशोधन.-उक्त नियमों के नियम 5 के खण्ड (i) और (ii) में "पंद्रह वर्षों" और "पांच वर्षोंं" शब्दों के स्थान पर क्रमशः "बीस वर्षाेंंं" और "दस वर्षाेंं" शब्द रखे जाएंगे।8399 राजपत्र, हिमाचल प्रदेश, 02 मार्च, 2016/12 फाल्गुन, 1937 6. नियम 7 का प्रतिस्थापन.-उक्त नियमों के नियम 7 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌;-

"7. वृक्षों की मंजूरी के लिए प्रक्र्रिया.- अधिकार धारक विरासत और अधिकार द्वारा अर्जित अपनी भू-धृति के सम्बन्ध में सम्बद्ध पटवारी से आवश्यक टिप्पण (रिमार्कस) प्राप्त करने के पश्चात्‌ सम्बद्ध ग्राम पंचायत को उपाबन्ध-I में वृक्षों की मंजूरी के लिए आवेदन कर सकेगा। सम्बद्ध ग्राम पंचायत, अधिकार धारक की आवश्यकताओं की असलियत का अभिनिश्चयन करने के पश्चात्‌, सिफारिश करने के लिए आवेदन की संवीक्षा करेगी। सिफारिश ग्राम पंचायत के संकल्प के रूप में की जाएगी। तत्पश्चात्‌ अधिकार धारक क्षेत्र के वन रक्षक को अपना आवेदन प्रस्तुत करेगा जो इसे इस प्रयोजन के लिए अनुरक्षित रजिस्टर में दर्ज करेगा और अधिकार धारक के आवेदन की प्राप्ति की अभिस्वीकृति देगा तथा मांग की असलियत का अभिनिश्चयन करने के पश्चात्‌ अपनी सिफारिश सहित आवेदन को वन खण्ड अधिकारी को भेजेगा, जो अपनी सिफारिशों सहित आवेदन को वन परिक्षेत्र अधिकारी को प्रस्तुत करेगा। वन परिक्षेत्र अधिकारी उसे अपनी सिफारिश सहित वन मण्डल अधिकारी को अग्रेषित करेगा। वन मण्डल अधिकारी, वन परिक्षेत्र अधिकारी से आवेदन की प्राप्ति के पश्चात्‌ आवश्यकताओं की असलियत और सम्बद्ध वन में नाश रक्षित (सालवेज) उपलब्धता के बारे में अपना समाधान होने के पश्चात्‌ वृक्षों को मंजूर करने की कार्रवाई करेगा और इन नियमों से संलग्न उपाबन्ध-II के अनुसार सम्बद्ध अधिकार धारक को अपना विनिश्चय सूचित करेगा।

7. नियम 12 का संशोधन.-उक्त नियमों के नियम 12 में "स्थान पर दूसरे" शब्दों के पश्चात्‌ "नाश रक्षित (सालवेज)" शब्द और कोष्ठक रखे जाएंगे।

8. नियम 14 का प्रतिस्थापन.-उक्त नियमों के नियम 14 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌;-

"14 शास्तियां.-यदि कोई अधिकार धारक प्राप्त की गई इमारती लकड़ी की उपयोगिता में इन नियमों के, नियम 3 (ii) के सिवाय, किसी उपबन्ध का उल्लंघन करता है तो उसके अधिकार अगले बीस वर्षों के लिए निलम्बित कर दिए जाएंगे। नियम 3 (ii) के उल्लंघन की दशा में ऐसे अधिकार धारक के इमारती लकड़ी वितरण अधिकार स्थायी रूप से निलम्बित कर दिए जाएंगे। अधिकार धारक उपरोक्त शास्ति के अतिरिक्त बाजार दर पर वृक्ष की लागत का संदाय के लिए भी दायी होगा।"।

9. उपाबन्ध-I का प्रतिस्थापन.-उक्त नियमों से संलग्न उपाबन्ध-I के स्थान पर निम्नलिखित उपाबन्ध रखा जाएगा, अर्थात्‌ः- .

(i) मकान/गौशाला के निर्माण, मरम्मत और परिवर्धन या परिवर्तन की आवश्यकता की पूर्ति के लिए वृक्ष मेरी भूमि पर उपलब्ध नहीं हैं;

(ii) मैनें गत दस वर्षाें के दौरान अपनी भूमि से दस वर्षीय पातन कार्यक्रम (फैलिंग प्रोग्राम) के अन्तर्गत किसी भी वृक्ष का विक्रय नहीं किया है;

(iii) मेरी भू-धृति केवल एक स्थान पर है/एक से अधिक स्थानों पर है अर्थात्‌ -------स्थान पर और --------स्थान पर और मैं वास्तव में------स्थान पर रह रहा हूं। पहले मंजूर की गई टी0डी0 के ब्यौरे निम्न प्रकार से है; ------------

(iv) मैं मूल अधिकार धारक हूं और परिवार का मुखिया भी हूं ;

(v) मैनें हिमाचल प्रदेश अभिधृति और भूमि सुधार अधिनियम,1972 की धारा 118 के अधीन सरकार की अनुमति प्राप्त करने के पश्चात्‌ भूमि क्रय नहीं की है;

(vi) मै समझता हॅू कि अधिकार धारकों के अधिकार वन संरक्षण में अधिकार धारकों के सक्रिय सहयोग और सहभागिता के अध्यधीन हैं तथा मैं वन अपराधियों को पकड़ने, आग बुझाने आदि हेतु अपने कर्तव्यों का पालन करूंगा; और

(vii) मै, टी0डी0 के अधीन अभिप्राप्त इमारती लकड़ी का दुरूपयोग नहीं करूंगा और इस बाबत वन विभाग के नियमों/अनुदेशों का पालन करूंगा।

वन रक्षक की रिर्पोट

(i) आवेदक ने गत बीस वर्षाें के दौरान नए आवासीय घर/गौशाला के निर्माण के लिए इमारती लकड़ी वितरण के अन्तर्गत वृक्ष/इमारती लकड़ी प्राप्त नही किए हैं/की है। आवेदक ने गत दस वर्षाें में आवासीय घर/गौशाला की मरम्मत,परिवर्धन या परिवर्तन के लिए इमारती लकड़ी वितरण के अन्तर्गत वृक्ष/इमारती लकड़ी प्राप्त नहीं किए हैं/की है।

(ii) आवेदक ने वन सम्पदा को कोई हानि/क्षति नहीं पहॅुचाई है/वन भूमि पर अवैध कब्जा नहीं किया है और आवेदक के विरूद्ध वन अपराध के बारे में कोई क्षतिपूर्ति रिपोर्ट/प्रथम इत्तिला रिपोर्ट/न्यायालय मामला लम्बित नहीं है।

(iii) इमारती लकड़ी की अपेक्षा -----------------कार्य के लिए है;

(iv) आवेदक वन संरक्षण में पूर्ण सहयोग देता है; और

(v) आवेदक को निम्नलिखित वृक्ष मंजूर किए जा सकेंगेः-

(iii) आवेदक ने दस वर्षीय पातन कार्यक्रम के अन्तर्गत गत दस वर्षाें के दौरान अपनी भूमि में से कोई वृक्ष नहीं बेचा है।

NOTIFICATION

Shimla-2, the 26th February, 2016

No. FFE-B-A(3)4/2015.—Whereas, the draft Himachal Pradesh Forest (Timber Distribution to the Right Holders) Amendment Rules, 2015 were published in the Rajpatra, Himachal Pradesh on 15-09-2015 vide Notification of even No. dated 03-09-2015 for inviting objection(s) and suggestion(s) from person(s) likely to be affected thereby within a period of 30 days from the date of their publication;

Whereas, no objection(s) or suggestion(s) from any interested person(s) has/have been received by the Principal Chief Conservator of Forests (HoFF), Himachal Pradesh within the above stipulated period;

Now, in exercise of the powers conferred by clause (L) of section 32 of the Indian Forest Act, 1927 (16 of 1927), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Forest (Timber Distribution to the Right Holders) Rules, 2013 notified vide Notification No. FFE-B-E(3)43/2006-Vol-II, dated 26-12-2013 and published in the Rajpatra, Himachal Pradesh on 28-12-2013, namely:-

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Forest (Timber Distribution to the Right Holders) Amendment rules, 2016.

(2) They shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 2.—In rule 2 of the Himachal Pradesh Forest (Timber Distribution to the Right Holders) Rules, 2013 (hereinafter referred to as the "said rules"), for clause(e), the following clause shall be substituted, namely:-

"(e) Timber Distribution Rights means right of a Right Holder having cultivable land, acquired only through inheritance, for grant of timber for construction, repair and addition or alteration of residential house and cow shed for bonafide domestic use of the Right Holder as recorded in the Forest Settlement Report of the area concerned:

Provided that no person who have purchased land for construction of residence, cultivation or any other allied purpose settled from outside in the revenue estate shall be entitled for Timber Distribution rights".

3. Amendment of rule 3.—In rule 3 of the said rules, for clauses (ii) and (vi), the following new clauses (ii) and (vi), shall respectively be substituted, namely:-

"(ii) in case Right Holder has land holding which qualifies him for grant of timber at more than one place, he may be granted timber only at one place where he actually resides;

(vi) timber shall not be granted to the Right Holders, if salvage trees for the purpose are not available in the forest where concerned Right Holders have Timber Distribution rights".

4. Amendment of rule 4.—In rule 4 of the said rules, for sub rule (2), the following sub- rule shall be substituted, namely:-

"(2) Trees shall be given from salvage (fallen, dry standing) trees. No green standing trees shall be granted to the Right Holder".

5. Amendment of rule 5.—In rule 5 of the said rules, in clauses (i) and (ii), for the words "fifteen years" and "five years", the words "twenty years" and "ten years" shall respectively be substituted.

6. Substitution of rule 7.—For rule 7 of the said rules, the following rule shall be substituted, namely:-

"7. "Procedure for grant of trees.–The Right Holder may apply for grant of trees on annexure-I to the Gram Panchayat concerned after getting necessary remarks from the Patwari concerned about his land holding acquired through inheritance and rights. The concerned Gram Panchayat shall scrutinize the applications for making recommendations after ascertaining the genuineness of the requirement of the Right Holders. The recommendation shall be made in the form of a resolution of the Gram Panchayat. Thereafter, Right Holder shall submit his application to the Forest Guard of the area who shall enter the same in the register maintained for the purpose and shall acknowledge the receipt of the application to the Right Holder and shall send the application with his recommendations to the Block Officer after ascertaining the genuineness of demand, who in turn shall submit the application alongwith his recommendations to the Range Officer. The Range Officer shall forward the same with his recommendations to the Divisional Forest Officer. After receipt of application from the Range Officer, the Divisional Forest Officer shall take action for grant of the trees after satisfying himself about the genuineness of the requirements and availability of salvage trees in the concerned forest and intimate his decision to the Right Holder concerned as per Annexure-II appended to these rules".

7. Amendment of rule 12.—In rule 12 of the said rules, after the words and sign "Thereafter, "another," the word "salvage" shall be inserted.

8. Substitution of rule 14.—For rule 14 of the said rules, the following rule shall be substituted, namely:-

"14 Penalties.—If any Right Holder, contravenes any of the provisions of these rules, except rule 3(ii), in utilization of timber obtained, his rights shall be suspended for next twenty years. In the case of contravention of rule 3(ii), Timber Distribution Rights of such Right Holder shall be suspended permanently. The Right Holder, in addition to the above penalty; shall also be liable to pay the cost of the tree at the market rate.

9. Substitution of Annexure-I.— For annexure-I annexed to the said rules, following Annexure shall be substituted namely:-

अतः इस सम्बन्ध में श्री अजीत सिंह पुत्र श्री चरणजीत सिंह, निवासी गांव भुंगरनी, तहसील पांवटा साहिब, जिला सिरमौर, हिमाचल प्रदेश की शादी के पंजीकरण बारे किसी व्यक्ति को कोई एतराज हो तो वह दिनांक 18-03-2016 तक असालतन अथवा वकालतन अधोहस्ताक्षरी की अदालत में उपस्थित होकर प्रस्तुत कर सकता है। निर्धारित तिथि तक कोई एतराज प्राप्त न होने की सूरत में प्रार्थी का विवाह पंजीकरण एवं दर्ज करने के नियमानुसार आदेश पारित कर दिये जायेंगे।
