(राज्यपाल महोदय द्वारा तारीख 4 अप्रैल, 2016 को यथाअनुमोदित)

हिमाचल प्रदेश अधीनस्थ न्यायालय कर्मचारी (वेतन, भत्ते और सेवा की अन्य शर्तें) अधिनियम, 2005 (2006 का अधिनियम संख्यांक 3) का और संशोधन करने के लिए अधिनियम। 112 राजपत्र, हिमाचल प्रदेश, 7 अप्रैल, 2016/18 चैत्र, 1938 भारत गणराज्य के छियासठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश अधीनस्थ न्यायालय कर्मचारी (वेतन, भत्ते और सेवा की अन्य शर्तें) द्वितीय संशोधन अधिनियम, 2015 है।

2. धारा 3 का संशोधन.-- हिमाचल प्रदेश अधीनस्थ न्यायालय कर्मचारी (वेतन, भत्ते और सेवा की अन्य शर्तें) अधिनियम, 2005 (जिसे इसमें इसके पश्चात्‌ "मूल अधिनियम" कहा गया है) की धारा 3 की उपधारा (1) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थात्‌ः-

परन्तु अनुसूची की क्रम संख्याः 1, 2, 7, 8, 9 और 33 में वर्णित कर्मचारियों के वे प्रवर्ग, जिन्हें शेट्‌टी आयोग की सिफारिशों के अनुसार उच्चतर वेतनमान दे दिए गए हैं, राज्य सरकार द्वारा, अधिसूचना संख्याः गृह-बी (ई) 2-7/2009-एच सी तारीख 24-09-2012 द्वारा प्रदान की गई अतिरिक्त वेतनवृद्धि के हकदार नहीं होंगे तथापि, उपरोक्त वर्णित प्रवर्गोें के सिवाय, कर्मचारियों के अन्य वे प्रवर्ग, जिन्हें उच्चतर वेतनमान प्रदान नहीं किया गया है, उक्त अधिसूचना के अधीन 1-10-2012 के बजाय 1-4-2003 से विद्यमान वेतन पर एक अतिरिक्त वेतनवृद्धि के हकदार होंगे।"।

THE HIMACHAL PRADESH SUBORDINATE COURTS' EMPLOYEES (PAY,

ALLOWANCES AND OTHER CONDITIONS OF SERVICE) SECOND

AMENDMENT ACT, 2015

(AS ASSENTED TO BY THE GOVERNOR ON 4TH APRIL, 2016)

ACT

further to amend the Himachal Pradesh Subordinate Courts' Employees (Pay, Allowances

and other Conditions of Services) Act, 2005 (Act No. 3 of 2006).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-sixth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Subordinate Courts' Employees (Pay, Allowances and other Conditions of Service) Second Amendment Act, 2015.

"(1) The Subordinate Courts' Employees shall be paid the pay scales, as specified in the SCHEDULE :

116 राजपत्र, हिमाचल प्रदेश, 7 अप्रैल, 2016/18 चैत्र, 1938 Provided that the categories of employees mentioned at Sr. Nos. 1, 2, 7, 8, 9 and 33 of the SCHEDULE, who have been given higher pay scales as per the recommendations of the Shetty Commission, shall not be entitled to additional increment granted by the State Government vide Notification No. Home-B (E) 2-7/2009-HC dated 24-09-2012, however, other categories of employees, except above mentioned categories, who have not been granted higher pay scale, shall be entitled to one additional increment on the existing pay with effect from 1-4-2003 instead of 1-10-2012 under the said notification .".

3. Substitution of SCHEDULE.—For the existing SCHEDULE appended to the principal Act, the following SCHEDULE shall be substituted, namely :—
