2016 का विधेयक संख्यांक 8 शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) संशोधन विधेयक, 2016

(विधान सभा में पुरःस्थापित रूप में)

शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) अधिनियम, 2007 (2008 का अधिनियम संख्यांक 2) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के सड़सठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.-- इस अधिनियम का संक्षिप्त नाम शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) संशोधन अधिनियम, 2016 है।

2. धारा 2 का संशोधन.--शिमला की सड़कों का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) अधिनियम, 2007 (जिसे इसमें इसके पश्चात्‌ 'मूल अधिनियम' कहा गया है) की धारा 2 की उपधारा (1) के खण्ड (ख ) में ''कोर (मध्य) माल रोड़ से'' शब्दों और चिन्ह के पश्चात्‌ ''राज्य सरकार द्वारा मेट्रोपोल के सामने अनुज्ञात पार्किंग स्थल के रूप में अधिसूचित क्षेत्र को अपवर्जित करके'' शब्द और चिन्ह अन्तःस्थापित किए जाएंगे।

3. धारा 3 का संशोधन.--मूल अधिनियम की धारा 3 की उपधारा (1) में,—

(क) खण्ड (iii) में, ''और हिमाचल प्रदेश राज्य विधान सभा के उपाध्यक्ष के साथ सम्बद्ध सरकारी (शासकीय) और सुरक्षा यान'' शब्दों और चिन्ह के स्थान पर '',हिमाचल प्रदेश राज्य विधान सभा के उपाध्यक्ष के साथ सम्बद्ध सरकारी (शासकीय) और सुरक्षा यान और हिमाचल प्रदेश विधान सभा के सदस्यों के यान'' चिन्ह और शब्द रखे जाएंगे। ;

(ख) खण्ड (iii) में, ''हिमाचल प्रदेश राज्य विधान सभा के सदस्यों,'' शब्दों और चिन्ह का लोप किया जाएगा। ; और

(ग) खण्ड (iii) में प्रथम परन्तुक के पश्चात्‌ निम्नलिखित परन्तुक अन्तः स्थापित किए जाएंंगे, अर्थात्‌ः-

''परन्तु यह और कि हिमाचल प्रदेश विधान सभा का वह सदस्य, जो मेट्रोपोल में रह रहा है और जिसे उसके यान को मेट्रोपोल तक चलाए जाने के लिए अनुज्ञात किया गया है, मेट्रोपोल के सामने अनुज्ञात पार्किंग स्थल में अपने यान को पार्क कर सकेगा :

परन्तु यह और कि हिमाचल प्रदेश विधान सभा के अध्यक्ष, हिमाचल प्रदेश उच्च न्यायालय के मुख्य न्यायाधीश, हिमाचल प्रदेश के पूर्व मुख्य मन्त्री, हिमाचल प्रदेश के मन्त्रियों, हिमाचल प्रदेश उच्च न्यायालय के न्यायाधीशों, हिमाचल प्रदेश विधान सभा के पूर्व अध्यक्ष और विधान सभा के सदस्यों को कोर (मध्य) माल रोड़ के भाग शिमला क्लब से इंदिरा गांधी राज्य खेल परिसर तक उनके यान का चलाया जाना अनुज्ञात किया जा सकेगा :''।

4. धारा 6 का संशोधन.--मूल अधिनियम की धारा 6 की उपधारा (1) के प्रथम परन्तुक में, '',विधान सभा के अध्यक्ष, उपाध्यक्ष या सदस्यों'' शब्दों और चिन्ह के पश्चात्‌ '' और हिमाचल प्रदेश विधान सभा के भूतपूर्व सदस्यों'' शब्द अन्तः स्थापित किए जाएंगे।

5. धारा 8 का संशोधन.--मूल अधिनियम की धारा 8 की उपधारा (5) में ''तीन हजार'' शब्दों के स्थान पर ''दस हजार'' शब्द रखे जाएंगे।

उद्‌देश्यों और कारणों का कथन

शिमला माल रोड़ की पहचान को वापस लौटाने के लिए, आम रास्ते के रूप में इसका उपयोग रोकने के आशय से तथा शिमला नगर की सील्ड और प्रतिबन्धित सड़कों पर लोक सुरक्षा और सुविधा के हित में यातायात का विनियमन करने के लिए शिमला की सड़कोेंं का उपयोग करने वालों तथा पैदल चलने वालों के लिए (लोक सुरक्षा और सुविधा) अधिनियम, 2007 अधिनियमित किया गया था। उपायुक्त, शिमला से मेट्रोपोल में रह रहे हिमाचल प्रदेश विधान सभा के सदस्यों के लिए मेट्रोपोल के सामने पार्किंग स्थल चिन्हित करने हेतु एक प्रस्ताव प्राप्त हुआ था। उपायुक्त, शिमला ने यह निवेदित किया है कि माननीय अध्यक्ष, विधान सभा ने विधान सभा के सदस्यों के साथ एक बैठक आयोजित की और उक्त बैठक में माननीय विधान सभा के सदस्यों ने इस बात की ओर ध्यान दिलाया कि मेट्रोपोल में रहते हुए, मेट्रोपोल के सामने कोई पार्किंग स्थल न होने के कारण, उन्हें अत्यन्त कठिनाई हो रही है और यह अनुरोध किया है कि उन्हें मेट्रोपोल के सामने उनके यानों (वाहनों) को पार्क करने की अनुज्ञा प्रदान की जाए। प्रस्ताव का परीक्षण किया गया और माननीय सदस्यों की मांग को उचित समझा गया। अतः पूर्वोक्त अधिनियम में ऐसा उपबन्ध करने का विनिश्चय किया गया जो उन्हें मेट्रोपोल के सामने अधिसूचित पार्किंग स्थल पर उनके यानों (वाहनों) को पार्क करने के लिए समर्थ बनाए। इसके अतिरिक्त, कुछ उच्च पदस्थों को उनके यान (वाहन) को इन्दिरा गांधी राज्य खेल परिसर तक चलाया जाना अनुज्ञात करना और विधान सभा के सदस्यों की बाबत सील्ड सड़कों के लिए अनुज्ञा-पत्र की सीलिंग को भी हटाने तथा भूतपूर्व विधान सभा के सदस्यों के मामले में अनुज्ञा-पत्र जारी करने हेतु सचिव हिमाचल प्रदेश विधान सभा को सशक्त करना भी न्यायसंगत और युक्तियुक्त समझा गया है। इसके अतिरिक्त, सील्ड सड़क या कोर (मध्य) माल रोड़ के भाग पर फिल्म की शूटिंग के लिए अनुज्ञात किए गए यानों (वाहनों) की दैनिक फीस की रकम को तीन हजार रुपए प्रतिदिन से बढ़ाकर दस हजार रुपए प्रतिदिन किया जाना भी आवश्यक समझा गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन किए जाने आवश्यक समझे गए हैं। यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है।

Bill No. 8 of 2016 THE SHIMLA ROAD USERS AND PEDESTRIANS (PUBLIC SAFETY AND CONVENIENCE) AMENDMENT BILL, 2016

(AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

further to amend the Shimla Road Users and Pedestrians (Public Safety and Convenience)

Act, 2007 (Act No. 2 of 2008).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Shimla Road Users and Pedestrians (Public Safety and Convenience) Amendment Act, 2016.

2. Amendment of section 2.—In section 2 of the Shimla Road Users and Pedestrians (Public Safety and Convenience) Act, 2007 (hereinafter referred to as the "principal Act"), in sub- section (1), in clause (b), after the words "and Ridge", the words "excluding area notified by the State Government as permitted parking place in front of the Metropole" shall be inserted.

3. Amendment of section 3.—In section 3 of the principal Act, in sub-section (1),- (a) in clause (ii), for the words "and Deputy Speaker of Himachal Pradesh State Legislative Assembly", the sign and words " , Deputy Speaker of Himachal Pradesh Legislative Assembly and vehicle of Members of Legislative Assembly of Himachal Pradesh" shall be substituted.;

(b) in clause (iii), the words and sign " Members of the Himachal Pradesh State Legislative Assembly," shall be omitted. ; and199 राजपत्र, हिमाचल प्रदेश, 12 अप्रैल, 2016/23 चैत्र, 1938 (c) in clause (iii), after the first proviso, the following provisos shall be inserted, namely:-

"Provided further that a Member of the Legislative Assembly of Himachal Pradesh who is residing in Metropole and permitted to ply his vehicle upto Metropole may park his vehicle in the permitted parking place in front of Metropole:

Provided further that the Speaker of the Himachal Pradesh Legislative Assembly, the Chief Justice of Himachal Pradesh High Court, former Chief Minister of Himachal Pradesh, Ministers of Himachal Pradesh, Judges of Himachal Pradesh High Court, former Speaker of Himachal Pradesh Legislative Assembly and Members of Legislative Assembly may be permitted to ply their vehicle on portion of Core Mall Road from Shimla Club to Indira Gandhi State Sports Complex:".

4. Amendment of section 6.—In section 6 of the principal Act, in sub-section (1), in the first proviso, after the words "Members of the Himachal Pradesh Legislative Assembly", the words, and sign "and Ex-Members of Legislative Assembly of Himachal Pradesh" shall be inserted.

5. Amendment of section 8.—In section 8 of the principal Act, in sub-section (5), for the figures "3000", the figures and sign "10,000" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

In order to restore the sanctity of Shimla Mall Road by preventing its use as a throughfare and to regulate traffic in the interest of public safety and convenience on sealed and restricted roads of Shimla Town, the Shimla Road Users and Pedestrians (Public Safety and Convenience) Act,2007 was enacted. A proposal was received from the Deputy Commissioner, Shimla to earmark parking place in front of Metropole for Members of the Legislative Assembly of Himachal Pradesh who are residing in Metropole. The Deputy Commissioner, Shimla has submitted that a meeting was convened by the Hon'ble Speaker, Legislative Assembly with the Members of Legislative Assembly and in the said meeting it was pointed out by the Hon'ble Members that there is great hardship to them being resident of Metropole as there is no parking place for them in front of the Metropole and have requested that they may be permitted to park their vehicles in front of the Metropole. The proposal has been examined and the demand of the Hon'ble Members is considered genuine. Thus, it has been decided to make a provision in the Act ibid which may enable them to park their vehicles in front of Metropole at the notified parking place. Further, it has also been considered just and reasonable to permit some dignitaries to ply their vehicles upto Indira Gandhi State Sports Complex and also to remove sealing of permit for sealed roads in respect of Members of Legislative Assembly and to empower the Secretary, Himachal Pradesh Vidhan Sabha to issue permits in case of Ex-MLA's. Further, it is also considered necessary to enhance the amount of daily fee of vehicles permitted for film shooting on portion of Sealed Road or Core Mall Road from 3000/- per day to Rs.10,000/- per day. This has necessitated amendments in the Act ibid. This Bill seeks to achieve the aforesaid objectives.

2016 का विधेयक संख्यांक 9 मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) संशोधन विधेयक, 2016

मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (2000 का अधिनियम संख्यांक 11) का और संशोधन करने के लिए विधेयक ।

भारत गणराज्य के सड़सठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.-इस अधिनियम का संक्षिप्त नाम मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) संशोधन अधिनियम, 2016 है।

2. धारा 3 का संशोधन.--मन्त्रियों के वेतन और भत्ता (हिमाचल प्रदेश) अधिनियम, 2000 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 3 की उपधारा (1) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थात्‌ः-201 राजपत्र, हिमाचल प्रदेश, 12 अप्रैल, 2016/23 चैत्र, 1938 ''(1) प्रत्येक मन्त्री निम्नलिखित दरों पर वेतन लेने का हकदार होगा, अर्थात्‌ः-

(क) मुख्य मन्त्री पचानवे हज़ार रूपए प्रतिमास;

(ख) केबिनेट मन्त्री अस्सी हज़ार रूपए प्रतिमास;

(ग) राज्य मन्त्री अटहत्तर हज़ार रूपए प्रतिमास; और

(घ) उप मन्त्री पचहत्तर हज़ार रूपए प्रतिमास।''।

3. धारा 4 का संशोधन.--मूल अधिनियम की धारा 4 में, ''तीस हज़ार'' शब्दों के स्थान पर ''पचानवे हज़ार'' शब्द रखे जाएंगे।

4. धारा 5 का संशोधन.--मूल अधिनियम की धारा 5 की उपधारा (3) में, ''दस प्रतिशत की दर से'' शब्दों के स्थान पर ''एक हज़ार पांच सौ रुपए'' शब्द रखे जाएंगे।

5. धारा 7 का संशोधन.--मूल अधिनियम की धारा 7 में,-

(क) उपधारा (1) में, ''दो लाख'' शब्दों के स्थान पर ''दो लाख पचास हज़ार'' शब्द रखे जाएंगे;

और

(ख) उपधारा (1) के प्रथम परन्तुक में, ''दो लाख'' शब्दों के स्थान पर ''दो लाख पचास हज़ार'' शब्द रखे जाएंगे; और

(ग) उपधारा (2) में, ''दस हज़ार'' शब्दों के स्थान पर ''पच्चीस हज़ार'' शब्द रखे जाएंगे।

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश विधान सभा की सदस्य सुख-सुविधा समिति ने सदस्यों के भत्तों और अन्य परिलब्धियों में बढ़ौतरी करने की सिफारिश की है, जिसे स्वीकार कर लिया गया है। अतः सदस्यों और मन्त्रियों के बीच एकरूपता बनाए रखने के लिए और मन्त्रियों के वेतन और भत्ते (हिमाचल प्रदेश) अधिनियम, 2000 के उपबन्धों को हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 के उपबंधों के अनुरूप लाने के लिए भी मुख्य मन्त्री, केबिनट मन्त्री, राज्य मन्त्री और उप-मन्त्री के वेतन को क्रमशः 65,000/- रुपए, 50,000/- रुपए, 48,000/- रुपए और 45,000/- रुपए से बढ़ाकर 95,000/- रुपए, 80,000/- रुपए, 78,000/-रुपए और 75,000/- रुपए प्रतिमास करने का विनिश्चय किया गया है। इसके अतिरिक्त सत्कार भत्ते को 30,000/- रुपए से बढ़ाकर 95,000/- रुपए प्रतिमास करने का भी विनिश्चय किया गया है और लाइसैन्स फीस की कटौती उसके वेतन के दस प्रतिशत की दर के बजाए एक हज़ार पांच सौ रूपए प्रतिमास की दर से करने का भी विनिश्चय किया गया है। इसके अतिरिक्त, मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए विद्यमान सीमा को 2,00,000/-रुपए से बढ़ाकर 2,50,000/- रुपए करने तथा यात्रा अग्रिम को 10,000/- रुपए से बढ़ाकर 25,000/- रुपए करने का विनिश्चय किया गया है। इसलिए पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है ।

further to amend the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000

(Act No. 11 of 2000).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty – seventh Year of the Republic of India as follow:—

1. Short title.—This Act may be called the Salaries and Allowances of Ministers (Himachal Pradesh) Amendment Act, 2016.

2. Amendment of section 3.—In section 3 of the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 (herein after referred to as the "principal Act"), for sub-section (1), the following sub-section shall be substituted, namely:—

(a) Chief Minister Ninety five thousand rupees

per mensem;

(b) Cabinet Minister Eighty thousand rupees per mensem;

(c) Minister of State Seventy eight thousand rupees per mensem; and

(d) Deputy Minister Seventy five thousand rupees per mensem.".

3. Amendment of section 4.—In section 4 of the principal Act, for the words "thirty thousand", the words "ninety five thousand" shall be substituted.

4. Amendment of section 5.—In section 5 of the principal Act, in sub-section (3), for the word, figures and signs "@ 10%", the words "one thousand five hundred" shall be substituted.

5. Amendment of section 7.—In section 7 of the principal Act,—

(a) in sub-section (1), for the words, "two lac rupees", the words "two lac fifty thousand rupees" shall be substituted.;

(b) in the first proviso to sub-section (1), for the words, "two lac rupees, the words, "two lac fifty thousand rupees" shall be substituted.; and

(c) in sub-section (2), for the words "ten thousand", the words "twenty five thousand" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

The Members Amenities Committee of the Himachal Pradesh Vidhan Sabha has recommended to enhance allowances and other perquisites to the Members which has been accepted. Thus, in order to maintain the parity amongst the Members and the Ministers and also to bring the provisions of the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000 in conformity with the provisions of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971, it has been decided to enhance salary of Chief Minister, Cabinet Minister, Minister of State and Deputy Minister from Rs. 65,000/-, 50,000/-, 48,000/- and 45,000/- to Rs, 95,000/-, 80,000/-, 78,000/- and 75,000/- respectively. It has also been decided to enhance sumptuary allowance from Rs. 30,000/- to Rs. 95,000/- per mensem and it has also been decided to deduct license fee @ Rs. 1500/- per mensem instead of @ 10% of his salary. Further, it has been decided to enhance existing limit for reimbursement of expenses incurred on account of free transit facility from Rs. 2,00,000/- to Rs. 2,50,000/- and travelling advance from Rs. 10,000/- to Rs. 25,000/-. This has necessitated amendment in the Act ibid.

हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन अधिनियम, 1971 (1971 का अधिनियम संख्यांक 4) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के सड़सठवें वर्ष में हिमाचल प्रदेश विधान सभा ़द्वारा निम्नलिखित रुप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष वेतन (संशोेधन) अधिनियम, 2016 है।

(क) उपधारा (1) में, ''पचास हजार'' शब्दों के स्थान पर ''अस्सी हजार'' शब्द रखे जाएंगे; और (ख) उपधारा (1-अअ) में; ''तीस हजार'' शब्दों के स्थान पर ''पचानवे हजार'' शब्द रखे जाएंगे। 3. धारा 4 का संशोधन.--मूल अधिनियम की धारा 4 में,-

(क) उपधारा (1) में, ''पैंतालीस हजार'' शब्दों के स्थान पर ''पचहत्तर हजार'' शब्द रखे जाएंगे;

और

(ख) उपधारा (1-अअ) में, ''तीस हजार'' शब्दों के स्थान पर ''पचानवे हजार'' शब्द रखे जाएंगे । 4. धारा 10-क का संशोधन.--मूल अधिनियम की धारा 10-क में,-

(क) उपधारा (1)में, ''दो लाख'' शब्दों के स्थान पर ''दो लाख पचास हजार'' शब्द रखें जाएंगे;

और

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश विधान सभा की सदस्य सुख-सुविधा समिति ने सदस्यों के वेतन और अन्य सुविधाओं में बढ़ौतरी करने की सिफारिश की है, जिसे स्वीकार कर लिया गया है तथा जिनको उन्हें प्रदान करने का विनिश्चय किया गया है । अतः सदस्यों, अध्यक्ष और उपाध्यक्ष के बीच एकरूपता बनाए रखने के लिए और हिमाचल प्रदेश विधान सभा अध्यक्ष और उपाध्यक्ष के वेतन अधिनियम, 1971 के उपबन्धों को हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेन्शन) अधिनियम, 1971 के उपबन्धों के अनुरूप लाने के लिए भी माननीय अध्यक्ष और उपाध्यक्ष के वेतन को क्रमशः 50,000/-रुपए से बढ़ाकर 80,000/-रुपए करने और 45,000/-रुपए से बढ़ाकर 75,000/-रूपए करने का विनिश्चय किया गया है। सत्कार भत्तें को क्रमशः 30,000/-रुपए से बढ़ाकर 95,000/-रुपए करने का भी विनिश्चय किया गया है। इसके अतिरिक्त मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए विद्यमान सीमा को 2,00,000/-रूपए से बढ़ाकर 2,50,000/-रूपए करने तथा यात्रा अग्रिम को 10,000/-रूपए से बढ़ाकर 25,000/-रूपए करने का भी विनिश्चय किया गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है ।

( AS INTRODUCED IN THE LEGISLATIVE ASSEMBLY)

further to amend the Himachal Pradesh Legislative Assembly Speaker's and Deputy

Speaker's Salaries Act, 1971 (Act No. 4 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty -seventh Year of the Republic of India as follow:—

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries (Amendment) Act, 2016.

2. Amendment of section 3.— In section 3 of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 (hereinafter referred to as the "principal Act"),-

(a) in sub-section (1), for the words "fifty thousand", the words "eighty thousand" shall be substituted.; and

(b) in sub-section (1-AA), for the words "thirty thousand", the words "ninety five thousand" shall be substituted.

3. Amendment of section 4.—In section 4 of the principal Act,—

(a) in sub-section (1), for the words "forty five thousand", the words "seventy five thousand" shall be substituted.; and

(b) in sub-section (1-AA), for the words "thirty thousand", the words "ninety five thousand" shall be substituted.

4. Amendment of section 10-A.— In section 10-A of the principal Act,-

(a) in sub-section (1), for the words "two lac rupees", the words "two lac fifty thousand rupees" shall be substituted; and

(b) in sub-section (2), for the words "ten thousand", the words "twenty five thousand" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

The Members Amenities Committee of the Himachal Pradesh Vidhan Sabha has recommended to enhance the Salaries and other facilities to the Members which has been accepted and has been decided to extend the same to them. Thus, in order to maintain the uniformity amongst the Members, Speaker and Deputy Speaker and also to bring the provisions of the Himachal Pradesh Legislative Assembly Speaker's and Deputy Speaker's Salaries Act, 1971 in conformity with the provisions of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971, it has been decided to enhance the salary in respect of the Hon'ble Speaker and Deputy Speaker from Rs. 50,000/- to Rs. 80,000/- and Rs. 45,000/- to Rs. 75,000/- respectively. It has also been decided to enhance Sumptuary Allowance from Rs. 30,000/- to Rs. 95,000/- respectively. It has further been decided to enhance existing limit for reimbursement of expenses incurred on account of free transit facility from Rs. 2,00,000/- to Rs. 2,50,000/- and travelling advance from Rs. 10,000/- to Rs. 25,000/-.

This Bill seeks to achieve the aforesaid objectives.

हिमाचल प्रदेश विधान सभा की सदस्य सुख-सुविधा समिति ने सदस्यों के वेतन और अन्य सुविधाओं में बढ़ौतरी करने की सिफारिश की है, जिसे स्वीकार कर लिया गया है। अतः सदस्यों और मन्त्रियों तथा मुख्य संसदीय सचिवों और संसदीय सचिवों के बीच एकरूपता बनाए रखने के लिए और हिमाचल प्रदेश संसदीय सचिव (नियुक्ति, वेतन, भत्ते, शक्तियां, विशेषाधिकार और सुखसुविधाएं) अधिनियम, 2006 (2007 का अधिनियम 210 राजपत्र, हिमाचल प्रदेश, 12 अप्रैल, 2016/23 चैत्र, 1938 संख्यांक 1) के उपबन्धों को हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 के उपबन्धों के अनुरूप लाने के लिए भी मुख्य संसदीय सचिव और संसदीय सचिव की बाबत वेतन को क्रमशः 40,000/- रुपए और 35,000/- रुपए से बढ़ाकर 65,000/- रुपए और 60,000/- रुपए प्रतिमास करने और लाईसेंस फीस की कटौती, उसके वेतन के दस प्रतिशत के बजाए एक हजार पांच सौ रुपए प्रतिमास की दर से करने का भी विनिश्चय किया गया है।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है ।

This Bill seeks to achieve the aforesaid objectives.

4. धारा 4-ख का संशोधन.--मूल अधिनियम की धारा 4-ख में,--

(क) ''साठ हजार'' शब्दों के स्थान पर ''नब्बे हजार'' शब्द रखे जाएंगे। ;

(ख) उपधारा (2) में, ''दस हजार'' शब्दों के स्थान पर ''तीस हजार'' शब्द रखे जाएंगे। ; और (ग) उपधारा (3) में, ''बारह हजार'' शब्दों के स्थान पर ''पंद्रह हजार'' शब्द रखे जाएंगें। 5. धारा 4-ङ का संशोधन.--मूल अधिनियम की धारा 4-ङ की उपधारा (2) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थात्‌ :--

''(2) प्रत्येक भूतपूर्व सदस्य, जिसने गृह निर्माण अग्रिम की सुविधा प्राप्त की है और ऐसे अग्रिम की सम्पूर्ण राशी का, उस पर ब्याज सहित प्रतिसंदाय कर दिया है, द्वितीय गृह निर्माण अग्रिम की सुविधा प्राप्त करने के लिए, प्रतिसंदेय अग्रिम स्वरूप ऐसी धनराशि, ऐसी शर्तों के अध्यधीन, जैसी इस निमित्त गृह निर्माण या बने बनाए गृह का क्रय करने के लिए या पुराने मकान की मरम्मत करने के लिए बनाए गए नियमों द्वारा अवधारित की जाए, प्राप्त करने का हकदार होगा ।''। 6. धारा 6 का संशोधन.--मूल अधिनियम की धारा 6 में,-

(क) उपधारा (1) और द्वितीय परन्तुक में, ''दो लाख'' शब्दों के स्थान पर ''दो लाख पच्चास हजार'' शब्द रखे जाएगें। ; और

(ख) उपधारा (1-क) मे,ं ''दस हजार'' शब्दों के स्थान पर ''पच्चीस हजार'' शब्द रखे जाएंगे । 7. धारा 6-क का संशोधन.--मूल अधिनियम की धारा 6-क में, ''एक लाख'' शब्दों के स्थान पर ''एक लाख पच्चीस हजार'' शब्द रखे जाएंगे।

8. धारा 6-ख का संशोधन.--मूल अधिनियम की धारा 6-ख में,--

(क) उपधारा (1) में ''बाईस'' शब्द के स्थान पर ''अटठाईस'' शब्द रखा जाएगा ; और

निर्वाह व्यय और उन यथेष्ट खर्चों, जो राज्य विधान सभा के माननीय सदस्यों को लोक प्रतिनिधि के रूप में सार्वजनिक जीवन की विभिन्न मांगों के कारण उपगत करने पड़ते हैं, में तीव्र वृद्वि के कारण उनकी विद्यमान उपलब्धियों और सुख-सुविधाओं में संशोधन की लगातार मांग रही है और विधान सभा की सुख-सुविधा समिति ने हिमाचल प्रदेश विधान सभा के सदस्यों के वेतन, भत्तों और अन्य परिलब्धियों में 214 राजपत्र, हिमाचल प्रदेश, 12 अप्रैल, 2016/23 चैत्र, 1938 बढ़ौतरी करने की भी सिफारिश की है। इसलिए, सदस्य सुख-सुविधा समिति की सिफारिशों को स्वीकार करने और सदस्यों के वेतन को 30,000/- रूप्ए से बढ़ाकर 55,000/- रूपए प्रतिमास करने, दैनिक भत्ते को 1500/- रूपए से बढ़ाकर 1800/- रूपए प्रतिदिन करने, निर्वाचन क्षेत्र भत्ते को 60,000/- रूपए से बढ़ाकर 90,000/- रूपए करने, कार्यालय भत्ते को 10,000/- रूपए से बढ़ाकर 30,000/- रूपए प्रतिमास करने, कम्पयूटर/डाटा एन्ट्री ऑपरेटर भत्ते को 12,000/- रूपए से बढ़ाकर 15,000/- रूपए प्रतिमास करने का विनिश्चय किया गया है। इसके अतिरिक्त, मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए विद्यमान सीमा को 2,00,000/- रुपए से बढ़ाकर 2,50,000/- रूपए और यात्रा अग्रिम को 10,000/- रूपए से बढ़ाकर 25,000/- रुपए करने का भी विनिश्चय किया गया है। भूतपूर्व-सदस्यों की दशा में, मुफ्त यात्रा (फ्री ट्रांजिट) सुविधा के कारण उपगत व्ययों की प्रतिपूर्ति के लिए सीमा अब 1,00,000/- रुपए के बजाए 1,25,000/-रूपए होगी। इसके अतिरिक्त भूतपूर्व-सदस्यों की पेंशन को 22,000/- रुपए प्रतिमास से बढ़ाकर 28,000/- रुपए प्रतिमास करने और प्रथम कार्यकाल की अवधि के अतिरिक्त प्रत्येक वर्ष के लिए अतिरिक्त पेंशन को 500/-रूपए से बढ़ाकर 1000/- प्रतिमास करने का भी विनिश्चय किया गया है। इसलिए हिमाचल प्रदेश विधान सभा (सदस्यो के भत्ते और पेंशन) अधिनियम, 1971 में संशोधन किए जाने आवश्यक हो गए हैं ।

further to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of

Members) Act, 1971 (Act No. 8 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year of the Republic of India as follow:-

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Amendment Bill, 2016.

2. Amendment of section 3.—In section 3 of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 (hereinafter referred to as the "principal Act"), in sub-section (1), for the words "thirty thousand'', the words "fifty five thousand" shall be substituted.

3. Amendment of section 4.—In section 4 of the principal Act, in sub-section (1), in clause (ii), for the words "one thousand five hundred", the words "one thousand eight hundred" shall be substituted.

4. Amendment of section 4-B.—In section 4-B of the principal Act,—

(a) in sub-section (1), for the words "sixty thousand", the words "ninety thousand" shall be substituted. ;

(b) in sub-section (2), for the words "ten thousand", the words "thirty thousand" shall be substituted. ; and

(c) in sub-section (3), for the words "twelve thousand", the words "fifteen thousand" shall be substituted.

5. Amendment of section 4-E.—In section 4-E of the principal Act, for sub-section (2), the following sub-section shall be substituted, namely:—

"(2) Each ex-member who has availed the facility of house building advance and has repaid whole amount of such advance with interest thereon, shall be entitled to avail facility of second house building advance by way of repayable advance, such sum of money, subject to such conditions, as may be determined by rules made in this behalf, for construction of house or for the purchase of built-up house or for renovation of old house.".

(a) in sub-section (1) and second proviso, for the words "two lac", the words "two lac fifty thousand" shall be substituted. ; and

(b) in sub-section (1-A), for the words "ten thousand", the words "twenty five thousand" shall be substituted.

7. Amendment of section 6-A.—In section 6-A of the principal Act, for the words "one lac rupees", the words "one lac twenty five thousand rupees" shall be subsituted.

8. Amendment of section 6-B.—In section 6-B of the principal Act,-

(a) in sub-section (1), for the figures and sign "22,000", the figures and sign "28,000" shall be substituted.; and

(b) in the first proviso to sub-section (1), for the figures "500", the figures "1000" shall be substituted.

STATEMENT OF OBJECTS AND REASONS

Due to sharp increase in the cost of living and the considerable expenses which the Hon'ble Members of the State Legislative Assembly as a public representative has to incur on account of various demands of the public life, there has been persistent demand for the revision of their existing emoluments and amenities and Vidhan Sabha Members Amenities Committee have also recommended to enhance the salary, allowances and other perquisites of the Members of the H.P. Legislative Assembly. As such, it has been decided to accept the recommendations of the Members Amenities Committee and to enhance the salary of Members from Rs. 30,000/- to Rs. 55,000/- per mensem, Daily Allowance from Rs. 1500/- to Rs. 1800/- per day, Constituency Allowance From Rs. 60,000/- to Rs. 90,000/-, Office Allowance from Rs. 10,000/- to Rs. 30,000/- per mensem, Computer/Data Entry Operator Allowance from Rs. 12,000/- to Rs. 15,000/- per mensem. It has also been decided to enhance existing limit for reimbursement of expenses incurred on account of free transit facility from Rs. 2,00,000/- to Rs. 2,50,000/- and Travelling Advance from Rs. 10,000/- to Rs. 25,000/-. In case of ex-members, now the limit for reimbursement of expenses incurred on account of free transit facility shall be Rs. 1,25,000/- instead of Rs. 1,00,000/- . It has further been decided to enhance the Pension to ex-member from Rs. 22,000/- to Rs. 28,000/- per mensem and additional pension from Rs. 500/- to Rs. 1000/- per mensem for every year in excess of the period of first term. This has necessitated the amendments in the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971.

This Bill seeks to achieve the aforesaid objectives.

Sudha Devi, IAS, District Magistrate Chamba do herby order regulation of vehicular traffic within Bharmour Sub-Division for the convenience and safety of the general public. These February, 2016 and shall remain in force till 31st March, regulations shall come in to effect form 1st 2017. The regulation for various places in Sub Division Bharmour shall be

1. Bharmour

(a) No traffic shall be allowed in the Chaurasi Bazar fron 8.00A.M. to 10.00A.M. and from 4.30 P.M. to 6.30P. M. except for Ambulance and motor vehicles needed for performing emergency duty.

(b) Only Ten Taxis shall be allowed to park at Old Bus Stand Bharmour at a place identified by the ADM Bharmour that shall be marked with yellow lines.

(c) Private vehicle shall be allowed to park on one side of the new parking marked with yellow line whereas other side of the parking shall be allowed for the remaining taxis and goods carriers etc.

(d) Only three vehicles each shall be allowed to park near Shamshan Ghat and there such motor vehicles shall be parked near Tyres Shop.

(e) Only five light vehicles shall be allowed to park near Shiv Kumar hardware shop.

(f) Loading and unloading points for Chaurasi Bazar shall be near Bharmani turn new parking and loading and unloading of good shall be allowed at Bus stand Bharmour that shall be identified by ADM Bharmour and shall be marked with yellow lines.

2. Holi Bus Stand:-

(a) Only 10 Taxis shall be allowed to park in Holi Bus Stand at a suitable place that shall be identified by ADM Bharmour and shall be marked with yellow lines.

(b) No Goods carrier vehicle shall be allowed to park at Holi Bus Stand. These motor vehicles shall be parked on the stretch of road from Holi Bus Stand to Shiv Nagari and219 राजपत्र, हिमाचल प्रदेश, 12 अप्रैल, 2016/23 चैत्र, 1938 near Civil Supply Depot that shall be identified by ADM Bharmour and shall be marked with yellow lines.

(c) Loading and unloading of goods shall be prohibited in the Bus Stand Holi and shall be allowed at nearby place that shall be identified by ADM Bharmour and shall be marked with yellow lines.

3. Kharamukh:-

(a) No. taxis or private vehicles shall be allowed to park on the left side of Kharamukh Bazar on the way from Bharmour to Chamba.

(b) Taxis and other vehicles shall be parked 50 meters away from Kharamukh Bazar.

(c) No goods carrier shall be allowed to park in Kahramukh Bazar except for loading and unloading at place designated for this purpose that shall be identified by ADM Bharmour shall be marked with yellow lines.

4. Loona Bazar:- (a) Buses travelling to Chhatrari and Chamba from Loona shall not park on link road Chhatrari but these buses shall be pared at a distance of 50 meters from Loona on the Loona Bharmour road.

4. Chowari Bazar

These regulations shall February, 2016 and shall remain force till 31st March, 2017. The come into effect from 1st regulations will be as under:—

1. There will be one way traffic for light motor vehicles entering from Khairi Pul and exit near Nathi Sweet Shop via D.A.V College Road.

2. Traffic permitting heavy vehicles/Buses can be allowed between Khairi Pul to Nathi Sweet Shop from 8.00 PM to 8.00 AM in summer season and 7.00 PM to 8.00 AM in winter season.

3. Parking of vehicles will be totally prohibited on D.A.V College road to Nathi Sweet Shop.

4. There will be no parking zone near Nathi Sweet Shop, near S.S. Printers shop, Sharma Hard Wares Shop, Near Hotel Sun Beam, and Near Bus Stand Banikhet on main road from Police Post Banikhet to Bus Stand Banikhet.

5. No vehicle shall be allowed to cross the speed limit of 20 km per hour while plying in Banikhet Bazar area. However, this order will not apply on Ambulance, Fire Brigade Vehicles, Vehicles of Magistrates, Police Officers on Law and Order duty and Flagged Vehicles.

6. No dumping of construction and others material will be allowed on road. Construction and other material can only be loaded and unloaded in Banikhet Bazar from 8.00 PM to 8.00 AM in summer season and 7.00 PM to 8.00 AM in winter season only at places marked with yellow lines.

7. The propose regulations/restrictions shall come into effect from 01st January, 2016 and shall remain in force till 31st January, 2016.
