संख्याः जीएडी-बी-(ए) 1-11/2013-1 (मण्डी).--हिमाचल प्रदेश के राज्यपाल की यह राय है कि वर्तमान उप-तहसील बालीचौकी, जिला मण्डी, हिमाचल प्रदेश का दर्जा बढ़ाकर तहसील का कर दिया जाए जिसका मुख्यालय बालीचौकी, जिला मण्डी, हिमाचल प्रदेश में होगा ताकि नजदीक के गांवों के सम्बद्ध लोगों को बेहतर सेवाएं उपलब्ध करवाई जा सकें और राजस्व से सम्बन्धित कार्य में उनको होने वाली असुविधा से निवारित किया जा सके तथा बेहतर प्रशासनिक नियन्त्रण हो सके ।

संख्याः एएचवाई-एफ (5)-5/99-पार्ट-IV-Loose.--हिमाचल प्रदेश के राज्यपाल, पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियन्त्रण अधिनियम, 2009 (2009 का 27) की धारा 43339 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2016/3 वैशाख 1938 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार के पूर्वानुमोदन से उक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः--

1. संक्षिप्त नाम व प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियन्त्रण (पड़ताल चौकी और करंतीन कैम्प, निरीक्षण की रीति) नियम, 2016 है।

(2) ये नियम, राजपत्र, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होगें।

2. परिभाषाएं--(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-- (क) 'अधिनियम' से पशुओं में संक्रामक और संसर्गजन्य रोगों से बचाव और नियन्त्रण अधिनियम, 2009 (2009 का 27) अभिप्रेत है;

(ख) 'प्ररूप' से इन नियमों से संलग्न प्ररूप अभिप्रेत है; और

(ग) 'धारा' से अधिनियम की कोई धारा अभिप्रेत है।

(2) उन शब्दों और पदों के, जो इन नियमों में परिभाषित नहीं किए गए हैं, वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं।

निरीक्षण की रीति और पड़ताल चौकी या करंतीन कैम्प में निरोध की अवधि-3.(1) यह सुनिश्चित करने के आशय से कि क्या पशु किसी अधिसूचित रोग से संक्रमित है तो पड़ताल चौकी पर रोके गए या करंतीन कैम्प में निरोध किए पशु को पड़ताल चौकी या करंतीन कैम्प के प्रभारी व्यक्ति द्वारा निम्नलिखित प्रयोजनों के लिए निरींक्षण किया जाएगाः-

(क) गतिविधि और चाल;

(ख) सुस्त, अवसादक, सामान्य या उत्तेजक व्यवहार;

(ग) शरीर के तापमान में वृद्वि;

(घ) मुॅंह, पैर (खुर) या थन में फोड़ा;

(ङ) अत्याधिक विदारण, नाक या योनि स्त्राव;

(च) त्वचा का रूखापन, खारिश, चरम रोग;

(छ) कमजोरी;

(ज) प्राकृतिक द्वारो से खून निकलना; और

(झ) गलकम्बल भाग में या शरीर के किसी अन्य भाग में शोफ या सूजन।

(2) पड़ताल चौकी या करंतीन कैम्प का प्रभारी व्यक्ति प्रयोगशाला निरीक्षण, यदि अपेक्षित हो, के लिए आवश्यक नमूने एकत्रित करेगा।

(3) पड़ताल चौकी का प्रभारी व्यक्ति पशुओं को पड़ताल चौकी पर निरीक्षण, अनिवार्य टीकाकरण और पहचान चिन्ह आदि के प्रयोजन के लिए बारह घण्टे से अनाधिक की अवधि के लिए रोक सकेगा। 340 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2016/3 वैशाख, 1938 पड़ताल चौकी पर टीकाकृत पशु के स्वामी को अधिनियम की धारा 9 के अधीन यथा अपेक्षित टीकाकरण प्रमाण-पत्र दिया जाएगा।

(4) पशुओं के परीक्षण के पश्चात प्रभारी अधिकारी प्ररूप क में अनुज्ञा पत्र को जारी करके या तो पशु का नियन्त्रित क्षेत्र या मुक्त क्षेत्र में प्रवेश अनुज्ञात करेगा या पशु को करंतीन कैम्प में भेजेगा। करंतीन कैम्प के प्रभारी अधिकारी द्वारा अनुज्ञा पत्र जारी करना-4 (1) करंतीन कैम्प का प्रभारी अधिकारी निम्न पशुओं का निरोध करेगा,--

(क) जो किसी अधिसूचित रोग से ग्रसित है, या

(ख) जो अधिसूचित रोग से संक्रमित पशुओं के सम्पर्क में आने वाले या उनके सामीप्य में रखे गए है; या

(ग) जो नियम 3 के उप-नियम (4) के अनुसार पड़ताल चौकी के प्रभारी द्वारा भेजे गए हैं; या (घ) यदि संक्रमित क्षेत्र से बाहर ले जाए जा रहें हैं

वे करंतीन कैम्प में चौदह दिन के करंतीन के अध्यधीन रहेंगे।

(2) करंतीन कैम्प का प्रभारी अधिकारी करंतीन कैम्प में निरोध किए गए पशुओं के स्वामी को प्ररूप ख मेें एक मासकीय अभिस्वीकृति देगा।

(3) करंतीन के दौरान पशुओं को विशिष्ट संख्या वाले कान के टैग पशुओं भैंस, भेड़, बकरी और सूअर तथा चिन्ह (गधे घोड़ो के लिए) या किसी अन्य उपयुक्त विधि द्वारा पहचान की जाएगी। पशुओं का किसी अधिसूचित रोग लिए नियमित रूप से परीक्षण कियाा जाएगा और टीकाकरण किया जाएगा तथा यदि अपेक्षित हो तो पशु चिकित्सीय उपचार की व्यवस्था की जाएगी। यदि पशुओं का टीकाकरण किया गया है तो ऐसे पशुओं के स्वामी को अधिनियम की धारा 9 के अधीन यथा अपेक्षित टीकाकरण प्रमाण-पत्र प्रदान किया जाएगा।

(4) सफल करंतीन के पश्चात करंतीन कैम्प का प्रभारी अधिकारी पशुओं को पशुओं के स्वामी को सौंप देगा और प्ररूप-ग के अनुसार अपने हस्ताक्षर सहित करंतीन निर्मुक्ति का अनुज्ञा-पत्र भी प्रदान करेगा। प्ररूप-ग अधिनियम की धारा 15 की उपधारा (2) के अधीन यथा अपेक्षित प्रवेश के अनुज्ञा-पत्र की भी पूर्ति करेगा।

No. Ahy-F(5)-5/99-Part-IV-L.—In exercise of the powers conferred by section 43 of the Prevention and Control of Infectious and Contagious Disease in Animals Act, 2009 ( No. 27 of 2009), the Governor of Himachal Pradesh, with the prior approval of Central Government, hereby makes the following Rules, for carryingout the purposes of the said Act, namely:—

1. Short Title and commencement.—(1) These rules may be called the Himachal Pradesh Prevention and Control of Infectious and Contagious Diseases in Animals (Check Post and Quarantine Camp, Manner of Inspection ) Rules, 2016.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions.— (1) In these rules unless the context otherwise requires,—

(a) 'Act' means the Prevention and Control of Infectious and Contagious Diseases in Animals Act, 2009 (No. 27 of 2009);

(b) 'form' means a form appended to these rules; and

(c) 'section' means a section of the Act.

(2) Words and expressions used but not defined in these rules shall have the meaning respectively as assigned to them in the Act.

3. The manner of inspection and the period of detention at a Check Post or at Quarantine Camp.—(1) In order to ascertain whether the animal is infected with any of the scheduled disease, the animal stopped at the check post or detained in the quarantine camp shall be inspected by the person-in-charge of check post or quarantine camp for the following purposes:—

(a) movement and gait;

(b) dull, depressed, normal or excited behaviour;

(c) increase in body temperature;

(d) ulcer in the mouth, feet or udder;

(e) excessive lacrimation, nasal or vaginal discharge;

(f) sweating and shivering;

(g) dryness of the skin, alopecia, skin rashes;

(h) weakness;

(i) bleeding through natural openings; and

(j) oedema or swelling in dewlap region or any other part of the body.

(2) The person-in-charge of check post or quarantine camp shall collect necessary samples for laboratory examination, if required.

(3) The person-in-charge of check post may detain animals, at the check post for a period not exceeding 12 hours for the purpose of inspection, compulsory vaccination and identification /marking etc. the owner of animals vaccinated at the check post, shall be given a vaccination certificate as required under section 9 of the Act.

(4) After examination of the animal, the officer-in-charge shall, either allow entry of the animal to the controlled Area or Free Area by issuing an Entry Permit in form A, or transport the animals to the Quarantine Camp.

4. Issue of permit by the Officer-in-charge Quarantine Camp.—(1) The officer- in- charge of the quarantine camp shall detain the animals,—

(a) suffering from any scheduled disease; or

(b) come into contact with or have been kept in the proximity of animal infected with scheduled disease; or

(c) transported by the In-charge of the check post as per sub-rule (4) of rule 3; or (d) if taking out from the infected area.

shall be subjected to a quarantine of 14 days in a Quarantine Camp.

(2) The officer-in-charge of quarantine camp shall give an official acknowledgement in form- B to the owner of the animals detained in the Quarantine Camp.

(3) During quarantine, the animals shall be ear-tagged bearing a unique number (for cattle, buffalo, sheep, goat and pigs) and branding (for donkey, horses) or identified by any other suitable method. Animals shall be examined and vaccinated regularly for any scheduled disease and shall be provided with veterinary treatment, if required. If animals are vaccinated, the owner of such animals shall be provided with a vaccination certificate as required under section 9 of the Act.

(4) After successful quarantine, the officer-in-charge of quarantine camp shall release the animals to the animal owner and also grant the Quarantine Release Permit as per form- C, under his signature. Form C shall also serve as Entry Permit as required under sub-section (2) of section 15 of the Act.
