संख्याः टी0सी0पी0-ए(2)-2/2016.-हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977, (1977 का अधिनियम संख्यांक 12) की धारा 77 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आदेश द्वारा, निदेश देते है कि हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977, (1977 का अधिनियम संख्यांक 12) की धारा 30, 30-क, 31, 34, 38, 39, 39-क, 39-ख, 39-ग, 81 और 83-क के अधीन निदेशक नगर एवं ग्राम योजना की शक्तियां इस आदेश के राजपत्र में प्रकाशन की तारीख से क्रमशः नगर परिषद्‌ ठियोग, रोहडू, घुमारवीं, सुन्दरनगर, बद्‌दी और कुल्लू के अन्तर्गत 51-राजपत्र/2016-15-06-2016 (1393) 1394 राजपत्र, हिमाचल प्रदेश, 15 जून, 2016/25 ज्येष्ठ, 1938 आने वाले क्षेत्रों की बाबत कार्यकारी अधिकारियों द्वारा और क्रमशः नगर पंचायत नारकण्डा, चौपाल, मेहतपुर, गगरेट, नादौन, सुजानपुर, भोटा, जोगिन्द्रनगर, तलाई, भुन्तर, बैजनाथ-पपरोला और नेरचौक के अन्तर्गत आने वाले क्षेत्रों की बाबत सचिव द्वारा प्रयोग की जाएंगी। उपरोक्त शक्तियों का प्रयोग निम्नलिखित शर्तो के अध्यधीन होगाः-

1. यह कि विकास अनुज्ञा हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977, (1977 का अधिनियम संख्यांक 12), हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014, और उपरोक्त निर्दिष्ट क्षेत्रों की विकास योजनाओं (यदि कोई हो) में अन्तर्विष्ट विनियमों के साथ-साथ समय-समय पर राज्य सरकार और हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग द्वारा जारी अनुदेशों और मार्गदर्शक सिद्वान्तों के उपबन्धों के अनुसार है। जहां कहीं आवश्यक हो उपरोक्त निर्दिष्ट नगरपालिका परिषदें और नगर पंचायतें अपनी आवास उप-विधियों को उपरोक्त निर्दिष्ट क्षेत्रों की विकास योजनाओं (यदि कोई हो) के उपबन्धों और नगर और ग्राम योजना विभाग, हिमाचल प्रदेश द्वारा विरचित हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 के अनुरूप उन्हें लाने के लिए संशोधन करेंगी ।

2. यह कि उपरोक्त निर्दिष्ट नगरपालिका परिषदें ओर नगर पंचायतें उपरोक्त प्रत्यायोजित शक्तियों की बाबत अतिरिक्त मुख्य सचिव/सचिव (नगर एवं ग्राम योजना) हिमाचल प्रदेश सरकार के सम्पूर्ण नियन्त्रणाधीन कार्य करेंगी ।

TOWN AND COUNTRY PLANNING DEPARTMENT

ORDER

Shimla-2, the 8th May, 2016

No: TCP-A(2)-2/2016.— In exercise of the powers conferred by sub section (1) of Section 77 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No.12of 1977), the Governor, Himachal Pradesh, by order, direct that the powers of the Director, Town and Country Planning under sections 30, 30-A, 31, 34, 38, 39, 39-A, 39-B, 39-C, 81 and 83-A of the Himachal Pradesh Town and Country Planning Act, 1977, (Act No. 12 of 1977) shall be exercised by the Executive Officers in respect of the areas falling under Municipal Council, Theog, Rohru, Ghumarwin, Sundernagar, Baddi and Kullu respectively and by the Secretary in respect of the areas falling under Nagar Panchayat Narkanda, Chopal, Mehatpur, Gagret, Nadaun, Sujanpur, Bhota, Jogindernagar, Talai, Bhunter, Baijnath-Paprola and Ner-Chowk respectively, from the dae of publication of this order in the Official Gazette.The exercise of the powers shall be subject to the following conditions:—

1. That the development permission is in accordance with the provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), Himachal Pradesh Town and Country Planning Rules, 2014, regulations contained in the1395 राजपत्र, हिमाचल प्रदेश, 15 जून, 2016/25 ज्येष्ठ 1938 Development Plans (if any) of the above referred areas as well as instructions and guidelines issued by the State Government and the Town and Country Planning Department Himachal Pradesh from time to time. Wherever necessary the above referred Municipal Councils and the Nagar Panchayats shall amend its Housing Bye- Laws to bring them in consonance with the provisions of Development Plan (if any) of the above referred areas and Himachal Pradesh Town and Country planning Rules, 2014 framed by the Town and Country Planning Department, Himachal Pradesh.

2. That the above referred Municipal Councils and Nagar Panchayats shall function under the overall control of the Additional Chief Secretary/Secretary (TCP) to the Government of Himachal Pradesh in respect of the powers delegated above.

No. EDN-(A)-Kha-(3)-3/98-II.—In exercise of the power conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the "Himachal Pradesh, Higher Education Department Post Graduate Teacher, class-III (Non-Gazetted) Recruitment and Promotion Rules,2010 notified vide this Department notification of even number dated 20th Sept,2010 namely:—"

1. Short titled and Commencement.—(1) These rules may be called the Himachal Pradesh Higher Education Department, Post Graduate Teacher, Class-III (Non Gazetted), Recruitment and Promotion (Ist Amendment) Rules, 2011.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-A.—In Annexure-A to the Himachal Pradesh Higher Education Department Post Graduate Teacher, class-III (Non Gazetted) Recruitment and Promotion Rules, 2010:—

(a) For the existing provisions against Col.No. 7 the following shall be substituted namely,:—

Essential Qualification(s):

Academic Qualification.—1. Master's Degree in the subject concerned from a recognized University (with minimum of 50% marks in aggregate) or its equivalent in the following subjects:—

(a) Post Graduate Teacher (English): English (b) Post Graduate Teacher (Hindi) : Hindi (c) Post Graduate Teacher (Sanskrit): (Sanskrit) (d) Post Graduate Teacher (Mathematics): (Mathematics/Applied Mathematics.

(e) Post Graduate Teacher (Physics): Physics/Electronics/Nuclear Physics: (f) Post Graduate Teacher (Chemistry):-chemistry/Biochemistry. (g) Post Graduate Teacher (Biology):- Biology/Zoology, life Microbiology/Bio- Technology/Molecular Biology/Plant Physiology/provided they have studied Botany and Zoology at Graduation level.

(h) Post Graduate Teacher (Home Science): Home Science (i) Post Graduate Teacher (Sociology): Sociology . (j) Post Graduate Teacher (Music) Music/instrumental/Vocal. (instrumental /Vocal. (k) Post Graduate Teacher (History): History) (l) Post Graduate Teacher (Geography) Geography). (m) Post Graduate Teacher (Commerce ) : Commerce with Accountancy/Financial Accountancy and income tax as major subjects of study. Holder of Degree of MFC( Master of finance Control ) is also eligible for the post of Post Graduate Teacher in Commerce subject from a recognized University.

(n) Post Graduate Teacher (Economics): Economics/Applied Economics /Business Economics .

(o) Post Graduate Teacher (Political Science) Political Science. (p) Post Graduate Teacher (Informatics Practices): Informatics Practices- B.E or B. Tech. in Computer Science/Information Technology or equivalent degree from a recognised University/ Institute .

OR

B.E or B. Tech (any stream ) from a recognised University/ Institute and Post Graduate Diploma in Computer Science/Technology/Applications or equivalent from a recognised University/Institute.

OR

M.Sc (Computer Science) MCA or equivalent from a recognised University/ Institute.

OR

Post Graduate Degree in Mathematics/Physics from a recognised University with Post Graduate Diploma in Computer Science/Applications from a recognized/ University/Institute.

OR

"B" or ""C" level course from DOEACC. Society-Ministry of information and communication Technology.

(i) Post Graduate Teacher (Public Administration ): Public Administration.

(ii) Post Graduate Teacher (Psychology); psychology.

(iii) Proficiency in teaching Hindi and English.

(i) Bachelor Education (B.Ed) as professional qualification from recognized University/Institutions with minimum 50% marks .

OR

Two years integrated M.Sc Ed course or an equivalent course from a recognized University.

(ii) Post Graduate Teacher (informatics Practices) are exempted from B.Ed Provided that for M.Com Candidates, B.Ed qualification will not be essential till the expiry of period of three years from the date H.P. University allows B.Com/M.com. Candidates to undertake B.Ed Degree/Course.

NOTE.—(i) In case of Post Graduate Teacher in Biology subject the candidate must have qualified Post Graduate Degree of M.Sc in Botany/Zoology/Life Science /Micro Biology/Bio- Technology/Molecular Bio Plant Physiology provided they have studied Botany and Zoology at graduation level.

(ii) In case of Post Graduate Teacher in Commerce, the candidate must have passed M.com from a recognized University.

(iii) The candidates having Master Degree in Public Administration are eligible for the post of Post Graduate Teacher in Political Science subject.

(iv) In case of Science subjects i.e Physics, Chemistry and Biology; candidates must have obtained the degree of M.Sc as regular candidates. However, the candidates who have obtained the degree of M.Sc or admitted in M.Sc. through distance education Mode prior to 6-4- 2010 for the subjects are eligible.

(p) Desirable Qualification(s).—Knowledge of Customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

(b) For the existing provisions against Col. No. 10 the following shall be substituted namely:—

(i) 50% by promotion.

Provided that in case of promotion of PGT (Informatics Practices), if suitable candidates are not available ,then the said posts shall be filled up 100% by direct recruitment on a regular basis or by recruitment on contract basis as the case may be. The contract employees will get emoluments as given in Column 15-A and will be governed by service conditions as specified in the said column. 50% by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be. No. TPT-F (l )-2/2001-III.—An Agreement between the States of Himachal Pradesh and Uttarakhand is proposed to be entered with respect to operations of Stage Carriage vehicles (buses) by the operators of one state into the territory of the other state as required under Sub Section (5) of Section 88 of the Motor Vehicles Act, 1988.

Now, therefore, in fulfillment of the requirements of the sub-section 5 of Section 85 o1 the Motor Vehicle Act, 1988, a notice as in Annexure-A herewith is published for the information of the persons likely to be affected thereby.

Notice is hereby given to the persons likely to be affected by the said reciprocal agreement between the States of Himachal Pradesh and Uttarakhand that objections/ suggestions in this regard, if any, be sent to the Additional Chief Secretary (Transport) to the Government of Himachal Pradesh, Shimla-171002 within 30 days from the date of publication of this notice in the official Gazette of Himachal Pradesh. Objections received after the prescribed tome shall not be entertained.

ANNEXURE-A 1. That there shall be no Stage Carriage operations by the private operators of either state in or through the territory of the other State.

2. The operations by the State Transport Undertaking (s), by whatever name these may be known, of one state in the territory of the other state shall be as follows:—

a. Operations of Himachal Road Transport Corporation in Uttrakhand

b. Operation of Uttrakhand Transport Corporation in Himachal Pradesh:

3. In addition to the above routes, if a State Transport Undertaking propose to start operation on any other route in the territory of the other State, it shall through the Transport Authorities of its State make an application to the State Transport Authority of the other State who will countersign the requisite permit for such route without any need for amending or reentering this agreement and on such countersignature being granted, this Agreement shall be deemed to have been modified to that extent.
