NO. GAD-A(B)8-4/2001-III.—In continuation to this Department's Notification of even number dated 28th May, 2016 (declaring 17th June, 2016 & 19th June, 2016 as public holiday in District Lahaul-Spiti & Chamba, Himachal Pradesh on account of general election of Panchayati Raj Institutions (in the areas of those PRIs, where the elections are scheduled to be held) on the 53-राजपत्र/2016-17-06-2016 (1459) 1460 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ, 1938 respective dates (in case poll is held), the Governor, Himachal Pradesh is also pleased to declare 17th June, 2016 as public holiday on account of election of casual vacancies of Panchayati Raj Institutions located in different Districts of the State where office bearers could not be elected for some reasons during the general election for PRIs held in January, 2016 (in the areas of those PRIs, where the elections are scheduled to be held), in case poll is held. All Government Offices, Boards, Corporations, Educational Institutions and Industrial Establishments situated in the above areas where elections are scheduled under Industrial Disputes Act and shops will remain closed on the said date in such areas. This will also be a paid holiday to daily wages employees and also within the meaning of Section 25 of Negotiable Instrument Act 1881.

It is, however, clarified that special casual leave may be given to those employees who are working in different places in the State but have a right to vote in respective Panchayati Raj Institutions, on the production of certificate from the concerned Presiding Officer that the employee has actually cast his/ her vote.

संख्याः शिक्षा-II-ख-(3)-3/98- II.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की समंसख्यक अधिसूचनाः तारीख 20-9-2010 द्वारा अधिसूचित हिमाचल प्रदेश उच्चतर शिक्षा विभाग, स्तानकोत्तर अध्यापक, वर्ग-।।। (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2010 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उच्चतर शिक्षा विभाग, स्नातकोत्तर अध्यापक, वर्ग -III (अराजपत्रित) भर्ती और प्रोन्नति, (प्रथम संशोधन) नियम, 2011 है । 2. ये नियम राजपत्र, हिमाचल प्रदेश मेंं प्रकाशित किये जाने की तारीख से प्रवृत होंगें । 2. उपाबन्ध-क का संशोधन.-- हिमाचल प्रदेश उच्चतर शिक्षा विभाग, स्तानकोत्तर अध्यापक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम,2010 के उपाबन्ध, 'क' मे -

(क) स्तम्भ संख्याः 7 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः- क अनिर्वाय अर्हताए.-(1) शैक्षणिक अर्हताए.-किसी मान्यता प्राप्त विश्वद्यिालय से सम्बद्व विषय में स्नातकोतर उपाधि (कम से कम 50 प्रतिशत कुल मिलाकर) या निम्नलिखित विषयों में इसके समतुल्यः- (क) स्नातकोत्तर अध्यापक (अग्रेजी).- अग्रेजी1463 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ 1938 (ख) स्नातकोत्तर अध्यापक (हिन्दी).- हिन्दी (ग) स्नातकोत्तर अध्यापक (संस्कृत).- संस्कृत

(घ) स्नातकोत्तर अध्यापक (गणित).- गणित/एप्लाईड गणित

(ड) स्नातकोत्तर अध्यापक (भौतिक शास्त्र).- भौतिकी/इलैक्ट्रोनिक्स/न्यूक्लियर भौतिकी । (च) स्नातकोत्तर अध्यापक (रसायन शास्त्र).- रसायन शास्त्र/जीव रसायन

(छ) स्नातकोत्तर अध्यापक (जीव विज्ञान).- जीव विज्ञान/प्राणी विज्ञान/लाईफ माईक्रोबाईलोजी /बायोटैक्नालॉजी/मौलेक्यूलर बायोलाजी/प्ंलाट फिजियोलॉजी परन्तु स्नातक स्तर पर उन्होने वनस्पति विज्ञान और प्राणी विज्ञान का अध्ययन किया हो ।

(ज) स्नातकोत्तर अध्यापक (गृह विज्ञान).- गृह विज्ञान

(झ) स्नातकोत्तर अध्यापक (समाज शास्त्र).- समाज शास्त्र

(ञ) स्नातकोत्तर अध्यापक (संगीत).- संगीत (वाद्य/स्वर)

(ट) स्नातकोत्तर अध्यापक (इतिहास).- इतिहास

(ठ) स्नातकोत्तर अध्यापक (भूगोल).- भूगोल

(ड) स्नातकोत्तर अध्यापक (वाणिज्य) लेखा शास्त्र/वित्तीय लेखा शास्त्र और आयकर अध्यापकों के एक मुख्य विषय के तौर पर वाणिज्य के साथ किसी मान्यता प्राप्त विश्वविद्यालय से एम0 एफ0 सी0 (वित्तीय एवं नियन्त्रण में स्नातकोतर) उपाधि रखने वाला भी वाणिज्य विषय में स्नातकोतर अध्यापक के पद के लिए पात्र होगा ।

(ढ) स्नातकोत्तर अध्यापक (अर्थशास्त्र).-अर्थशास्त्र/प्रायोगिक अर्थशास्त्र/बिजनैस अर्थशास्त्र (ण) स्नातकोत्तर अध्यापक, (राजनीति शास्त्र).- राजनीति शास्त्र

(त) स्नातकोत्तर अध्यापक (इन्फारमैटिक्स प्रैक्टिसिज).- किसी मान्याता प्राप्त विश्वविद्यालय/ संस्थान से इन्फारमैटिक्स प्रैक्टिसिजः - कम्पयुटर विज्ञान में बी.ई या बी टैक की उपाधि अथवा इसके समतुल्य ।

या

किसी मान्यता प्राप्त विश्वविद्यालय/संस्थान से (किसी भी विद्या शाखा) में बी. ई. या बी. टैक और मान्यता प्राप्त विश्वविद्यालय/संस्थान से कम्पयुटर विज्ञान/टैक्नोलाजी/ एप्लीकेशन में स्नातकोतर डिप्लोमा या इसके समतुल्य ।

या

किसी मान्यता प्राप्त विश्वविद्यालय/संस्थान से विज्ञान निष्णात/(कम्पयुटर विज्ञान)/एम. सी. ए या समतुल्य ।

या

किसी मान्यता प्राप्त विश्वविद्यालय से गणित/भौतिकी में स्नातकोतर उपाधि के साथ किसी मान्यता प्राप्त विश्वविद्यालय/संस्थान से कम्पयुटर विज्ञान/एप्लीकेशन में स्नातकोतर डिप्लोमा ।1464 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ, 1938 या डोएक सोसाईटी, सूचना और संचार तकनीक मन्त्रालय से "बी" या "सी" स्तर का कोर्स । (i) स्नातकोत्तर अध्यापक (लोक प्रशासन).- लोक प्रशासन।

(ii) स्नातकोत्तर (मनोविज्ञान).- मनोविज्ञान।

2. व्यावसायिक अर्हता.-(i) किसी मान्यता प्राप्त विश्वविधालय/संस्थान से व्यावसायिक अर्हता के रूप में कम से कम पचास प्रतिशत अंकों के साथ शिक्षा स्नातक (बी0एड0)।

या

किसी मान्यता प्राप्त विश्वविधालय से दो वर्ष का एम0एस0सी0 एड0 कोर्स या इसके समतुल्यः (ii) स्नातकोतर अध्यापकों (इनफारमेटिक प्रैक्टिसिज) को बी0एड0 में छूट होगी।

परन्तु वाणिज्य स्नातकोतर (एम0काम0) अभ्यर्थियों के लिए हिमाचल प्रदेश विश्वविधालय द्वारा वाणिज्य स्नातक/वाणिज्य स्नातकोत्तर अभ्यर्थियों के लिए बी0एड0 कोर्स अनुज्ञात करने की तारीख से तीन वर्ष की अवधि के अवसान तक बी0एड0 की अर्हता अनिवार्य नहीं होगीः

टिप्पण.-(i) जीव विज्ञान विषय मे स्नातकोत्तर अध्यापक की दशा में अभ्यार्थी द्वारा वनस्पति विज्ञान/प्राणी विज्ञान/लाईफ सांईस/माइक्रो बायोलाँजी/जैव तकनीकी मौलेक्यूलर बायो/प्लांट फिजियोलाँजी में एम0एस0सी0 की स्नातकोत्तर उपाधि प्राप्त की होनी चाहिए, परन्तु उन्होने स्नातक स्तर तक वनस्पति विज्ञान, प्राणी विज्ञान का अध्ययन किया हो।

(ii) वाणिज्य विषय में स्नातकोत्तर अध्यापक की दशा में अभ्यर्थी का किसी मान्यता प्राप्त विश्वविधालय से वाणिज्य स्नातकोत्तर उतीर्ण होना चाहिए।

(iii) लोक प्रशासन में मास्टर उपाधि वाले अभ्यर्थी राजनीति विज्ञान मे स्नातकोत्तर अध्यापक के पद हेतु पात्र होंगें।

(iv) विज्ञान विषयों अर्थात भौतिकी, रसायन शास्त्र और जीव विज्ञान की दशा में, अभ्यर्थी को नियमित अभ्यर्थियों के रूप में विज्ञान निष्णात (एम.एस.सी.) की उपाधि प्राप्त होनी चाहिए। तथापि अभ्यर्थियों जिन्होने उक्त विषयों में विज्ञान निष्णात (एम.एस.सी) की उपाधि प्राप्त कर ली है या जिन्होने 06.04.2010 से पूर्व उक्त विषयों में दूरवर्ती शिक्षा माध्यम से एम.एस.सी. मे प्रवेश ले लिया है, भी पात्र होंगे।

(ख) वांछनीय अर्हतांए.-हिमाचल प्रदेश की रूढियों/रीतियों और बोलियों का ज्ञान और प्रदेश मे विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

(ख) स्तम्भ संख्याः 10 के सामने विघमान उपबन्धो के स्थान पर निम्नलिखित रखा जाएगा अर्थातः- (i) पचास प्रतिशत प्रोन्नति द्वाराः

परन्तु स्नातकोत्तर अध्यापक (इन्फामैटिक्स प्रैक्टिसिज) की दशा में यदि उपयुक्त अभ्यर्थी उपलब्ध न हो तो उक्त पदों को, यथास्थिति, प्रतिशत सीधी भर्ती द्वारा नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा भरा जाएगा। संविदा पर नियुक्त कर्मचारी स्तम्भ संख्याः 15-क में दी गई उपलब्धियां प्राप्त करेंगे और स्तम्भ में यथाविनिर्दिष्ट सेवा शर्तो द्वारा विनियमित होंगें।1465 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ 1938 (ii) पचास प्रतिशत सीधी भर्ती द्वारा यथास्थिति नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा । संविदा पर नियुक्त कर्मचारी स्तम्भ संख्याः 15-क में दी गई उपलब्धिया प्राप्त करेगे और उक्त स्तम्भ में यथा विनिर्दिष्ट सेवा शर्तो द्वारा विनियनित होंगे।

EXCISE AND TAXATION DEPARTMENT

NOTIFICATION

No.7-675/2015-EXN-13579- In exercise of the powers conferred by Section 59 of the Punjab Excise Act, 1914 (1 of 1914) read with Section 82 of the Himachal Pradesh Excise Act, 2011, as in force in the areas comprised in Himachal Pradesh immediately before 1st November, 1966 and as in force in the Territories transferred to Himachal Pradesh under Section 5 of the 1466 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ, 1938 Punjab Re-Organization Act, 1966 (31 of 1966) and by virtue of the powers of the Financial Commissioner (Excise), conferred on me under Section 9 of the said Act, read with the Himachal Pradesh (Excise Powers and Appeal) Orders, 1965, I ,Pushpendra Rajput, Excise and Taxation Commissioner, Himachal Pradesh hereby make the following further amendments in the Himachal Pradesh Liquor License Rules, 1986 (hereinafter called the 'said rules') as amended from time to time, with immediate effect :--

AMENDMENTS

In the said rules :

1. In Rule 1 after entry 'L-1 E' (Export) new entries 'L-1S' & 'L-1W ' and after entry 'L-13' new entries 'L-13S '& 'L-13W' shall be added as per the following description namely :--

2. In the Para, after entry L-21 and after L-1E (Export), new entries 'L-1S' & 'L-1W ' and after entry' L-13' new entries 'L-13S '& 'L-13W' shall be added.

3. (i) In Proviso to Rule 12(1) after the entry L-1E (Export), a new entry 'L-1S' for storage of foreign liquor by the manufacturer/supplier shall be added; and

(ii) L-1W shall be added so as to sell foreign liquor, Beer, Wine & RTD to the retail licensees of the District/zone inter-alia on the following terms and condition:--1467 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ 1938 (a) The license(s) authorize(s) to store or sell the foreign liquor, Beer, Wine & RTD as the case may be in wholesale at the mentioned premises.

(b) The licensee shall not sell less than one dozen of bottles of liquor or as may be prescribed in the liquor sourcing/sale policy of HPBL to any licensed/authorized person.

(c) The licensee shall prominently display in front of his licensed premises a signboard showing in Hindi or English the wholesale price of each kind of liquor.

(d) The licensee shall sell foreign liquor, Beer, Wine & RTD wholesale only to a person holding a license in form L-2, L-3, L-4, L-5 L-4A, L-5A L-6, L-7, L-8, L-9, L-10, L- 11, L-12, L-12A, L-12B, and L-12C. He shall sell bottled liquor only in sealed and capsule bottles.

(e) The licensee in addition to the provisions of the Punjab/HP Excise Act and Rules framed thereunder from time to time, shall also further comply with the instructions/directions/orders/notifications issued by the Excise & Taxation Commissioner (HP) from time to time.

(f) The licensee will observe the dry days as notified by the Excise & Taxation Commissioner from time to time.

(g) The licensee shall get the license renewed every year on payment of such fee and such other conditions as may be/are fixed by the Excise & Taxation Commissioner from time to time as per the Act /Rules/Orders/Notifications issued thereunder in so far as these are not inconsistent and are applicable in the case of aforementioned licenses shall apply MUTATIS.MUTANDIS.

(h) The existing provisions regarding registration/renewal of brands including approval of labels etc. pertaining to the foreign liquor, Beer, Wine & RTD which will be stored, purchased and sold in the aforementioned licensed premises shall also be applicable accordingly.

4. In Rule 22, a new sub rule namely ''22 A'' shall be added as fellows:--

A license in form 'L-13S' shall be granted for storage of country liquor by HBPL/manufacturer/supplier and

A license in form 'L-13W' shall be granted to sell CL to the retail licensees of the District/zone inter-alia on the following terms and condition:--

(a) The license(s) authorize(s) to store or sell CL as the case may be in wholesale at the mentioned premises.

(b) The licensee shall not sell less than one dozen of bottles of liquor or as may be prescribed in the liquor sourcing/sale policy of HPBL to any licensed/authorized person.

(c) The licensee shall prominently display in front of his licensed premises a signboard showing in Hindi or English the wholesale price of each kind of liquor.

(d) The licensee shall sell CL wholesale only to a person holding a license in form L-14 &L-14A. He shall sell bottled liquor only in sealed and capsule bottles.

5. (i) In Rule 38, after Sub Rule 38(1-A), a new Sub Rule namely 38 (1-AA) shall be added as follows:--

A license in form L-1W shall be granted for the wholesale vend of foreign liquor to the trade only:--

(a) The licensee shall sell foreign liquor, only to the persons holding a license in form L-2, L-3, L-3A, L-4, L-4A, L-5, L-5A, L-6, L-7, L-8, L-9, L-10BB, L-12, L-12A, L-12B or L-12C and he shall sell bottled liquor only in sealed and capsuled bottles.

(b) The licensee shall obtain supplies only from the licensees having license in form L-1B, L-1C, L-1BB, S-1B, S-1A and out of duty paid godown of the manufacturer.

(c) The licensee shall not sell any brand of liquor i.e. foreign liquor, Beer, Cider, Wine or RTD unless such brand has been registered with the Financial Commissioner (Excise) on payment of brand registration fee as prescribed.

(d) No passes for sale of un-registered brands of the liquor specified in clause (c) of this sub-rule shall be issued and no passes for the sales of brands registered but not renewed before the 15th day of April shall be issued;]

(e) The holder of manufacturer/supplier license in form L-1B, L-1BB, L-1C, S-1A, S-1B may apply for the grant of L-1S license in any District for storage of foreign liquor, Beer, Wine & RTD without facility to sell the liquor to the retailers like L-2 etc. The supplies to the retailers will be made through a mandatory L-1W licensed premises of HPBL located inside the manufacturer/ supplier's L-1S premises. The holder of license in form L-1S may be authorised by the Excise & Taxation Commissioner Himachal Pradesh to stock the liquor of other manufacturer(s)/supplier(s) as per procedure which may be prescribed.

(f) A licensee in form L-1W shall supply liquor to L-2 etc. licensees within the District in the case of manufacturer/supplier's depot and in the zone in the case of (HPBL exclusive) for which such license has been obtained & License fee has to be paid accordingly as prescribed in Schedule-A appended to these Rules.

(g) The transfer of foreign liquor, Beer, Wine, Cider & RTD etc. from one L-1S/ L-1W to another L-1S and L-1W within the State may be allowed after close of every quarter by the 7th day of the subsequent month of such quarter subject to the condition that both such L-1S and L-1W licenses/licensed premises are owned by the same person who shall furnish documentary proof of such ownership to concerned District I/c and the case shall be sent to the Excise & Taxation Commissioner, Himachal Pradesh for approval before any permit/pass is issued. The concerned licensee shall also enclose the stock statements (Quarts, Pints, Nips brands wise, batch wise with manufacturing date and hologram serial number wise) relating to both the licensed premises i.e. transferor and transferee premises and such statements shall be duly signed and countersigned by the ETI/AETO I/C of the L-1S/L-1W, AETC/ETO Incharge of the District as well as by the Collector (Excise) of the Zone concerned respectively.

(h) The license in form L-1S for the manufacturer/supplier in any District shall be allowed only to store foreign liquor, Beer, Wine, Cider & RTD as per ORDER FOR SUPLLY approved by HPBL and not to sell it further to retailers. The storage, purchase and sale activity of the manufacturer/supplier's L-1S license will be restricted only within the District where it is located. The L-1W license of HPBL will be situated inside the L-1S licensed premises of the manufacturer/supplier of the District authorises purchase and further sale to the retailers like L-2 etc. by HPBL . The storage, purchase and sale activity of the L-1S and L-1W licenses of HPBL own depot will be valid for the zone as a whole where in it is located.

(i) Application for the grant of L-1S & L-1W licenses will be submitted to the Excise Officer, Incharge of the District concerned, who will forward the same, after recording his remarks/recommendation to the Collector (Excise) of the zone concerned, who will grant the license subject to approval of the Financial Commissioner (Excise).

(j) The holder of L-1S & L-1W licenses will have to deposit or furnish a security of Rs.2,00,000/-(Two Lacs) in the shape of cash or time deposit receipt or National Saving Certificate duly pledged to the Excise Officer, incharge of the District concerned. The other codal formalities like approval of premises etc. will also be observed.

5. (ii) In Rule 38, after Sub Rule 38(1-AA), a new Sub Rule namely 38 (1-AAA) shall be added as follows:--

A license in form L-13W shall be granted for the wholesale vend of country liquor to the trade only:--

(a) The licensee shall sell country liquor only to the persons holding a license in form L- 14 or L-14A and he shall sell bottled liquor only in sealed and capsuled bottles.

(b) The licensee shall obtain supplies only from the manufactures of the country liquor out of duty paid godown.

(c) The licensee shall not sell any brand of liquor i.e. CL unless such brand has been registered with the Financial Commissioner (Excise) on payment of brand registration fee as prescribed.

(d) No passes for sale of un-registered brands of the liquor specified in clause (c) of this sub-rule shall be issued and no passes for the sales of brands registered but not renewed before the 15th day of April shall be issued;] 1470 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ, 1938 (e) The holder of manufacturer/supplier of country liquor may apply for the grant of L- 13S license in any District for storage of CL without facility to sell the liquor to the retailers like L-14 or L-14A etc. The supplies to the retailers will be made through mandatory L-13W licensed premises of HPBL located inside the manufacturer/ supplier's L-13S premises. The holder of license in form L-13S may be authorised by the Excise & Taxation Commissioner Himachal Pradesh to stock the liquor of other manufacturer(s)/supplier(s) as per procedure which may be prescribed.

(f) A licensee in form L-13W shall supply liquor to L-14, or L-14A licensees within the District in the case of manufacturer/supplier and in the zone in the case of (HPBL exclusive) for which such license has been obtained & License fee has to be paid accordingly as prescribed in schedule-A appended to these Rules.

(g) The transfer of CL from one L-13S/ L-13W to another L-13S and L-13W within the State may be allowed after close of every quarter by the 7th day of the subsequent month of such quarter subject to the condition that both such L-13S and L-13W licenses/licensed premises are owned by the same person who shall furnish documentary proof of such ownership to concerned I/c and the case shall be sent to the Excise & Taxation Commissioner, Himachal Pradesh for approval before any permit/pass is issued. The concerned licensee shall also enclose the stock statements (Quarts, Pints, Nips brands wise, batch wise with manufacturing date and hologram serial number wise) relating to both the licensed premises i.e. transferor and transferee premises and such statements shall be duly signed and countersigned by the ETI/AETO I/C of the L-13S/L-13W, AETC/ETO Incharge of the District as well as by the Collector (Excise) of the Zone concerned respectively.

(h) The license in form L-13S for the manufacturer/supplier in any District shall be allowed only to store CL as per ORDER FOR SUPLLY approved by HPBL and not to sell it further to retailers. (viii) To protect, preserve and promote the historical, social and religious traditions ssociated with the Prashar Lake and Temple.

In addition to the above authority will undertake any further development work in the area entrusted by the Government in this behalf.

This authority is constituted for a period of two years. The Non-Official members will get TA/ DA in accordance with the existing rules/instructions of the Government as amended from time to time.

उपरोक्त विषय पर आवेदनकर्त्ताओं ने अचल सम्पति बारे आवेदन पत्र गुजारा है कि उनके पिता श्री चिन्तू पुत्र श्री जैडू पुत्र स्वारू, निवासी अड़ोट, महाल नारला, डा0 कुन्नु, तहसील पधर अरसा वर्षों से लापता है। जिनके बारे गुमशुदगी रिपोर्ट पुलिस थाना पधर स्थित द्रंग डायरी संख्या-20 (A) दिनांक 24-12-2014 दर्ज है। जिनकी अचल सम्पति स्थित मुहाल नारला/534 तहसील पधर, जिला मण्डी में उनके जायज वारसान सर्वश्री छजू राम, रूप चन्द, चमन लाल, जै सिंह व सूरजू देवी के नाम हस्तातरण बारे ईन्तकाल नं0-564 मकफूल उलखबरी पटवार वृत्त नारला, तहसील पधर मे दर्ज शुद्ध है। यदि श्री चिन्तू राम की अचल सम्पति उसके जायज वारसानों के नाम हस्तांतरण बारे किसी व्यक्ति को उजर व एतराज हो तो वह1485 राजपत्र, हिमाचल प्रदेश, 17 जून, 2016/27 ज्येष्ठ 1938 असालतन या वकालतन अधोहस्ताक्षरी के कार्यालय में किसी भी कार्य दिवस मे इस ईश्तहार के प्रकाशन होने उपरान्त एक माह के अन्दर प्रस्तुत कर सकता है। अन्यथा इन्तकाल तस्दीक कर दिया जायेगा।

यह दरख्वास्त श्रीमती बिमला देवी पुत्री चरन दास हालाबाद पत्नी श्री पदम चन्द, निवासी गांव दोफदा, तहसील रामपुर बुशैहर, जिला शिमला (हि0 प्र0) ने इस आशय के साथ प्रस्तुत की है कि अराजी खाता/खतौनी नं0 54 मिन/201, खसरा नं0 356, रकबा तादादी 00-14-02 है0, वाका चक दोफदा का कब्जा मौका प्रार्थी विला किसी रोक टोक के अरसा देरिना से चला आ रहा है परन्तु उपरोक्त कागजात माल में प्रतिवादी नं0 4 व 5 के स्व0 पिता चरण दास का कब्जा दर्ज है, जो काबले दरुस्ती है। प्रतिवादी चरण दास फौत हो चुका है। आवेदक खाना काश्त में कब्जा अपना दर्ज/दरुस्त करवाना चाहता है। जिसकी दरुस्ती की दरख्वास्त इस अदालत में विचाराधीन है। प्रतिवादी नं0 1 ता 3 को बार-बार समन जारी करने के उपरान्त भी तामील असालतन न होनी पाई जा रही है । इस प्रकार इस अदालत को यकीन हो गया है कि इनकी तामील साधारण तरीके से होनी सम्भव नहीं है।

इतः इस इश्तहार द्वारा प्रतिवादी नं0 1 ता 3 को सूचित किया जाता है कि यदि दरुस्ती उपरोक्त अराजी के खाना काश्त में वहक श्रीमती बिमला देवी पुत्री चरन दास दर्ज करने बारे कोई आपत्ति हो तो दिनांक 30-06-2016 को या इससे पूर्व अदालत हजा में हाजिर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा उपरोक्त के खाना काश्त में प्रतिवादी नं0 1 ता 3 के स्थान पर वादी उपरोक्त का कब्जा नियमानुसार दर्ज करने के आदेश पारित किए जाएंगे।
