संख्याः रैव डी (जी) 6-12/2016.--हिमाचल प्रदेश पट्‌टा (संशोधन) नियम, 2015 के प्रारूप को, इस विभाग की अधिसूचना संख्याः रैव डी (जी) 6-69/2011-II तारीख 23-01-2016 द्वारा, हिमाचल प्रदेश-भू-जोत अधिकतम सीमा अधिनियम, 1972 (1973 का अधिनियम संख्यांक 19) की धारा 26 के साथ पठित हिमाचल प्रदेश ग्राम शामलात भूमि निधान और उपयोग अधिनियम, 1974 (1974 का अधिनियम संख्यांक 61-राजपत्र/2016-28-06-2016 (1889) 1890 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़, 1938 18) की धारा 13 के अधीन यथा अपेक्षित के अनुसार जन साधारण से अक्षेपों और सुझावों को आमंत्रित करने के लिए तारीख 23-01-2016 को राजपत्र, हिमाचल प्रदेश में प्रकाशित किया गया था;

और इस निमित्त नियत अवधि के भीतर प्राप्त हुए आक्षेपों और सुझावों पर सम्यक्‌ रूप से विचार किया गया;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश-भू-जोत अधिकतम सीमा अधिनियम, 1972 (1973 का अधिनियम संख्यांक 19) की धारा 26 के साथ पठित हिमाचल प्रदेश ग्राम शामलात भूमि निधान और उपयोग अधिनियम, 1974 (1974 का अधिनियम संख्यांक 18) की धारा 13 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः रैव डी (जी) 6-69/2011-पार्ट-III तारीख 4-3-2014 द्वारा अधिसूचित और तारीख 5-3-2014 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश पट्‌टा नियम, 2013 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है; अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पट्‌टा (संशोधन) नियम, 2016 है।

(2) ये नियम, राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. नियम 4 का संशोधन.--हिमाचल प्रदेश पट्‌टा नियम, 2013 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 4 के खण्ड (iii) ''युद्ध विधवाओं'' शब्दों और चिन्ह के पश्चात्‌ ''स्वतन्त्रता सेनानी और उनके प्रतिपाल्य'' शब्द अन्तः स्थापित किए जाएंगे।

3. नियम 7 का संशोधन.--उक्त नियमों के नियम 7 में परन्तुक के पश्चात्‌ निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्‌ः--

''परन्तु यह और कि व्यपवर्तित वन भूमि की दशा में पट्‌टा, इन नियमों से संलग्न प्ररूप ''ग'' और ''घ'' के अनुसार अनिवार्यता प्रमाण-पत्र, अनापति प्रमाण पत्र के आधार पर सरकार द्वारा मन्जूर किया जा सकेगा और केन्द्रीय या राज्य वन विभाग द्वारा मन्जूर वन भूमि के व्यपवर्तन के लिए अनुमोदन, केवल सम्बद्व उपायुक्त-एवं-कलक्टर द्वारा, किन्हीं अन्य औपचारिकताओं का पालन किए बिना, पट्‌टा भाटक/रकम की संगणना और निर्धारण के पश्चात्‌ ही किया जाएगा।''।

4. नियम 8 का सशोंधन.--उक्त नियमों के नियम 8 में,--

(क) खण्ड (i) के परन्तुक में, ''जल विद्युत परियोजनाओं (एच ई पीज)'' शब्दों और कोष्ठकों के पश्चात्‌'' और सौर उर्जा परियोजनाएं'' शब्द अन्तःस्थापित किए जाएंगे;

(ख) खण्ड (i) में, परन्तुक के पश्चात्‌ निम्नलिखित परन्तुक अन्तःस्थापित किए जाएंगे, अर्थात्‌ः- ''परन्तु जल विद्युत परियोजनाओं (एच.ई.पी.एस), सौर उर्जा परियोजनाओं और अन्य अवसंरचनात्मक परियोजनाओं, जिनके लिए सरकारी वन भूमि राज्य या केन्द्रीय सरकार द्वारा व्यपवर्तित की गई है, तो पट्‌टा भाटक/रकम प्रतिवर्ष एक रूपए प्रति वर्गमीटर की दर से प्रभारित की जाएगी और अन्य सरकारी भूमि (गैर-वन भूमि) के लिए पट्‌टा भाटक/रकम चालू वृत्त दर की विद्यमान दस प्रतिशत की दर से प्रभारित की जाएगीः

परन्तु यह और कि विद्युत और अन्य अवंसरचनात्मक परियोजनाओं की बाबत, जहां व्यपवर्तित सरकारी वन भूमि का पट्‌टा 31-12-2015 से पूर्व के प्रचलित नियमों के अनुसार विद्यमान दरों पर वार्षिक पट्‌टा भाटक आधार पर मन्जूर या प्रदान किया गया है, तो पट्‌टा भाटक/रकम, 01-01-2016 के पश्चात बिना किसी और छूट के एकरूप दर पर प्रतिवर्ष एक रूपए प्रति वर्गमीटर की पुररीक्षित पट्‌टा दर पर प्रभारित की जाएगीः1891 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़ 1938 परन्तु यह और भी कि पहले से ही निष्पादित या क्रियान्वित परियोजनाओं या जो हिमाचल प्रदेश राज्य विद्युत परिषद और हिमाचल प्रदेश विद्युत निगम सीमित की विद्युत परियोजनाओं सहित राज्य या केन्द्रीय सरकार के विभागों से शतप्रतिशत निधीयन के अधीन राज्य में निष्पादित की जानी हैं; के लिए सरकारी या व्यपवर्तित वन भूमि, ऐसी परियोजनाओं को सम्पूर्ण पट्‌टा अवधि के लिए प्रतिमास एक रूपए प्रति बीघा के नाममात्र पट्‌टा भाटक पर पट्‌टे पर उपलब्ध करवाई जाएगी। ''; और (ग) खण्ड (iii) के उप-खण्ड (घ) के पश्चात्‌ निम्नलिखित परन्तुक अन्तःस्थापित किया जाएगा, अर्थात्‌ः--

''परन्तु प्रवर्ग (क) से (ग) के लिए रियायती पट्‌टा भाटक/रकम नाममात्र पट्‌टा भाटक के रूप में प्रतिमास एक रूपए की दर से प्रभारित किया जाएगा/की जाएगी और प्रवर्ग (घ) के लिए पट्‌टांतरित भूमि की चालू वृत दरों के बीस प्रतिशत की दर से एक मुश्त तथा उस अवधि, जिसके लिए भूमि का पट्‌टा मन्जूर किया गया है, के लिए एक रूपया प्रतिमास नाममात्र पट्‌टा राशि प्रभारित की जाएगी। ''।

5. नए नियम 18-क का अन्तःस्थापन.--उक्त नियमों के नियम 18 के पश्चात्‌ निम्नलिखित नया नियम अन्तः स्थापित किया जाएगा, अर्थात्‌ः--

'' 18-क शास्तिः- पट्‌टेदार, नियत अवधि के भीतर पट्‌टा विलेख के अनिष्पादन या पट्‌टा रकम के असंदाय या पट्‌टे के अनवीकरण के लिए और पट्‌टा विलेख के निबधनों और शर्तों के अननुपालन अथवा हिमाचल प्रदेश पट्‌टा नियम, 2013 के उपबन्धों के उल्लंघन की दशा में भी विद्यमान पट्‌टा भाटक/रकम का दस प्रतिशत की दर से शास्ति के रूप में अतिरिक्त रकम संदत्त करने के लिए दायी होगा। ''।

No. Rev-D (G) 6-12/2016.—WHEREAS, the draft Himachal Pradesh Lease (Amendment) Rules, 2015 were published in the Rajpatra, Himachal Pradesh on 23-01-2016 for inviting objections and suggestions from the general public, vide this Department Notification No. Rev-D (G) 6-69/2011-II dated 23-01-2016 as required under section 13 of the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 (Act No. 18 of 1974) read with section 26 of the Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No. 19 of 1973);

AND WHEREAS, the objection (s) or suggestions (s) so received in this behalf, have been duly considered ;

1892 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़, 1938 NOW, THEREFORE, in exercise of the powers conferred by section 13 of the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 (Act No. 18 of 1974) read with section 26 of the Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No. 19 of 1973), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Himachal Pradesh Lease Rules, 2013, notified vide this Department Notification No. Rev-D (G) 6- 69/2011-Part-III dated 4-3-2014 and published in Rajpatra, Himachal Pradesh on 05-03-2014, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Lease (Amendment) Rules, 2016.

(2) They shall come into force from the date of publication in Rajpatra, Himachal Pradesh.

2. Amendment of rule 4.—In rule 4 of the Himachal Pradesh Lease Rules, 2013 (hereinafter referred to as the 'said rules'), in clause (iii), after the words and sign "war widows", the words and sign "freedom fighters and their wards", shall be inserted.

3. Amendment of rule 7.—In rule 7 of the said rules, after the proviso, the following proviso shall be inserted, namely:—

"Provided further that the lease in case of diverted forest land may be sanctioned by the Government, on the basis of Essentiality Certificate, No Objection Certificate as per Forms''C'' and "D" appended to these rules and approval for diversion of forest land granted by the Central or State Forest Departments, only after calculation and assessment of lease rent/amount by the concerned Deputy Commissioner-cum-Collector, without observing any other codal formalities.".

4. Amendment of rule 8.— In rule 8 of the said rules,—

(a) In clause (i), in the proviso, after the words, brackets and letters "Hydro Electric Projects (HEPs)", the words "and Solar Power Projects" shall be inserted.;

(b) In clause (i), after the proviso, the following provisos shall be inserted, namely:—

"Provided that for the Hydro Electric Projects (HEPs), Solar Power Projects and other infrastructure projects for which Government forest land has been diverted by the State or Central Government, the lease rent/ amount shall be charged @ Re. 1 per Sqmt., Per annum and for other Government land (non-forest land), the lease rent/amount shall be charged at the existing rate of 10% of the current circle rate:

Provided further that in respect of power and other infrastructure projects, where the lease of diverted Government forest land has been sanctioned or granted on annual lease rent basis on the existing rates as per prevailing rules prior to 31-12-2015, the lease rent/amount shall be charged on the revised lease rate of Re. 1/- per sqmt., per annum after 01-01-2016 on uniform rates without any further concessions:

Provided further that the projects already executed or implemented or which are to be executed in the State under 100% funding from the State or Central Government Departments including the power projects of Himachal Pradesh State Electricity Board and Himachal Pradesh Power Corporation Limited, the Government or diverted forest land on lease shall be provided to such projects on token lease rent of Re. 1/- per bigha per month for entire lease period."; and1893 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़ 1938 (c) in clause (iii), after sub-clause (d), the following proviso shall be inserted, namely:— "Provided that the concessional lease rent/amount for categories (a) to (c) shall be charged @ Re 1/- per month as token lease rent and for category (d) shall be charged @ 20% of the current circle rates of the demised land in lumpsum and Re. 1/- per month as token lease money for the period for which the land is granted on lease.".

5. Insertion of new rule 18 A.—After rule 18 of the said rules, the following new rule shall be inserted, namely:—

"18-A Penalty.- The lessee shall be liable to pay additional amount as penalty for non execution of lease deed or non-payment of lease amount or nonrenewal of lease within the stipulated period @ 10% of the existing lease rent/ amount and also in the event of non- compliance of the terms and conditions of lease deed or contravention of the provisions of Himachal Pradesh Lease Rules, 2013".

संख्याःटी.सी.पी.-एफ(5)-7/2005.-हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्याक 12) की धारा-13 की उपधारा (1) के अधीन, सरकार की अधिसूचना संख्याः टी0सी0पी0-एफ0 ( 5)-7/2005, तारीख 4-3-2014 द्वारा घुमारवीं योजना क्षेत्र का गठन कर लिया गया है तथा उक्त योजना क्षेत्र के विद्यमान भू-उपयोग के मानचित्र को पूर्वोक्त अधिनियम की धारा 15-क की उपधारा (1) के अन्तर्गत सरकार की अधिसूचना संख्याः टी.सी.पी.-एफ (5) -7/2005 तारीख 4-3-2014 द्वारा बन्द कर किया गया है ।

अतः घुमारवीं योजना क्षेत्र को धारा 13 की उपधारा (2) के खण्ड (क) के अधीन, सोलह (16) सम्पूर्ण और इक्तालीस (41) भागतः राजस्व मुहालों को अपवर्जित करके और तीन राजस्व मुहालों अर्थात्‌ चैहड़ी/393, जाहड़ी/391, और लैहड़ी सरेल/272 को सम्मिलित करके तथा हिमाचल प्रदेश नगर एवं ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्याक 12) के उपबन्धों के अधीन, सरकार की अधिसूचना संख्याः टी. सी.पी.-एफ (5) -7/2005 तारीख 14.6.2016 .द्वारा अधिसूचित योजना क्षेत्र की सीमा को परिवर्तित करके, पुनर्गठित किया गया है। 1900 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़, 1938 हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है कि पूर्वोक्त योजना क्षेत्र में भू-उपयोग में परिवर्तन या उसपर किसी निर्माण संक्रिया से सतह या किसी भूमि या मिटटी पर हानिकारक अवरोध होने की सम्भावना है या मिट्‌टी के संरक्षण, भूमि खिसकने की रोकथाम या भूमि कटाव से संरक्षण हेतु हानिकारक समझा गया है, और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार उक्त क्षेत्र की योजना बनाना और विकास करना कठिन होने की सम्भावना है।

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वोक्त अधिनियम की धारा 15-क की उपधारा (1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, तीन नए राजस्व मुहालों अर्थात मोहाल चैहड़ी/393, मोहाल जाहड़ी/391, और मोहाल लैहड़ी सरेल/272, को सम्मिलित कर पुनर्गठित घुमारवीं योजना क्षेत्र के विद्यमान भू- उपयोग को, इस अधिसूचना के राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से एक वर्ष की अवधि के लिए बन्द करते हैं ।

No. TCP-F(5)-7/2005.—WHEREAS Ghumarwin Planning Area has been constituted under subsection (1) of section 13 of the Himachal Pradesh Town & Country Planning Act, 1977 (Act No. 12 of 1977) vide Govt. Notification No. TCP-F(5)-7/2005 dated. Shimla- 4-3-2014 & existing landuse map of the said Planning Area has been frozen under sub section (1) of section 15- A of the Act ibid vide Govt. Notification No. TCP-F(5)-7/2005 dated. Shimla- 4-3-2014;

NOW Ghumarwin Planning Area has been re-constituted under clause (a) of sub-section (2) of Section 13 by excluding sixteen Complete and forty one Partly revenue mohals and including 3 revenue mohals i.e Cheri/393, Jahri/391, and Lehri Sarail/ 272 and by altering the notified Planning Area boundary under the provisions of the Himachal Pradesh Town & Country Planning Act, 1977 (Act No. 12 of 1977) vide Govt. Notification No.TCP– F(5)-7/2005 dated 14.6.2016;

WHEREAS the Governor of Himachal Pradesh is satisfied that in the aforesaid Planning Area, the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of section 15- A of the Act ibid, the Governor of Himachal Pradesh is pleased to freeze the existing land use of reconstituted Ghumarwin Planning Area i.e inclusion of new three revenue Mohals i.e. Mohal Cheri/393, Mohal Jahri/391, and Mohal Lehri Sarail/272 for a period of one year from the date of publication of this Notification in the Official Gazette.

स्ांख्याः जीएडी-बी-(ए) 1-11/2013-1 (मण्डी).-हिमाचल प्रदेश के राज्यपाल की राय है कि हिमाचल प्रदेश के जिला मण्डी के विद्यमान उपमण्डल (नागरिक) मण्डी (ग्रामीण) और उपमण्डल (नागरिक) मण्डी (शहरी) का, उप मण्डल (नागरिक) मण्डी (ग्रामीण) से तहसील कोटली और तहसील औट को अपवर्जित करके और इसे मण्डी जिला के उप मण्डल (नागरिक) मण्डी (शहरी) में सम्मिलित करके, पुनर्गठन करना आवश्यक है ।

अतः हिमाचल प्रदेश के राज्यपाल, दण्ड प्रक्रिया संहिता, 1973 की धारा 7 की उपधारा (3) के साथ पठित हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16 ) की धारा 5 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के परामर्श से, तुरन्त प्रभाव से यह आदेश देते हैं कि उपरोक्त पुनर्गठन के पश्चात्‌ उपमण्डल (नागरिक) मण्डी (ग्रामीण) में केवल तहसील बल्ह ही समाविष्ट होगी जिसका नया नाम उपमण्डल (नागरिक) बल्ह होगा और जिसका मुख्यालय नैरचौक में होगा। इसके अतिरिक्त उपमण्डल (नागरिक) मण्डी (शहरी) में तहसील सदर, तहसील कोटली व तहसील औट समाविष्ट होगी और यह उप मण्डल (नागरिक) सदर मण्डी, जिला मण्डी, हिमाचल प्रदेश के रूप में पुनः नामित होगा ।

GAD-B(A)1-11/2013-1 (Mandi).— Whereas, the Governor of Himachal Pradesh is of the opinion that it is necessary to reorganize the existing Sub-Division (Civil) Mandi (Rural) and Sub- Division (Civil) Mandi (Urban) in District Mandi by excluding Tehsil Kotli and Tehsil Aut from Sub-Division (Civil) Mandi (Rural) and to include it in Sub-Division (Civil) Mandi (Urban), District Mandi.

Now, therefore, in exercise of the powers conferred by section 6 of the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) and section 5 of the Registration Act, 1908 (Act No. 16 of 1908) read with sub-section (3) of section-7 of the Code of Criminal Procedure 1973, the Governor of Himachal Pradesh, in consultation with the High Court of Himachal Pradesh, is pleased to order, with immediate effect, that after above reorganization, Sub-Division (Civil) Mandi (Rural) will comprise of Tehsil Balh only and it shall be re-named as Sub-Division (Civil) Balh with its Head quarter at Ner Chowk. Further Sub-Division (Civil) Mandi (Urban) will comprise of Tehsil Sadar, Tehsil Kotli and Tehsil Aut and it shall be re-named as Sub-Division (Civil) Sadar Mandi District Mandi, Himachal Pradesht.

GAD-B(A)1-11/2013-II (Mandi).—Whereas, the Governor of Himachal Pradesh is of the opinion that it is necessary to do so that in District Mandi a new Sub-Division (Civil) to be known as "Janjehli" may be created by excluding the entire Tehsil Thunag, having 14 Patwar Circles, 4 Patwar Circles of Sub-Tehsil Chhatri and one Patwar Circle of Tehsil Balichowki, from Sub- Division (C) Chachiot.

जैसा कि श्रीमती बिमला देवी पुत्री श्री चौंटू राम, निवासी ग्राम कुलाह, डा0 जरवा, तहसील शिलाई, जिला सिरमौर, हिमाचल प्रदेश ने मय शपथ-पत्र इस प्रार्थना अनुरोध के साथ प्रस्तुत किया है कि उसका विवाह बिजा राम पुत्र श्री मोती राम, निवासी ग्राम डाबरा, डा0 शिल्ला, तहसील पांवटा साहिब, जिला सिरमौर के साथ दिनांक 13-04-2011 को हुआ है तथा अज्ञानतावश ग्राम पंचायत बोकाला पाब, तहसील पांवटा साहिब के रिकार्ड में विवाह का पंजीकरण नहीं करवा सकी है जिसे अब पंजीकरण करवाना चाहती है। अतः इस सम्बन्ध में श्रीमती बिमला देवी पुत्री श्री चौंटू राम, निवासी ग्राम कुलाह, डा0 जरवा, तहसील शिलाई, जिला सिरमौर, हिमाचल प्रदेश के विवाह के पंजीकरण बारे किसी व्यक्ति को कोई एतराज हो तो दिनांक 12-07-2016 तक असालतन अथवा वकालतन अधोहस्ताक्षरी की अदालत में उपस्थित होकर प्रस्तुत कर सकता है। निर्धारित तिथि तक कोई एतराज प्राप्त न होने की सूरत में प्रार्थी का विवाह पंजीकरण एवं दर्ज करने के नियमानुसार आदेश पारित कर दिये जायेंगे।1919 राजपत्र, हिमाचल प्रदेश, 28 जून, 2016/7 आषाढ़ 1938 आज दिनांक 13-06-2016 को मेरे हस्ताक्षर व मोहर अदालत से जारी हुआ। मोहर।

NOTICE UNDER SECTION 16 OF SPECIAL MARRIAGE ACT

Whereas Shri Pushpinder Singh s/o Shri Inderjit Singh, r/o H.No. 14, Ward No. 3, Badrinagar, Paonta Sahib, District Sirmaur, H.P. and Komal d/o Shri Bhajnik Singh, r/o c/o Manohar Cycle Works Bhojpur Bazar, Sunder Nagar District Mandi, H.P. at present residing at H.No. 14, Ward No. 3, Badrinagar, Paonta Sahib, District Sirmaur have filed an application for registration of their marriage which was solemnized on 27-04-2015. I solemnized my marriage at Gurudwara Sri Paonta Sahib and they have been living husband and wife ever since then. Notices are given to all concerned and General Public to this effect that if any body has got any objection regarding the registration of marriage they should file their written objections and should appear personally or through their authorised agents before this court within a period of 30 days from the date of issue of this notice. After expiry of the said period, the marriage certificate would be issued to the applicants by this court and later on no objection will be heard and accepted.
