संख्याः गृह-बी-बी(2)4/2004-III लूज.--हिमाचल प्रदेश के राज्यपाल, इस विभाग की अधिसूचना संख्या संख्याः गृह-बी-बी(2)4/2004-III लूज तारीख 14 जून, 2016 के क्रम में और हिमाचल प्रदेश न्यायिक अधिकारी (वेतन, भत्ते और सेवा की शर्तें) अधिनियम, 2003 (2003 का अधिनियम संख्यांक 10) की धारा 4 की उपधारा (1) के साथ पठित भारत के संविधान के अनुच्छेद 233, 234 और अनुच्छेद 309 के परन्तुक द्वारा 75-राजपत्र/2016-16-07-2016 (2547) 2548 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2016/25 आषाढ़, 1938 प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस निमित्त उन्हें सशक्त बनाने के लिए समस्त अन्य शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश न्यायिक सेवा (द्वितीय संशोधन) नियम, 2016 है।

2. नियम 3 का संशोधन.--हिमाचल प्रदेश न्यायिक सेवा नियम, 2004 (जिन्हें इसमें इसके पश्चात्‌ "उक्त नियम" कहा गया है) के नियम 3 के उप-नियम (3) के स्थान पर निम्नलिखित उप-नियम रख जाएगा, अर्थात्‌ः--

"(3) इन नियमों के प्रारम्भ की तारीख से नीचे स्तम्भ (2) में विनिर्दिष्ट विद्यमान संवर्ग, निम्न स्तम्भ (1) में तत्स्थानी प्रविष्टियों में विनिर्दिष्ट संवर्ग के रुप में अभिहित होंगे और यह तदनुसार सेवा का गठन करेंगेः-

(1)	(2)
(क) जिला न्यायाधीश/ अतिरिक्त जिला न्यायाधीश	(i) जिला एवं सत्र न्यायाधीश (ii) अतिरिक्त जिला एवं सत्र न्यायाधीश
(ख) सीनियर सिविल न्यायाधीश	(i) वरिष्ठ उप न्यायाधीश एवं मुख्य न्यायिक मजिस्ट्रेट (ii) अतिरिक्त मुख्य न्यायिक मजिस्ट्रेट
(ग) सिविल न्यायाधीश	(i) उप-न्यायाधीश एवं न्यायिक मजिस्ट्रेट।"।

3. नियम 5 का संशोधन.--उक्त नियमों के नियम 5 में, सारणी के अन्त में निम्नलिखित उपबंध अन्तःस्थापित किया जाएगा, अर्थात्‌ः-

"निःशक्त व्यक्तियों के लिए आरक्षण.-

अतिरिक्त जिला न्यायाधीशों एवं सिविल न्यायाधीशों के प्रवर्गों के लिए तीन प्रतिशत आरक्षणः-- आरक्षण निम्न अभ्यर्थियों को प्रदान किया जाएगाः-

(क) कम दृष्टि के अन्धेपन से ग्रस्त किन्तु निःशक्तता 75% और उससे अधिक न हो,

(ख) श्रवण क्षीणता से ग्रस्त किन्तु ऐसी क्षीणता, श्रवण-सहाय/शल्य सुधार के पश्चात्‌ 60 डैसीबल या उससे अधिक न हो

(ग) चलने-फिरने की निःशक्तता से ग्रस्त

(टिप्पणः- कार्यात्मक प्रबल हाथ वाले व्यक्तियों को भी विचारा जा सकता है) :

परन्तु अभ्यर्थी को,-

(i) किसी प्रकार की मानसिक मन्दता अन्तगर््रस्तता की मात्रा और गंभीर मानसिक रोग जैसे खण्डित मनस्कता या विकार ग्रस्त और चिरकालिक मनोविक्षिप्ति नहीं होनी चाहिए,2549 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2016/25 आषाढ़ 1938 (ii) किसी प्रकार के तंन्त्रिकीय अपसामान्यता के विकार जो उच्चतर मानसिक कृत्य/बोध और सार्थक वाणी दोष वाला नहीं होना चाहिएः

परन्तु यह और कि कर्मचारियों के समस्त प्रवर्गों के लिए तैयार की गई चयन सूची तब तक विधिमान्य होगी जब तक आगामी चयन सूची प्रकाशित नहीं हो जाती है।"। 4. नियम 5 के अधीन सारणी का प्रतिस्थापन.--उक्त नियमों के नियम 5 में विद्यमान सारणी के स्थान पर निम्नलिखित सारणी रखी जाएगी, अर्थात्‌ः--

1.	जिला न्यायाधीश/अतिरिक्त जिला न्यायाधीश	प्रतिशत, सिनियर (क) पैंसठ न्यायाधीशों में से सिविल गुणागुण (मैरिट) एवं वरिष्ठता के सिद्वान्त के आधार पर और जैसा उपयुक्तता टैस्ट विनियमों के अनुसार उच्च न्यायालय द्वारा विहित एवं संचालित किया जाए, उत्तीर्ण करने पर, प्रोन्नति द्वारा
		(ख) दस प्रतिशत, सिनियर सिविल गुणागुण न्यायाधीशों में से (मैरिट) के आधार पर सीमित परीक्षा, जैसी कि प्रतियोगी मे ं अनुसार उच्च विनियमों विहित और न्यायालय द्वारा स ं चालित की जाए, के माध्यम से, प्रोन्नति द्वारा यदि पद (पदों) को इस पद्धति के अधीन उपयुक्त अभ्यर्थियों की अप्राप्यता के कारण नहीं भरा तो उसे (उन्हें) जा सके, पद्धति (क) के अधीन नियमित प्रोन्नति द्वारा भरा जाएगा।	सिनियर सिविल न्यायाधीश के संवर्ग में कम से कम पांच वर्ष की सेवा।
		(ग) पच्चीस प्रतिशत, पात्र अधिवक्ताओं में से लिखित परीक्षा के साथ-साथ मौखिक परीक्षा, (वाइवा-वोसि) जैसी कि विनियमों के अनुसार उच्च न्यायालय द्वारा विहित और स चालित की जाए, के आधार ं पर सीधी भर्ती द्वारा	और अर्हताओं, आयु सीमा अनुभव, आदि सहित पात्रता मापदण्ड निम्नलिखित होंगेः- (i) भारत का नागरिक हो, (ii) भारतीय विधि परिषद्‌ द्वारा मान्यता प्राप्त विधि मे ं उपाधि धारक हो, (iii) आवेदनों की प्राप्ति हेतु नियत अंतिम तारीख को बार में अधिवक्ता
			के रुप में विधि व्यवसाय की कम से वर्ष की कम सात अवधि हो। iv) आवेदन की प्राप्ति के ( लिए विहित अंतिम तारीख को 35 वर्ष की आयु प्राप्त कर ली हो और 45 वर्ष की आयु प्राप्त न की हो। ि टप्पण.--इस खण्ड क े प्रयोजन के लिए उस अवधि, जिसके दौरान कोई व्यक्ति अधिवक्ता रहा हो, की संगणना में, वह अवधि भी सम्मिलित होगी जिसके दौरान उसने न्यायिक पद (जुडिशॅल ऑफिस) धारण किया हो। न्यायिक स् पष्टीकरण-I अधिकारी के अन्तर्गत कोई उच्च अन्य पद जिसे न्यायालय द्वारा इस प्रयोजन के लिए बनाए गए विनियमों द्वारा न्यायिक पद के समतुल्य विहित किया गया हो। प्रवर्ग (क), स् पष्टीकरण-II (ग) में से जिला (ख) और न्यायाधीश/ अतिरिक्त जिला न्यायाधीश के संवर्ग उच्च के लिए नियुक्ति न्यायालय द्वारा इस निमित्त अनुरक्षित किए गए पद चौंतीस बिन्दु आधारित अनुसार की रोस्टर के जाएगी। ि टप्पण 1ः सीधी भर्ती में आरक्षण 31 पदों तक की संवर्ग सदस्य संख्या के के लिए मॉडल रोस्टर अनुसार होगा।
			टिप्पण 2ः यदि संवर्ग सदस्य संख्या परिवर्तित होती है तो तत्स्थानी परिवर्तन पद आधारित रोस्टर मे ं किए जांएगे। ि टप्पण 3ः पहले की गई नियुक्ति नए रोस्टर के पुनःस्थापन के कारण प्रभावित नहीं होगी। ः अभ्यर्थी, स् पष्टीकरण III जो किसी सरकारी विभाग या किसी अन्य संगठन में नियोजित है, को अपने -अपने नियोक्ता(ओं) के माध्यम से अपने आवेदन प्रस्तुत करने अपेक्षित हैं।

कः उपरोक्त खण्ड (ख) और (ग) में दर्शाई गई भर्ती की पद्धति (यदि परिस्थितियां अपेक्षित हों, तो वर्ष में दो बार की जाएगी) के माध्यम से प्रोन्नति द्वारा जिला न्यायाधीशों/ अतिरिक्त जिला न्यायाधीशों के संवर्ग में रिक्तियों को भरने के लिए निम्नलिखित समय अनुसूची का अनुसरण किया जाएगाः--

1.	उच्च न्यायालय द्वारा अधिसूचित की जाने वाली रिक्तियों की संख्या, रिक्तियों की संगणना निम्नलिखित सहित की जाएगी- ( क) विद्यमान रिक्तियां; (ख) रिक्तियां, जो सेवानिवृति के कारण, एक वर्ष के भीतर उदभूत होें; (ग) न्यायिक अधिकारियों के अन्य विभागो में प्रतिनियुक्ति पर जाने के कारण भविष्य में उदभूत होने वाली रिक्तियो को अस्थायी रिक्तियॉं माना जा सकेगा; और (घ) न्यायिक अधिकारियों के अन्य विभागों में प्रतिनियुक्ति पर जाने के कारण उद्‌भूत हुई रिक्तियों को अस्थायी रिक्तियां माना जा सकेगा।	31 मार्च	15 नवम्बर
2.	पात्र अभ्यर्थियों से आवेदन आमन्त्रित करने के लिए विज्ञापन	15 अप्रैल	20 नवम्बर
3.	आवेदन प्राप्त करने की अन्तिम तारीख	30 अप्रैल	10 दिसम्बर
4.	पात्र आवेदकों की सूची का प्रकाशन।	15 मई	15 जनवरी
5.	पात्र आवेदकों को प्रवेश पत्रों का प्रेषण/जारी करना।	16 मई से 15 जून	2 फरवरी से 16 फरवरी
6.	लिखित परीक्षा में निम्नलिखित समाविष्ट हो सकेगा-- ( क) बहुविध विकल्प प्रश्नों (मल्टीपल च्वाईस क्वेसचनज) सहित वस्तुपरक प्रश्न (ऑवजेक्टिव क्वेसचनज) जिसकी संवीक्षा कम्पयूटर की सहायता से की जाएगी, और ( ख) प्रातीविक (सबजैकटिव) वर्णनात्मक (नैरेटिव)।	30 जून	7 मार्च
7.	लिखित परीक्षा के परिणाम की घोषणा। ( क) परिणाम को वैबसाईट पर डाला जाएगा और समाचार पत्र में भी प्रकाशित करवाया जाएगा। ( ख) सफर अभ्यर्थियों के लिए उपलब्ध रिक्तियों का 1ः3 का अनुपात बनाए रखा जाएगा।	16 अगस्त	7 अप्रैल
8.	मौखिक परीक्षा	1 से 7 सितम्बर	13 से 20 अप्रैल
9.	अंतिम चयन सूची की घोषणा और नियुक्ति प्राधिकारी को संसूचित करना। ( क) परिणाम को वैबसाईट पर डाला जाएगा और समाचार पत्र में भी प्रकाशित करवाया जाएगा। ( ख) चयन सूची को गुणागुण (मैरिट) के आधार पर प्रकाशित किया जाएगा और अधिसूचित की गई रिक्तियों की संख्या के दो गुणा होगी।	15 सितम्बर	27 अप्रैल
10.	तारीख को समस्त विद्यमान रिक्त पदों के लिए सक्षम प्राधिकारी द्वारा नियुक्ति पत्र का जारी किया जाना।	30 सितम्बर	30 अप्रैल
11.	कार्यग्रहण की अन्तिम तारीख	31 अक्तूबर	11 मई

खः उपरोक्त खण्ड (क) में दर्शित भर्ती की पद्धति (यदि परिस्थितियॉं अपेक्षित हों तो वर्ष में दो बार की जाएगी) के माध्यम से जिला न्यायाधीशों/ अतिरिक्त जिला न्यायाधीशों के संवर्ग में रिक्तियों को भरने के लिए निम्नलिखित समय अनुसूची का अनुसरण किया जाएगाः--

3.	पात्र अधिकारियों की सूची का प्रकाशन।	30 मई	10 दिसम्बर
4.	मौखिक परीक्षा मापदण्ड; ( क) पिछले पांच वर्षों की वार्षिक गोपनीय रिपोर्ट; (ख) प्रस्तुत किए गए अधिनिर्णयों का मूल्यांकन; और (ग) मौखिक साक्षात्कार में प्रदर्शन।	15 मई से 31 जुलाई	1 से 15 जनवरी
5.	अंतिम चयन सूची की घोषणा और नियुक्ति प्राधिकारी की संसूचना। ( क) परिणाम को वैबसाइट पर डाला जा सकेगा और समाचार पत्र में भी प्रकाशित करवाया जा सकेगा। (ख) चयन सूची को गुणागुण के आधार पर प्रकाशित किया जाएगा और अधिसूचित की गई रिक्तियों की संख्या के दो गुणा होगी।	31 अगस्त	2 फरवरी
6.	तारीख को समस्त विद्यमान रिक्त पदों के लिए सक्षम प्राधिकारी द्वारा नियुक्ति पत्र का जारी किया जाना।	30 सितम्बर	7 मार्च
7.	कार्यग्रहण की अंतिम तारीख	31 अक्तूबर	7 अप्रैल

स्पष्टीकरण-I प्रवर्ग (क) (ख) और (ग) में से जिला न्यायाधीशों के संवर्ग के लिए नियुक्तियां, उच्च न्यायालय द्वारा इस निमित्त बनाए रखे जाने वाले 40 बिन्दु रोस्टर के अनुसार की जाएगी।

टिप्पण.--भर्ती की उपरोक्त पद्धति के माध्यम से सिनियर सिविल न्यायाधीश के संवर्ग में रिक्तियों को भरने के लिए (यदि परिस्थितियां अपेक्षित हों तो एक वर्ष में दो बार की जाएगी) निम्नलिखित समय अनुसूची का अनुसरण किया जाएगाः--

टिप्पण Iः नियुक्ति प्राधिकारी, उन परिस्थितियों मे जहां उपरोक्त वांछित अनुभव रखने वाले सिविल न्यायाधीश उपलब्ध न हो तो वहां उपरोक्त न्यूनतम अनुभव मापदण्ड को शिथिल कर सकेगा किन्तु किसी भी दशा में तीन वर्ष से कम के अनुभव के लिए ऐसा शिथिलीकरण नहीं किया जाएगा।

टिप्पण IIः भर्ती की उपरोक्त पद्धति के माध्यम सें सिनियर सिविल न्यायाधीश के संवर्ग में रिक्तियों को भरने के लिए (यदि परिस्थितियां अपेक्षित हों तो एक वर्ष में दो बार की जाएगी) निम्नलिखित अनुसूची का अनुसरण किया जाएगाः--2554 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2016/25 आषाढ़, 1938

3.	सिविल न्यायाधीश	हिमाचल प्रदेश लोक सेवा आयोग द्वारा संचालित की जाने वाली प्रतियोगी परीक्षा लिखित के मौखिक परीक्षा साथ-साथ (वाइवा-वासि) में प्राप्त गुणागुण (मैरिट) के आधार पर सीधी भर्ती द्वारा।	अर्हता और आयु आदि सहित पात्रता का मापदण्ड निम्नलिखित होगा। (1) भारत का नागरिक हो। (2) भारतीय विधिज्ञ परिषद्‌ द्वारा मान्यता प्राप्त विधि की उपाधि रखता हो। (3) आवेदनों को प्राप्त होने की विहित अंतिम तारीख को आयु सीमा न्यूनतम 22 (बाईस)वर्ष और अधिकतम 35 (पैंतीस) वर्ष अनुसूचित जाति/अनुसूचित जनजाति/अन्य ं विहित आरक्षित वर्गों से सम्बन्धित अभ्यर्थियो की दशा मे ं 38 (अड़तीस) वर्ष होगीः
			परन्तु सेवा के लिए सीधी नियुक्तियां, हिमाचल प्रदेश सरकार द्वारा अनुसूचित जाति/ अनुसूचित जनजाति, पिछड़े वर्गों, शारीरिक निःशक्तो के लिए सेवा में आरक्षण ं सम्बन्धित समय-समय पर जारी और उच्च न्यायालय के परामर्श से ऐसी नियुक्तियों को लागू आदेशों के अध्यधीन होगीः परन्तु यह और कि अनूसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों हेतु आरक्षित रोस्टर बिन्दु के विरुद्ध बैकलॉग /अग्रेषित रिक्ति को भरने के लिए तीन भर्ती वर्षों की समयावधि लागू होगी और तृतीय भर्ती वर्ष में किसी विशिष्ट अग्रेषित /बैक लॉग रिक्ति को भरते समय, यह अधिसूचित किया जाएगा कि यदि उस प्रवर्ग से, जिसके लिए पद आरक्षित है, उपयुक्त अभ्यर्थी उपलब्ध नहीं है, तो रिक्ति अनारक्षित समझी जाएगी और अनारक्षित रिक्ति के रुप में भरी जाएगीः परन्तु यह और कि यदि बैकलॉग/ अग्रेषित आरक्षित रिक्ति तृतीय आनुक्रमिक भर्ती वर्ष मे ं अनारक्षित अभ्यर्थी द्वारा भरी जाती है तो ऐसा अभ्यर्थी उस प्रवर्ग, जिसके लिए अग्रेषित भर्ती प्रक्रिया का अनुसरण किया गया था के लिए, आरक्षित रोस्टर बिन्दु का अस्थायी रुप से स्थान लेगा और ऐसा अभ्यर्थी/नियुक्त व्यक्ति आरक्षित रोस्टर बिन्दु को रिक्त करेगा और जैसे ही ऐसी अनारक्षित रिक्ति पद आधारित रोस्टर में उपलब्ध हो जाती है, अनारक्षित रोस्टर बिन्दु का स्थान लेगा और अनारक्षित अभ्यर्थी द्वारा इस प्रकार रिक्त किए गए रोस्टर बिन्दु को ऐसे रोस्टर बिन्दु प्रवर्ग के लिए नियत आरक्षित रिक्ति के रुप में विज्ञापित किया जाएगा।

टिप्पण.--भर्ती की उपरोक्त पद्धति के माध्यम से सिविल न्यायाधीश के संवर्ग में रिक्तियों को भरने के लिए (यदि परिस्थितियां अपेक्षित हों तो एक वर्ष में दो बार की जाएगी) निम्नलिखित समय अनुसूची का अनुसरण किया जाएगा।

2.	पात्र अभ्यर्थियों से आवेदन आमंत्रित करने के लिए विज्ञापन	15 जून	15 दिसम्बर

टिप्पण.--सीधी भर्ती के लिए आवेदन करने वाला प्रत्येक अभ्यर्थी या तो उपरोक्त (ग) में वर्णित पद या 3 में वर्णित पद के लिए आवेदन के साथ, उससे असंबद्ध दो प्रतिष्ठित व्यक्तियों, जो उसके सद्‌व्यवहार के साथ-साथ पूर्ववृत्तों को प्रमाणित करते हो, द्वारा दिए गए प्रमाण पत्र को प्रस्तुत करना होगा2557 राजपत्र, हिमाचल प्रदेश, 16 जुलाई, 2016/25 आषाढ़ 1938 5. नियम 7 का संशोधन.--उक्त नियमों के नियम 7 के उप नियम (2) के स्थान पर निम्नलिखित उप-नियम रखे जाएंगे, अर्थात्‌ः--

"(2) सेवा में प्रवेश के समय उच्चतर अर्हता, जैसे विधि स्नातकोत्तर, रखने वाले चयनित अभ्यर्थियों को तीन अग्रिम वेतन वृद्धियांॅं दी जाएगी।

(3) सेवा के सदस्य का वेतन, जहां आवश्यक हो, समय-समय पर हिमाचल प्रदेश में प्रवृत्त नियमों के उपबन्धों के अधीन नियत किया जाएगा, परन्तु जहां सदस्य की वेतनवृद्धि उसके विभागीय परीक्षा पास करने में असफल रहने पर रोक दी गई है तो वह विहित मानदण्ड द्वारा विभागीय परीक्षा पास करने से पूर्व सेवा में अपनी नियुक्ति से पूर्व उस द्वारा धारण किए गए पद के टाईम वेतनमान में अपनी अधिष्ठायी या स्थानापन्न वेतन में वृद्धि के आधार पर वेतन के पुनः निर्धारण का हकदार नहीं होगा। तथापि, इस अवधि के दौरान उसे समय-समय पर उसका अधिष्ठायी वेतन दिया जा सकेगा यदि वह सेवा मेें उसके स्थानापन्न वेतन से अधिक होता है।"। 6. नियम 14 का संशोधन.--उक्त नियमों के नियम 14 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्‌ः--

"14. अधिवर्षिता की आयु.--सेवा के सदस्य की अधिवर्षिता की आयु 60 (साठ) वर्ष होगीः परन्तु 58 (अठावन) वर्ष पूर्ण होने से पूर्व अधिकारी के सेवा अभिलेख का मूल्यांकन किया जाएगा और सेवा में 60 (साठ) वर्ष की आयु तक उसे रखे रखने के लिए उसकी उपयुक्तता, क्षमता और स्वस्थता अवधारित की जाएगी और यदि वह उपयुक्त और स्वस्थ नहीं पाया जाता है तो उसे 58 (अठावन) वर्ष की आयु परी ही अनिवार्यतः सेवा निवृत कर दिया जाएगा।"।

No. Home-B-B(2)-4/2004-III-Loose.—In continuation of this department Notification No. Home-B-B(2)-4/2004-III-Loose dated 14th June, 2016 and in exercise of the powers conferred by articles 233, 234 and proviso to Article 309 of the Constitution of India read with sub-section (1) of section 4 of the Himachal Pradesh Judicial Officers (Pay, Allowances and Conditions of Service) Act, 2003 (Act No. 10 of 2003) and all other powers enabling him in this behalf, the Governor of Himachal Pradesh, in consultation with the High Court of Himachal Pradesh and Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Judicial Service Rules, 2004, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Judicial Service (2nd Amendment) Rules, 2016. Amendment of rule-3.—be rule-3 of Rule-3 of the Himachal Pradesh Judicial Service Rules, 2004 (hereinafter referred to as the "said rules", for subrule (3), the following sub-rule shall be substituted, namely :—

"(3) With effect from the date of commencement of these rules, the existing cadres specified in column (2) below shall stand designated as the cadres specified in the corresponding entries in column (1) below and they shall accordingly constitute the service:—

(1)	(2)
(a) District Judges/Addl. District Judges.	(i) District & Sessions Judges (ii) Addl. District & Sessions Judges
(b) Senior Civil Judges	(i) Senior Sub Judge -cum- Chief Judicial Magistrates (ii) Addl. Chief Judicial Magistrates
(c) Civil Judges	(i) Sub Judge-cum-J.M.".

3. Amendment of rule-5.—In rule -5 of the said rules, at the end of the Table, the following provision shall be inserted, namely:—

"Reservation for the persons with disability,- 3% reservation to the categories of the Additional District Judges and Civil Judges:—

Reservation shall be provided to the candidates:

(a) suffering from blindness of low vision provided that the disability is not 75% and more,

(b) suffering from hearing impairment, provided that such impairment is not of 60 decibel or more after hearing aid/surgical correction.

(Note: Persons with functional dominant hand can also be considered):

Provided further that the candidate,-

(i) should not have any mental retardation of any degree and major mental illness like Schizophrenia or affective disorder and chronic psychosis,

(ii) should not have any Neurological disorder having impaired higher mental function/cognition and significant speech defect:

Provided further that the Selection list prepared for all categories of officials shall be valid till the next select list is published.".

4. Substitution of Table under rule 5.—In rule 5 of the said rules, for the existing Table, the following Table shall be substituted, namely:—

However, if the post (s) cannot be filled under this mode due to non-availability of suitable candidate (s), the same shall be filled by regular promotion under mode (a). ( c) 25% by direct recruitment, from amongst eligible Advocates, on the basis of examination, written as well as oral (viva voce) test as may be prescribed and conducted by the High Court in accordance with regulations.	M inimum Service of 5 years in the cadre of Senior Civil Judge. T he following shall be the eligibility criteria, including qualifications, age limit and experience etc. ( i) Citizen of India; ( ii) Holder of a degree in Law as recognized by the Bar Council of India. ( iii) Practicing Advocate at the Bar for a minimum period of seven years as on the last date fixed for receipt of the applications. (iv) Must have attained the age of 35 (thirty five) years and must not have attained the age of 45 (forty five) years as on the last date prescribed for receipt of applications. N ote: For the purpose of this clause, in computing the period during which a person has been an Advocate there shall be included any period during which he has held a judicial office.
			Explanation I - Judicial Officer includes any other Office as may be prescribed being equivalent to a Judicial Office, by the High Court in the regulations made for this purpose. E xplanation II – Appointment to the cadre of the District Judges/ Additional District Judges from categories (a), (b) & (c) shall be in accordance with post based 34 point roster to be maintained by the High Court in this behalf. N ote 1: Reservation in direct recruitment shall be as per Model Roster for cadre strength upto 31 posts. N ote 2: In case the cadre strength is changed, the corresponding changes shall be made in post-based roster. N ote 3: The appointment already made shall not be affected on account of introduction of new roster. E xplanation (III): The candidates who are employed in any Government department or in any other Organization are required to submit their application(s) through their respective employer(s).

3.	Civil Judges	By direct recruitment on the basis of merit obtained in the competitive examination, written as well as oral (viva voce) tests to be conducted by the H.P. Public Service Commission.	The following shall be the eligibility criteria including qualification and age etc:- (1) Citizen of India (2) Holder of Degree in Law as recognized by the Bar Council of India.
			(3) Age limit, minimum 22 years and Maximum 35 years and 38 years in cases of candidates belonging to Scheduled Caste/Scheduled Tribe/other prescribed reserved categories as on the last date prescribed for receipt of application. Provided that the direct appointments to the service shall be subject to the orders regarding reservation in the service for SC, ST, Backward Classes, Physically disabled issued by the Himachal Pradesh Govt., from time to time, and made applicable to such appointments, in consultation with the High Court. Provided further that a time cap of three recruitment years shall apply for filing up of backlog/carry forward vacancy against reserved roster point for Schedule Castes/Schedule Tribes/ Other Backward Classes and while doing so in the 3rd recruitment year to fill up a particular carry forward/backlog vacancy, it shall be notified that in case suitable candidate from the category to which the post is reserved is not available then the vacancy will be treated as un-reserved and filled in as unreserved vacancy. Provided further that if backlog/carry forward reserved vacancy is filled by un-reserved candidate in the 3rd successive recruitment year, such candidate shall temporarily occupy the roster point reserved for the category for which carry forward recruitment process was followed and such candidate/appointee shall vacate the reserved roster point and
			occupy the un-reserved roster point as soon as such unreserved vacancy is available in the post based roster and that the roster point so vacated by un-reserved candidate shall be advertised as reserved vacancy meant for such roster point category.

Note.—Every candidate applying for direct recruitment, either for the post mentioned in (c) or post mentioned at 3 above shall submit alongwith the application, certificate furnished by two respectable persons un-connected with him, testifying to his character good behavior as well as antecedents.

5. Amendment of rule 7.—In rule-7 of the said rules, for sub-rule (2), the following subrules shall be substituted, namely :—

"(2) The selected candidates having a higher qualification like Post Graduation in Law at the time of entry in service shall be given three advance increments.

(3) The pay of the member of the service shall be fixed where necessary under the provision of the rules in force in Himachal Pradesh, from time to time, provided that where the increment of a member is withheld for his failure to pass the departmental examination, he shall not be entitled before he passes the departmental examination by the prescribed standard, to the re-fixation of pay on the basis of enhancement in his substantive or officiating pay the time scale of the post held by him prior to his appointment to the service. However, during this period he may be allowed his substantive pay from time to time if the same happens to be more than his officiating pay in the service.".

6. Amendment of rule 14.—For rule-14 of the said rules, the rule shall be substituted, namely:—

"14. Age of superannuation.—The age of superannuation of a member of the service shall be 60 (sixty) years.

Provided that before the completion of 58 (fifty eight) years, service record of the officer will be evaluated and his suitability, potential and fitness for being retained in service upto the age of 60 (sixty) years shall be determined and in case he is not found suitable and fit, he shall be compulsorily retired at the age of 58 (fifty eight) years.".

No. TPT-F (l )-2/2001-III .—An Agreement between the States of Himachal Pradesh and Uttarakhand is proposed to be entered with respect to operations of Stage Carriage vehicles (buses) by the operators of one state into the territory of the other state as required under Sub Section (5) of Section 88 of the Motor Vehicles Act, 1988.

Now, therefore, in fulfillment of the requirements of the sub-section 5 of Section 85 o1 the Motor Vehicle Act, 1988, a notice as in Annexure-A herewith is published for the information of the persons likely to be affected thereby.
