No. TPT-F (1)-3/2015-I.—In continuation of this department Notification No. Tpt-F(1)- 3/2015 dated 20.02.2016, the Governor, Himachal Pradesh pursuance of the powers conferred under clause (iii) of proviso to sub rule (1) of rule 108 of the Central Motor Vehicle Rules, 1989 78-राजपत्र/2016-21-07-2016 (2905) 2906 राजपत्र, हिमाचल प्रदेश, 21 जुलाई, 2016/30 आषाढ़, 1938 and all other powers enabling him in this behalf, is pleased to allow to use "Blue Light without Flasher" upon top front of the official vehicle of DFO Flying Squad within his jurisdiction. This notification will be effective from the date of publication in H.P. Rajpatra.

संख्याःएम0पी0पी0-ए(3)-2/2013-I.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश विद्युत वितरण प्रबन्धन उत्तरदायित्व अधिनियम, 2014 (2015 का अधिनियम संख्यांक 5) की धारा 12 धारा 180 द्वारा प्रदत्त शक्तियों का प्रयागे करते हुए, अधिनियम के उपबन्धों को कार्यान्वित करने के लिए हिमाचल प्रदेश विद्युत वितरण प्रबन्धन उत्तरदायित्व अधिनियम, 2016 बनाते है;ं अर्थात्‌ः-

1 ़ संक्षिप्त नाम और प्रारंभ--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश विद्युत वितरण प्रबन्धन उत्तरदायित्व अधिनियम, 2016 है।

2. ये नियम राजपत्र, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत होंगे।

2. परिभाषाए.ं--(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से हिमाचल प्रदेश विद्युत वितरण प्रबन्धन उत्तरदायित्व अधिनियम, 2014 (2015 का अधिनियम संख्यांक 5) अभिप्रेत है;

(ख) "राज्य विद्युत वितरण प्रबन्धन कथन (स्टेटमेन्ट)" से वह कथन (स्टेटमेन्ट) अभिप्रेत है जो आगामी वित्तीय वर्ष के लिए प्रमुख निष्पादन सकेंतकों को प्राप्त करने हेतु राज्य सरकार की पॉलिसियां और युक्तियां अधिकथित करती है; और

(ग) "प्ररूप" से इन नियमों में सलंग्न प्ररूप अभिप्रेत हैं।

(2) उन शब्दों और पदाें के जो इन नियमों में प्रयुक्त है किन्तु परिभाषित नहीं हैं वहीं अर्थ होंगे जो अधिनियम या वित्तीय पुनर्गठन योजना या विद्युत अधिनियम, 2003 और तद्‌धीन बनाए गए नियमों और विनियमों में उनके हैं।

3. राज्य विद्युत वितरण प्रबन्धन कथन (स्टेटमेन्ट).--राज्य वितरण अनुज्ञप्तिधारी प्रत्येक तिमाही के अवसान के पश्चात्‌ साठ दिन के भीतर वितरण प्रवन्धन कथन (स्टेटमेन्ट) के अनुसार प्ररूप में अपेक्षित सूचना तैयार करेगा और उसे प्रस्तुत करेगा ।

4. राज्य वितरण अनुज्ञप्तिधारी द्वारा किए गए उपाय.--राज्य वितरण अनुज्ञप्तिधारी, अधिनियम की धारा 4, 5, 6 और 8 की अपेक्षाआें के अनुसार धारणीयता को प्राप्त करने और आवश्यक लेखा उपायों की दीर्घकालीक योजना के लिए समस्त आवश्यक उपाय करेगा।2907 राजपत्र, हिमाचल प्रदेश, 21 जुलाई, 2016/30 आषाढ़ 1938 प्ररूप

Shimla-2, the 18th July, 2016

No. MPP-A(3)-2/2013-I.—In exercise of the powers conferred by section 12 of the Himachal Pradesh Electricity Distribution Management Responsibility Act, 2014 (Act. No 5 of 2015), the Governor of Himachal Pradesh is pleased to make the Himachal Pradesh Electricity Distribution Management Responsibility Rules, 2016 for carrying out the provisions of the Act, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Electricity Distribution Management Responsibility Rules, 2016.

(2) They shall come into force on the date of their publication in the Rajpatra, Himachal Pradesh.

2. Definitions.—(1) In these rules, unless the context otherwise requires;

(a) "Act" means the Himachal Pradesh Electricity Distribution Management Responsibility Act, 2014 ( Act No. 5 of 2015);

(b) "State Electricity Distribution Management Statement" means a statement which lays down the policies and strategies of the State Government for achieving the Key Performance Indicators for the ensuing year; and

(c) "form" means the form appended to these rules.

(2) The words and expressions used herein but not defined in these rules shall have the meanings assigned thereto under the Act or the Financial Restructuring Plan or the Electricity Act, 2003, and rules and regulations made there under.

3. State Electricity Distribution Management Statement.—State Distribution Licensee shall prepare and submit information required as per the Distribution Management Statement in form within sixty days after end of each quarter.

4. Measures to be taken by State Distribution Licensee.— State Distribution Licensee shall take all the necessary measures for long term planning to achieve sustainability and the necessary accounting measures as per requirements of sections 4,5, 6 and 8 of the Act.
