संख्या श्रम (ए) 7-7/2016.--हिमाचल प्रदेश के राज्यपाल, कारखाना अधिनियम 1948 (1948 का अधिनियम संख्यांक 63) की धारा 115 के साथ पठित धारा 112 द्वारा प्रदा शक्तियों का प्रयोग करते हुए, उद्योग विभाग की अधिसूचना संख्याः डी 80-12/48-III तारीख 6-5-1952 द्वारा अधिसूचित हिमाचल प्रदेश 79-राजपत्र/2016-22-07-2016 (2921) 2922 राजपत्र, हिमाचल प्रदेश, 22 जुलाई, 2016/31 आषाढ़, 1938 फैक्टरिज़ रूल्ज, 1950 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इन्हें जन साधारण की सूचना हेतू राजपत्र, हिमाचल प्रदेश में एतद द्वारा प्रकाशित किया जाता है, इन प्रारूप नियमों से सम्भाव्य प्रभावित होने वाले किसी व्यक्ति के इन नियमो की बावत यदि कोई आक्षेप या सुझाव है/हैं तो वह उसे/उन्हें प्रारुप नियमों के राजपत्र हिमाचल प्रदेश मे प्रकाशन की तारीख से 45 दिन के भीतर प्रधान सचिव (श्रम एवं रोजगार) हिमाचल प्रदेश सरकार को भेज सकेगा;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप या सुझाव, यदि कोई है/हाें, पर इन प्रारूप नियमों को अन्तिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश फैक्टरिज (अमैडमैंट) रूल्ज, 2016 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश मे प्रकाशन की तारीख से प्रवृत होंगे।

2. नियम 5 का संशोधन.--हिमाचल प्रदेश फैक्टरिज रूल्ज, 1950 (जिन्हें इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 5 में;

(क) उप-नियम (1) में "or five years" शब्दों के पश्चात्‌ "or ten years" शब्द अंतःस्थापित किए जाएंगे;

(ख) उप-नियम (2) में "five years, the license fee shall be five times" शब्दों और चिन्ह के स्थान पर "five years or ten years, the licence fee shall be five times or ten times, as the case may be" शब्द और चिन्ह रखे जाएगे।; और

(ग) उप-नियम (3) में "or five years" शब्दों के पश्चात्‌ "or ten years" शब्द अंतःस्थापित किए जाएंगे।

3. नियम 7 का संशोधन.--उक्त नियमों के नियम 7 में;

(क) उप-नियम (2) में, "or five years" शब्दों के पश्चात "or ten years" शब्द अतःस्थापित किए जाएंगे;

(ख) उप-नियम (3) में, "made for five years, the renewal fee shall be five times" शब्दों और चिन्ह के स्थान पर "made for five years or ten years, the renewal fee shall be five times or ten times, as the case may be" शब्द और चिन्ह रखे जाएंगे; और

(ग) उप-नियम (3) के परन्तुक में, "or five years" शब्दों के पश्चात्‌ " or ten years" शब्द अतःस्थापित किए जाएंगे।

Shimla-171002, the 18th July, 2016

No. Shram(A)7-7/2016.—In exercise of the powers conferred by section 112 read with section 115 of theFactories Act, 1948, (Act No. 63 of 1948), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Factories Rules 1950 notified vide Industries Department Notification No. D. 80-12-48.III dated 6th May, 1952 and the same are hereby published in the Rajpatra, Himachal Pradesh for general information of the public;

If any person likely to be affected by the draft rules has any objection(s) or suggestion(s) in respect of these rules, he may send the same to the Principal Secretary (L&E) to the Government of H.P., Shimla-2, within 45 days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh;

Objection(s) or suggestion(s), if any, received within the period specified above, shall be considered by the State Government before finalising the draft rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Factories (Amendment) Rules, 2016.

(2) They shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of rule 5.—In rule 5 of the Himachal Pradesh Factories Rules, 1950 (hereafter referred to as the said rules),

(a) in sub-rule (1), after the words "or five years", the words "or ten years" shall be inserted;

(b) in sub-rule (2) for the words and sign "five years, the licence fee shall be five times" the words and signs "five years or ten years, the licence fee shall be five times or ten times, as the case may be," shall be substituted; and

(c) in sub-rule (3), after the words "or five years", the words "or ten years" shall be inserted.

3. Amendment of rule 7.—(a) in sub-rule (2), after the words "or five years", the words "or ten years" shall be inserted;

(b) in sub-rule (3), for the words and sign "made for five years, the renewal fee shall be five times", the words and signs "made for five years or ten years, the renewal fee shall be five times or ten times, as the case may be," shall be substituted; and

(c) in the proviso to sub-rule(3), after the words "or five years", the words "or ten years" shall be inserted.

The scheme is aimed at bringing the newly merged areas or the newly constituted ULBs to equivalent standards of civic amenities and livelihood opportunities to that of existing urban areas/ ULBs.

ANNEXURE-A LAL BAHADUR SHASTRI KAMGAR EVAM SHAHRI AJIVIKA YOJNA LAKSHAY 1. NEED: In order to provide advanced urban facilities, civic amenitiesand livelihood opportunity to the people of those areas that are assuming urban characteristics, state government is fulfilling the demands and aspirations of the people by including urbanized rural areas in to urban local bodies or constituting new urban local bodies in the state. Since people of newly merged areas have opted for urban facilities the need has been felt to launch a new scheme to come up to the aspirations of the people coming into urban fold with a desire of improved living standards by way of advanced civic amenities and better livelihood opportunities.

2. OBJECTIVE: This scheme is aimed at bringing the newly merged areas or the newly constituted ULBs to equivalent standards of civic amenities and livelihood opportunities to that of existing urban areas/ULBs. While doing so, this scheme would also ensure that the people of newly merged areas on the one hand are provided with advanced civic amenities and better livelihood opportunities, on the other,they keep getting the facilities and livelihood opportunities available to them while in rural fold such as waged labour under MNREGA and they are not placed at the disadvantage in terms of facilities or livelihood in any manner.

3. AIM:

i. To make provision of quality urban infrastructure and basic civic amenities in the merged areas

ii. To continue providing wage labour to MNREGA job card holders for the time being and gradually shifting these families towards decent skilled livelihood opportunities.

iii. To encourage and facilitate poor households engaged in waged labour jobs to set up their own enterprises by imparting skill training, subsidy linked credit and entrepreneurship trainings.

iv. To provide decent housing facilities

4. DURATION: This scheme aims at bringing all merged areas at par with already existing urban areas with respect to basic infrastructure, civic amenities and livelihood opportunities within a period of three years. So the duration of this scheme in merged areas would be three years.

i. Basic infrastructure development: This scheme aims at providing high class basic infrastructure to provide basic civic amenities to the people of merged areas such as improved roads, walkways, streets, storm water drains, parks/gardens, children parks.

ii. Sanitation: Sanitation is the basic civic amenity that has to be necessarily provided to the people of urban areas. This component shall also be covered under this scheme and it would include road/street sweeping, drains clearing/cleaning, muck and debris clearance etc.

iii. Waged labour. Since the poor people of the merged areas have the facilities of waged labour of 100 days in a year under MNREGA scheme applicable in rural areas only, this scheme would address the concern of the poor people who used to take waged employment under MNREGA. Hence only those people who are job card holders while the area was merged into the ULB or created a new ULB (i.e. during 2015-16) shall be eligible for wage labour under this scheme. These job card holders shall be given first preference for fulfilling the requirement of waged labour for the execution of civil or sanitation works under this scheme. The list of job card holders shall be revised every year and it would be based upon demand.

6. FINANCING:

i. GRANT ADMISSIBLE: Rs 10 lakhs shall be provided to each newly created ward of Municipal Corporation and each newly created Nagar Panchayat.

ii. MATERIAL - WAGE RATIO: Out of this special grant, 70% shall be spenton

the wages whereas 30% shall be spent on material component of the works. The

70:30 material wage ratio shall be maintained at the ward level and not

necessarily for the individual work.

iii. CONVERGENCE: In case the cost of material required for one particular work or for all the works taken together in the ward is more than 30% then material over and above the 30% can be provided through the convergence with other development schemes such as MPLAD, MLALAD, State finance commission grants, 14th Finance Commission grants, maintenance of ULB roads, or any other central or state scheme.

7. IMPLEMENTATION:

i. REGISTRATION OF JOB (Wage Labour) SEEKERS: All Job card holders under MNREGA scheme shall be registered as job seekers immediately after the new NP comes into existence or new ward is created in Municipal Corporation after the merger of new areas.

ii. REVISION OF LIST OF JOB SEEKERS: All people desirous of waged labour shall have to apply and register every year afresh to enable MC prepare annual wage plan. All desirous of wage employment shall apply by 31st December for the next financial year.

iii. Demand for the Job (Wage labour): Any enrolled person desirous of wage labour shall apply to the person/official designated by MC/NP for the purpose or the ward councillor concerned whenever he/she is in need of the job.

iv. PREPARATION OF ANNUAL WARD DEVELOPMENT PLAN: The annual plan for the execution of infrastructure and sanitation works under the scheme shall be prepared as per the priorities of the people in ward sabha by February end. Ward sabha for the purpose shall be convened and conducted for the purpose of planning under LAKSHAY scheme as per the provision of the HP Municipal Act 1994.

Ward level annual development plan under this scheme shall be prepared in such a manner that Rs 7 lakh is spent on labour component whereas Rs 3 Lakhs is spent on material component. vi. In case the material demand is more than Rs 3 Lakhs, the funds over and above three lakhs shall be arranged by MC through convergence as explained above.

vii. The MC/NP shall ensure that the annual development plan under this scheme is ready by 15th January and all codal formalities for the initiation of the work are completed by 31st March so as to start the development works in first week of April. viii. The enrolled job seekers shall be given priority for wage labour in implementation of the works under this scheme. ix. EXECUTION OF WORKS

a. All works in the municipal areas are executed through civil works contracts so it would be mandatory for the contractors to employ only enrolled waged labourers for the execution of works under this scheme.

b. Alternately the SHGs of the empaneled job card holders shall be eligible to execute the works under this scheme and there would be no need of tendering of works if they are awarded to SHGs formed under NULM scheme.

8. PROVISION OF SKILLED LIVELIHOOD:—This scheme aims at enhancing livelihood opportunities for the poor and disadvantaged people besides making provision of basic civic amenities in merged areas. Hence following strategy shall be followed to enhance livelihood opportunities of the poor families.

i. All poor families shall be organised into the SHGs under the NULM ii. All poor families especially the people engaged in wage labour jobs shall be made fully aware of the skill development programme under NULM and all family members of these families who are desirous of skill training or the skill up gradation in the trade of their choice shall be provided skill training. Rs 18000/ per person shall be spent on their skill training as per NULM norms.

iii. All job card holders/enrolled wage labourers or their family members who successfully undergo skill training in the trade of their choice shall be given the benefit of subsidised credit under National Urban Livelihood Mission to enable them start their own self-employment ventures

iv. The aim of this scheme is to ensure that all poor families are not only dependant on the waged labour but they have decent livelihood facilities by the end of 3 years.

9. PROVISION OF DECENT HOUSING:—While making the provision for decent and sustainable livelihood, this scheme aims at enhancement of quality of the life of poor and disadvantaged people residing in the merged areas. Hence the MC shall prepare the Housing plan of action as well and it shall form part of the annual development plan under this scheme. It shall be ensured that all poor families residing in the merged areas have decent housing facility within the duration of this scheme i.e. 3 years.
