Shimla-171002, the 18th August, 2016

No.EDN-A-Kha(2)23/2013-L-II.—Whereas the services of the 80 Lecturers (College Cadre), now Assistant Professors, were regularised in the pay scale of Rs.15,600- 39,100+6,000(GP) with effect from 1st June 2014 vide this department notification No. EDN-A- Kha(2)23/2013 dated 14th July 2014 and 28th July 2014 and a COPC No.307 of 2014 has been 101-राजपत्र/2016-20-08-2016 (3621) 3622 राजपत्र, हिमाचल प्रदेश, 20 अगस्त, 2016/29 श्रावण, 1938 filed against the order of respondent. The matter was examined in detail and it was found that in view of the judgment of the Hon'ble High Court in CWP No.2336/2009, the services of these Lecturers (College Cadre) (Annexure-A) could not have been regularized.

2. Whereas the Competent Authority having carefully considered the entire matter, came to the conclusion that the orders of regularization need to be withdrawn and a show cause notice was issued in their favour on 18th April, 2016. All the said Assistant Professors submitted their replies except Sr. No. 11 and 12. Both the candidates filed an OA No.1939/2016 titled Parmoj Sharma & ors vs State of H.P. against the said show cause notice in which the Hon'ble HPSAT directed to maintain status qua till further orders. The case was examined and found that the matter of Candidates at Sr. No. 11 and 12 is different from others, as they were not appointed on contract basis as per the old contract policy under which others were appointed. Their services were taken over from the erstwhile privately managed college Sujanpur.

3. In view of the above, therefore, the Competent Authority come to the conclusion that the services of these Assistant Professors were regularised wrongly and found fit to withdraw the regularization orders of these Assistant Professors (College Cadre) except Sr. No. 11 and 12 with immediate effect and also decided that they be allowed to continue as Contract Appointees (College Cadre) on the same terms and conditions as were applicable to them prior to their regularisation.

4. All the concerned be informed accordingly.

No. EXN-F(10)-20/2014-Loose.—In exercise of the powers conferred by section 10 of the Himachal Pradesh Value Added Tax Act, 2005(Act No.12 of 2005), the Governor of Himachal Pradesh, proposes to make the following amendment in Part-II of SCHEDULE-'A' appended to the Act ibid and the same is hereby published in the Rajpatra, Himachal Pradesh for the information of general public;

If any interested person likely to be affected thereby has any objection(s) or suggestion(s) with regard to the proposed amendments, he may send the same to the Excise and Taxation Commissioner, Himachal Pradesh, Shimla-171009 within a period of 10 days from the date of its publication in the Rajpatra, Himachal Pradesh;

Objection(s) or suggestion(s), if any, received within the above stipulated period, shall be taken into consideration by the Government before finalizing the same, namely:—

उपरोक्त मुकद्दमा उनवान वाला में श्री ज्योति लाल पुत्र गुरमेल सिंह, जात जट, गांव लमलैहडी, डा0 लमलैहडी, तहसील ऊना, जिला ऊना (हि0 प्र0) ने इस न्यायालय में प्रार्थना-पत्र प्रस्तुत किया हे कि उसका विवाह दिनांक 07-10-2014 को श्रीमती रजनी पुत्री श्री गोरख, गांव खुरवाई, डा0 खुरवाई, तहसील बंगाणा, जिला ऊना, (हि0 प्र0) के साथ हुआ है। लेकिन अज्ञानता के कारण अपने विवाह का इन्द्राज स्थानीय रजिस्ट्रार विवाह पंजीकरण, लमलैहडी, तहसील ऊना (हि0 प्र0) में न करवा सका।

अतः इस सन्दर्भ में आम जनता को सूचित किया जाता है कि उपरोक्त वर्णित के विवाह का इन्द्राज रजिस्ट्रार विवाह स्थानीय पंजीकरण लमलैहडी, तहसील ऊना, जिला ऊना (हि0 प्र0) में दर्ज करवाने बारे किसी को एतराज हो तो वह दिनांक 26-08-2016 को इस न्यायालय में उपस्थित होकर प्रस्तुत कर सकता है, अन्यथा इसके बाद उक्त वर्णित विवाह के पंजीकरण हेतु आगामी कार्यावाही अमल में लाई जायेगी। इसके बाद कोई भी एतराज काबले समायत न होगा।
