संंंख्याः टी0पी0टी0-ए (3)-7/2015.--हिमाचल प्रदेश के राज्यपाल, केन्द्रीय मोटर यान नियम, 1989 के नियम 118 के उप नियम (2) द्वारा प्रदन्त शक्तियों का प्रयोग करते हुए, समय-समय पर यथा संशोधित ए0आई0एस0ः 018/2001 मानक के अनुरूप, अधिकतम 80 किलोमीटर प्रति घण्टा पूर्व नियत गति वाले समस्त प्रकार के परिवहन यानों में या तो विनिर्माण प्रक्रम में या डीलरशिप स्तर पर निम्नलिखित शर्तों के अघ्यधीन, 116-राजपत्र/2016-8-09-2016 (4313) 4314 राजपत्र, हिमाचल प्रदेश, 8 सितम्बर, 2016/17 भाद्रपद, 1938 गति नियन्त्रक उपकरण (गति सीमित करने का उपकरण या गति सीमित की क्रियाविधि) एतदद्वारा अधिसुचित करते है, अर्थातः-

1. हिमाचल प्रदेश में, किसी भी परिवहन यान के एजिस्ट्रीकरण एवं अनुज्ञापन प्राधिकारी (आर0एल0ए0) या क्षेत्रीय परिवहन अधिकारी (आर0टी0ओ0) द्वारा तब तक एजिस्ट्रीकृत नहीं किया जाएगा जब तक कि उसमें केन्द्रीय मोटर यान नियम, 1989 के नियम 118 की उपेक्षा की अनुपालन में गति नियन्त्रक न लगाया गया हो;

2. वे परिवहन यान जो प्रथम अक्तूबर, 2015 से पूर्व रजिस्ट्रीकृत हैं और जिनमें गति नियन्त्रक नहीं लगाए गए है, में 31 दिसम्बर, 2016 से पूर्व, यथास्थिति, पूर्व नियत 80 किलोमीटर प्रतिधण्टा या 60 किलोमीटर प्रति धण्टा की गति वाले गति नियन्त्रक लगाने हाेंगे, ऐसा न होने पर उपयुक्तता प्रमाण-पत्र जारी/नवीकृत नहीं किया जाएगा।

3. यानों के निम्नलिखित प्रवर्गों में 60 किलामीटर प्रतिघण्टा की अधिकतम गति वाला गति नियन्त्रक लगाना होगा :-

(क) परिसंकटमय माल वाहक यान;

(ख) डम्परज;

(ग) टैैंंकरज;

(घ) स्कूूल बसेेंं;

4. यानों के निम्नलिखित प्रवर्गो में 80 किलोमीटर प्रतिधण्टा की अधिकतम गति वाला गति नियन्त्रक लगाना होगा :-

(क) मंजिली गाडियां;

(ख) चालक सीट के अतिरिक्त आठ यात्रियों से अधिक सीट क्षमता वाले एम 1, एम 2 और एम 3 तथा 3500 किलाग्राम से अधिक सकल भार वाली संविदा गाडियां;

(ग) चालक सीट के अतिरिक्त आठ यात्रियों से अधिक सीट क्षमता और 3500 किलोग्राम से अधिक सकल भार वाली मैक्सी कैब्ज;

(घ) प्राईवेट सेवा यान (परिवहन);

(ङ) बसें (ओमनी बसिज) (परिवहन);

(च) मोटर यान अधिनियम, 1988 (ए0 आई0 टी0 ओ0 बी0 एस0) की धारा 88 की उपधारा (9) के अधीन जारी अनुज्ञा पत्रों के अन्तर्गत आने वाले पर्यटक यान 81 सीट क्षमता से अधिक तथा 3500 किलोग्राम से अधिक सकल भार वाली मैक्सी कैब्ज;

(छ) तिपहिया माल गाडी (गुडज कैरिज) के सिवाय माल यान; और

(ज) नियम 126 के विनिर्दिष्ट किसी परीक्षण अभिकरण द्वारा सत्यापित और प्रमाणित अधिकतम निर्धारित गति 80 किलोमीटर प्रतिधण्टा से अनधिक। इसमें यथा उपबंधित के सिवाय, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 41 की उपधारा (4) के अधीन केन्द्रीय सरकार द्वारा अधिसूचित और प्रथम अक्तूबर, 2015 को या उसके पश्चात विनिर्मित प्रत्येक परिवहन यान में4315 राजपत्र, हिमाचल प्रदेश, 8 सितम्बर, 2016/17 भाद्रपद, 1938 यान विनिर्माता द्वारा या तो विनिर्माण प्रक्रम में या डीलरशिप स्तर पर समय-समय पर यथा संशोधित ए0आई0एस0ः 018/2001 मानक के अनुरूप अधिकतम 80 किलामीटर प्रतिधण्टा पूर्व नियम गति वाला गति नियन्त्रक (गति सीमित करने का उपकरण या गति सीमित करने की क्रियाविधि) लगाना होगा;

परन्तु वे परिवहन यान जो, -

(क) दो पहिया;

(ख) तिपहिया;

(ग) चौपहिया साइकिलय

(घ) यात्रियों और उनके सामान के लिए उपयोग में लाए गए चारपहिया, जिनकी बैठने की क्षमता चालक सीट (एम 1 प्रवर्ग) के अतिरिक्त आठ यात्रियों से अधिक नहीं है और जिस यान का सकल भार 3500 किलोग्राम से अधिक नहीं है;

(ङ) अग्निशामक;

(च) एम्बुलैसिंज;

(छ) पुलिस यान;

(ज) नियम 126 में विनिर्दिष्ट किसी परीक्षण अभिकरण द्वारा सत्यापित और प्रमाणीकृत अधिकतम निर्धारित गति 80 किलोमीटर प्रतिधण्टा से अनधिक, को गति नियन्त्रक (गति सीमित करने का उपकरण या गति सीमित करने की क्रिया) लगाना आपेक्षित नहीं होगा;

परन्तु यह और कि प्रथम अक्तूबर, 2015 को या असके पश्चात्‌ विनिर्मित परिवहन यान जैसे डम्परज, टैंकरज, स्कूल बसें जो परिसंकटमय माल का वहन करते है या यानों का कोई अन्य प्रवर्ग, जो समय-समय पर केन्द्रीय सरकार द्वारा राजपत्र में प्रकाशित अधिसूचना द्वारा विनिर्दिष्ट करें, में यान विनिर्माता द्वारा या तो विनिर्माण प्रक्रम में या डीलरशिप स्तर पर समय-समय पर यथा संशोधित ए0आई0एस0ः 018/2001 मानक के अनुरूप अधिकतम 60 किलोमीटर प्रतिघण्टा पूर्व नियत गति वाला गति नियन्त्रक (गति सीमित करने का उपकरण या गति सीमित करने की क्रिया विधि) लगाना होगा;

5. किसी विनिर्माता, जिसके पास केन्द्रीय मोटर यान नियम, 1989 के नियम 126 के अधीन यथा उपबंधित किसी सर्वोच्च अभिकरण से प्रकार (टाइप) अनुमोदित प्रमाण पत्र (टी0ए0सी0) है, को परिवहन विभाग द्वारा दस्तावेजों के परीक्षण और सत्यापन के अध्यधीन गति नियन्त्रक लगाने के लिए प्राधिकृत किया जाएगा। इसके अतिरिक्त विनिर्माता सम्पूर्ण राज्य में व्यौहारी नेटवर्क स्थापित करेगा और विक्रय और विक्रय पश्च सेवा उपलब्ध करवाएगा;

6. गति नियन्त्रक समय-समय पर यथा संशोधित ए0आई0एस0 ः 018/2001 मानकाें के अनुरूप होगा;

7. उन परिवहन यानों जिन में गति नियन्त्रक लगे हुए हैं, को परिवहन विभाग के सम्बद्व पंजीयन एवं अनुज्ञापन प्राधिकारी /क्षेत्रीय परिवहन अधिकारी से मुहर सहित, गति नियन्त्रक की नियन्त्रण यूनिट को सील करवाना अपेक्षित होगा। इसके अतिरिक्त यदि परिवहन यान में कोई इलैक्ट्रोनिक गति नियन्त्रक लगा हुआ है तो उसे सील करवाना अपेक्षित नहीं होगा;

4316 राजपत्र, हिमाचल प्रदेश, 8 सितम्बर, 2016/17 भाद्रपद, 1938 8. गति नियन्त्रक का विनिर्माता/व्यौहारी परिवहन यान में नियन्त्रक लगाते समय गति नियन्त्रक पर, यान का रजिस्ट्रीकरण चिन्ह भी समुद्रभृत/उत्कीर्ण करेगा ताकि किसी अन्य यान के लिए इसका प्रयोग न किया जा सके;

9. गति नियन्त्रक की न्यूनतम वारण्टी अवधि विक्रय और विनिर्माण की तारीख से बारह मास होगी। विनिर्माता/प्राधिकृत व्यौहारी गति नियन्त्रक/उसके स्पेयर पाटर्स की उपलब्धता सुनिश्चित करेगा। विनिर्माता/ प्राधिकृत व्यौहारी कम्पनी के होलाग्राम सहित प्रतिष्ठापन प्रमाण-पत्र जारी करेगा और सम्बद्व पंजीयन एवं अनुज्ञापन प्राधिकारी/क्षेत्रीय परिवहन अधिकारी को प्रत्येक मास की दस तारीख से पूर्व मासिक रिर्पोट प्रस्तुत करेगा;

10. सम्बद्व रजिस्ट्रीकरण प्राधिकारी गति नियन्त्रक से युक्त प्रत्येक यान का अभिलेख (रिकार्ड) अनुरक्षित करेगा और परिवहन आयुक्त को मासिक रिपोर्ट भेजेगा;

11. यान का चालक और स्वामी यह सुनिश्चित करेगा कि गति नियन्त्रक की मरम्मत और रख-रखाव प्राधिकृत कर्मशाला में ही किया जाए ;

12. प्रिवहन यान का चालक और स्वामी सम्बद्व रजिस्ट्रीकरण प्राधिकारी की अनुज्ञा के बिना परिवहन विभाग की आधिकारिक मुहर/ प्राधिकारिक मुद्रा से छेड़-छाड़ नहीं करेगा। यदि किसी समय पर यह पाया जाता है कि गति नियन्त्रक की मुहर के साथ छेड़-छाड़ की गई है तो ऐसी स्थिति में स्वामी इसके लिए दायी होगा और इस दशा में सक्षम प्राधिकारी मामले की रिपोर्ट सम्बद्व पंजीयन एवं अनुज्ञापन प्राधिकारी/ क्षेत्रीय परिवहन प्राधिकारी को करेगा जो अधिनियम के उपबंधों के अनुसार यान के अनुज्ञापत्र के रद्‌दकरण या निलम्बन के लिए कार्यवाहियां आरम्भ करेगा;

13. गति नियन्त्रक विद्यमान होते हुए यदि सक्षम प्राधिकारी के पास यह विश्वास कारण है कि यान विहित गति से अधिक गति से चलाया जा रहा है तो वह चालक या स्वामी को यान को सम्बद्व पंजीयन एवं अनुज्ञापन प्राधिकारी /क्षेत्रीय परिवहन अधिकारी के समक्ष परीक्षण/ निरीक्षण हेतु ले जाने के लिए, लिखित में निदेश दे सकेगा। यदि ऐसा परीक्षण और निरीक्षण करने पर इससे छेड़-छाड़ की गई पाई जाती है तो इस अधिसूचना की शर्त संख्या 12 के अनुसार कार्यवाई की जा सकेगी। यदि कोई छेड-छाड की गई नहीं पाई जाती है, परन्तु मशीन में खराबी पाई जाती है तो यान के स्वामी को किसी प्राधिकृत व्यौहारी से गति नियन्त्रक को बदलने या उसकी मरम्मत करवाने का निर्देश दिया जाएगा।

NOTIFICATION

Shimla-2, the 7th September, 2016

No. TPT-A (3)-7/2015.—In exercise of the powers conferred by sub-rule (2) of rule 118 of the Central Motor Vehicle Rules, 1989, the Governor, Himachal Pradesh, hereby notify the fitment of speed governor (speed limiting device or speed limiting function) in all types of transport4317 राजपत्र, हिमाचल प्रदेश, 8 सितम्बर, 2016/17 भाद्रपद, 1938 vehicles either in manufacturing stage or at the dealership stage having maximum pre-set speed of 80 Kilometer per hour conforming to the Standard AIS: 018/2001 and as amended from time to time subject to the following conditions, namely:—

1. No transport vehicle shall be registered by any Registering and Licensing Authority (RLA) or Regional Transport Officer (RTO) in Himachal Pradesh unless the same is fitted with speed governor which complies with the requirement of rule 118 of the Central Motor Vehicles Rules, 1989;

2. The Transport Vehicles which have been already registered before 1st October, 2015 and are not fitted /equipped with speed governor, shall be equipped/ fitted with speed governor having pre-set speed of 80 kmph or 60 kmph, as the case may be, before 31st December, 2016 failing which fitness certificate shall not be issued/renewed;

3. The following categories of vehicles shall be fitted with speed governor having maximum speed of 60 Kmph:—

(a) Vehicle carrying hazardous goods;

(b) Dumpers;

(c) Tankers;

(d) School buses;

4. The following categories of vehicles shall be fitted with speed governor having maximum speed limiting to 80 Kmph:—

(a) Stage Carriages;

(b) Contract carriages of M1, M2 and M3 category with seating capacity exceeding 8 passengers, in addition to driver seat and exceeding 3500 Kgs GVW;

(c) Maxi cabs with seating capacity exceeding 8 passengers in addition to driver seat and exceeding 3500 Kgs GVW;

(d) Private Service Vehicles (Transport);

(e) Omni Buses (Transport);

(f) Tourist Vehicles covered with permits issued under sub-section (9) of section 88 of the Motor Vehicles Act, 1988 (AITOBs) and Maxi Cabs exceeding seating capacity 8+1 and exceeding 3500 Kgs (GVW);

(g) Goods vehicles except 3 wheeler goods carriage; and

(h) Verified and certified by a testing agency specified in rule 126 to have maximum rated speed of not more than 80 kmph.

Every transport vehicle notified by the Central Government under sub- section (4) of Section 41 of the Motor Vehicles Act 1988 (59 of 1988) save as provided herein, and manufactured on or after 1st October, 2015 shall be equipped or fitted by the vehicle4318 राजपत्र, हिमाचल प्रदेश, 8 सितम्बर, 2016/17 भाद्रपद, 1938 manufacturer, either in the manufacturing stage or at the dealership stage, with a speed governor (speed limiting device or speed limiting function) having maximum pre- set speed of 80 Kmph conforming to the Standard AIS: 018/2001 and as amended from time to time:

Provided that the transport vehicles that are,-

(a) two wheelers;

(b) three wheelers;

(c) quadricycle;

(d) four wheeled and used for carriage of passengers and their luggage with seating capacity not exceeding eight passengers in addition to driver seat (M1 category) and not exceeding 3500 Kg gross vehicle weight ;

(e) fire tenders;

(f) ambulances;

(g) police vehicles;

(h) verified and certified by a testing agency specified in rule 126 to have maximum rated speed of not more than 80 Kilometer per hour, shall not be required to be equipped or fitted with speed governor (speed limiting device or speed limiting function):

Provided further that the transport vehicles manufactured on or after 1st October 2015 that are dumpers, tankers, school buses those carrying hazardous goods or any other category of vehicle, as may be specified by the Central Government from time to time by notification, published in the Official Gazette, shall be equipped or fitted by the vehicle manufacturer either at the manufacturing stage or at the dealership stage with a speed governor (speed limiting device or speed limiting function) having maximum speed of 60 kilometers per hour conforming to the Standard AIS: 018/2001 and as amended from time to time;

5. A manufacturer that has a type approval certificate (TAC) from any of the apex agency as provided under rule 126 of Central Motor Vehicles Rules, 1989, shall be authorised by the Transport Department for fitment of speed governors subject to testing and verification of documents. Further, the manufacturer shall establish the dealer network in the whole of the State and provide sale and after sale service;

6. The speed governor shall comply with AIS: 018/2001 standards and as amended from time to time;

7. The transport vehicles that are fitted with speed governors shall be required to seal the control unit of the speed governor with the seal of the Transport Department from the concerned Registering and Licensing Authority/ Regional Transport Officer. Further, if the transport vehicles are equipped or fitted with an electronic speed governor, the same shall not be required to be sealed;

8. The manufacturer/dealer of the speed governor while fitting speed governor in the transport vehicle shall also emboss/engrave the registration mark of the vehicle on the speed governor so that the same cannot be used for any other vehicle;

9. The minimum warranty period of speed governor shall be 12 months from the date of sale. The manufacturer/authorized dealer shall ensure the availability of speed governor/spare parts thereof. The manufacturer/authorized dealer shall issue installation certificate with company hologram and shall submit monthly reports before 10th of every month to the concerned Registering and Licensing Authority/Regional Transport Officer.

10. The concerned registering authority shall maintain the record of each vehicle fitted with speed governor and shall send a monthly report to the Transport Commissioner;

11. The driver and owner of the vehicle shall ensure that repair and maintenance of the speed governor shall be carried out at the authorized workshop only;

12. The owner or the driver of transport vehicle shall not tamper with the official seal of the Transport Department without permission from the concerned registering authority. If it is found at any point of time that any seal of the speed governor has been tempered with, in that case, the owner shall be held liable for that and in that event, the competent authority shall report the matter to the concerned Regional Licensing Authority/Regional Transport Officer who shall initiate the proceedings of cancellation or suspension of the permit of the vehicle as per the provisions of the Act;

13. Notwithstanding the presence of a speed governor, if the competent authority has reason to believe that the vehicle is plying at the higher speed than the prescribed speed, he may in writing direct the driver or owner to submit the vehicle for test/inspection to concerned Registering and Licensing Authority/Regional Transport Officer. If on such test/inspection, tampering is detected, an action may be taken as per condition No. 12 of this notification. If no tampering is detected but the machine is found faulty, the owner of the vehicle shall be directed to get changed/repaired the speed governor from an authorised dealer.
