संख्याःटी.सी.पी.ए(3)-4/2011.-हिमाचल प्रदेश के राज्यपाल इस विभाग की समसंख्यक अधिसूचना तारीख 21-01-2014 का अधिक्रमण करते हुए, हिमाचल प्रदेश लोक सेवा गारंटी नियम, 2011 के नियम 4 के साथ पठित हिमाचल प्रदेश लोक सेवा गारंटी अधिनियम, 2011 (2011 का अधिनियम संख्याक 34) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश की 120-राजपत्र/2016-19-09-2016 (4415) 4416 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 बावत विभिन्न सेवाओं, पदाभिहित अधिकारियों, अपील प्राधिकारियों और समय सीमाओं को निम्नलिखित ब्यौरे के अनुसार अधिसूचित करते हैंः-

TCP-A(3)-4/2011.—In supersession of this Department's Notification of even No. dated 21.1.2014, the Governor of Himachal Pradesh, in exercise of the powers conferred by section 3 of the Himachal Pradesh Public Service Guarantee Act, 2011 (Act No. 34 of 2011) read with Rule 4 of the Himachal Pradesh Public Service Guarantee Rules, 2011, is pleased to notify various services, Designated Officers, Appellate Authorities and time limits etc. in respect of the Town and Country Planning Department, Himachal Pradesh as per details given below:—

संंख्याःटी0एस0एम0 एफ(1)-3/2013.--हिमाचल प्र्र्र्रदेश केेेे राज्यपाल, हिमाचल प्रदेश पर्यटन विकास और रजिस्ट्र्रीकरण अधिनियम, 2002 (2002 का अधिनियम संंंंख्यांंंंक 15) की धारा 64 द्वारा प्र्रदत्त शक्तियोेेेंंंं का प्रयोेेेग करते हुए, विविध साहसिक क्रियाकलापों का कार्यान्वयन करनेे केे लिए निम्नलिखित नियम बनानेेेे का प्रस्ताव करते हैैं और इन्हें जनसाधारण की सूूूूचना के लिए एतद्‌द्वारा राजपत्र (असाधारण), हिमाचल प्रदेश में प्रकाशित किया जाता है;

किसी हितबद्ध व्यक्ति को इन नियमों की बाबत कोई आक्षेप या सुझाव है/हैं वह उसे /उन्हें उक्त प्रारूप नियमों के राजपत्र, हिमााचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर मुख्य सचिव (पर्यटन और नागरिक उड्‌डयन) हिमाचल प्रदेश सरकार को भेज सकेगा ;

उपरोक्त विनिर्दिष्ट अवधि के भीतर प्राप्त आक्षेप /सुझाव, यदि कोई है/हैं, पर उक्त प्रारूप नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ः-

प्र्रारूप नियम

अध्याय-1

प्र्रारम्भिक

1. संंंक्षिप्त नाम औैैर प्र्र्रारम्भ.-(1) इन नियमों का संंंक्षिप्त नाम हिमाचल प्र्र्रदेश विविध साहसिक क्रियाकलाप नियम, 2016 हैैै।

(2) येेे नियम, राजपत्र हिमाचल प्र्र्रदेश में प्र्र्रकाशन की तारीख से प्र्र्रवृृृत्त हांंेंगे।

2. परिभाषाएंंं.-(1) इन नियमों मेेेंंं जब तक कि कोेेर्ई बात विषय या सन्दर्र्भ सेेे विरूद्ध न होेे,- (क) "अधिनियम" सेेे हिमाचल प्र्र्रदेेेश रजिस्ट्रीकरण अधिनियम, 2002 (2002 का अधिनियम संंंंख्यांंंंक 15) अभिप्र्र्र्रेेेेत हैै;

(ख) "संगम" से हिमाचल प्रदेश सोसाइटी रजिस्ट्रीकरण अधिनियम, 2006 के अधीन रजिस्ट्रीकृत कोई संगम अभिप्रेत है ;

(ग) "कर्मीदल के सदस्यों" से प्रचालन के साथ चलने वाले गाइड सहित ऐसे व्यक्ति अभिप्रेत हैं जो विविध साहसिक क्रियाकलापों जैसे रैपेलिंग, रिवर क्रॉसिंग, स्कीईंग, पैदल यात्रा (ट्रैकिंग), रॉक क्लाईबिंग, हॉट एअॅर बैलूनिंग, जोरबिंग बॉल्ज, रोलिंग बॉल्ज, वाटर बॉल्ज, बंजी जंपिंग और जिपलाइन/फ्‌लाईंग फॉक्स, जॉय राईडज/फन पार्कों जैसी विविध साहसिक क्रियाकलापों का संचालन करते हैं;

(घ) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(ङ) "अनुदेशक" से ऐसा व्यक्ति अभिप्रेत है जो इन नियमों के प्रयोजनाें के लिए, इस रूप में अर्हित और रजिस्ट्रीकृत है और विविध साहसिक क्रियाकलापाें के संचालन के लिए इनके निर्विघ्न और सुरक्षित समापन के लिए साथ में रहता है या उनका संचालन करता है ;

(च) "विविध साहसिक क्रियाकलाप" से ऐसे साहसिक क्रियाकलाप जैसे रैपेलिंग, रिवर क्रॉसिंग, स्कीईंग, ट्रैकिंग, रॉक क्लाईबिंग, हॉट एअॅर बैलूनिंग, जोरबिंग बॉल्ज, रोलिंग बॉल्ज, वाटर बॉल्ज, बंजी जंपिंग और जिपलाइन/फ्‌लाईंग फॉक्स, जॉय राईडज/फन पार्कस या कोई अन्य ऐसे क्रियाकलाप जैसे सरकार द्वारा समय-समय पर अधिसूचित किए जाएं, अभिप्रेत हैं ;

(छ) "ऑपरेटर" से ऐसा/ऐसे साहसिक क्रियाकलाप ऑपरेटर, चाहे वैयक्तिक, कम्पनी या संगम या सोसाइटी है/हैं, जो विविध साहसिक क्रियाकलापाें जैसे रैपेलिंग, रिवर क्रॉसिंग, स्कीईंग, ट्रैकिंग, रॉक क्लाईबिंग, हॉट एअॅर बैलूनिंग, जोरबिंग बॉल्ज, रोलिंग बॉल्ज, वाटर बॉल्ज, बंजी जंपिंग और जिपलाइन/फ्‌लाईंग फॉक्स, जॉय राईडज/फन पार्कस आदि का संचालन करने के लिए अधिनियम के अधीन इस रूप में रजिस्ट्रीकृत है, अभिप्रेत है/हैं;

(ज) "प्रचालन" से विविध साहसिक क्रियाकलापों के लिए की जाने वाली आमोद-यात्रा (ट्रिप) या इसके संचालन के लिए कोई कार्य अभिप्रेत है ;

(झ) "सहभागी" से ऐसा/ऐसे व्यक्ति अभिप्रेत है/हैं जो विविध साहसिक क्रियाकलापों में सहभागी होता है/होते हैं ;

() "सोसाइटी" से हिमाचल प्रदेश सहकारी सोसाइटी रजिस्ट्रीकरण अधिनियम, 1968 के अधीन रजिस्ट्रीकृत कोई सहकारी सोसाइटी अभिप्रेत है;

(ट) इन नियमों के प्रयोजन के लिए "उपयुक्त काल (सीजन)" से 15 जुलाई से 15 सितम्बर तक की अवधि, जिसके दौरान कोई भी रिवर क्रॉसिंग क्रियाकलाप अनुज्ञात किए/करवाए नहीं जाएगें को अपवर्जित करके सम्पूर्ण वर्ष अभिप्रेत है; किन्तु लाहौल एवं स्पिति जिला में 15 जुलाई से 15 सितम्बर की अवधि के दौरान रिवर क्रॉसिंग क्रियाकलाप भी अनुज्ञापत किए जा सकेंगे यदि मौसम अनुकूल हो ;

(ठ) "धारा" से अधिनियम की धारा अभिप्रेत है ; और

(ड) "तकनीकी समिति" से नियम 8 के अधीन आयुक्त द्वारा गठित समिति अभिप्रेत है।

(2) समस्त अन्य शब्दों और पदों के जो इन नियमों में प्रयुक्त है किन्तु परिभाषित नहीं है, वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं।

अध्याय-2

रजिस्ट्रीकरण

3. विविध साहसिक क्रियाकलापों के ऑपरेटर के रजिस्ट्रीकरण के लिए आवेदन.-(1) विविध साहसिक क्रियाकलापों के रूप में कार्य करने का आशय रखने वाला कोई व्यक्ति, आगामी सीजन के लिए प्रत्येक वर्ष प्रथम जनवरी से पन्द्रह मार्च तक विहित प्राधिकारी के पक्ष में 2000/- रूपए के मांगदेय ड्राफ्‌ट सहित रजिस्ट्रीकरण के लिए प्ररूप-1 में विहित प्राधिकारी को आवेदन कर सकेगा। विहित प्राधिकारी इस प्रकार प्राप्त आवेदनों की प्रारम्भ में जांच करेगा और उन्हें तकनीकी समिति के समक्ष रखेगा जो प्रत्येक वर्ष 15 अप्रैल से पूर्व बैठक आयोजित करेगी और दस्तावेजों की संवीक्षा करने तथा उपस्करों का निरीक्षण करने गाइडों/अनुदेशकाें की/का व्यवहारिक परीक्षा/शारीरिक परीक्षण संचालित करने और अन्तिम अनुमोदन प्रदान करने के लिए समस्त अर्हित आपरेटरों को कम से कम 15 दिन का स्पष्ट नोटिस देकर तारीख, समय और स्थान नियत करेगी।

(2) सीजन के मध्य किसी भी ऑपरेटर को साहसिक क्रियाकलाप संचालित करना अनुज्ञात नहीं किया जाएगा। 4422 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (3) यथास्थिति, गाइड (गाइडों) या अनुदेशक (अनुदेशकों) या सोसाइटी (सोसाइटियों), जिनका स्थानीय कार्यालय है और जिनका सुसंगत क्षेत्र में कम से कम दो वर्ष का अनुभव है, को अधिनियम के अधीन हिमाचल प्रदेश पर्यटन विभाग के पास रजिस्ट्रीकृत किया जाएगा।

(4) विहित प्राधिकारी तकनीकी समिति के अनुमोदन के पश्चात सम्बद्ध ऑपरेटर को प्ररूप-3 में रजिस्ट्रीकरण प्रमाण पत्र जारी करेगा जो इसके जारी करने की तारीख से तीन वर्ष की अवधि के लिए होगा। (5) विविध साहसिक क्रियाकलाप चलाने के लिए रजिस्ट्रीकृत ऑपरेटर से भिन्न किसी भी व्यक्ति को प्रत्यक्षतः या अप्रत्यक्षतः संचालन करना अनुज्ञात नहीं किया जाएगा जब तक कि तकनीकी समिति का समाधान नहीं हो जाता कि संचालन करने वाले ऑपरेटर के पास समस्त उपस्कर हैं और वह इन नियमों के अधीन अन्य अपेक्षाओं को पूर्ण करता है तथा उसका प्रस्ताव तकनीकी समिति द्वारा सम्यक्‌ रूप से अनुमोदित किया गया है / स्वीकृत (मंजूर) किया गया है।

4. अर्हताएं.-(1) किसी भी ऑपरेटर को विविध साहसिक क्रियाकलाप संचालित करना तब तक अनुज्ञात नहीं किया जाएगा जब तक कि उसके पास अर्हित गाइड/अनुदेशक न हों, और जब तक जिन्होनें सम्बद्ध क्रियाकलाप में कम से कम दो वर्ष के अनुभव और अपेक्षित मानदण्डों के साथ अच्छे ट्रेक रिकार्ड सहित अटल विहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान, मनाली हिमाचल प्रदेश या हिमालयन पर्वतारोहण संस्थान दार्जिलिंग या नेहरू पर्वतारोहण संस्थान उत्तरकाशी या जवाहर पर्वतारोहरण शीतकालीन खेल संस्थान, पहलगाम या किसी मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान मेथड ऑफ इन्स्ट्रक्शनज का कोर्स न किया हो।

(2) किसी भी ऑपरेटर को स्कीईंग का संचालन करना तब तक अनुज्ञात नहीं किया जाएगा जब तक कि उसके पास अर्हित गाइड / अनुदेशक न हों और जब तक जिन्होेंने सम्बद्ध क्रियाकलापों में कम से कम दो वर्ष के अनुभव और अपेक्षित मानदण्डों के साथ अच्छे ट्रेक रिकार्ड सहित अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान, मनाली, हिमाचल प्रदेश या भारतीय स्कीईंग और पर्वतारोहण संस्थान गुलमर्ग या गढ़वाल मण्डल विकास निगम लिमिटेड, औली या जवाहर पर्वतारोहण और शीतकालीन खेल संस्थान पहलगाम या किसी मान्यता प्राप्त मेथड ऑफ इन्स्ट्रक्शनज (स्कीईंग) का कोर्स न किया हो। (3) किसी ऑपरेटर जिसने किसी मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान से सम्बद्ध क्रियाकलाप में एडवान्स कोर्स किया है, को विविध साहसिक क्रियाकलाप के लिए इस रूप में रजिस्ट्रीकृत किया जा सकेगा। 5. विविध साहसिक क्रियाकलापों/फन पार्कों के लिए आवेदन करने/रजिस्ट्रीकरण हेतु अपेक्षा.- सम्प्रवर्तक, जो आवेदन करने का आशय रखते हों, अपने आवेदन के साथ निम्नलिखित ब्यौरे प्रस्तुत करेंगे,- (i) समस्त प्रकार के सम्बद्ध विविध साहसिक क्रियाकलाप के लिए बिल सहित उपस्कर का प्रकार, मेक तथा माडल। उपस्कर, प्रमाणन करने वाले अभिकरणाें जैसे इण्टरनेशनल क्लाईंबिंग एण्ड माऊण्टेनेरिंग फेडरेशन (यू.आई.ए.ए.) कमेटी ऑफ यूरोपियन नामर्ज (सी.ई.एन.), भारतीय मानक ब्यूरो (बी.आई.एस.) या इण्टरनेशनल ऑरगेनाइजेशन फॉर स्टैण्डराइजेशन (आई.एस.ओ.) द्वारा सम्यक्‌ रूप से प्रमाणित किया जाएगा।

(ii) डिजाइन/भार वहन क्षमता, आयुस्य और इसके सुरक्षित प्रचालन के लिए कितने समय में मरम्मत अपेक्षित है। राइडज/उपस्करों को स्थापित करने की अनुज्ञा के पश्चात्‌ सम्बद्ध आवेदक या संप्रवर्तक तकनीकी समिति से अंतिम निरीक्षण रिपोर्ट प्राप्त करेगा। कोई भी फन पार्क तब तक जनसाधारण के लिए नहीं खोला जाएगा जब तब कि इसे तकनीकी समिति द्वारा स्वीकृति (मंजूरी) न दे दी गई हो; और

(iii) तकनीकी समिति द्वारा उपस्कर का त्रैमासिक निरीक्षण करना अनिवार्य होगा और समिति को क्रियाकलापों के अस्थायी रूप से बंद करने के आदेश देने की शक्तियां होंगी। यदि वांछित सुरक्षा मापदण्ड पूर्ण नहीं होते हैं तो समिति इसके स्थायी रूप से बन्द करने की सिफारिश कर सकेगी।4423 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 6. गाइड /अनुदेशक का रजिस्ट्रीकरण.-(1) गाइड या अनुदेशक के रूप में विविध साहसिक क्रियाकलाप ( क्रियाकलापों) में सहभागी होने का आशय रखने वाला कोई व्यक्ति, विहित दस्तावेजों / और विहित प्राधिकारी के पक्ष में 2000/- रूपए के मांगदेय ड्राफ्‌ट सहित रजिस्ट्रीकरण के लिए विहित प्राधिकारी को प्ररूप-2 में आवेदन करेगा। सम्बद्ध क्षेत्र का विहित प्राधिकारी अपना पूर्णतया यह समाधान हो जाने पर कि आवेदक रजिस्ट्रीकरण के लिए अपेक्षित अर्हताओं और मानदण्डाें को पूर्ण करता है और यदि उसके आवेदन की तकनीकी समिति ने भी सिफारिश की है, रजिस्ट्रीकरण प्रमाण-पत्र जारी करेगा जो इसके जारी करने की तारीख से तीन वर्ष की अवधि के लिए होगा।

(2) विहित प्राधिकारी, साहसिक क्रियाकलाप ऑपरेटर के रूप में रजिस्ट्रीकरण के लिए ई-मेल के माध्यम से आवेदन स्वीकार कर सकेगा और ई-मेल के माध्यम से अभिस्वीकृति दे सकेगा और यदि अधिनियम के अधीन यथा अपेक्षित उसका आवेदन समस्त प्रकार से पूर्ण है तो उसे विविध साहसिक क्रियाकलाप ऑपरेटर के रूप में रजिस्ट्रीकृत कर सकेगा। विहित प्राधिकारी, ई-मेल के माध्यम से आवेदन स्वीकार करने की दशा में, नियम-3 के अधीन रजिस्ट्रीकरण प्रमाण पत्र को जारी करते समय रजिस्ट्रीकरण फीस स्वीकार कर सकेगा। 7. गाइड/अनुदेशक के लिए अर्हता.- (1) गाईड/अनुदेशक की आयु इक्कीस वर्ष अवश्य होनी चाहिए और चिकित्सा अधिकारी द्वारा यथा प्रमाणित चिकित्सक दृष्टया योग्य होना चाहिए। उसके पास सरकारी अस्पताल या किसी मान्यता प्राप्त संस्थान के चिकित्सा अधिकारी द्वारा जारी वैध बुनियादी फर्स्ट एॅड और काडिर्याे पल्मनेरी रिससिटॅशन (सी.पी.आर.) या इसके समतुल्य अवश्य होना चाहिए। उसमें हिन्दी और अंग्रेजी में विचार आदान-प्रदान करने की अच्छी दक्षता होनी चाहिए।

(2) विविध साहसिक क्रियाकलाप के लिए अनुदेशक ने भारत में किसी रजिस्ट्रीकृत या मान्यता प्राप्त पर्वतारोहण संस्थान जैसे अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान, मनाली, हिमाचल प्रदेश या हिमालयन पर्वतारोहण संस्थान दार्जिलिंग या नेहरू पर्वतारोहण संस्थान, उत्तरकाशी या किसी मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान या देश से बाहर के किसी संस्थान से पर्वतारोहण में अर्हित मेथडज़ ऑफ इन्स्ट्रक्शनज कोर्स या इसके समतुल्य कोर्स किया हो तथा स्कीईंग के साहसिक क्रियाकलाप के लिए अटल बिहारी पर्वतारोहण और सहबद्ध खेल संस्थान मनाली, हिमाचल प्रदेश या भारतीय स्कीईंग और पर्वतारोहण संस्थान, गुलमर्ग या गढ़वाल मण्डल विकास निगम लिमिटेड, औली या जवाहर पर्वतारोहण और शीतकालीन खेल संस्थान, पहलगाम या किसी मान्यता प्राप्त राष्ट्रीय या राज्य संस्थान से मेथडज ऑफ इन्स्ट्रक्शनज कोर्स (स्कीर्ईग) अर्हित करने सहित सम्बद्ध क्रियाकलाप में कम से कम दो वर्ष का अनुभव और अपेक्षित मानदण्डों सहित अच्छा ट्रैक रिकार्ड होना चाहिए।

8. तकनीकी समिति का गठन.-आयुक्त, विविध साहसिक क्रियाकलापों जैसे रैपेलिंग, रिवर क्रॉसिंग, स्कीइंग, ट्रैकिंग, रॉक क्लाईबिंग, हॉट एअॅर बैलूनिंग, जोरबिंग बॉल्ज, रोलिंग बॉल्ज, वाटर बॉल्ज, बंजी जंपिंग और जिपलाइन/फ्‌लाईंग फॉक्स, जॉय राईडज/फन पार्कस आदि संचालन करने के लिए, अधिसूचना द्वारा, किसी क्षेत्र के लिए, तकनीकी समिति का गठन करेगा जिसमें निम्नलिखित सदस्य होंगे, अर्थात्‌ :-

(i) निदेशक, अटल बिहारी वाजपेयी पर्वतारोहण और अध्यक्ष सहबद्ध खेल संस्थान, मनाली या उसका प्रतिनिधि।

(ii) सम्बद्ध क्षेत्र का उप-मण्डल अधिकारी (नागरिक) या सदस्य उसका प्रतिनिधि।

(iii) सम्बद्ध क्षेत्र का उप पुलिस अधीक्षक सदस्य (iv) सम्बद्ध क्षेत्र का वन मण्डल अधिकारी या उसका प्रतिनिधि सदस्य (v) सम्बद्ध क्षेत्र का मुख्य चिकित्सा अधिकारी या उसका प्रतिनिधि सदस्य (vi) अटल बिहारी वाजपेयी पर्वतारोहण और खेल संस्थान, सदस्य मनाली का अनुदेशक या उसका प्रतिनिधि। 4424 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (vii) साहसिक क्रियाकलापों से सम्बद्ध दो सदस्य (संगम सदस्य का एक सदस्य और सम्बद्ध रजिस्ट्रीकृत साहसिक क्रियाकलाप से एक सदस्य या कोई सुविज्ञ (जानकार सदस्य)।

(viii) हिमाचल प्रदेश लोक निर्माण विभाग के सम्बद्ध क्षेत्र सदस्य, और का अधिशासी अभियन्ता (यान्त्रिकी)।

(ix) उप-निदेशक, पर्यटन एवं नागरिक उड्‌डयन या सदस्य सचिव। जिला पर्यटन विकास अधिकारी और उसकी अनुपस्थिति में सम्बद्ध क्षेत्र का सहायक पर्यटन विकास अधिकारी।

9. तकनीकी समिति के कृत्य.-तकनीकी समिति निम्नलिखित के लिए उत्तरदायी होगी,- (i) नियम 3 और 4 के अनुसार सुरक्षा के दृष्टिकोण से ऑपरेटर द्वारा रखे गए उपस्कर का निरीक्षण करने और उसको प्रमाणित करने ;

(ii) ऑपरेटर (ऑपरेटरों) और गाइड (गाइडों)/अनुदेशक (अनुदेशकाें) के जीवन-वृत्त की जांच करने और उनकी सुविज्ञता (निपुणता) अभिनिश्चित करने के आशय से उनका शारीरिक परीक्षण करवाना और ऐसा करके ऑपरेटरों के साथ-साथ दोनों गाइड (गाइडों)/ अनुदेशक (अनुदेशकाें) को अनुज्ञप्ति जारी करने के लिए अनुमोदन करने ;

(iii) ऑपरेटर गाइड और अनुदेशक इन नियमों में उपदर्शित प्रक्रिया का अनुसरण करेगा / करेंगे ;

(iv) राज्य में विविध साहसिक क्रियाकलापों का प्रचालन करने के लिए नए स्थलों, नदियां, स्थानों और क्षेत्रों, जहां सुरक्षित रूप से प्रचालन किया जा सकता है, की पहचान करने ;

(v) विविध साहसिक क्रियाकलापों के रूप में अन्य खेलों/क्रियाकलापों की पहचान करने और उनको अधिसूचित करने की संस्तुति करने ;

(vi) रैपेलिंग/रिवर क्रॉसिंग, आश्रय बोल्ट (ऐन्करिज बोल्ट) और अन्य कृत्रिम जुड़नार (जुड़ाव की वस्तुओं) और उपस्कर की निरीक्षण करने और उनको प्रमाणित करने ;

(vii) विहित प्राधिकारी द्वारा पर्यटकों/सहभागियों से प्रभारित की जाने वाली फीस की संस्तुति करने ;

(viii) समय-समय पर नियमों में वर्णित विविध साहसिक क्रियाकलापाें के सुरक्षित प्रचालन के लिए मार्गदर्शक सिद्धान्त और परामर्श (जानकारी) यदि कोई हो, जारी करने / देने ;

(ix) ऑपरेटर (ऑपरेटरों)/गाइड (गाइडों)/और अनुदेशकों की चिकित्सक दृष्टया योग्यता का अवधारण करने ;

(x) क्षेत्र के लिए वहन (परिवहन) क्षमता नियत करने ; और

(xi) विविध साहसिक क्रियाकलापों का प्रचालन करने के लिए सही विस्तार क्षेत्र (स्ट्रेचिज) और स्थानों को अधिसूचित करने।4425 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 10. विनियामक समिति का गठन और इसके कृत्य.-आयुक्त (पर्यटन), अधिसूचना द्वारा, प्रत्येक स्थल, नदी और प्रचालन क्षेत्र के लिए, निम्नलिखित सदस्याें से समाविस्ट, एक विनियामक समिति का गठन करेगा, अर्थात्‌ :-

(i) सम्बद्ध जिला का उपायुक्त अध्यक्ष, (ii) सम्बद्ध जिला का पुलिस अधीक्षक सदस्य (iii) सम्बद्ध क्षेत्र का उप-मण्डल मजिस्ट्रेट सदस्य (iv) सम्बद्ध क्षेत्र का आदेशक गृह रक्षा सदस्य (v) सम्बद्ध क्षेत्र का मुख्य चिकित्सा अधिकारी या उसका प्रतिनिधि (vi) अटल बिहारी वाजपेयी पर्वतारोहण और सहबद्ध खेल संस्थान, मनाली का प्रतिनिधि (vii) हिमाचल प्रदेश लोक निर्माण विभाग के सम्बद्ध क्षेत्र का अधिशासी अभियन्ता (मैकेनिकल) (viii) उप-निदेशक, पर्यटन एवं नागरिक उड्‌डयन या जिला पर्यटन विकास अधिकारी और उसकी अनुपस्थिति में सहायक जिला पर्यटन और विकास अधिकारी

11. विनियामक समिति के कृत्य.-विनियामक समिति निम्नलिखित कृत्याें का अनुपालन करेगी,- (i) विनियामक समिति, सम्बद्ध जिला के विविध साहसिक क्रियाकलापाें के संगमों, यदि कोई हैं, की सहायता से क्षेत्र में प्रचालनों को विनियामित करने के लिए सम्पूर्ण नियन्त्रण रखेगी। (ii) विनियामक समिति प्रचालनों के दौरान, यह सुनिश्चित करने के लिए कि इन नियमों का अनुसरण किया जा रहा है, औचक निरीक्षण करेगी और

(iii) विनियामक समिति को सरकार द्वारा विविध साहसिक क्रियाकलापाें के प्रचालन के सम्बन्ध में कोई अन्य कृत्य सौंपा जा सकेगा।

अध्याय-3

सुरक्षा उपाय

12. विविध साहसिक क्रियाकलापों के संचालन के कार्यान्वयन के लिए अपेक्षित उपस्कर.-प्रत्येक ऑपरेटर को प्रचालन का कार्यान्वयन अनुज्ञात करने से पूर्व उसे निम्नलिखित उपस्कर (उपस्करों) की व्यवस्था करनी होगी। तकनीकी समिति उपस्कर (उपस्करों) की प्रत्येक मद (वस्तु) की जाँच करेगी और उसे सम्बद्ध क्षत्रे के उप-निदेशक, पर्यटन एवं नागरिक उड्‌डयन या जिला पर्यटन विकास अधिकारी या सहायक पर्यटन विकास अधिकारी के माध्यम से स्टांपित करवाएगी, अर्थात्‌ः-

(i) रैपेलिंग :

(क) स्टान्स अच्छी तरह से सुरक्षित होनी चाहिए ;

(ख) स्वच्छन्द संचलन के लिए स्थल पर पर्याप्त स्थान होना चाहिए ;

(ग) उतरने के स्थल पर पर्याप्त स्थान होना चाहिए ;

(घ) प्राथमिक उपचार पेटिका (फर्स्ट एड बाक्स) हर समय उपलब्ध होनी चाहिए;

(ड.) क्षेत्र पत्थर/गिरने वाले शिला खण्ड एवं असंहत पत्थर रहित होना चाहिए ; और

(च) मानक उपस्कर, भारतीय मानक ब्यूरों (बी.आई एस) या अन्तराष्ट्रीय मानक निर्मित, मॉडल, विनिर्माण करने के वर्ष, क्रय का वर्ष और तकनीकी विनिर्देशन वाला होना चाहिए। मानक उपस्कर निम्नलिखित विनिर्देशन का होना चाहिए :-;

➢ लाइबिंग रोप :

• व्यास 10 से 11 मिलीमीटर।

• लम्बाई 120 से 140 फुट

• क्ेरनामेण्टल रोप

• न्यूनतम 800 किलोग्राम ब्रेकिंग स्ट्रेन्थ (इण्टरनेशनल क्लाइबिंग

• एण्ड माउण्टेनेरिंग फेडरेशन (यू.आई.ए.ए.) द्वारा प्रमाणित हो)

➢ रैपलिंग रोप :

• व्यास 8 से 10 मिलीमीटर।

• लम्बाई 180 से 200 फुट

• केरनामेण्टल रोप

• न्यूनतम 600 किलोग्राम ब्रेकिंग स्ट्रेन्थ (इण्टरनेशनल क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन (यू.

आई.ए.ए.) द्वारा प्रमाणित हो) ।

➢ केराबीनीर :

• स्क्रू गेट सहित जिरकाल एलॉए। • 3000 किलोग्राम क्षमता (इण्टरनेशनल क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन) (यू.आई.ए.ए.) द्वारा प्रमाणित हो) ।

➢ रैपेलिंग हीट हारनैस :

• समायोज्य

• गद्‌देदार नायलॉन सामग्री (इण्टरनेशनल क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन) (यू.आई.ए.ए) द्वारा प्रमाणित हो) ।

➢ दस्ताने :

• तनने वाले नॉयलॉन और कैनवास सामग्री (कपड़े) सहित चमड़े की हथेली वाले

➢ जूते :

• रबर तलवे वाले

➢ अष्ट आकृति (उतरने के लिए) :

• 2500 किलाग्राम ब्रेकिंग स्ट्रेन्थ से कम न हो। (इण्टरनेशनल क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन)(यू.आई.ए.ए.) द्वारा प्रमाणित हो)।4427 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 ➢ वस्त्र :

• समुचित रूप से पहनने योग्य हो, ढीले न हों।

➢ हेलमेट :

• भारतीय मानक ब्यूरो (बी.आई.एस.) या अन्तराष्ट्रीय मानक स्ट्रेप सहित किसी रिसाव या किसी भाग की क्षति रहित, अच्छी स्थिति में अवश्य होना चाहिए।

(ii) रिवर क्रॉसिंग/जिपलाइन/फ्‌लाइंग फॉक्सः-

(क) जिपलाइन/फ्‌लाइंग फॉक्स के लिए दो रीतियां अर्थात फ्‌लाइंग फॉक्स या टाइरोलीन पारगमन उपयोग मे लाई जाती हैं। रस्सियां (रोपस), केरावाईनर्ज पुली/घिरनी तथा सीट हार्नेस सुरक्षित रूप से नदी पार करने में मुख्य भूमिका निभाती है। जिपलाइन/फ्‌लाइंग फॉक्स के लिए (नदी के ऊपर किनारों पर जोड़ी गई रस्सियां (रोपस)) इण्टरनेशनल क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन)(यू.आई.ए.ए.), भारतीय मानक ब्यूरो (बी.आई.एस.)/अन्तरर्राष्ट्रीय मानक चिन्ह वाले मानक के अनुसार केवल स्थिर कबला रस्सी का प्रयोग किया जाना चाहिए। यात्रियों/ साहसिक कार्य प्रेमियों की सुरक्षा सुनिश्चित करने के लिए वाणिज्यिक प्रयोजन हेतु पुली घिरनी खूँटी वाली रस्सी सहित क्लाइबिंग एण्ड माउण्टेनेरिंग फेडरेशन) (यू.आई.ए.ए.), ब्यूरो ऑफ इण्डियन स्टैडंर्ज (बी.आइ.एस.)/अन्तर्राष्ट्रीय मानक चिन्ह वाली वृहतर आकार की होनी चाहिए। हैलमेट (टोप) अनिवार्य हैं जो किसी संभाव्य घटना की दशा में सिर को अधिकतम सुरक्षा प्रदान करता है। नदी के दोनों किनारों पर स्थिरक (एंकरज), चाहे कृत्रिम हो या प्राकृतिक, ठोस और अभेद्य होने चाहिए। व्यास की एक अतिरिक्त फाईबर कोर स्टील तार की रस्सी, जिसे फैलाव (विस्तार) और ले जाए जाने वाले भार के आधार पर सुरक्षा उपाय के रूप में चयनित किया जा सकेगा, होनी चाहिए। नदी पार करने वाला व्यक्ति इस तार के साथ बंधा होना चाहिए जो एक सुरक्षा उपाय के रूप में भी कार्य करेगी। अतिरिक्त स्टील तार रस्सी, जिसका फाईबर कोर न्यूनतम 12 मिलीमीटर व्यास का 6 x 19 (12/6/1) या 6 x 37 (18/12/6/1) का बना हो, भी उपलब्ध करवाया जाना चाहिए। उपस्कर के निम्नलिखित विनिर्देशन होने चाहिए :-

• स्थिरण शिलाखण्ड गोल पैर के जमाव वाले गर्डर सहित न्यूनतम 1.5 x 1 x 1 मीटर सी.सी (1 :

2 : 4) के आकार वाले भूमिगत बनाए जाने चाहिए।

• आधार, स्थिरण शिलाखण्ड से न्यूनतम 2 मीटर आगे होना चाहिए।

• अतिरिक्त रस्सियों को नियंत्रित करने के लिए सुसंगत भारतीय मानक कोड के सद्रश न्यूनतम 8 यू शिकंजो (कलैंप) की व्यवस्थ की जाए।

• समस्त पुलियां (घिरनियां) सुसंगत भारतीय मानक कोड के सद्रश और नरम स्टील की बनी होनी चाहिए।

• उपलब्ध करवाई गई सिटकनियां (बोल्टस) एच.टी.ग्रेड की होनी चाहिए।

• नदी पार करने के कार्यकलापों में भाग लेते समय सभी गाइडाें/सहभागियों के पास हर समय जीवन रक्षक जैकेटें होनी चाहिए/ जैकेट की पर्याप्त उत्पलावकता (न्यूनतम 6.14 किलोग्राम और 9-10 किलोग्राम) वाली अधिमान्य होनी चाहिए, उचित प्रकार की जैकेट आरामदेह फीतों से युक्त व्यवस्थ सहित (यू0एस0 कोस्ट गार्ड टाइप-III या V/यूरोपियन मानक समिति (सी.ई.एन.)/ भारतीय मानक ब्यूरो संगठन (आई.एस.ओ.) वाली अवश्य होना चाहिए और जीवन रक्षक जैकेट4428 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 ठीक प्रकार से पहनी जानी चाहिए। फुलाने योग्य जीवन रक्षक जैकेट और की होल टाइप की जीवन रक्षक अनुज्ञात नहीं की जानी चाहिए। गाइडाें को यह अवश्य सुनिश्चित करना होगा कि यात्रा प्रारम्भ करने से पूर्व जीवन रक्षक जैकेटें सुरक्षित रीति से कसकर बांधी गई हैं। • हिमाचल प्रदेश आकाशी रज्जू मार्ग अधिनियम, 1968 के सुसंगत उपबन्धों का सर्वथा पालन करना होगा।

(iii) बंजी जंपिंग :

➢ अनिवार्य अपेक्षाः जम्प लाइन के सभी पार्ट दोहरे (डुपलिकेटिड) होना चाहिए। इसका फैलाव (विस्तार) बंजी के संयोजन से कूदने वाले (जम्पर) और रेखा (लाइन) के दूसरे अंतिम किनारे पर अवसंरचना के संयोजक तक हो। सामान्यतः कूदने वाले का एक संयोजन टखने के फीतों से और दूसरा शरीर या गद्‌दी के कवच (सीट हारनेस) के साथ होना चाहिए।

➢ उपस्कर.-बी एण्ड यू एल कवच, (हारनेस) कारबाइनरज अच्छी बनावट वाले और इस प्रयोजन के लिए उपयुक्त होने चाहिए। प्रतिष्ठित प्रदायक से पर्वतारोहण उपस्कर समुचित है और कारबाइनरज स्क्रू गेट टाइप के होने चाहिए।

➢ गुथी हुई रस्सियां.-कम से कम दो गुथी हुई रस्सियां उपयोग की जानी चाहिए और कूदने वाले के वजन से मेल खाती हो, वे भारी कार्य गुथी हुई रबर डोर या समरूप मानक प्रमाण बी. एस. 3 एफ 701991 विनिर्देशन वाली होनी चाहिए।

➢ बिना गुथी रस्सियां.-सामान्यतः एक बिना गुथी रस्सी पर्याप्त है क्योंकि इसकी संरचना में अन्तर्निहित प्रचुरता के कारण लगभग एक हजार व्यक्ति इकट्‌ठे रवाना होने के लिए खडे़ होते हैं। प्रत्येक रस्सी किसी स्वतन्त्र प्राप्तिस्थान (स्त्रोत) से परीक्षक से प्रमाणित होनी चाहिए और उसे कुदने वाले के बजन के अनुसार चुना जाना चाहिए।

➢ रस्सी लॉग बुक्स.-ऐसी लॉग बुक्स रखी जानी चाहिए, जिनमें अधिकतम भार, उचित प्रशिक्षण सूची का वर्णन हो जिसमें यह उपदर्शित किया गया हो कि कैसे कोई व्यक्ति सक्षमता के एक स्तर से अगले स्तर तक प्रगति करता है।

➢ सम्पूर्ण प्रभारी व्यक्ति.-सम्पूर्ण प्रभारी व्यक्ति को स्थल पर सूक्ष्म निरीक्षण रखना चाहिए। दर्शकों को, उनकी सुरक्षा के लिए और प्रचालकों की अन्यमनस्कता के निवारित करने के लिए, कूदने के स्थान (जंप-जोन) से वर्जित करने की व्यवस्था की जानी चाहिए।

➢ कोई भी प्रभारी इसके साथ सुरक्षित रूप से सम्बद्ध होना चाहिए। विशेषतय.- दर्शक द्वारा तेरह वर्ष से कम आयु के बच्चों द्वारा सवारी करना हत्तोसाहित किया जाना चाहिए।

➢ दिन प्रारम्भ होने पर इसकी सुव्यवस्था सुनिश्चित करने के लिए पूरी लाइन का डेड वेट ड्राप टेस्ट होना चाहिए।

(iv) जहाँ किसी प्रकार के एअॅरक्राफ्‌ट, बैलून, ग्लाइडर आदि कि साहसिक क्रियाकलाप आयोजित किए जाने हैं, के लिए महानिदेशक नागरिक विमानन (डी.जी.सी.ए.) से समुचित मंजूरी (स्वीकृति) अवश्य प्राप्त की जानी अपेक्षित है और इण्डियन एअॅर फोर्स आईडेंटिफिकेशन एजेन्सीज (ए.डी.आई.ए.) की अधिसूचना अनिवार्य है। ऐसे क्रियाकलापाें का प्रचालन करने के लिए मंजूरी/अनुज्ञप्ति से पूर्व निम्नलिखित को महत्व दिया जा सकेगाः-

➢ नोटम (एन.ओ.टी.ए.एम.).-उड़ान/वायु साहसिक क्रियाकलापाें का संचालन करने के लिए सम्बद्ध नागरिक विमानन अभिकरणें जैसे डी.डी.सी.ए. को सूचित करना अनिवार्य होगा ताकि उड़ान4429 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 क्रियाकलापों के सुरक्षित और सुगम संचालन के लिए उड़ान क्रियाकलापों की प्रकृति ज्ञात की जा सके।

➢ एअॅर डिफेंस आईडेंटिफेकेशन एजेन्सी (ए.डी.आई.ए.) की मंजूरी (स्वीकृति).-ऐसे प्रचालकों/उड़ान स्कूलों/वायु साहसिक क्लबों के लिए उनकी उड़ान के सम्बद्ध एअॅर डिफंसे आईडेंटिफिकेशन एजेंसी (ए.डी.आई.ए.) के ऊँचाई, उड़ान की अवधि, प्रचालन के क्षेत्र आदि के लिए वायु सुरक्षा मंजूरी (स्वीेकृति), आकाशी पिण्ड की तुरन्त पहचान और उड़ान सुरक्षा के जोखिम के बिना कारगर वायु उड़ान स्थल प्रबन्धन के समस्त ब्यौरों सहित अपरिहार्य/अनिवार्य अपेक्षा होगी।

(V) जॉय राइडस वाले फन पार्कों के लिए मार्गदर्शक सिद्धान्त.-सुरक्षा सुनिश्चित करने के लिए त्रैमासिक आधार पर उपस्करों की जांच करने के निम्नलिखित सदस्यों की एक पृथक्‌ उप-समिति बनाई जाएगीः-

(क) सम्बद्ध उपमण्डल अधिकारी (नागरिक) अध्यक्ष

(ख) हिमाचल प्रदेश लोक निर्माण विभाग सदस्य के सम्बद्ध क्षेत्र के अधिशासी अभियन्ता (मैकेनिकल) का प्रतिनिधि

(ग) पुलिस विभाग से एक प्रतिनिधि जो सहायक सदस्य उप-निरीक्षक की पंक्ति से नीचे का न हो

(घ) उप-निदेशक, पर्यटन/जिला पर्यटन विकास सदस्य सचिव अधिकारी/सहायक पर्यटन विकास अधिकारी

(vi) अन्य साहसिक क्रीड़ाएं.-पहले से ही विद्यमान राष्ट्रीय/अन्तर्राष्ट्रीय मानदण्ड लागू होंगे।

(vii) प्रिचयकरण दौड़े.-प्रत्येक मौसम या नई नदियों/स्थलों पर वाणिज्यिक प्रचालन से पूर्व एक या दो परिचयकरण से पूर्व एक या दो परिचयकरण दौड़ों की सिफारिश की जाती है। नदियां वाणिज्यिक रूप से बाढ़ के स्तर पर नहीं बह रही होनी चाहिए।

13. प्रचालन के दौरान चिकित्सा प्रसुविधाएं और अन्य प्रसुविधाएं उपलब्ध करवाना.-प्रचालक, प्रचालन के दौरान कम से कम त्रिकोणीय पटि्‌टयों, जीवाणूशून्य गदि्‌दयाें, जाली लहरदार पटि्‌टयों, दबाव वाली पटि्‌टयों, प्राथमिक उपचार चिपकने वाली पटि्‌टयों, खपचियों, कैचियों वाली दो प्राथमिक उपचार किटें साथ रखेगा।

14. प्रचालक के कर्तव्य.-प्रचालक का यह कर्तव्य होगा कि,-

(i) वह समस्त घटनाओं/दुर्घटनाओं के बारे में सम्बद्ध संगम/सम्बद्ध जिला प्रशासन/अध्यक्ष सम्बद्ध तकनीकी समिति/उप-निदेशक पर्यटन एवं नागरिक उड्‌डयन या जिला पर्यटन विकास अधिकारी को तुरन्त रिपोर्ट करे ;

(ii) वह यह सुनिश्चित करे कि कार्यकलाप सूर्य छिपने से एक घण्टा पूर्व 6ः00 बजे से पूर्व, जो भी पूर्वतर हो, समाप्त हो जाएं ;

(iii) वह रजिस्ट्रीकरण और अनुज्ञप्ति के प्रयोजन के लिए उपस्कर के विनिर्देशन सहित प्राप्त किए गए उपस्कर के विक्रय पत्र की प्रति उपलब्ध करवाए। इस दस्तावेज के अभाव में रजिस्ट्रीकरण के प्रयोजन के लिए प्रचालक को न विचारे ;

(v) यह प्रचालक का उत्तरदायित्व होगा कि भाग लेने वाला (सहभागी) इन नियमों में अधिकथित मानदण्डों को सर्वथा पालन करे ;

(vi) वह विविध साहसिक क्रियाकलापों के प्रारम्भ से पूर्व भाग लेने वाले (सहभागियों) के लिए न्यूनतम 2.00 लाख रूपए का बीमा सुनिश्चित कर;े

(vii) वह इन नियमों में विहित प्ररूप में अतिथि/आगंतुक के रजिस्टर का अनुसरण करे और उसे अपने पास रखें ;

(viii) वह प्रयुक्त उपस्करों और सहभागियों के नाम की प्रविष्टि के लिए उप-निदेशक पर्यटन/जिला पर्यटन विकास अधिकारी/सहायक पर्यटन विकास अधिकारी या उसके द्वारा सम्बद्ध जिला के प्राधिकृत अधिकारी/पदधारी द्वारा प्रमाणित सम्यक्‌ रूप से दोहरे नम्बर से (डूप्लीकेट) संख्याकित बिल बुक/लॉग बुक को अनुरक्षित करे। सम्प्रवर्तक द्वारा उपस्कर के निरीक्षण, इसकी सफाई-धुलाई, मरम्मत और बदलने आदि के ब्यौरों की बाबत लॉग बुक को प्रतिदिन बनाए रखा जाना चाहिए ;

(ix) वह स्वागत काउण्टर पर एक शिकायत/सुझाव पुस्तिका का अनुरक्षण करे और उसे बनाए रखे ;

(x) दोहरे नम्बर (डूप्लीकेट) से संख्याकित वह संदाये/अग्रिमाें की प्राप्ति के लिए सम्यक्‌ रूप से रसीद बुक का अनुरक्षण करे;

(xi) वह बिल बनाए और कम्पयूटर पर अभिलेख का अनुरक्षण करे तथा उसकी एक सोफ्‌ट प्रति अभिलेख और निरीक्षण हेतु रखे ;

(xii) वह विहित प्राधिकारी या उसके प्रतिनिधि द्वारा समस्त बिल पुस्तकाें और रजिस्टरों को सम्यक्‌ रूप से सत्यापित करवाए ;

(xiii) वह प्ररूप 4 के अनुसार सरकार को क्षतिपूर्ति बंध पत्र प्रस्तुत करे ; और

(xiv) वह प्ररूप 5 के अनुसार भागीदार से बंध पत्र प्राप्त करे ;

15. रजिस्ट्रीकरण फीस और उपयोक्ता फीस का संग्रहण.-प्रचालक प्रचालन प्रारम्भ करने से पूर्व निम्नलिखित फीस का संदाय करेगा/करेंगे,-

(i) उपयोक्ता फीस 1500/- रुपए प्रतिवर्ष ; और

(ii) प्रति गाइड/अनुदेशक फीस 1000/- रुपए प्रतिवर्ष

16. उप-मण्डल स्तर पर, उप-मण्डल विविध साहसिक क्रियाकलाप संगम के नाम और अभिनाम से संगम बनाना.-आयुक्त, निम्नलिखित में से सरकार के दो नामनिर्देशीतीयों को सम्मिलित करके प्रत्येक उप-मण्डल के लिए उप-मण्डल विविध साहसिक क्रियाकलाप संगम के नाम और अभिनाम से उप-मण्डल स्तर पर एक संगम बना सकेगा,-

(i) सम्बद्ध उप-मण्डल का उप मण्डल मजिस्ट्रेट या तहसीलदार अध्यक्ष4431 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (ii) सम्बद्ध उप-मण्डल का पुलिस अधीक्षक या उसका प्रतिनिधि सदस्य जो उप-निरीक्षक की पंक्ति से नीचे का न हो

(iii) जिला पर्यटन विकास अधिकारी या सहायक पर्यटन सदस्य सचिव; और विकास अधिकारी

अन्य सदस्य इन नियमों के अधीन रजिस्ट्रीकृत प्रचालकों में से लिए जाऐंगे। उपर्युक्त संगम के सदस्य बनने के लिए समस्त प्रचालकों को इन नियमाें के अधीन रजिस्ट्रीकृत होना अनिवार्य होगा। 17. उप-मण्डल विविध साहसिक क्रियाकलाप संगम के कृत्य.-उप मण्डल विविध साहसिक क्रियाकलाप संगम सुनिश्चित करेगा कि,-

(i) समस्त विविध साहसिक क्रियाकलापों का संचालन निर्विघ्न, सुरक्षितया और सुविधाजनक रूप में हो ;

(ii) उप-मण्डल विविध साहसिक क्रियाकलाप संगम एक स्वतः विनियामक निकाय के रूप में कार्य करे ;

(iii) सहभागियों के समुचित मार्गदर्शन के लिए हर समय सुरक्षा मानदण्डाें का पालन हो रहा है;

(iv) शास्ति अधिरोपित करने सहित व्यतिक्रमियों के विरूद्ध उपयुक्त कार्रवाई हो ;

(v) किसी दुर्घटना की दशा में, विविध साहसिक क्रियाकलाप के पर्यटकाें/सहभागियों को चिकित्सा प्राथमिक उपचार सहित हर सम्भव सहायता और सहयोग प्राप्त हो ;

(vi) आपातकाल की दशा में संगम पर एम्बुलेंस, चिकित्सा प्रसुविधा और दुर्घटना (दुर्घटनाओं) से बचाव की व्यवस्था हो ;

(vii) हर समय तकनीकी समिति और विनियामक समिति के साथ समुचित सम्पर्क बनाए रखा जाए ;

(viii) निरीक्षण के प्रयोजन के लिए तकनीकी समिति और विनियामक समिति को हर सम्भव सहयोग (सहायता) उपलब्ध हो; और

(ix) प्रचालकों, अनुदेशकों, गाइडों और विविध साहसिक क्रियाकलापाें के प्रचालन में लगे अन्य सम्बद्ध कर्मचारिवृन्द का कल्याण हो।

TOURISM AND CIVIL AVIATION DEPARTMENT

NOTIFICATION

Shimla, the 9th September, 2016

No. TSM. F(1)-3/2013.—In exercise of the powers conferred by section 64 of the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No. 15 of 2002), the Governor, Himachal Pradesh proposes to make the following rules for carrying out the Miscellaneous Adventure Activities and the same are hereby published in the Rajpatra, Himachal Pradesh (Extra- Ordinary) for information of general public;

Any interested person who has any objection (s) or suggestion (s) with regard to these rules, may send the same to the Additional Chief Secretary (Tourism and Civil Aviation) to the Government of Himachal Pradesh within a period of thirty days from the date of publication of the said draft rules in the Rajpatra, Himachal Pradesh;

The objection (s) or suggestion (s), if any, received within the period specified above shall be taken into consideration by the State Government before finalizing the said draft rules, namely:—

DRAFT RULES

CHAPTER-I

PRELIMINARY

1. Short title and commencement.— (1) These rules may be called the Himachal Pradesh Miscellaneous Adventure Activities Rules 2016.

(2) They shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Definitions.- (1) In these rules, unless there is anything repugnant in the subject or context ,-

(a) "Act" means the Himachal Pradesh Tourism Development and Registration Act, 2002 (Act No. 15 of 2002) ;

(b) "Association" means a society registered under the Himachal Pradesh Societies Registration Act, 2006 ;

(c) "Crew Members" mean the persons who conduct the Miscellaneous Adventure Activities like Rappelling, River Crossing, Skiing, Trekking, Rock Climbing, Hot Air Ballooning, Zorbing Balls, Rolling Balls, Water Balls, Bungee Jumping and Zipline/ Flying Fox, Joy Rides /Fun Parks including the guides accompanying the operation ;

(d) "Form" means a form appended to these rules;

(e) "Instructor" means a person who, for the purposes of these rules, is qualified and registered as such and accompanies or conducts the operation of Miscellaneous Adventure Activity (s) for its/ their smooth and safe completion.;

(f) "Miscellaneous Adventure Activities" means the adventure activities like Rappelling, River Crossing, Skiing, Trekking, Rock Climbing, Hot Air Ballooning, Zorbing Balls, Rolling Balls, Water Balls, Bungee Jumping and Zipline/Flying Fox, Joy Rides /Fun Parks, or any other such activity as notified by the Government from time to time ;

(g) "Operator" means an Adventure Activity Operator(s) whether individual, company or an association or society which is registered as such under the Act for carrying out the Miscellaneous Adventure Activities like Rappelling, River Crossing, Skiing, Trekking, Rock Climbing, Hot Air Ballooning, Zorbing Balls, Rolling Balls, Water Balls, Bungee Jumping and Zipline/Flying Fox, Joy Rides /Fun Parks etc ;

(i) "Participant" means the person (s) who participates in Miscellaneous Adventure Activities ;

(j) "Society" means a Co-operative society registered under the Himachal Pradesh Co- operative Societies Act, 1968 ;

(k) "season", for the purpose of these rules, means whole of the year excluding the period from 15th July to 15th September during which no river crossing activities shall be permitted/undertaken; provided that river crossing activities may be permitted in Lahaul & Spiti District during the period from 15th July to 15th September, if the weather conditions permit to do so;

(l) "section" means a section of the Act ; and

(m) "Technical Committee" means the Committee constituted by the Commissioner under rule 8;

(2) All the other words and expressions used in these rules but not defined shall have the same meaning respectively as assigned to them in the Act.

CHAPTER-II

REGISTRATION

3. Application for registration of Miscellaneous Adventure Activities Operator.—(1) Any person intending to act as an Miscellaneous Adventure Activities Operator may make an application on form-1 to the prescribed authority for registration alongwith demand draft of Rs.2000/- in favour of prescribed authority for the ensuing season from 1st of January to 15th of March each year. The prescribed authority shall scrutinize the applications, so received, initially and put up the same before the Technical Committee which shall hold the meeting before 15th of April each year and fix date, time and venue for the scrutiny, inspection of the documents and equipments, conducting practical/ physical tests of guides/ instructors and final approval by giving at least 15 days' clear notice to all the qualified operators.

(2) No operator shall be permitted to operate Miscellaneous Adventure Activities in the middle of the season.

(3) The operator (s) or guide (s) or instructor (s) or societies (s), as the case may be, who have a local office and have at least two years' experience in the relevant field shall be registered with the Tourism Department, Himachal Pradesh under the Act.

(4) The prescribed authority shall issue a Certificate of Registration in form-3 to the concerned operator after the approval of the Technical Committee for a period of three years from the date of issue.

(5) No person, other than an operator, registered for carrying out the Miscellaneous Adventure Activities shall be permitted to carry on any operation either directly or indirectly unless the Technical Committee is satisfied that the operator has all the equipments and fulfils other requirements under these rules and his proposal has been duly approved/cleared by the Technical Committee.

4. Qualifications.—(1) No operator shall be permitted to operate the Miscellaneous Adventure Activities unless he has qualified guides/instructors who have done methods of instruction course from Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports, Manali, H.P. or Himalayan Mountaineering Institute, Darjeeling or Nehru Institute of Mountaineering, Uttrakashi or Jawahar Institute of Mountaineering and Winter Sports, Pehlgam or any recognized National or State Institute with at least experience of two years in concerned activities and with required standards with good track record.

(2) No operator shall be permitted to operate the Skiing unless he has qualified guides/instructors who have done Methods of Instruction (Skiing) course from Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports, Manali, H.P. or Indian Institute of Skiing and Mountaineering Gulmarg or sGarhwal Mandal Vikas Nigam Limited, Auli or Jawahar Institute of Mountaineering and Winter Sports, Pehlgam or any recognized National or State Institute with at least experience of two years in concerned activities and with required standards with good track record.

(3) The operator who has done Advance Course in the concerned activity from any recognized National or State Institute, may be registered as such for Miscellaneous Adventure Activities.

(5) Requirement for Applying/Registration for Miscellaneous Adventure Activities/ Fun Parks.—The promoters intending to apply shall submit following details with their applications,-

(i) Type, Make, Model of the equipment for all types of Miscellaneous Adventure Activity concerned alongwith bills. The equipment shall be duly certified by the certifying agencies like the International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme), Committee of European Norms (C.E.N), Bureau of Indian Standards (B.I.S). or International Organisation for Standardisation (ISO);

(ii) design/load carrying capacity, Life and what periodic repairs are required for its safe operation. After permission to install the rides/equipments, the applicant or promoter concerned shall obtain final inspection report from the Technical Committee. No Fun Park shall be opened to the public unless it is cleared by the Technical Committee; and (iii) quarterly inspection of the equipment by the Technical Committee shall be mamdatory and the Committee shall have the powers to order temporary closure of the activities. If desired safety standards are not met, the Committee may recommend its permanent closure.

6. Registration of Guide/Instructor.—(1) Any person intending to participate in Miscellaneous Adventure Activity (ies) as a guide or an instructor, shall apply to the prescribed authority for registration alongwith prescribed documents/and a demand draft of Rs. 2000/- (Rs. Two Thousand only) in favour of the prescribed authority in Form-2. After being fully satisfied that the applicant fulfils the requisite qualifications and standard for registration and his application has the recommendations of the Technical Committee, the prescribed authority of the area concerned shall issue a certificate of registration for a period of three years from the date of issue.

(2) The prescribed authority may accept the application for the registration as Miscellaneous Adventure Activities operator through e-mail and acknowledge through e-mail and also register him as Miscellaneous Adventure Activities operator if the application is complete in 4440 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 all respect as required under the Act. In case of acceptance of the application through e-mail, the prescribed authority may accept the registration fee at the time of issuance of the Registration Certificate under rule 3.

7. Qualification of Guide/Instructor.—(1) The guide/ instructor must be 21 years of age and should be medically fit as certified by the Medical Officer. He should also hold a valid basic First Aid and Cardio Pulmonary Resuscitation (CPR) Certificate or equivalent issued by Medical Officer of the Government Hospital or any recognized institution. He should have good communication skills in Hindi and English.

(2) The instructor for Miscellaneous Adventure Activities should have qualified Methods of instruction course in mountaineering from any registered/recognized Mountaineering Institutes in India i.e. Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports, Manali, H.P. or Himalayan Mountaineering Institute, Darjeeling or Nehru Institute of Mountaineering, Uttrakashi or any recognized National or State institute or any institute abroad or its equivalent and for the adventure activity of Skiing should have qualified the Methods of Instruction Course (Skiing) from Atal Bihari Vajpayee Institute of Mountaineering and Allied Sports, Manali, H.P. or Indian Institute of Skiing and Mountaineering, Gulmarg or Garhwal Mandal Vikas Nigam Limited, Auli or Jawahar Institute of Mountaineering and Winter Sports, Pehlgam or any recognized National or State Institute with at least experience of two years in concerned activities and with required standards with good track record.

8. Constitution of the Technical Committee.—The Commissioner shall, by notification, constitute a Technical Committee for an area for conducting Miscellaneous Adventure Activities like Rappelling, River Crossing, Skiing, Trekking, Rock Climbing, Hot Air Ballooning, Zorbing Balls, Rolling Balls, Water Balls, Bungee Jumping and Zipline/Flying Fox, Joy Rides /Fun Parks etc. which shall consist of the following members namely:—

(i) The Director, Atal Bihari Vajpyee Institute Chairman, of Mountaineering & Allied Sports, Manali. or his representative

(ii) The Sub-Divisional Officer(Civil) of area Member, concerned or his/her representative.

(iii) The Deputy Superintendent of Police of area Member, concerned

(iv) Divisional Forest Officer concerned or Member, his/her representative.

(v) Chief Medical Officer of area concerned Member, or his/her representative.

(vi) Instructor or representative of , Atal Bihari Member, Vajpyee. Institute of Mountaineering & Allied. Sports, Manali

(vii) Two members of related Adventure Activities Members, (one member of the association and one member from Concerned registered adventure activity or any Knowledgeable member).

(viii) Executive Engineer (Mechanical) HPPWD, Member, of the area concerned.

(ix) Deputy Director Tourism & Civil Aviation or Member Secretary District Tourism Development Officer And in his absence Assistant Tourism Development Officer of the area concerned.

9. Functions of the Technical Committee:—The Technical Committee shall be responsible to,—

(i) inspect and certify the equipment possessed by the operator from safety point of view as per rules 3 and 4 ;

(ii) scrutinize the bio data of the operator (s) and guide (s)/ instructor (s) and to conduct their physical tests in order to ascertain their expertise and, by doing so, approve the issue of licence both to the operators as well as guide (s)/instructor (s);

(iii) ensure that the operator (s), the guide (s)/and instructor (s) shall follow the procedures indicated in these rules ;

(iv) identify new sites, rivers, spots and areas for operation of Miscellaneous Adventure Activities in the State, where operations can safely be conducted;

(v) identify and recommend the notification of other sports/activities as Miscellaneous Adventure Activities;

(vi) Inspect & certify the artificial anchors for Rappelling, River Crossing, Anchorage bolts & other fixtures and the equipment;

(vii) recommend the fee to be charged from the tourists/participants by the prescribed authority ;

(viii) issue guidelines and advisories, if any, for the safe conduct of the Miscellaneous Adventure Activities mentioned in the rules from time to time;

(ix) determine the medical fitness of the operator (s)/guide (s)/and instructors;

(x) fix the carrying capacity of the area; and

(xi) notify the exact stretches and places for the conduct of Miscellaneous Adventure Activities.

10. Constitution of Regulatory Committee and its functions.—The Commissioner (Tourism) shall, by notification, constitute a Regulatory Committee for each site, river and area of operation, consisting of the following members, namely:

(i) The Deputy Commissioner of the concerned District Chairman, (ii) Superintendent of Police of the concerned District Member, (iii) Sub-Divisional Magistrate of the concerned area Member,4442 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (iv) Commandant Home Guards of the concerned area Member, (v) Chief Medical Officer of the concerned District or Member, his representative

Member, (vi) Representative of, Atal Bihari Vajpyee Institute of Mountaineering and Allied Sports, Manali

(vii) Executive Engineer (Mechanical), HPPWD, of the Member, concerned area

(viii) Deputy Director Tourism & Civil Aviation or Member District Tourism Development Officer and in his Secretary absence Assistant Tourism Development Officer

11. Functions of the Regulatory Committee.—The Regulatory Committee shall perform the following functions,—

(i) the Regulatory Committee shall exercise the overall control for regulating the operations in the area with the assistance of the Miscellaneous Adventure Activities Associations, if any, of the district concerned;

(ii) the Regulatory Committee may conduct surprise inspections during the operations to ensure that these rules are being followed; and

(iii) the Regulatory Committee may be entrusted with any other function in relation to Miscellaneous Adventure Activities operation by the Government.

CHAPTER-III

SAFETY MEASURES

12. Equipment required for carrying out Miscellaneous Adventure Activities Operations.—Each operator shall arrange the following equipment (s) before he is permitted to carry out the operation. The Technical Committee shall check each item of equipment (s) and get the same stamped through the Deputy Director Tourism & Civil Aviation or District Tourism Development Officer or Assistant Tourism Development Officer of the area concerned, namely:—

(i) Rappelling:—

(a) the stance should be well protected;

(b) the site should have sufficient place for free movement ;

(c) the landing site should have enough space;

(d) the First-Aid box to be available all the time;

(e) the area should be free from stone/boulder falling & loose stones; and

(f) the standard equipment, Bureau of Indian Standards (BIS) or international standard should have the make, model, year of manufacturing, year of purchase and all other technical specifications. The standard equipment should be of the following specifications:—

• 10 to 11 mm in diameter.

• 120 to 140 feet in length.

• Kernamantle rope.

• Minimum 800 kg breaking strength (International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme) certified).

➢ Rappelling Rope:—

• 8 to 10 mm in diameter.

• 180 to 200 feet in length.

• Kernamantle rope.

• Minimum 600 kg breaking strength International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme) certified).

➢ Carabineer:—

• Zicral alloy with screw gate.

• 3000 kg strength.

• International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme) certified.

➢ Rappelling Seat Harness:—

• Adjustable.

• Padded, nylon material.

• International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme) certified.

➢ Gloves:—

• Leather palmed with stretch nylon and canvass material (cloth).

➢ Foot Wear:—

• Rubber soled.

➢ Figure of Eight (Descender):—

• Not less than 2500 kg breaking strength.

• International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme) certified.

➢ Clothing:—

• Not loose, proper fit.

• Bureau of Indian Standards (B.I.S) or International Standard.

• With strap, must be in good condition with no leakage or compartment damage.

(ii) River Crossing/ Zipline/ Flying Fox:—

(a) For Zipline/Flying Fox two methods are applied i.e. Flying Fox or Tyrolean Traverse. Ropes, carabiners pulley & seat harness play a major role to cross safely. For Zipline/Flying Fox (ropes attached on the ends above the river) only static cabala rope should be used as per the standard of International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme), Bureau of Indian Standards (B.I.S), International standard mark. For commercial purpose, the pulley should be of larger size labeling labeling standard of International Climbing and Mountaineering Federation (Union Internationale des Association d'Alpinisme), Bureau of Indian Standards (B.I.S), International standard mark to ensure the safety of the tourists/ adventure lovers with a belay rope. Helmet is essential which provides maximum safety to the head in case of any eventuality. Anchors on both sides of the river, either artificial or natural must be solid or bomb proof. One extra fiber core steel wire rope of the diameter which can be selected on the basis of span & load to be carried should be provided as a safety measure. The person crossing the river should be attached to this wire rope also which act as a safety measure. Additional steel wire rope having fiber core of minimum 12 mm diameter of 6 x 19 (12/6/1) construction or 6 x 37 (18/12/6/1) has to be provided. The equipment should be of the following specifications:—

• the anchorage block should be made under ground with minimum size 1.5x1x1 m, C.C. (1:2:4) having anchorage girder with round footing.

• the abutment should be minimum 2 meters ahead of the anchorage block.

• minimum 8 Nos. U-clamps conforming to relevant Inidan Standard Code be provided for holding additional rope.

• all pulleys must conform to relevant Indian Standard Code and made of mild steel.

• all bolts provided should be of High Tensile (HT) grade.

• all guides/ participants must have a life jacket on all times while participating in river crossing activity. The life jacket must have adequate buoyancy (minimum of 6.14 kg and preferable 9-10 kg), must be the proper type (U.S. Coast Guard type III or V/Committee of European Norms (C.E.N) /International Organisation for Standardisation (ISO) with a provision of ensuring a snug fit by straps etc. and the life jacket must be worn correctly. Inflatable life jacket and the 'Keyhole' type jackets should not be allowed. Guides must ensure that the life jackets are fastened in a secure manner before the start of trip.

• relevant provisions of Himachal Pradesh aerial Ropeway Act, 1968 are to be adhered to strictly.

Essential Requirement.—All parts of the jump line must be duplicated. This extends from the connection of the bungee to the jumper and the connection to the structure at the other end of the line. Normally the jumper should have an attachment to ankle straps and another to a body or seat harness.

➢ Equipment.—B&UL harness, karabiners should be of sound construction and suitable for this use. Mountaineering equipment from reputable suppliers is appropriate and karabiners should be of the screw gate type.

➢ Braided Ropes.—At least 2 braided ropes should be used and matched to the weight of the jumper, they should be to BS 3F 70 1991 specification for heavy duty braided rubber cord, or to a demonstrably similar standard.

➢ Unbraided Ropes.—Normally one unbraided rope is adequate because of the in- built redundancy from its structure of approximately one thousand individual stands bound together. Each rope should have an examiners certificate from an independent source and be selected according to the weight of the jumper.

➢ Rope Log Books.—Should be kept, describing maximum load, a proper training schedule showing how a person progresses from one level of competence to the next.

➢ The person in overall charge.—Should keep close control of the site. Arrangements should be made to exclude spectators from the jump zone for their own safety and to avoid distraction of the operators.

➢ Anyone in charge should be securely attached to it. Spectator riding especially by children below the age of 13 years should be discouraged.

➢ There should be a dead-weight drop test of the whole line at the beginning of the day to ensure its integrity.

(iv) Hot Air Ballooning.—Adventure activity where any kind of aircraft, balloon, glider etc. is planned needs to have appropriate clearances from Director General of Civil Aviation (DGCA) and necessary notification to Indian Air Force Identification Agencies (ADIA) is mandatory. The following may be emphasized before clearance/license to operate such activities are issued:-

➢ NOTAM.—to conduct the flying/ air adventure activities it is mandatory to inform the concerned civil aviation agencies such as DGCA so that the nature of the flying activity may be known for safe and smooth conduct of flying activities.

➢ Air Defence Identification Agency Clearance.—There is an inescapable requirement for such operators/flying schools/air adventure clubs to intimate their flight plan to concerned Air Defence Identification Agency (ADIA) with all necessary details- height, duration of flight, area of operation etc. for issue of Air Defence Clearance, prompt identification of the aerial object and effective airspace management without jeopardizing flight safety.

4446 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (v) Guidelines for Fun Parks having Joy Rides.—For ensuring safety a separate Sub- Committee shall be formed to inspect the equipments on quarterly basis comprising of the following members:—

(a) Sub-Divisional Officer (Civil) concerned Chairman

(b) Representative of Executive Engineer, HPPWD Member (Mechanical) concerned area.

(c) Representative from Police Department Member not less than ASI

(d) Deputy Director Tourism /District Tourism Member Development Officer/Assistant Tourism Secretary Development Officer

(vi) Other Adventure Sports.—Already existing National/ International norms/ guidelines shall be applicable.

(vii) Familiarization Runs.—One or two familiarization runs before operating commercially each season or on new rivers/ sites are recommended. Rivers should not be run commercially at flood levels.

13. Medical facilities and other facilities to be made available during operation.—The operator during each operation shall carry two well-equipped first aid kits consisting of triangular bandages, sterile pads, gauze roller bandages, pressure bandages, first aid adhesive tape, splints, scissors, as a bare minimum.

14. Duties of Operator.- It shall be the duty of the operator,—

(i) to report all incidents/ accidents immediately to the Association concerned/ District Administration concerned/ Chairman, Technical Committee concerned/Dy Director Tourism & Civil Aviation or District Tourism Development Officer;

(ii) to ensure that the activities finish one hour before sun set or 6.00 P.M. whichever is earlier;

(iii) to provide copy of sale letter of the equipment procured alongwith specification of equipment for the purpose of Registration & License. In absence of this document, the operator may not be considered for the purpose of registration;

(iv) to keep the environment clean;

(v) It shall be the responsibility of the operator that the participant adhere strictly to the norms laid down in these rules;

(vi) to insure the participants for minimum Rs. 2.00 lakh before commencing the Miscellaneous Adventure Activity (ies).

(vii) to maintain and keep a Guest/ Visitor Register in the form prescribed in the Rule; (viii) to maintain Bill Book/ Log Book duly numbered in duplicate certified by the Deputy Director Tourism/ DTDO/ ATDO or his authorized officer/ official of the4447 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 District concerned for entry of equipment used and name of participants shall be maintained. The Log Book should be maintained daily with regard to inspection of the equipment by promoter, its service, repair and detail of replacement etc; (ix) to maintain and keep a Complaint/ Suggestion Book at the reception counter;

(x) to maintain a Receipt Book duly numbered in duplicate for receipt of payments/ advances;

(xi) to do billing or maintains the record on computer and keep a soft copy of the same for record and inspection;

(xii) to get all the bill books and registers duly verified by the prescribed authority or its representative;

(xiii) to submit the Indemnity Bond to the Government as per Form-4; and

(xiv) to get an undertaking from the participant as per Form-5.

15. Collection of Registration Fee and User Fee.—The operator (s) shall, pay the following fees before commencing the operations;

(i) User Fee: Rs. 1500/- per year ; and

(ii) Per Guide/ Instrctor Fee : Rs. 1000/- per year.

16. Formation of association at sub divisional level under name and style of Sub Division Miscellaneous Adventure Activities Association.—The Commissioner shall form an association at the Sub Division level with the name and style of Sub Divisional Miscellaneous Adventure Activities Association for each Sub Division involving two nominees of the Government,—

(i) Sub Divisional Magistrate of the Chairman Sub Division concerned or Tehsildar. Member

(ii) Deputy Superintendent of Police of the Sub Division concerned or his representative not below the rank of a Sub- Inspector;

(iii) District Tourism Development Officer Member Or Assistant Tourism Development Secretary Officer and

Other members shall be taken from amongst the operators registered under these rules. It will be mandatory for all the operators registered under these rules to become a member of the aforesaid association.

17. Function of the Sub Divisional Miscellaneous Adventure Activities Association.— The Sub Divisional Miscellaneous Adventure Activities Association shall ensure that,—

(i) all the miscellaneous adventure activities are conducted smoothly, safely and conveniently;

(iii) all the safety norms for being adhered to all the time for proper guidance of the participants;

(iv) a suitable action be taken against the defaulters including imposition of penalty;

(v) all possible help and assistance including medical first-aid be extended to the tourists/ participants of the Miscellaneous adventure activities in case of an accident;

(vi) Ambulance, medical facility and evacuation of casualty (ies) be arranged timely in case of emergency;

(vii) proper liaison with the Technical Committee and Regulator Committee be maintained all the time;

(viii) all possible assistance to the Technical Committee and the Regulatory Committee for the purpose of inspection be provided; and.

(ix) the welfare of the operators, instructors, guides and other concerned staff involved in conducting of miscellaneous adventure activities.

(ii) इसे 1 जनवरी, 2014 से प्रवृत्त हुआ माना जाएगा और इसे सदैव इसी रूप में प्रभावी हुआ माना जाएगा।

2. पैराग्राफ-6ग का संशोधन.--निर्वाचन प्रतीक (आरक्षण और आवंटन) आदेश, 1968 के मौजूदा पैराग्राफ-6ग को निम्नलिखित के द्‌वारा प्रतिस्थापित किया जाएगाः--

''6ग-राष्ट्रीय या राज्यीय दल के रूप में मान्यता प्राप्त बने रहने के लिए शर्तें.--(1) पैरा 6क और पैरा 6ख में कुछ भी होते हुए, यदि राज्यीय दल या राष्ट्रीय दल के रूप में मान्यताप्राप्त कोई राजनीतिक दल, उस लोक सभा/संबंधित विधान सभा के साधारण निर्वाचन, जिसके आधार पर उसने मान्यता प्राप्त की थी, के उपरांत आयोजित लोक सभा या राज्य की विधान सभा, जैसा भी मामला हो, के अगले साधारण निर्वाचन (जिन्हें इसमें इसके पश्चात्‌ ''अगला निर्वाचन'' कहा गया है) में, पैरा 6क या पैरा 6ख, जैसा भी मामला हो, की शर्तों को पूरा करने में विफल रहता है तो उसे मान्यताप्राप्त राज्यीय दल या राष्ट्रीय दल, जैसा भी मामला हो, माना जाता रहेगा।

(2) यदि कोई मान्यताप्राप्त राजनीतिक दल उप-पैरा (1) के उपबंधों के अंतर्गत, लोक सभा या, जैसा भी मामला हो, राज्य की विधान सभा के अगले निर्वाचन के बाद मान्यताप्राप्त राष्ट्रीय दल या राज्यीय दल के रूप में माना जाना जारी रहता है, तो यह प्रश्न कि क्या लोक सभा या जैसा भी मामला हो, संबंधित राज्य की विधान सभा के किसी अनुवर्ती साधारण निर्वाचन के बाद भी यह मान्यताप्राप्त बना रहेगा, यह उस दल द्‌वारा पैरा-6क या 6ख, जैसा भी मामला हो, में विनिर्दिष्ट शर्तों को पूरा किए जाने की शर्तों के अधीन होगा।''

No.56/Symbol/2016/PPS-II.—In exercise of the powers conferred by Article-324 of the Constitution of India read with section 29A of the Representation of the People Act, 1951, section 21 of the General Clauses Act, 1897, Rules 5 and 10 of the Conduct of Elections Rules, 1961, and all other powers enabling the Commission in this behalf, the Election Commission of India hereby 4456 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 makes the following Order to further amend the Election Symbols (Reservation and Allotment) Order, 1968, namely:—

1. Short title and commencement.—(i) This Order shall be called the Election Symbols (Reservation and Allotment) (Amendment) Order, 2016.

(ii) It shall be deemed to have come into force with effect from 1st January, 2014, and shall always be deemed to have been so effective.

2. Amendment of Paragraph-6C.—The existing Paragraph-6C of the Election Symbols (Reservation and Allotment) Order, 1968 shall be substituted as follows:—

"6C-Conditions for continued recognition as a National or State Party.—(1) Notwithstanding anything in Paragraph 6A and Paragraph 6B, if a political party recognized as a State Party or National Party fails to fulfil the conditions of Paragraph 6A or, as the case may be, Paragraph 6B, at the next general election to the House of the People or, as the case may be, to the Legislative Assembly of the State, following the general election to the House/Assembly concerned on the basis of which it got recognition (hereinafter referred to as "the next election"), it shall continue to be treated as recognized State Party or National Party, as the case may be.

(2) If a recognised political party continues to be treated as recognised National Party or State Party after the next election to the House of the People or, as the case may be, to the Legislative Assembly of the State under the provisions of sub-paragraph (1), the question whether it shall further continue to be so recognised after any subsequent general election to the House of the People or, as the case may be, to the Legislative Assembly of the State concerned, shall be subject to the fulfilment by the party of the conditions specified in Paragraph-6A or 6B, as the case may be."

No. PUB (F)-12-2/2011.—In supersession of all previous notifications issued in this behalf from time to time, the Governor , Himachal Pradesh is pleased to make the following Rules:—

1. Short Title, Commencement and Definitions.—(1) These rules shall be called "Himachal Pradesh Government Awards for Development Journalism, Rules, 2016."

(2) They shall come into force from the date of publishing the notification in the official gazette.

(3) In these rules, following words shall have the meaning as assigned to them, unless a different intention appears from the subject of context.

(b) "Development reporting" is reporting the change that is taking place in the lives of the people in the State. It should tell the story of what is going well and what is going wrong. It includes reporting on non-officials initiatives in State's development, educational reforms, social welfare etc. and in depth reporting of official development programmes. All development reporting should be necessarily investigative.

(c) "Director" means the Director of Information and Public Relations appointed as such by the Government.

(d) "Journalist" means a person engaged in the profession of Journalism and working in newspapers/news agencies/TV/News Networks/as Editor, Associate Editor, Assistant Editor, Chief Sub Editor, Senior Sub Editor, Sub Editor, Staff Correspondent, Special Correspondent, Principal Correspondent and Sr. Correspondent/ Correspondent but shall not include a Government employee.

(e) "Newspaper" includes dailies, weeklies of standing having a good circulation, not less than 20,000 copies and other periodicals being published regularly in English or Hindi.

(f) "Electronic Media" means a Satellite News Channels having telecast at national hook up.

(g) "Screening Committee" means a Committee constituted by the Government for the purpose from time to time.

(h) "Year" means the year starting from 01st January and ending on 31st December of year.

2. Objective of the Scheme.—Objective of the Scheme.—To expound the achievements of State Government from development point of view at various levels.

3. Type and Value of Awards.—Type and Value of Awards.—(1) There shall be four types of awards, categorized as under:—

(A) National Award,

(B) State Award ,

(C) District Award ,

(D) Electronic Media Award,

(A) National Award, for which national level stories will be considered and will be opened to all journalists throughout the country.

(B) State Award, for State Award, the state level stories would be considered and Journalists stationed or posted in Himachal Pradesh and working in Himachal Pradesh will be eligible for this Award.

(C) District Award, this will be given for district level best stories and Journalists working in the districts who will be eligible for the District level Award.

(D) Electronic Media Award, this award will be given for best developmental story telecast on any National/Satellite News Channels.

(2) (i) Value of the National Award for Print Media.—The Value of the National Award for the best story published in the newspapers and other periodicals will be Rs. 1,00,000/- (Rupees One Lakh).

(ii) Value of State level Award for Print Media.—For first best story published in newspapers and other periodicals will be Rs. 75,000/- (Rupees Seventy Five Thousand)

For second best story published in newspapers and other periodicals will be Rs. 40,000/- (Rupees Forty Thousand).

For third best story published in newspapers and other periodicals will be Rs. 30,000/- (Rupees Thirty Thousand).

(iii) Value of District level Award for Print Media.—For first district level best story published in the newspapers and other periodicals will be Rs. 50,000/-( Rupees Fifty Thousand).

For second best district level story published in the newspapers and other periodicals will be Rs. 30,000/- ( Rupees Thirty Thousand )

For the third best district level story published in the newspapers and other periodicals will be Rs. 20,000/- (Rupees Twenty Thousand).

(iv) Value of Award for Developmental story telecast on Satellite News Channel.—(a) For the first best developmental story telecast on Satellite News Channel on national hook up will be Rs. 50,000/- (Rupees Fifty Thousand).

(b) For the second best developmental story telecast on Satellite News Channel on national hook up will be Rs. 30,000/-. ( Rupees Thirty Thousand ).

(c) For the third best developmental story telecast on Satellite News Channel on national hook up will be Rs. 20,000/- (Rupees Twenty Thousand).

4. Entitlement for Award.—Entitlement for Award.—(1) The award will be given to Journalist for writing the best developmental story about the State which can be on any aspect of development as defined in rule 1 (3) (b).

(2) The language and presentation of the story shall also be taken into account while matching selection for award stories.

(3) In the case of Award, where two or more than two stories are found to be equal merit, the amount of the award will be apportioned equally.

(4) A Journalist who has received an award shall be considered again after three years from the year in which he has been given such award.

(5) A Journalist shall be disqualified for the award, if it is established to the satisfaction of the Government that canvassing has been done on his behalf for award.

(6) Only those stories which have been published/ telecast during the calendar Year i.e. 1st January to 31st December will be considered for the award.

5. Procedure for Selection.—Procedure for Selection.—(1) Entries for the Award may be received by the Director, Information and Public Relations through any of the following methods:—

(i) The Director may select Stories published during the year, at his own initiative.

(ii) Story of deserving Journalists can be sponsored by any individual or organization.

(iii) A Journalist may, on his own, file an entry for the award. The Director will announce the awards in the press and will also circulate the Scheme of Awards to all Directors of Public Relations in different States of the Country for further circulation to the newspapers in their States as also directly to major newspapers.

(iv) The Director (I&PR) will constitute a committee of five eminent personalities from different fields from the Himachal

Pradesh, who individually or collectively will nominate or select stories for consideration of the awards which have been published in daily newspaper or telecast in electronic media in or outside State in that calendar year.

(2) No entry fee shall be charged.

(3) Each person/organization will mention whether the entry is for the District level, State level, or the National Level Award. Each entry shall be accompanied by four photo state copies of the Story, as published in the newspapers, along with one copy of the entire original newspaper in which it was published. For award to Electronic media, the best story telecast will be considered for which entries in the shape of DVD/CD with a certificate from the Head of the National Satellite News Channel about telecast of the story with time and date will have to be submitted.

(4) There shall be a Screening Committee consisting of the Secretary (I&PR), the Director and one eminent Journalist to be nominated by the Government. The Committee shall select the entries which in their view deserve further consideration by the Board of Judges.

(5) The Government shall, every year nominate a Board of four Judges, who shall be eminent Journalists and at least one of whom shall be a Journalist of a Hindi newspaper. One member will be from the National Satellite News Channel.

(6) The screened entries shall be sent to each Judge for his/her consideration but the decision of the Board of Judges will be taken in a meeting. The Board may, if it thinks fit, recommend that no story deserves an award.

(7) Each Judge of the Board of Judges and the Non-Official Member of Screening Committee shall be entitled to an honorarium of Rs. 5000/-, besides, he shall be declared as State Guest and also be entitled to journey expenses by any mode of travel (including air).

(8) The evaluation by the Board of Judges shall be considered by the Government and awards will be announced every year.

(9) The decision of the Government on the award shall be final and shall not be questioned in any court of Law.

Presentation of Award.—Presentation of Award.—(1) The award shall be given in a simple but befitting function to be organized by the Information and Public Relations Department. (2) The award winners shall be treated as State Guests and shall be given to and fro free expenses from his place of normal residence by any mode of communication.

7. Miscellaneous Provisions.—Miscellaneous Provisions.—(1) The Govt. shall have the power to make any change in the scheme or issue any clarification in respect of the scheme whenever necessary.

(2) The Director of Information and Public Relations Department will be over all in- charge of the scheme and may issue necessary instructions in this regard for its proper implementation from time to time.

संख्या-पी.सी.एच.-एच.ए.(1)11/2010-II.--हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ वेतनमान आशुलिपिकों की नियुक्ति और सेवा की शर्तें) नियम, 2013 का प्रारूप, अधिसूचना संख्या पी.सी.एच.- एच.ए. (1)11/2010-II तारीख 10 जुलाई, 2013 द्वारा, राजपत्र हिमाचल प्रदेश में तारीख 23 जुलाई, 2013 को हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 186 के अधीन यथाअपेक्षित के अनुसार, इससे सम्भव्य प्रभावित होने वाले व्यक्तियों से आक्षेप और सुझाव आमंत्रित करने के लिए प्रकाशित किया गया थाः और नियत अवधि के दौरान इस निमित कोई भी आक्षेप/सुझाव प्राप्त नहीं हुआ है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक-4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाते है, अर्थातः-

1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (जिला परिषद्‌ में कनिष्ठ वेतनमान आशुलिपिकों की नियुक्ति और सेवा की शर्तें) नियम, 2016 है।

2. परिभाषाएं.--(1) इन नियमों में, जब तक सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 अभिप्रेत है ;

(ख) ''निदेशक'' से निदेशक, पंचायती राज, हिमाचल प्रदेश अभिप्रेत है; और

(ग) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिपे्रत है।

(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं है, के वही अर्थ होंगे जो उनके अधिनियम में हैं।4461 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 3. पदों की संख्या.-कनिष्ठ वेतनमान आशुलिपिक के पदों की, अपने-अपने जिला परिषदों में, ऐसी संख्या होगी, जैसी सरकार द्वारा मंजूर की गई हो और समय-समय पर मंजूर की जाए।

4. वेतनमान.-कनिष्ठ वेतनमान आशुलिपिकों के पद का वेतनमान निम्नलिखित होगाः- (क) नियमित रूप से नियुक्त व्यक्तियों के लिए वेतनमान : पे बैंड 5910-20200 रूपए 2800 रूपए ग्रेड पे; और

(ख) संविदा पर नियुक्त व्यक्तियों के लिए उपलब्धियां : नियम 14 में दिए गए ब्यौरे के अनुसार 8710/-रूपए प्रतिमास।

5. पद का प्रकार (चयन पद अथवा अचयन पद).--कनिष्ठ वेतनमान आशुलिपिक का पद अचयन होगा।

6. सीधी नियुक्ति के लिए आयु.-कोई व्यक्ति कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त किए जाने हेतु तभी पात्र होगा, यदि उसकी आयु 18 से 45 के बीच हैः

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में छूट के लिए पात्र नहीं होगाः

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य वर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतनी ही छटू दी जा सकेगी, जितनी हिमाचल प्रदेश सरकार के साधारण या विशेष (आदेशों) के अधीन अनुज्ञेय हैः

परन्तु यह और भी कि पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के सभी कर्मचारियों को, जो ऐसे पब्लिक सेक्टर, निगमों तथा स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी जाएगी, जैसी सरकारी कर्मचारियों को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के ऐसे कर्मचारिवृन्दक को नहीं दी जाएगी, जो पश्चात्‌वर्ती ऐसे निगमों/स्वायत्त निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे।

(1) सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

(2) अन्यथा सुअर्हित अभ्यर्थियों की दशा में सीधी भर्ती के लिए आयु सीमा और अनुभव, राज्य सरकार के विवेकानुसार शिथिल किया जा सकेगा।

7. सीधे नियुक्त किए जाने वाले व्यक्तियों के लिए अपेक्षित और अन्य अर्हताएं.--(1) कनिष्ठ वेतनमान आशुलिपिक के पद पर नियुक्ति के लिए अभ्यर्थी, हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त स्कूल शिक्षा बोर्ड से, कम से कम दस जमा दो (102) या इसके समतुल्य शैक्षित अर्हता रखता हो।

(2) कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त के लिए प्रत्येक अभ्यर्थी की हिन्दी और अंग्रेजी आशुलिपि में क्रमशः अस्सी शब्द और सत्तर शब्द प्रति मिनट की गति होनी चाहिए और अंग्रेजी और हिन्दी टंकण में क्रमशः चालीस और तीस शब्द प्रति मिनट की गति होनी चाहिएः 4462 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 परन्तु यथा उपरोक्त वर्णित आशुलिपि और टंकण में अपेक्षित गति रखने वाला कोई अभ्यर्थी, केवल एक भाषा में भी पद के लिए आवेदन करने के लिए पात्र होगा और पद पर नियुक्ति के लिए चयन की दशा में, उसे पद पर कार्यग्रहण करने की तारीख से छह मास के भीतर, दूसरी भाषा में टेस्ट उत्तीर्ण करना होगा। (3) उन अभ्यर्थियों को अधिमान दिया जाएगा, जो हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता रखते हों।

8. परिवीक्षा की अवधि.--नियमित आधार पर नियुक्त व्यक्ति, दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा मुख्य कार्यकारी अधिकारी, जिला परिषद्‌, विशेष परिस्थितियों में और लिखित कारणों से आदेश दे।

9. नियुक्ति की पद्धति.--अभ्यर्थी, सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर नियुक्त किया जाएगा।

10. सीधी/संविदा नियुक्ति हेतु अनिवार्य अपेक्षा.--कनिष्ठ वेतनमान आशुलिपिक के रूप में नियुक्त किए जाने के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

11. नियुक्ति के लिए चयन.--यथास्थिति, सीधी या संविदात्मक नियुक्ति के मामले में, पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर या अन्य भर्ती प्राधिकरण, ऐसा करना आवश्यक या समीचीन समझे, तो लिखित परीक्षा या व्यावहारिक परीक्षा के इस आधार पर किया जाएगा, जिसका स्तर/ पाठ्‌यक्रम आदि, यथास्थिति, बोर्ड या अन्य नियुक्ति प्राधिकारी द्वारा अवधारित किया जाएगा।

12. नियमित आधार पर नियुक्त व्यक्तियों की सेवा की शर्तें.--नियमित आधार पर नियुक्त व्यक्तियों की दशा में, सेवा की वे अन्य शर्तें, जो राज्य सरकार के कनिष्ठ वेतनमान आशुलिपिक को लागू हैं, आवश्यक परिवर्तनों सहित लागू होंगी।

13. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां, नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

(i) संकल्पनाः

(क) इस पॉलिसी के अधीन जिला परिषद्‌ में कनिष्ठ वेतनमान आशुलिपिक को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण हेतु सम्बद्ध मुख्य कार्यकारी अधिकारी यह प्रमाण पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण, वर्ष के दौरान संतोषजनक पाया गया है और केवल तभी निदेशक का पूर्व अनुमोदन प्राप्त करके, उसकी संविदा अवधि नवीकृत/ विस्तारित की जाएगी।

(ख) पद का हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर के कार्यक्षेत्र में आना.--सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर को नियुक्ति/चयन के लिए भेजेगा।

(ग) चयन, इन नियमों से विनिर्दिश्ट पात्रता शर्तों के अनुसार किया जाएगा।4463 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (ii) संविदात्मक उपलब्धियांः

संविदा के आधार पर नियुक्त कनिष्ठ वेतनमान आशुलिपिक को 8710/- रूपए की समेकित नियत संविदात्मक रकम (जो पे बैंड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है, तो पश्चात्‌वर्ती वर्षों के लिए संविदात्मक उपलब्धियों में पद के पे बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत, वार्षिक वृद्धि के रूप में अनुज्ञात किया जाएगा। (iii) नियुक्ति/अनुशासन प्राधिकारीः

सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी, नियुक्ति और अनुशासन प्राधिकारी होगा। (iv) चयन प्रक्रियाः

संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, यथास्थिति, हिमाचल प्रदेश कर्मचारी चयन आयोग, हमीरपुर या अन्य नियुक्ति प्राधिकारी द्वारा मौखिक परीक्षा के आधार पर किया जाएगा या यदि आवश्यक या समीचीन समझा जाए, तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, आयोग या किसी अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

(v) नियुक्ति और करारः

अभ्यर्थी को, चयन और प्ररूप-I में उसे नियुक्ति पत्र जारी करने के पश्चात्‌, इन नियमों से संलग्न प्ररूप-II के अनुसार करार हस्ताक्षरित करना होगा।

(vi) निबन्धन और शर्तेंः

(क) संविदा के आधार पर नियुक्त व्यक्ति को 8710/-रूपए की नियत संविदात्मक रकम (जो पे बैण्ड का न्यूनतम जमा ग्रेड पे के बराबर होगी) प्रतिमास संदत्त की जाएगी। संविदा पर नियुक्त व्यक्ति आगे बढ़ाए गए वर्ष/वर्षों के लिए संविदात्मक रकम में पद के पे-बैण्ड का न्यूनतम जमा ग्रेड पे का तीन प्रतिशत वार्षिक वृद्धि के रूप में प्राप्त करने का हकदार होगा और अन्य कोई प्रसुविधाएं, जैसे वरिष्ठ/चयन वेतनमान आदि नहीं किया जाएगा।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है, तो नियुक्ति समाप्त किए जाने के लिए दायी होगी।

(ग) संविदा पर नियुक्त व्यक्ति एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा। यह अवकाश एक वर्ष तक संचित किया जा सकेगा। संविदा पर नियुक्त व्यक्ति को किसी भी प्रकार का अन्य कोई अवकाश अनुज्ञात नहीं होगा। वह चिकित्सा प्रतिपूर्ति और एल0टी0सी0 इत्यादि के लिए भी हकदार नहीं होगा/होगी। केवल प्रसूति अवकाश, नियमानुसार दिया जाएगा।

(घ) मुख्य कार्यकारी अधिकारी, जिला परिषद्‌ के अनुमोदन के बिना सेवा से अनधिकृत अनुपस्थिति से, स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। संविदा पर नियुक्त व्यक्ति कर्तव्य (ड्‌यूटि) से अनुपस्थिति की अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा।

(ङ) संविदा पर नियुक्त पदधारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया है, अपने-अपने जिला परिषद्‌ के भीतर आवश्यकतानुसार प्रशासनिक आधार पर स्थानान्तरण के लिए पात्र होगा। 4464 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 (च) चयनित अभ्यर्थी को सरकारी/रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक समय से गर्भवती महिला प्रसव होने तक, अस्थायी तौर पर अनुपयुक्त बनी रहेगी। महिला अभ्यर्थियों का किसी प्राधिकृत चिकित्सा अधिकारी/ व्यवसायी द्वारा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित तत्स्थानी कर्मचारियों को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/ दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों के उपबन्ध जैसे एफ0आर0, एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे।

14. नियुक्ति प्राधिकारी.-(1) सम्बद्ध जिला परिषद्‌ का मुख्य कार्यकारी अधिकारी नियुक्ति प्राधिकारी होगा और नियुक्ति-पत्र उसके द्वारा जारी किया जाएगा।

(2) सम्बद्ध जिला परिषद का सचिव प्रवास कार्यक्रम, छुट्‌टी आदि के लिए नियंत्रण अधिकारी होगा। 15. कनिष्ठ वेतनमान आशुलिपिक की वरिष्ठता.--नियमित कनिष्ठ वेतनमान आशुलिपिक की वरिष्ठता, उनके कार्यग्रहण की तारीख से अवधारित की जाएगी और निदेशालय स्तर पर समेकित या अनुरक्षित की जाएगी।

16. आरक्षण.-सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।

17. जॉब चार्ट.--कनिष्ठ वेतनमान आशुलिपिक का जॉब चार्ट ऐसा होगा, जैसा निदशक द्वारा समय-समय पर विनिर्दिष्ट किया जाए।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां यह, कारणों को लिखित में अभिलिखित करके, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को, किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

19. निरसन और व्यावृत्तियॉं.--(1) इन नियमों के प्रवृत्त होने की तारीख को और से जिला परिषद्‌ द्वारा अधिसूचना संख्या पी0सी0एच0-एच0ए0 (3) 25/2007-1407-31, तारीख 22 मई, 2009 द्वारा, संविदा के आधार पर कनिष्ठ वेतनमान आशुलिपिक की नियुक्ति हेतु निरसित हो जाएंगे।

(2) ऐसे निरसन के होते हुए भी, इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई, इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

NO. PCH-HA-(1)11/2010-II.—Whereas the draft Himachal Pradesh Panchayati Raj (Appointment and conditions of service of Junior Scale Stenographers in Zila Parishads) Rules, 2013, were published in the Rajpatra, Himachal Pradesh on 23rd July, 2013 for inviting objections and suggestions from the persons likely to be affected thereby vide notification No. PCH-HA (1)11/2010-II, dated 10th July, 2013 as required under section 186 of the Himachal Pradesh Panchayati Raj Act, 1994;

And whereas no objection/suggestion has been received in this behalf during the stipulated period;

Now, therefore, in exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No.4 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Panchayati Raj (Appointment and Conditions of Service of Junior Scale Stenographers in Zila Parishads) Rules, 2016.

2. Definitions.— (1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Panchayati Raj Act, 1994;

(b) "Director" means the Director of Panchayati Raj, Himachal Pradesh; and (c) "Form" means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same meaning as respectively assigned to them in the Act.

3. Number of Posts.—There shall be such number of posts of Junior Scale Stenographers as may be sanctioned by the State Government from time to time in the respective Zila Parishads.

4. Scale of Pay.—The scale of pay for the post of Junior Scale Stenographers shall be as under:--

(a) Pay band for regular appointees: PB-Rs. 5910+20200 + Rs. 2800 Grade Pay; and (b) Emoluments for contractual appointees: Rs. 8710/- per month, as per details given in rule 14.

5. Type of post (whether selection or non selection post).—The post of the Junior Scale Stenographers shall be Non-Selection.

6. Age for direct appointment.—A person to be appointed as Junior Scale Stenographer shall be eligible if he is having age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on ad-hoc or on contract basis:

Provided further that if a candidate appointed on ad-hoc basis had become overage on the date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age limit by virtue of his such ad-hoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/ Other Categories of persons to the extent permissible under the General or Special Order (s) of the State Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servant before absorption in Public Sector Corporations/ Autonomous Bodies at the time of initial constitution of such corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in which the Post(s) is/ are advertised for inviting applications or notified to the Employment Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relax able at the discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.—(1) The candidate to be appointed as Junior Scale Stenographer shall possess minimum educational qualification of Ten Plus Two (10+2) or its equivalent, from Board of School Education recognized by the Himachal Pradesh Government.

(2) Every candidate to be appointed as Junior Scale Stenographer shall have a speed of eighty and seventy words per minute in English and Hindi shorthand respectively and forty and thirty words per minute in English and Hindi typewriting respectively:

Provided that a candidate shall also be eligible to apply for the post having the requisite speed as mentioned above in shorthand and typewriting in one language only, and in the event of his selection to the post, he shall have to qualify the test in other language within six months from the date of joining the post.

(3) Preference shall be given to those candidates who have knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the State.

8. Period of Probation.—The regular appointee shall remain under probation for a period of two years subject to such further extension for a period not exceeding one year, as may be 4470 राजपत्र, हिमाचल प्रदेश, 19 सितम्बर, 2016/28 भाद्रपद, 1938 ordered by the Chief Executive Officer, Zila Parishad in special circumstances and reasons thereof to be recorded in writing.

9. Method of appointment.—The candidate shall be appointed either by direct recruitment on regular basis or on contract basis, as the case may be.

10. Essential requirement for direct/contract appointment.—The candidate to be appointed as Junior Scale Stenographer must be a citizen of India.

11. Selection for appointment.—The selection to the post, in case of direct or contractual appointment, as the case may be, shall be made on the basis of viva-voce test or if Himachal Pradesh Staff Selection Commission, Hamirpur or other Appointing Authority, as the case may be, so considers necessary or expedient by a written test or practical test, the standard/syllabus etc. of which, will be determined by the Commission or other Appointing Authority, as the case may be.

12. Conditions of Service for regular appointees.—The other conditions of service in the case of regular appointees shall apply mutatis-mutandis as are applicable in the case of State Government Junior Scale Stenographers.

13. Selection for appointment to the post by Contract Appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under these rules the Junior Scale Stenographers in Zila Parishad will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned Chief Executive Officer shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract will be renewed/ extended after taking prior approval of the Director.

(b) POST SHALL BE IN THE PURVIEW OF HIMACHAL PRADESH STAFF SELECTION COMMISSION, HAMIRPUR.—The Chief Executive Officer of the concerned Zila Parishad after obtaining the approval of the Government to fill up the post on contract basis shall send requisition to the Himachal Pradesh Staff Selection Commission, Hamirpur for appointment/selection.

(c) The selection shall be made in accordance with the eligibility conditions specified in these rules.

(II) CONTRACTUAL EMOLUMENTS:

The Junior Scale Stenographers appointed on contract basis will be paid consolidated fixed contractual amount @ ` 8710/- P.M. (which shall be equal to minimum of the pay band+ Grade pay). 3% of the minimum of pay band + grade pay of the post as annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is extended beyond one year.

The Chief Executive Officer of the concerned Zila Parishad will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of Contract Appointment will be made by the Himachal Pradesh Staff Selection Commission, Hamirpur or other Appointing Authority, as the case may be, on the basis of viva-voce test or if so considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the Commission or any other Appointing Authority, as the case may be.

(V) APPOINTMENT AND AGREEMENT:

After selection of a candidate an appointment letter will be issued to him in Form-I and he shall sign an Agreement as per Form-II appended to these rules.

(VI) TERMS AND CONDTIONS:

(a) The contractual appointee will be paid fixed contractual amount @ Rs. 8710/- P.M. (which shall be equal to minimum of the pay band+ grade pay). The contract appointee will be entitled to increase in the contractual amount i.e. 3% of minimum of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such as senior /selection scales etc. will be given.

(b) The service of the Contractual Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contractual Appointee will be entitled to one day's causal leave after putting in one month's service. This leave can be accumulated up to one year. No leave of any other kind will be admissible to the contract appointee. He/She shall not be entitled to Medical Re-imbursement and LTC etc. Only maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Chief Executive Officer, Zila Parishad shall automatically lead to the termination of the contract. Contractual Appointee shall not be entitled to contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who has completed three years tenure at one place of positing will be eligible for transfer on need based basis within the respective Zila Parishad on administrative ground (s).

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The woman candidate will be got re-examined for fitness from an authorized Medical Officer/Practitioner.

(g) Contractual appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as are applicable to the regular counter-part official at the minimum of pay scale.

They will be entitled to emoluments etc. as detailed in this Column.

14. Appointing Authority.—(1) The Chief Executive Officer of concerned Zila Prishad shall be the Appointing Authority and letter of appointment shall be issued by him.

(2) The Secretary of the concerned Zila Parishad shall be the controlling officer for tour programme and leave etc.

15. Seniority of Junior Scale Stenographer.—The seniority of the regular Junior Scale Stenographers shall be determined from the date of joining and consolidated and maintained at Directorate level.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/ Backward Classes/ Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Job Chart.—The job chart for the Junior Scale Stenographers shall be such as may be specified by the Director from time to time.

18. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the provisions(s) of these rules with respect to any class or category of person (s) or post(s).

19. Repeal and Savings.— (1) On and from the date of commencement of these rules, the rules notified for the appointment of Junior Scale Stenographers on contract basis by Zila Parishad vide notification No. PCH-HA (3) 25/2007-1407-31 dated 22nd May, 2009 shall stand repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken, under the rules so repealed, shall be deemed to have been validly made, done or taken under these rules.

5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. A contractual Junior Scale Stenographer will not be entitled to contractual amount for the period of absence from duty.

6. An official appointed on contractual basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis within the concerned Zila Prishad on administrative grounds.

7. Selected candidate will have to submit a certificate of his/her fitness from a Government/Registered Medical Practitioner.
