No. MPP-F(1)2/2005-XI.—The Governor, Himachal Pradesh is pleased to notify the partial modification to the notification issued by the department of MPP & Power, GoHP vide No. MPP-F (10)-24/2011 dated 05/10/2011 and subsequent amendments issued from time to time to the following extent:—

Re-scheduling of payment on account of Pre-Commissioning of Local Area

Development Fund (LADF) and adjustment of expenditure against LADF.

A. The payment schedule of pre-commissioning LADF payable @ 1% (for projects upto 5 MW) / @ 1.5% (for projects above 5 MW) of the project cost, shall be :—

4642 राजपत्र, हिमाचल प्रदेश, 28 सितम्बर, 2016/6 आश्विन, 1938 (i) 1st installment comprising 25% of total payable LADF is to be deposited within 24 months of signing of Implementation Agreement i.e. at the time of achieving zero date after obtaining all statutory and non-statutory clearances and achieving financial closure.

B. The expenditure incurred by the developer on various activities executed on the demands of local villages/Project Affected Area/Zone, shall be liable for adjustment against the dues of LADF subject to:—

(i) The work/activity stands complete /likely to be got completed within the amount eligible under the probable share of the concerned project affected village/block/ zone/ district in line with the norms fixed in Policy guidelines dated 05.10.2011.

(ii) The work/activity should have public utility and duly verified and recommended by Deputy Commissioner/Directorate of Energy, H.P. for adjustment provided that the developer properly submits all relevant details including demand of Gram Sabha/Gram Panchayat in shape of resolution passed by concerned Gram Sabha/ Gram Panchayat and that shall be acceptable to Local Area Development Committee (LADC).

(iii) The amount spent on (i) and (ii) above, shall be included/adjusted against total amount of payable on account of LADF.

(iv) In case the total expenditure incurred on such activities which are being executed on the public demand of Project Affected Area (PAA) / villages, on completion of the work, exceeds the limit of share as defined in the notification dated 05.10.2011, the Project Proponent shall be liable to pay the balance amount from their own resources and the amount beyond the limit of respective share shall not be chargeable to LADF. हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 (1971 का अधिनियम संख्यांक 8) का और संशोधन करने के लिए अधिनियम ।

भारत गणराज्य के सड़सठवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. स्ांक्षिप्त नाम.-इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) द्वितीय संशोधन अधिनियम, 2016 है।

2. धारा 4-ङ का संशोधन.-हिमाचल प्रदेश विधान सभा (सदस्यों के भत्ते और पेंशन) अधिनियम, 1971 (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 4-ङ की उपधारा (2) के स्थान पर निम्नलिखित उपधारा रखी जाएगी, अर्थात्‌ :-

''(2) प्रत्येक भूतपूर्व सदस्य, जिसने उपधारा (1) के अधीन गृह निर्माण अग्रिम की सुविधा प्राप्त की है या सदस्य के रूप में ऐसी सुविधा प्राप्त की है और ऐसे अग्रिम की सम्पूर्ण रकम का, उस पर ब्याज सहित प्रतिसंदाय कर दिया है, द्वितीय गृह निर्माण अग्रिम की सुविधा प्राप्त करने के लिए प्रतिसंदेय अग्रिम स्वरूप, ऐसी धनराशि, ऐसी शर्तों के अध्यधीन, जैसे इस निमित्त गृह निर्माण या बने बनाए गृह का क्रय करने या पुराने गृह का पुनरूद्धार करने के लिए बनाए गए नियमों द्वारा अवधारित की जाए, प्राप्त करने का हकदार होगा।''।

3. धारा 4-च का संशोधन.-मूल अधिनियम की धारा 4-च की उपधारा (2) में, ''प्रत्येक सदस्य, जिसने उपधारा (1) के अधीन मोटर कार अग्रिम की सुविधा प्राप्त की है'' शब्दों, चिन्हों और अंक के स्थान पर ''प्रत्येक भूतपूर्व सदस्य, जिसने उपधारा (1) के अधीन मोटर कार अग्रिम की सुविधा प्राप्त की है या सदस्य के रूप में ऐसी सुविधा प्राप्त की है'' शब्द, चिन्ह और अंक रखे जाएंगे।

THE HIMACHAL PRADESH LEGISLATIVE ASSEMBLY (ALLOWANCES AND

PENSION OF MEMBERS) SECOND AMENDMENT ACT, 2016

(AS ASSENTED TO BY THE GOVERNOR ON 26TH SEPTEMBER, 2016)

AN

ACT

further to amend the Himachal Pradesh Legislative Assembly (Allowances and Pension of

Members) Act, 1971 (Act No. 8 of 1971).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-seventh Year of the Republic of India as follow :—

1. Short title.—This Act may be called the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Second Amendment Bill, 2016.

2. Amendment of section 4-E.—In section 4-E of the Himachal Pradesh Legislative Assembly (Allowances and Pension of Members) Act, 1971 hereinafter referred to as the "principal Act", for sub-section (2), the following sub-section shall be substituted, namely :—

"(2) Each ex-member who has availed the facility of house building advance under sub- section (1) or availed such facility as a member and has repaid whole amount of such advance with interest thereon, shall be entitled to avail facility of second house building advance by way of repayable advance, such sum of money, subject to such conditions, as may be determined by rules made in this behalf, for construction of house or for the purchase of built-up house or for renovation of old house.".

3. Amendment of section 4-F.—In section 4-F of the principal Act, in sub-section (2), after the words, figure and signs "sub-section (1)", the words "or availed such facility as a member" shall be inserted.

सं0पी0बी0डब्ल्यू0(बी0)एफ(5)22/2015.-यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु गांव क्याण/240, तहसील सुन्दरनगर, जिला सोलन, हिमाचल प्रदेश में सलापड़-ततापानी सड़क के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह घोषित किया जाता है कि निम्नलिखित विवरणी में वर्णित भूमि उपर्युक्त प्रयोजन के लिए अपेक्षित है।

2. यह घोषणा, भूमि अर्जन, पुनर्वास और पुर्नव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-19 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों को सूचना हेतु की जाती है तथा उक्त अधिनियम के अधीन भू-अर्जन समाहर्ता लोक निर्माण विभाग, मण्डी को उक्त भूमि के अर्जन करने के आदेश लेने का एतद्‌ द्वारा निदेश दिया जाता है।

3. भूमि रेखांक का निरीक्षण भू-अर्जन समाहर्ता, लोक निर्माण विभाग मण्डी, जिला मण्डी के कार्यालय में किया जा सकता है।
