NOTIFICATION

Shimla-13, the 27th September, 2016

No.IT-A(3)-1/2004.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh 128-राजपत्र/2016-29-09-2016 (4647) 4648 राजपत्र, हिमाचल प्रदेश, 29 सितम्बर, 2016/7 आश्विन, 1938 Public Service Commission, is pleased to make the following Rules to amend the Himachal Pradesh, Department of Information Technology, Deputy Manager, Class-I (Gazetted) Recruitment & Promotion Rules, 2008 notified vide this Department Notification No.IT-A(3)- 1/2004 dated 18th November, 2008 namely:—

1. Short title and Commencement.—(i) These rules may be called the Himachal Pradesh Information Technology Department, Deputy Manager, Class-I (Gazetted) Recruitment & Promotion (1st Amendment) Rules, 2016.

(ii) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure "A" to the Himachal Pradesh Department of Information Technology, Deputy Manager, Class-I (Gazetted) Recruitment & Promotion Rules, 2008;

(a) For the existing provision against column No. 7(a), the following shall be substituted, namely:—

(i) B.E./B. Tech Degree in Computer Science/ Engineering /Information Technology or Master Degree in Computer Application (MCA)/'B' Level course from DOEACC (National Institute of Electronics & Information Technology (NIELIT)) with first class or at least 60% marks in aggregate or equivalent grade.

(ii) Post qualification experience of at least six years in the field of Information and Communication Technology in Government/ Corporate Sector as Deputy Manager/System Analyst/ Scientist-B/ Sr. Programmer/System Administrator/ Network Administrator/Consultant/ Business Analyst.

OR

(i) B.E./B. Tech. (Electronics / Industrial Electronics / Electronics & Communication) with first class or at least 60% marks in aggregate or equivalent grade with one year 'A' Level of DOEACC(National Institute of Electronics & Information Technology (NIELIT)) or Post-Graduate Diploma in Computer Science/ Applications/ Information Technology with first class or at least 60% marks in aggregate or equivalent grade

(ii) Post qualification experience of at least six years in the field of Information and Communication Technology in Government/ Corporate Sector as Deputy Manager/System Analyst/ Scientist-B/ Sr. Programmer/System Administrator/ Network Administrator/Consultant/ Business Analyst.

(b) For the existing provision against column No.8, the following shall be substituted, namely:—

Age.—Not Applicable

Education Qualification.—yes, as prescribed against Col. No. 7 (a)(i) above.

(b) No probation in the case of appointment on contract basis, tenure basis, re- employment after superannuation and absorption.

(ii) Promotion.—Two years of the period of probation prescribed for the direct recruitment to the post, if any, in the case of promotion form one group to another.

(d) For the existing provision against column No.10, the following shall be substituted, namely:—

100% by promotion failing which on secondment basis failing which both by direct recruitment on a regular basis or by recruitment on contract basis, as the case may be.

(e) For the existing provision against column No.11-i), the following shall be substituted, namely:—

By promotion from amongst the Assistant Programmer subject to possessing of education qualification prescribed for direct recruitment against Column No. 7(a)(i) above with 08 (eight) years regular service or regular combined with continuous adhoc service rendered, if any, in the grade after acquiring the prescribed education qualification failing which on secondment basis/by transfer from amongst the incumbents of this post or analogous post subject to possessing of education qualification prescribed for direct recruitment against Column No. 7(a)(i) above and working in the identical pay scale from other Departments/Boards/Corporations of Himachal Pradesh Government, Departments of Government of India or other State Governments.

(f) For the existing provision against column No.15& 15A(iv) and (vii)(c), the following shall be substituted, namely:-

Selection for appointment to the post in the case of direct recruitment shall be made on the basis of interview/personality test, if the Himachal Pradesh Public Service Commission or other recruiting agency/authority as the case may be, so consider necessary or expedient on the basis of interview/personality test preceded by a screening test (objective type)/ written test or practical test or physical test, the standard/syllabus, etc. of which, will be determined by the Commission/ other recruiting agency/ authority as the case may be.

(a) Under this policy, the Deputy Manager, in the Department of Information Technology, Himachal Pradesh will be engaged on contract basis initially for one year, which may be extendable on year to year basis: Provided that for extension/ renewal of contract period on year to year basis, the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/ extended.

(iv) Selection for appointment to the post in the case of contract appointment shall be made on the basis of interview/ personality test, if the Himachal Pradesh Public Service Commission so consider necessary or expedient on the basis of interview/ personality test preceded by a screening test (objective type)/ written test or practical test or4650 राजपत्र, हिमाचल प्रदेश, 29 सितम्बर, 2016/7 आश्विन, 1938 physical test, the standard/ syllabus, etc. of which, will be determined by the Himachal Pradesh Public Service Commission.

(vii) The contract appointee will be paid fixed contractual amount @ Rs. 21,000/- P.M. (which shall be equal to minimum of the pay band + grade pay). The contractappointee will be entitled for increase in contractual amount @ Rs. 630/- (3% of the minimum of pay band + grade pay of the post) for the further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(c) Contract appointee will be entitled for one day's casual leave after putting one month service. However, the contract appointee will also be entitled for 135 days Maternity Leave, 10 days Medical Leave and 5 days Special Leave. A female contract appointee shall also be entitled for Maternity Leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in the case of miscarriage including abortion, on the production of medical certificate issued by the authorized Government Medical Officer. He/ She shall not be entitled for Medical Re- imbursement and LTC etc. No leave for any kind except above is admissible to the contract appointee.

Provided that un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(ii) Post qualification experience of at least ten years in the field of Information and Communication Technology in Government/ Corporate Sector as Manager / System Analyst/ Scientist-C/ Database Administrator/ Program Lead/ Technical Lead / Application Lead/ Consultant/ Business Analyst.

OR

(i) Master Degree in Physics /Mathematics/ Statics /Operations Research with first Class or atleast 60% marks in aggregate or equivalent grade with one year 'A' Level of DOEACC (National Institute of Electronics & Information Technology (NIELIT))/ Post-Graduate Diploma in Computer Science/ Applications/ Information Technology with first class or atleast 60% marks in aggregate or equivalent grade.

(ii) Post qualification experience of at least eleven years in the field of Information and Communication Technology in Government/ Corporate Sector as Manager / System Analyst/ Scientist-C/ Database Administrator/ Program Lead/ Technical Lead / Application Lead/ Consultant/ Business Analyst.

OR

(i) Master Degree in Computer Science/ Information Technology with first Class or atleast 60% marks in aggregate or equivalent grade.

(ii) Post qualification experience of at least eleven years in the field of Information and Communication Technology in Government/ Corporate Sector as Manager/ System Analyst/ Scientist-C/ Database Administrator/ Program Lead/ Technical Lead / Application Lead/ Consultant/ Business Analyst.

OR

(i) B.E./ B. Tech Degree in Electronics / Industrial Electronics / Electronics & Communication with first class or atleast 60% marks in aggregate or equivalent grade with one year 'A' Level of DOEACC (National Institute of Electronics & Information Technology (NIELIT))/ Post-Graduate Diploma in Computer Science/ Applications / Information Technology with first class or at least 60% marks in aggregate or equivalent grade

(ii) Post qualification experience of at least eleven years in the field of Information and Communication Technology in Government/ Corporate Sector as Manager /4652 राजपत्र, हिमाचल प्रदेश, 29 सितम्बर, 2016/7 आश्विन, 1938 System Analyst/Scientist-C/Database Administrator/Program Lead/Technical Lead /Application Lead/ Consultant/ Business Analyst.

(b) For the existing provision against column No.8, the following shall be substituted, namely:—

Age.—Not Applicable.

Education Qualification.—Yes, as prescribed against Col. No. 7 (a)(i) above.

(c) For the existing provision against column No.9, the following shall be substituted, namely:—

(a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in the case of appointment on contract basis, tenure basis, re- employment after superannuation and absorption.

(ii) Promotion: No Promotion

(d) For the existing provision against column No.10, the following shall be substituted, namely:-

100% by promotion failing which by direct recruitment on regular basis or by recruitment on contract basis, as the case may be failing both on secondment basis.

(e) For the existing provision against column No.11, the following shall be substituted, namely:—

By promotion from amongst the Deputy Managers, Information Technology subject to possessing of education qualification prescribed for direct recruitment against Column No. 7(a)(i) above with 04 (four) years regular service or regular combined with continuous adhoc service rendered, if any, in the grade after acquiring the prescribed education qualification failing which by direct recruitment failing both on secondment basis from amongst the incumbents of this post or analogous post possessing the education qualification prescribed for direct recruitment against Column No. 7(a)(i) above and working in the identical pay scale from other Departments/ Boards/ Corporations of Himachal Pradesh Government, Departments of Government of India or other State Governments.

(f) For the existing provision against column No.15& 15A(iv) and (vii)(c), the following shall be substituted, namely:—

(vii) The contractappointee will be paid fixed contractual amount @ Rs. 22,200/- P.M. (which shall be equal to minimum of the pay band + grade pay). The contract appointee will be entitled for increase in contractual amount @ Rs. 666/- (3% of the minimum of pay band + grade pay of the post) for the further extended years and no other allied benefits such as senior/selection scales etc. will be given.

(c) Contract appointee will be entitled for one day's casual leave after putting one month service. However, the contract appointee will also be entitled for 135 days Maternity Leave, 10 days Medical Leave and 5 days Special Leave. No. MPP-F(1)2/2005-XI.—The Governor, Himachal Pradesh is pleased to notify Guidelines for Declaration of Commercial Operation Date (COD) of various Hydro Electric Projects in the State of Himachal Pradesh whereby the Directorate of Energy (DoE), Himachal Pradesh, through the Chief Engineer (Energy) shall be the designated Nodal Agency for permitting the formal declaration of the Commercial Operation Dates (CoDs) of all Hydro Electric Projects to be commissioned whether for the purpose of commercial or captive use within the State, with immediate effect.

The Directorate of Energy (DoE) on the receipt of written requests from the respective developer(s) for declaration of Commercial Operation Dates (CoDs) submitted well before 60 days prior to the scheduled completion of the Project (s), shall seek all necessary reports from the concerned agencies / authorities alongwith clear-cut recommendations, before permitting formal declaration for Commercial Operation Date (CoD) of a Project by the IPP/IPPs after seeking report on the following parameters/aspects:-

1) Report on Authority & Safety Aspects (Concerned Department/Office: Directorate of

Energy, Himachal Pradesh):

A report on the Safety aspects shall be submitted by Authority and Safety Cell of DoE for ascertaining completion of all the Civil, Hydro and Electro-Mechanical Components in favour of the project as per the standard guidelines/procedures.

2) Report on certification of all Electrical Installations on the Project. (Concerned

Department/Office: Chief Electrical Inspectorate, Himachal Pradesh):

A report of the Chief Electrical Inspectorate, H.P. for certification in respect of all electrical installations on the project in accordance with the provisions/mandatory stipulations laid down in the Indian Electricity Rules, 1956 as well as in line with the guidelines issued by Central Electricity Regulatory Commission (CERC) with respect to the Certification of CoD alongwith the recommendations for allowing go ahead with synchronization of unit(s).

3) Report on Power House Design of the Project (Concerned Department/Office: The

Chief Engineer (Generation) HPSEBL, Sundernagar):

A report of the Director (Power House Designs) Himachal Pradesh State Electricity Board Limited (HPSEBL), Sundernagar, for ascertaining all operational aspects of the project's operation during test runs and subsequent synchronization of unit(s) alongwith recommendations.

4) Report on Power Evacuation System to be utilized for transmission of the power to

be generated from the Project.

(Concerned Department/Office: HPTCL and Chief Engineer (System Operations)

HPSEBL, Vidyut Bhawan, Shimla)

A report of HPTCL or Chief Engineer (System Operation), HPSEBL, with reference to the connectivity for evacuation of power from the project alongwith recommendations for allowing synchronization of units as the case may be.

5) Nomination of the Independent Engineer

(Concerned Department/Office: Mutually agreed Independent Engineer by HPSEBL/

HPPTCL and the concerned Independent Power Producer)

An independent Engineer with adequate competence to be mutually nominated by the concerned parties among which the Power Purchase Agreement (PPA) has been entered for sale and purchase of power.

6) Report on Power Evacuation Arrangement in case the scheduling of the power to

be generated from a Project, is to be carried out through Northern Region Load

Dispatch Centre (NRLDC), utilizing transmission line of any Third Party viz.

Central Government undertaking like Power Grid Corporation of India Limited

(PGCIL) or its Joint Venture etc.

(Concerned Department/Office: The Chairman- cum- Managing Director of the

concerned Central Transmission Utility /Public Sector Under taking (PSU).

A report on the availability of the power evacuation system alongwith recommendations for allowing the access to the concerned Project in consultation with the State Transmission Utility (STU).

After ascertaining all the above aspects and ensuring that the Independent Power Producer (IPPs) have followed the prescribed standards, specifications and the norms / guidelines laid down in this regard, the Chief Engineer (Energy), Directorate of Energy in consultation with SLDC shall formally permit the developer to certify the declaration of Commercial Operation Date (CoD) for all unit (s).

No. TCP-A(3)-1/2014-III.—In exercise of the powers conferred by Section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to notify the procedure for registration of Structural Engineers, as required under clause (ii) of Note appended below sub-rule (2) of Rule 21 of the Himachal Pradesh Town and Country Planning (Amendment) Rules, 2016 notified vide this Department Notification No. TCP-A(3)-1/2014-II dated 28.7.2016 and published in the Official Gazette of Himachal Pradesh on 30.7.2016 as under:—

1. Essential Requirement:

Structural Stability Certificate shall be given by the Registered Structural Engineer in Form- 15 of the Rules.

2. Qualification:

The minimum qualification for a Structural Engineer shall be Graduation in Civil Engineering of recognized Indian or foreign university or Institution of Engineers (India) and with minimum six years experience in structural engineering practice with designing and field work.

In the case of Post-Graduation Degree of recognized Indian or foreign university in the branch of Structural Engineering, experience of four years shall be required.

In the case of Doctorate in Structural Engineering, experience of one year shall be required.

Provided that the Structural Engineer applying for registration will submit self- declaration about their experience alongwith their application.

3. Registration/ empanelment:

A Structural Engineer would require to get registered with the Department. For this purpose online application shall be submitted along with a fee of Rs. 2000/- only. The Registration shall be valid for a period of 5 years after which it can be renewed by paying a fee of Rs. 2500/- only for every 5 years block thereafter.

Provided that the Structural Engineers registered with the Institution of Engineers (India), Kolkata shall not be required to be registered under these rules. They, however, shall be required to get empanelled with the Director without paying any fees. The Structural Engineers once empanelled shall not require any renewal of empanelment.

4. Cancellation of Registration:

The Director may suspend or cancel the Registration/ empanelment of any Structural Engineer, who in the opinion of the Director is not carrying out the requirements of the Zoning Regulations framed under the Interim Development Plan, Development Plan and the Guidelines4657 राजपत्र, हिमाचल प्रदेश, 29 सितम्बर, 2016/7 आश्विन, 1938 issued under the Himachal Pradesh Town and Country Planning Act, 1977 and the Himachal Pradesh Town and Country Planning Rules, 2014.

Provided that before the Registration/ empanelment is cancelled, an opportunity of being heard shall be afforded to the concerned Structural Engineer.

Provided further that the Structural Engineers registered with the Institution of Engineers (India), Kolkata and empanelled with the Director shall only be suspended or cancelled by the said Institution in which they are registered, on recommendation of Director.

5. Structural design and safety:

For any building under the jurisdiction of Planning Area, Special Area and Deemed Planning Area, structural design/retrofitting shall only be carried out by a Structural Engineer.

This Notification shall take effect from the date of its publication in the H.P. Rajpatra of Himachal Pradesh.

संख्याः पी.बी.डब्लयू(बी)एफ(5)30/2015.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामत गांव नावर, तहसील ठियोग, जिला शिमला में बलदेयां-धर्मपुर-क्यारटू सडक के निर्माण हेतु अर्जित भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुर्नव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यो को करने के लिए सहर्ष प्राधिकार देते हैं।
