संख्याः पीईआर (एपी-बी)बी(1)-1/2012.-हिमाचल प्रदेश सरकार ने अधिसूचना संख्याः पीईआर (एपी)-सी-ए(3)-1/2007-। तारीख 24-12-2014 द्वारा हिमाचल प्रदेश कार्मिक विभाग, कनिष्ठ कार्यालय सहायक (सूचना प्रौद्योगिकी), वर्ग-III (अराजपत्रित), लिपिक वर्गीय सेवाएं, सामान्य भर्ती और प्रोन्नति नियम, 2014, जो हिमाचल प्रदेश सरकार के विभिन्न विभागों को लागू हैं, अधिसूचित किए हैं;

134-राजपत्र/2016-6-10-2016 (4871) 4872 राजपत्र, हिमाचल प्रदेश, 6 अक्तूबर, 2016/14 आश्विन, 1938 और उपरोक्त सामान्य भर्ती और प्रोन्नति नियम हिमाचल प्रदेश सरकार द्वारा भारत के संविधान के अनुच्छेद 309 के अधीन विरचित किए गए हैं इसलिए ये हिमाचल प्रदेश लोक सेवा आयोग को लागू नहीं हैं क्योंकि आयोग के कर्मचारियों की सेवा शर्तें भारत के संविधान के अनुच्छेद 318 (ख) के उपबन्धों के अधीन विनियमित की जाती हैं;

इसलिए, उपरोक्त पद के भर्ती और प्रोन्नति नियमों में एकरुपता लाने के दृष्टिगत, हिमाचल प्रदेश के राज्यपाल, दी हिमाचल प्रदेश पब्लिक सर्विस कमीशन (स्टाफ) रैग्यूलेशनज, 1971 के रैग्यूलेशन 8 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश देते हैं कि उपरोक्त वर्णित भर्ती और प्रोन्नति नियम, हिमाचल प्रदेश लोक सेवा आयोग में कनिष्ठ कार्यालय सहायक के पद को, इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, इस शर्त के अध्यधीन लागू होंगे कि उक्त नियमों के स्तम्भ संख्या 15-क के निम्नलिखित तत्स्थानों उपबन्धों को निम्न प्रकार से पढ़ा जाएः-

''(।)(ख) पद का हिमाचल प्रदेश लोक सेवा आयोग के कार्यक्षेत्र में आना.-सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ सचिव, हिमाचल प्रदेश लोक सेवा आयोग रिक्त पद (पदों) के ब्यौरे कम से कम दो अग्रणी समाचार पत्रों में विज्ञापित करवाएगा और इन नियमों में यथा विहित, अर्हताएं रखने तथा अन्य पात्रता शर्तों को परिपूर्ण करने वाले अभ्यर्थियों से आवेदन आमंत्रित करेगा।

(VI) नियुक्ति/अनुशासन प्राधिकारी.-सचिव, हिमाचल प्रदेश लोक सेवा आयोग नियुक्ति और अनुशासन प्राधिकारी होगा।

(VII) चयन प्रक्रिया.-संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, मौखिक परीक्षा के आधार पर किया जाएगा या यदि आवश्यक या समीचीन समझा जाए तो लिखित परीक्षा या व्यावहारिक परीक्षा के आधार पर किया जाएगा जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा। (VIII) संविदात्मक नियुक्तियों के लिए चयन समिति.-जैसी सम्बद्ध भर्ती अभिकरण, अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए। ''।

No.Per (AP-B)B(1)-1/2012.—Whereas the Government of Himachal Pradesh vide notification No. Per(AP)-C-A(3)-1/2007-I, Dated 24-12-2014 has notified the Himachal Pradesh, Department of Personnel, Junior Office Assistant (Information Technology), Class-III (Non- Gazetted) Ministerial Services, Common Recruitment and Promotion Rules, 2014 which are applicable to various departments of the Government of Himachal Pradesh;

And whereas the above Common Recruitment and Promotion Rules have been framed by the Government of Himachal Pradesh under Article 309 of the Constitution of India and as such are not applicable to Himachal Pradesh Public Service Commission because the service conditions of the employees of the Commission are regulated under the provisions of Article 318(b) of the Constitution of India;

Now, therefore, with a view to bring uniformity in the Recruitment and Promotion Rules in respect of the above post, the Governor, Himachal Pradesh, in exercise of the powers conferred by regulation 8 of the Himachal Pradesh Public Service Commission (Staff) Regulations, 1971, in consultation with the Himachal Pradesh Public Service Commission, is pleased to order that the above mentioned Recruitment and Promotion Rules shall be applicable to the post of Junior Office Assistant in the Himachal Pradesh Public Service Commission from the date of publication of this Notification in Rajpatra, Himachal Pradesh subject to the condition that the following corresponding provisions of Column No. 15-A of the said rules, shall be read as under:—

"(I)(b) POST FALLS WITHIN THE PURVIEW OF HP PUBLIC SERVICE COMMISSION.—The Secretary HPPSC after obtaining the approval of the Government to fill up the posts on contract basis will advertise the details of the vacant posts in at least two leading newspapers and invite applications from candidate having the prescribed qualifications and fulfilling the other eligibility conditions as prescribed in these Rules.

(III) APPOINTING/DISCIPLINARY AUTHORITY.—The Secretary, HP Public Service Commission will be appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of Contract Appointment will be made on the basis of viva-voce test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.—As may be constituted by the concerned recruiting agency i.e. the Himachal Pradesh Public Service Commission from time to time.".

(1) In clause 1(b) after the words "Boiler Engineer" and before the words "with regard to" in the first line is to be read as:
