No. EDN-A-Kha (2)12/2016-L-Botany.—The Governor, Himachal Pradesh is pleased to order to regularise the services of the Smt. Neetu W/O Sh. Neeraj Kumar, R/O Village & PO Ner Chowk Tehsil, Balh, District Mandi, H.P. Assistant Professors in Botany (College Cadre) Government College Drang at Narla, Distt. Mandi, H.P. in the pay scale of Rs.15,600– 39,100+6,000 (GP) per month with effect from the date of her actual joining at Government 157-राजपत्र/2016-16-11-2016 (5563) 5564 राजपत्र, हिमाचल प्रदेश, 16 नवम्बर, 2016/25 कार्तिक, 1938 College Drang at Narla, Distt. Mandi and with effect from the date of regularisation of her Junior i.e. Mr.Vivek Chand (OBC) on notional basis vide this department notification No. No.EDN-A- Kha(2)12/2016 dated 10th May 2016 subject to the fulfilment of following terms and conditions.

Terms and conditions:--

I. That the above regularization will be treated as fresh direct appointment.

II. That these appointees will be placed at the initial of the pay scale prescribed for newly appointed Assistant Professor (College Cadre) i.e. Rs.15,600 – 39,100+6,000 (GP), subject to the conditions that they are qualified as per R & P Rules in vogue, on the date of her initial appointment.

III. That her seniority will be finalized by the Government as per the Rules, instructions issued by the Government from time to time.

IV. That she will not claim the benefit of pay fixation, seniority etc. of previous service rendered on contract basis on account of her regularization.

V. That she will remain on probation for a period of two years and during the period of probation her service can be terminated at any time by giving one month notice of pay in lieu thereof by the appointing authority without assigning any reason.

VI. That the appointment shall carry with it the liability to serve in any part of Himachal Pradesh.

VII. That she will have to give a declaration for the effect that she has only one living spouse.

VIII. That she will have to take an oath of allegiance/faithfulness to the Constitution of India or making a solemn affirmation.

IX. That she will have to produce all the certificates in original at the time of joining this appointment.

X. That she will have to pass the Department Examination as prescribed in the Himachal Pradesh Departmental Examination Rules 1997, as amended from time to time.

If the above terms and conditions are acceptable to her, she should submit her joining report at her place of posting within a week's time from the issue to this notification to the Government through the Principal Government College mentioned against her name, failing which this offer of appointment /regularisation shall stand cancelled and no further extension will be accorded. No further correspondence shall be entertained in this behalf.

No. HPERC/391.—The Himachal Pradesh Regulatory Commission, in exercise of the powers conferred by Section 42 and sub-sections (1) and (2) of Section 181 of the Electricity Act, 2003 (36 of 2003) and all other powers enabling it in this behalf, after previous publication, hereby makes the following amendment in regulations, namely:—

1. Short title, extent and commencement.--(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Cross Subsidy Surcharge, Additional Surcharge and Phasing of Cross Subsidy) (First Amendment) Regulations, 2016.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment in Regulation 3.—The sub-regulation (2) of Regulation 3 of Himachal Pradesh Electricity Regulatory Commission (Cross Subsidy Surcharge, Additional Surcharge and Phasing of Cross Subsidy) Regulations, 2006 shall be substituted as:—

"The cross subsidy surcharge shall be determined by the Commission on the methodology and surcharge formula, specified in the revised Tariff Policy, 2016, which is given as under:—

Surcharge formula:

S= T-[C/(1-L/100)+D+R]

(a) "S" is the surcharge;

(b) "T" is the tariff payable by the relevant category of consumers, including reflecting the Renewable Purchase Obligation;

(c) "C" is the per unit weighted average cost of power purchase by the Licensee, including meeting the Renewable Purchase Obligation;

(d) "D" is the aggregate of transmission, distribution and wheeling charges applicable to the relevant voltage level;

(e) "L" is the aggregate of transmission, distribution and commercial losses, expressed as a percentage applicable to the relevant voltage level;

(f) "R" is the per unit cost of carrying regulatory assets.

Provided that the surcharge shall not exceed 20% of the tariff applicable to the respective category of the consumers, seeking open access.

Provided further that the Commission, while keeping the overall objectives of the Electricity Act in view, may review and vary the formula, taking into consideration the different circumstances related to power supply, prevailing in the area of Distribution Licensee.

3. Amendment in Regulation 4.—The Regulation 4 of Himachal Pradesh Electricity Regulatory Commission (Cross Subsidy Surcharge, Additional Surcharge and Phasing of Cross Subsidy) Regulations, 2006 shall be substituted as:

"4. Restriction of Cross Subsidy Surcharge.—

The Commission may further restrict the cross subsidy surcharge computed in accordance with Regulation 3, in a manner as it may consider appropriate, from time to time for respective categories of consumers and also for different time of a day."
