Dainik Bhaskar, D.B.Corporation Ltd. Regional Office, Plot No:11-12, Sector-25D, Chandigarh and M/S Dainik Bhaskar, Malbrow House Near DPRO Office, Chhota Shimla, Shimla-2, H.P. accruing to him on account of entitlement due to recommendations of the Majithia Wage Board notification w.e.f.11/11/11.

As per the report under Section 17(2) of the Working Journalists and Other Newspaper Employees (Conditions of Services) Act, 1955 and Industrial Disputes Act, 1947 of the Labour- cum-Conciliation Officer Shimla Zone, Shimla, the dispute could not be settled despite during investigation/conciliation proceedings. The report so prepared has been considered and decided that this dispute is required to be legally adjudicated by the Labour Court/Industrial Tribunal.

Therefore, the undersigned while exercising the powers vested in me by the Government of Himachal Pradesh vide Notification No:Shram(A)4-17/11-L dated; 18-10-2016, under Sub Section- 2 of Section 17 of the Working Journalists and Other Newspaper Employees (Conditions of Services) Act, 1955 refers this dispute to the Labour Court/Industrial Tribunal Shimla constituted under Section-7 of the Industrial Disputes Act, 1947 with the following issues:

"Whether the action of the employers M/S. Dainik Bhaskar, D.B.Corporation Ltd. Regional Office, Plot No:11-12, Sector-25D, Chandigarh and M/S Dainik Bhaskar, Malbrow House Near DPRO Office, Chhota Shimla, Shimla-2, H.P. for not paying claim of arrears amounting to Rs- 4,94,707/- (Rs-Four lakh ninety four thousand seven hundred seven only) to Shri Kuldeep Sharma S/O Shri Hari Krishan Sharma R/O Village Rihar, P.O. Salana, Via Shoghi, Distirct & Tehsil Shimla, H.P.17121, as difference of wages actually drawn and due as per recommendation of Majithia Wage Boards (Copy of claim enclosed) constituted under Section 9 & 13(C) of the Working Journalists and Other Newspaper Employees (Condition of Services and Miscellaneous Provisions Act, 1955) is legal and justified ? If yes, to what amount of relief/arrear, along with interest etc the aggrieved employee is entitled to from the above employers/Management?"
