संख्याःपी.बी.डब्लयू(बी)एफ (5)63/2016.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु नामत गांव रिंझ, तहसील बल्ह, जिला मण्डी, हिमाचल प्रदेश मे डडोर बग्गी सडक के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌ 218-राजपत्र/2017-16-02-2017 (7165) 7166 राजपत्र, हिमाचल प्रदेश, 16 फरवरी, 2017/27 माघ, 1938 द्वारा यह अधिसूचित किया जाता है कि उक्त परिक्षेत्र में जैसा कि निम्न विवरणी में निर्दिष्ट किया गया है, उपरोक्त प्रयोजन के लिए भूमि का अर्जन अपेक्षित है।

2. यह अधिसूचना ऐसे सभी व्यक्तियों को, जो इससे सम्बन्धित हो सकते हैं, की जानकारी के लिए भूमि अर्जन, पुनर्वास और पुर्नव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-11 के उपबन्धों के अन्तर्गत जारी की जाती है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उस धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यो को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्व व्यक्ति जिसे उक्त परिक्षे़त्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के साठ (60) दिन की अवधि के भीतर भू.-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी, हिमाचल प्रदेश के समक्ष लिखित आपत्ति दायर कर सकता हैं

It appears to the undersigned that there exists a dispute on the issue of non-payment of arrear of wages to Shri Dhananjay Sharma Sr.Reporter Ajeet Singh Building Totu, Shimla, H.P. and the management/employer/Bureau Chief Editor-in-Chief, Amar Ujala Publication Ltd.1101, 11th Floor Antriksh Bhawan, 22 Kasturba Gandhi Narg, Connaught Place New Delhi-110001 and Unit Head Amar Ujalla, Timber House Shimla-171001. accruing to him on account of entitlement due to recommendations of the Majithia Wage Board notification w.e.f. 11/11/11.

The report so prepared has been considered and decided that this dispute is required to be legally adjudicated by the Labour Court/Industrial Tribunal.

Therefore, the undersigned while exercising the powers vested in me by the Government of Himachal Pradesh vide Notification No: Shram(A)4-17/11-L dated; 18-10-2016, under Sub Section-2 of Section 17 of the Working Journalists and Other Newspaper Employees (Conditions of Services) Act, 1955 refers this dispute to the Labour Court/Industrial Tribunal Shimla constituted under Section-7 of the Industrial Disputes Act, 1947 with the following issues:

"Whether the action of the employers Bureau Chief Editor-in-Chief, Amar Ujala Publication Ltd.1101, 11th Floor Antriksh Bhawan, 22 Kasturba Gandhi Narg, Connaught Place New Deohi-110001 and Unit Head Amar Ujalla, Timber House Shimla-171001. for not paying claim of arrears amounting to Rs-1,14,814.00/- (Rs-One lakh fourteen thousand eitht hundred fourteen only) Shri Dhananjay Sharma Sr.Reporter Ajeet Singh Building Totu, Shimla, H.P. as difference of wages actually drawn and due as per recommendation of Majithia Wage Boards (Copy of claim enclosed) constituted under Section 9 & 13(C) of the Working Journalists and Other Newspaper Employees (Condition of Services and Miscellaneous Provisions Act, 1955) is legal and justified ? If yes, to what amount of relief/arrear, along with interest etc the aggrieved employee is entitled to from the above employers/Management?"

Shimla-171002, the 4th February, 2017

No. Shram(F)1-1/2015.—The Governor, Himachal Pradesh in pursuance to "Chief Minister's Startup/Innovation Projects/New Industries Scheme" notified by the Industries Department vide Notification No. Ind-II(F) 12-3/2015, dated 15.11.2016 is pleased to introduce the concept of Self Certification & provisional registration as per para 6.5 of the said scheme in the following manner:—

1. All the new enterprises in the State will be required to submit only self-certified documents online or manually. The Department will issue provisional registration within 15 days from the submission of the documents. Self-certification will reduce the regulatory burden on startups. Startups shall be allowed to self-certify compliance with labour laws and environment laws and any other statutory/mandatory laws.

2. No inspections by the officers of the Labour Department will be done for 3 years without the permission of Head of the Department. Startups may be inspected only on receipt of complaint of violation, filed in writing and approved by at least one Senior Level Officer to the Inspecting Officer. The format developed by the Ministry of Labour & Employment, Govt. of India for self-declaration are to be used by the start-ups during the first year under the following labour laws:

a. The Industrial Disputes Act, 1947. b. The Trade Unions Act, 1926. c. The Building and other Constructions Worker (Regulation and Employment and Conditions of Service) Act 1996.

d. The Industrial Employment (Standing Orders) Act, 1946. e. The Inter-State Migrant Workmen (Regulation of Employment and conditions of Service) Act, 1979

f. The Payment of Gratuity Act, 1972 g. The Contract Labour (Regulation and Abolition) Act, 1970. h. The Employees' Provident Funds and Miscellaneous Provisions Act, 1952. i. The Employees' State Insurance Act, 1948.

3. For the first year of setting up of the Start-ups such establishments may not be inspected under any of the 4 Labour Laws i.e. i) The Building and other Constructions Worker (Regulation and Employment and Conditions of Service) Act 1996, ii) The Inter-State Migrant Workmen (Regulation of Employment and conditions of Service) Act, 1979, iii) The Payment of Gratuity Act, 1972 & iv) The Contract Labour (Regulation and Abolition) Act, 1970. These start-ups may be asked to submit an online self-declaration instead.

4. Start-ups may be allowed to submit self-certified returns (as is being done under Shram Suvidha Portal under these Acts for the Central sphere) under aforesaid Acts. From the second year onwards, up to three years from the setting up of the unit such start-ups may be taken up for inspection only when very credible and verifiable complaint of violation is filed in writing and the approval has been obtained from at least one level senior to the inspecting officer.

5. Approved formats shall be used by the Start-up during the first year for making self- declaration under above mentioned labour laws which are annexed at Annexure A, B, C, & D respectively of this Notification.

श्री धर्म पाल पुत्र स्व0 श्री साधू राम, निवासी मानपुर देवड़ा, तहसील पांवटा साहिब, जिला सिरमौर ने एक प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि आवेदक किन्हीं कारणों से अपनी माता स्व0 कला देवी की मृत्यु तिथि 14-7-1984 का इन्द्राज निर्धारित अवधि के अन्दर सम्बन्धित ग्राम पंचायत में दर्ज नहीं करवा पाया है। इस बारे आवेदक द्वारा एक ब्यान हल्फी भी पेश किया गया है तथा इस सम्बन्ध में दो गवाहों के शपथ-पत्र भी आवेदक ने अपने प्रार्थना-पत्र के साथ संलग्न किये हैं। आवेदक ने ग्राम पंचायत मानपुर देवड़ा में अपनी ऊपर वर्णित माता की मृत्यु तिथि 14-07-1984 को दर्ज करने का अनुरोध किया है।
