BYE LAWS TO REGATION POSTING OF BILL, HORDINGS, ADVERTIMENTS OF

NAGAR PANCHAYAT JUBBAL

1. Short title commence and application.—These Bye–laws may be called the Nagar Panchayat Jubbal (Regulating the posting of Bills Hoardings, Advertisements sign board etc) Bye- laws 2017

(1) They shall come in to force on the date of their publication in the Rajpatra, Himachal Pradesh.

(2) They shall apply to Nagar Panchayat Jubbal.

2. Definitions.— in these bye laws unless the context otherwise requires.—

(a) "Act" means the Himachal Pradesh, Municipal Act 1994

(b) "Bills" means any poster, notice and advertisements printed on paper of board painted on Hording, Sign board or walls etc. and hung on poles etc.

(c) "Nagar Panchayat" means the Nagar Panchayat Jubbal and

(d) "Schedule" Means the schedule indicating the rate in respect of sign boards.

3. Prohibition of sticking, Fixing hanging or painting bills, posters, advertisements, notice etc:- No person shall without the written permission of the Secretary Nagar Panchayat Jubbal stick, fix or hung or cause to be fixed stick, hung or paint bills, posters advertisements, notice over any place or property whether private or public in street or road in contravention of the following conditions:—

i. Hording shall not be allowed in the required width the national/state high ways and other scheduled roads as they cause traffic hazard and are against the instructions of the Govt. of India and Hon'ble Himachal Pradesh High Court.

ii. No Hording advertisements shall be put on the valley side above the rode level (including on the roofs of building) to preserve the aesthetics, scenic beauty and the views of hills.

iii. No hoardings, advertising shall be put at the place where it affects, endangers the growth of flora;

iv. No hoardings shall be located in thickly wooded area and no wire of any kind shall be placed on trees.

v. No hoardings, advertising shall exceed dimension size of 16sq. meters,

vi. No hoardings, advertising shall be against the guideline of the PWD,

vii. No hoardings, advertising shall be located never a water source;

viii. No hoardings, advertising shall be in the form of writing engraving nailing and craving on any nature animate on inanimate object;

x. The beauty of nature formation such as hills, rivers, trees and rocks shall not be destroyed by indiscriminate installation of commercial advertisements.

4. Exemption.—Subject to the conditions mentioned in Bye Laws 3 privet board may be erected on respective premises by Govt. Offices, Association or mercantile firms for posting their own notice, Advertisements etc.

Prohibition of displaying indecent picture or language, advertisements containing indecent picture or language shall not be allowed. Secretary Nagar Panchayat Jubbal shall be authority to decide as to the decency or otherwise of the advertisements and the appeal against the decision shall be made to the Nagar Panchayat Jubbal whose decision shall be final.

5. Fee for Permission :

i. Fee @ Rs. 500/- per sqm. shall be payable for every permission granted under bye laws No. 3 above per annum.

ii. Cloth banners @ Rs. 200/ - per month per banner.

6. When a person desires to remove the advertisements, he will put space as it was before.

7. Penalties :—Whoever contravenes any of these bye laws shall be punishable with fine which may extend to Ten thousand Rupees and when contravention is a continuing one, with further fine which may extend to Rs. 200/ - for every day, after first day during which such contravention continues.

HIMACHAL PRADESH WAQF BOARD

Lakkar Bazar, Shimla

NOTIFICATION

Dated: the 9th March, 2017

No. HPWB/POI/666/2017.—The Himachal Pradesh Waqf Board hereby frames a policy for recruitment, promotion and transfer of Imams in various Mosques in the State which are being run under direct management of the Board.

2. At present, there are five categories of Imams in the Mosques maintained by the Board namely (i) Alim Imam, (ii) Hafiz Imam, (iii) Nazra Imam, (iv) Muazzin and (v) Caretaker.

3. The present policy for Imams/Caretakers does not provide any scope for promotion of Imams in the next grade. The facts remain there are some Imams who are highly qualified and knowledgeable, but denied promotions for want of a comprehensive policy/guidelines for recruitment, promotion and transfer of Imams.

4. Keeping in view the above, the following policy for recruitment, promotion and transfer of Imams specifying various categories of Imams, qualification and experience for new recruitment and eligibility for promotion for efficient performance of Imams and better management of Mosques.—

5. Eligibility for direct recruitment and promotion

82 राजपत्र, हिमाचल प्रदेश, 06 अप्रैल, 2017/16 चैत्र, 1939 5.1 The direct recruitment and promotions will be made by the Board on the recommendations of Religious Affairs Committee (RAC) to be constituted by the Board under Section 18 of the Waqf Act, 1995 (as amended)

5.2 The promotions of Imams in different categories shall be implemented w.e.f. 01.04.2017

6. Criteria for appointment/promotion

Direct recruitment shall be made only in the category mentioned at sr. nos. 3, 5, 7 & 8 i.e. Junior Hafiz, Junior Hafiz Alim Imam and Junior Alim Imam and Nazra Imam/ Caretaker/ Muazzin/ Muzawir by the Board on the recommendations of Religious Affairs Committee (RAC). No fresh appointment shall be made in the category at Sr. No. 1, 2, 4 & 6.

7. Age Limit

Age limit for direct recruitment/appointment of Imam will be 20-45

8. Agreement

After selection, candidate Imam shall have to sign a written agreement with the HP Waqf Board

9. Superannuation

All category of Imam will be retired from the services of the HP Wakf Board on attaining the age of 65 years. However, extension in service may be granted on year to year basis to an Imam beyond 65 years up to 70 years subject to medically fitness. On production of medical fitness certificate issued by Govt. Hospital case may be considered.

10. Transfer of Imams

All the Imams of HP Waqf Board will be transferred from one Mosque to other within Himachal Pradesh after every three years. However, all the existing Imams who have already completed period of three years at one place will also be covered under this policy. Non compliance will lead to termination of services and vacation of waqf property. If at any stage Board83 राजपत्र, हिमाचल प्रदेश, 06 अप्रैल, 2017/16 चैत्र, 1939 finds any adverse report in respect of any Imam, he will be shifted after a preliminary enquiry. On transfer/ retirement/demise, they will have to vacate the Hujra failing which legal action will be initiated against them or their LRs.

11. Disciplinary Action

In case political involvement, adverse statement given in media, work and conduct of Imam found unsatisfactory or complaint of misconduct at any instance, their services will be terminated after due enquiry by the Board.

12. Duties and responsibilities

(i) Imam shall be responsible for leading 5 time prayers, Juma Prayers, Eid-ul-Fitre & Eid-ul Azha prayers

(ii) Imam will be accountable to the public as well as Board. (iii) Provide burial services and guidance (iv) Conduct matrimonial services (v) Imam will recite Holy Quran in Traveeh during the month of Ramazan (vi) Maintenance of Attendance Register (vii) Maintenance and upkeep of the premises of Mosque (viii) Maintenance of Visitors Register (ix) Imam of Mosque shall also ensure that no undesirable elements stay in the Mosque premises and Mosque premises will not misuse for personal gain.

(x) Imam will impart Deeni Taleem to the Muslim children

13. Service Conditions of Imams

Service Conditions of Imams will be notified separately.

14. Caretaker Imams

Caretaker Imams were appointed on temporary basis for one year as a stop gap arrangement which has continued till date. In compliance of the orders, dated 29.06.2016 of Hon'ble H.P. High Court, these Caretaker Imams will be appointed according to their qualifications after assessment of their past service. However, if they have worked in any capacity in the employment of the HP Wakf Board for three years or more in the same Mosque the tenure rules notified hereby would also apply to them.

No. HPERC/428.—The Himachal Pradesh Electricity Regulatory Commission, in exercise of the powers conferred by sub-section (1) of Section 61, sub-section(1) of Section 62, clauses (a), 84 राजपत्र, हिमाचल प्रदेश, 06 अप्रैल, 2017/16 चैत्र, 1939 (b) and (e) of sub-section (1) of Section 86 and clause (zd) of sub-section (2) of Section 181, of the Electricity Act, 2003 (36 of 2003 and all other powers enabling it in this behalf, after previous publications, hereby makes the following amendments in HPERC (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2012, namely:—

REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) (Third Amendment) Regulations, 2017.

(2) These regulations shall come into force from 1st April, 2017.

2. Amendment in Regulation 1.—In sub-regulation (2) of Regulation 1 of the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2012 (hereinafter referred as "the said Regulations"), for the figures "31.03.2017", the figures "30.09.2017" shall be substituted.

3. Amendment in Regulation 9.—In sub-regulation (1) of Regulation 9 of the said Regulations.—

(i) for the words and figures "31st day of March, 2017", the words and figures "30th day of September, 2017" shall be substituted; and

(ii) in the existing 1st proviso after the word "Provided", the word "further" shall be added, and before the 1st proviso so amended, the following proviso shall be inserted namely:—

"Provided that the generic levellised tariffs, for the SHPs, for the control period, determined under these regulations by the Commission, prior to commencement of the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) (Third Amendment) Regulations, 2017, shall continue to be in force till 30th day of September, 2017 unless amended or revoked earlier." 4. Amendment in Regulation 17.—Regulation17of the said Regulations.—

(i) for the 3rd proviso to sub-regulation (2), the following proviso shall be substituted namely:—

"Provided further that the Commission may, in order to promote such technologies for smaller capacities, follow, mutatis mutandis, upto the limits as it may consider necessary separately for each such technology but not exceeding 5 MW for any such technology, the technological specific parameters, including capital cost, and other terms and conditions, as notified, or may be notified, by the Central Commission under its Renewable Energy Tariff Regulations in respect of the relevant financial year(s), for the relevant renewable energy technology, as may be considered appropriate by it" ; and

(ii) at the end of sub-regulation (3), the following proviso shall be added, namely:—

"Provided that the Commission may, by suo-moto order, adopt, in respect of any period, the generic levellised tariff determined by the Central Commission for the corresponding period in relation to any or all categories of such renewable energy technologies other than SHPs."
