संंख्याः स्वास्थ्य-ख(ख)1-3/2008-1.--हिमाचल प्रदेश केेेे राज्यपाल, भारत के संविधान केेेे अनुच्छेद 309 केेेे परन्तुक द्वारा प्रदत्त शक्तियोेंेंेंं का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग केेेे परामर्र्श सेे, इस विभाग की अधिसूचना संख्या हैल्थ-ए(ए)3-6/98 तारीख 02-12-1999 द्वारा राजपत्र, 46-राजपत्र/2017-03-06-2017 (1827) 1828 राजपत्र, हिमाचल प्रदेश, 3 जून, 2017/13 ज्येष्ठ, 1939 हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश चिकित्सा शिक्षा सेवा नियम, 1999 का और संशोधन करनेेेे केेेे लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमोेंं का संक्षिप्त नाम हिमाचल प्रदेश चिकित्सा शिक्षा सेवा (नौवां संशोधन) नियम, 2017 है।

(2) येेेे नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. अनैक्सचर -1 का संशोधन.--हिमाचल प्रदेश चिकित्सा शिक्षा सेवा नियम, 1999 (जिन्हेेेे इसमेेंेंेंं इसकेेेे पश्चात उक्त नियम कहा गया है) केे अनैक्सचर-1 में क्रम संख्या 6 केेेे सामनेेेे स्तम्भ-11 केेेे विद्यमान उपबन्धोेंेंेंं केेेे स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"सह आचार्यः-सहायक आचार्यों में सेेेे प्रोन्नति द्वारा, जिनका सम्बन्ध विशेषज्ञता मेेंें पांंच वर्ष का नियमित सेवाकाल होेेे या ग्रेड में की गर्र्ई लगातार तदर्र्थ सेवा, यदि कोई हो को सम्मिलित करके पांच वर्र्ष का नियमित सेवाकाल हो, ऐसा ने होने पर सहायक आचार्यों मेेेें सेेेे प्रोन्नति द्वारा जिनका सहायक आचार्र्य और प्रवक्ता के रुप में संयुक्तः छः वर्र्ष का नियमित सेवाकाल होेेे या ग्रेड में की गर्र्ई लगातार तदर्थ सेवा, यदि कोई होेेे कोेेे सम्मिलित करकेेेे छह वर्र्ष का नियमित सेवाकाल हो, जिसमेेंेंेंं सम्बन्ध विशेषज्ञता में सहायक आचार्र्य केे रुप मेेंेंेंं चार वर्र्ष की अनिवार्र्य सेवा सम्मिलित होगी, ऐसा न होने पर सीधी भर्र्ती द्वाराः

परन्तु प्रोन्नति या सीधी भर्र्ती द्वारा भरेेेे जानेेेे वालेेेे पदोेंेंेंं केेेे समस्त मामलोेंेंेंं मेेंं, पदधारी, सम्बन्ध विशेषज्ञता में स्नातकोत्तर के पश्चात कम सेेेे कम पांच वर्ष का अध्यापन अनुभव अवश्य रखता हो।'' 3. अपैंडिक्स-बी का संशोधन.--उक्त नियमोेंंं से संलग्न अपैंडिक्स-बी में क्रम संख्याः 6 (111) केेेे सामनेेेे विद्यमान उपबन्ध केेेे स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

''सह आचार्र्यःः- सम्बन्ध विशेषज्ञता में सहायक आचार्र्य केेेे रुप में कम सेेेे कम पांच वर्ष का अध्यापन अनुभव, ऐसा न होने पर सहायक आचार्र्य जोेेे सहायक आचार्र्य और प्रवक्ता केेेे रुप में संयुक्ततः छः वर्र्ष का अध्यापन अनुभव रखता हो, जिसमेें स्नातकोत्तर केेेे पश्चात सम्बन्ध विशेषज्ञता में सहायक आचार्र्य केेेे रुप मेेंेंेंं चार वर्र्ष का अध्यापन अनुभव सम्मिलित होगाः

परन्तुुुु सभी मामलोेंेंेंं मेेंेंेंं पदधारी, सम्बन्ध विशेषज्ञता मेेंेंेंं स्नातकोत्तर केेेे पश्चात कम सेेेे कम पांच वर्र्ष का अध्यापन अनुभव अवश्य रखता हो।''

अनैक्सचर-II का संशोधन.--उक्त नियमों से संलग्न अनैक्सचर-II में, विद्यमान प्रविष्टि संख्या 36 के नीचे निम्नलिखित प्रविष्टियां अन्तःस्थापित की जाएगी, अर्थात्‌ः--

37 इम्युनो हेमेटोलॉजी एण्ड ब्लड ट्रांसफयूजन.--डी0 एम0 (इम्युनोलॉजी) या एम0 डी0 (इम्युनो हेमेटोलॉजी एण्ड ब्लड ट्रांसफयूजन)/एम0 डी0 (पैथोलॉजी या बैक्टीरियोलॉजी या हैमेटोलॉजी) सहित इम्युनो हेमेटोलॉजी एण्ड ब्लड ट्रांसफयूजन के विभाग में दो वर्ष का अध्यापन अनुभव या विशेष प्रशिक्षण। 38 न्यूक्लर मैडिसिन.--एम0 डी0 (न्यूक्लर मैडिसिन)/एम0 डी0 (रेडियोथैरेपी) सहित किसी मान्यता प्राप्त केन्द्र में न्यूक्लर मैडिसिन में दो वर्ष का अनुभव/एम0 डी0 (मैडिसिन) सहित डी0 आर0 एम0 या डी0 एन0 एम0/एम0 डी0 (रेडियो डाइग्नोसिज) सहित किसी मान्यता प्राप्त केन्द्र में न्यूक्लीयर मैडिसिन में दो वर्ष का अनुभव/एम0 डी0 (बायोफिजिक्सि) या बायोफिजिक्सि में इसके समतुल्य अर्हता संहिता न्यूक्लीयर मैडिसिन में डी0 आर0 एम0 या डी0 एन0 एम0 या डी0 एन0 बी0 सहित किसी मान्यता प्राप्त केन्द्र में न्यूक्लीयर मैडिसिन में दो वर्ष का अनुभव।

39 एमरजेन्सी मैडिसिन.--एम0 डी0 एमरजैन्सी मैडिसिन डिपार्ममैन्ट या एम0 डी0 (जनरल मैडिसिन)/एम0 एस0 (जनरल सर्जरी)/एम0 डी0 (रेस्प0 मैडि0)/एम0 डी0 (एनस्थिसिया)/एम0 एस01829 राजपत्र, हिमाचल प्रदेश, 3 जून, 2017/13 ज्येष्ठ, 1939 (ऑर्थोपेडिक्स) सहित एमरजैन्सी मैडिसिन या एम0 डी0 (जनरल मैडिसिन)/एम0 एस0 (जनरल सर्जरी)/ एम0 डी0 (रेस्प0 मैडि0)/एम0 डी0 (एनस्थिसिया)/एम0 एस0 (ऑर्थोपेडिक्स) में दो वर्ष का प्रशिक्षण। टिप्पण-1.--एम0 डी0, ई0 एम0 डी0 अभ्यर्थियों या उन अभ्यर्थियों को अधिकान्‌ दिया जाएगा जिन्होंने ई0 एम0 डी0 में दो वर्ष का प्रशिक्षण प्राप्त किया हो।

टिप्पणः-उपरोक्त यथावर्णित शैक्षणिक अर्हता, अधिसूचना की तारीख अर्थात्‌ 15-12-2009 से दस वर्ष की अवधि के लिए अध्यापन संकाय पद हेतु शैक्षिणिक अर्हता होगी। यह भी दोहराया जाता है कि केवल एम0 डी0 (एमरजैन्सी मैडिसिन) की शैक्षणिक अर्हता, 15-12-2019 के पश्चात्‌ अध्यापन संकाय के पद संकाय पर नियुक्ति के लिए अपेक्षित शैक्षणिक अर्हता होगी।

40 कार्डिअक एनस्थिसिया.--एम0 डी0 (एनस्थिजियोलॉजी) सहित कार्डिअक एनस्थिजियोलॉजी में दो वर्ष का विशेष प्रशिक्षण।

टिप्पणः-उपरोक्त यथावर्णित शैक्षणिक अर्हता, अधिसूचना की तारीख अर्थात्‌ 15-12-2009 से दस वर्ष की अवधि के लिए अध्यापन संकाय पद हेतु शैक्षणिक अर्हता होगी। यह भी दोहराया जाता है कि केवल एम0 डी0 (कार्डिअक एनस्थिसिया) की शैक्षणिक अर्हता, 15-12-2009 के पश्चात्‌ अध्यापन संकाय के पद पर नियुक्ति के लिए अपेक्षित शैक्षणिक अर्हता होगी।

41 न्यूरो रेडियोलॉजी.--न्यूरो रेडियोलॉजी (एम0 बी0 बी0 एस0 के पश्चात्‌ दो वर्ष या तीन वर्ष या पांच वर्ष का मान्यता प्राप्त कोर्स) में डी0 एम0 या इसके समकक्ष मान्यता प्राप्त अर्हता।

42 मेडिकल ऑनोकोलॉजी.--डी0 एम0 (मेडिकल ऑनोकोलॉजी)/एम0 डी0 (मैडिसन) या एम0 डी0 (रेडियोथेरेपी) या एम0 डी0 (पीडियाट्रिक्स) सहित मैडिकल ऑनोकोलॉजी में दो वर्ष का विशेष प्रशिक्षण। 43 एन्डोक्रिनोलॉजी.--डी0 एम0 (एन्डोक्रिनोलॉजी)/एम0 डी0 (मैडिसन) या एम0 डी0 (पीडियाट्रिक्स) सहित एन्डोक्रिनोलॉजी में दो वर्ष का प्रशिक्षण।

NOTIFICATION

Dated; the 26th May, 2017

No. HFW-B(B)1-3/2008-I.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal Pradesh Public Service Commission is pleased to make the following Rules further to amend the Himachal Pradesh Medical Education Service Rules, 1999 notified in Rajpatra vide this department Notification NO: Health-A (A) 3- 6/98, dated 02.12.1999, namely:—

1830 राजपत्र, हिमाचल प्रदेश, 3 जून, 2017/13 ज्येष्ठ, 1939 1. Short tile and commencement.—(1) These rules may be called the Himachal Pradesh th Amendment) Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Annexure-I.—In Annexure-I to the Himachal Pradesh Medical Education Service Rules, 1999 (herein after referred to as the "said rules", for the existing provisions of Column 11 against Sr. No. 6, the following shall be substituted, namely:—

"Associate Professor:—By promotion from amongst the Assistant Professors who possess five years regular service or regular combined with continuous adhoc service, if any, in the grade, in the concerned speciality, failing which by promotion from amongst the Assistant Professors who possess six years regular service or regular combined with continuous adhoc service, if any, as Assistant Professor and Lecturer combined, which shall include four years essential service as Assistant Professor in the concerned speciality failing which by direct recruitment.

Provided that in all cases for posts to be filled up by promotion or direct recruitment the incumbent must possess at least five years teaching experience after Post Graduation in the concerned specialty."

Amendment of Appendix-B.—In Appendix- B appended to the said rules, for the existing provision against Sr. No. 6 (iii), the following shall be substituted, namely:—

"Associate Professor:—Atleast five years teaching experience as Assistant Professor in the concerned specialty, failing which an Assistant Professor having six years teaching experience as Assistant Professor and Lecturer combined which shall include four years teaching experience as Assistant Professor in the concerned specialty after Post graduation:

Provided that in all cases the incumbent must possess atleast five years teaching experience after post gradation in the concerned specialty.".

3. Amendment of Annexure-II.—In Annexure-II appended to the said rules, below existing entry: 36, following entries shall be inserted, namely:—

"37 IMMUNO HAEMATOLOGY AND BLOOD TRANSFUSION.—D.M. (Immunology) OR M.D. (Immuni-Haematology and Blood Transfusion)/M.D. (Pathology or Bacteriology or Haematology) with 2 years teaching experience or special training in the deptt. of Immuno-Haematology and Blood transfusion.

38. NUCLEAR MEDICINE.—M.D. (Nuclear Medicine)/M.D.(Radio-Therapy) with two years experience in Nuclear Medicine in a recognised centre/M.D.(Medicine) with DRM (Diploma in radiation medicine OR DNM (Diploma in Nuclear Medicine/M.D. (Radio- Diagnosis) with two years experience in Nuclear Medicine in a recognised centre/M.D.(Bio- Physics) or its equivalent qualification in Bio-Physics with DRM (Diploma in Radiation Medicine) or DNM (Diploma in Nuclear Medicine) Or DNB (Diplomate of national Board) in Nuclear Medicine with two years experience in Nuclear Medicine in a recognised centre.

39. EMERGENCY MEDICINE.—MD, Emergency Medicine Department or M.D. (General Medicine)/M.S. (General Surgery)/ M.D. (Respiratory Medicine)/M.D. (Anaesthesia)/ M.S. (Orthopaedics) with 2 years training in Emergency Medicine or M.D. (General Medicine)/ M.S. (General Surgery)/M.D. (Respiratory Medicine)/M.D.(Anaesthesia)/M.S. (Orthopaedics).

Note:-1:—Preference will be given to MD, EMD or to those who have done 2 year training in EMD.

NOTE:— The academic qualification as mentioned above will be the academic qualification required for teaching faculty post for a period of 10 years w.e.f. 15-12-2009 i.e date of notification. It is reiterated that only the academic qualification of MD (Emergency Medicine) will be the required academic qualification for appointment to the post of teaching faculty after 15-12-2019.

40. CARDIAC ANESTHESIA.—M.D. (Anaesthesiology) with 2 years special training in Cardiac Anaesthesiology.

Note:—The academic qualification as mentioned above will be the academic qualification required for teaching faculty post for a period of 10 years w.e.f. 15-12-2009 i.e date of notification. It is reiterated that only the academic qualification of DM (Cardiac Anesthesia) will be the required academic qualification for appointment to the post of teaching faculty after 15-12-2019.

41 NEURO RADIOLOGY.—D.M. in Neuro Radiology (2 years or 3 years, or 5 years recognized course after MBBS) or a qualification recognized equivalent thereto.

42. MEDICAL ONCOLOGY.—D.M. (Medical Oncology)/MD (Medicine) or MD (Radiotherapy) or MD (Paediatrics) with 2 year special training in Medical oncology.

43. Endocrinology.— D.M.(Endocrinology)/M. D. (Medicine) or M.D.(Paediatrics) with two years special training in Endocrinology.

No. 47-LSA/L.A.C.-Scheme/2003.—In exercise of the powers conferred by clause (g) of section 2 read with section 12 (g) of The Legal Services Authorities Act, 1987 (Act No. 39 of 1987), the Himachal Pradesh State Legal Services Authority hereby makes the following Scheme further to amend the Himachal Pradesh Legal Aid Counsel Scheme, 2003 notified vide this Authority Notification No.47-LSA/L.A.C. Scheme/2003-6891-7126, 7139-7141, 7145 & 7146, dated 22nd September 2003, published in the Rajpatra, Himachal Pradesh, dated 4th October, 2003, namely :—

1. Short title and commencement.—(i) This Scheme may be called the Himachal Pradesh Legal Aid Counsel (fourth amendment) Scheme, 2010.

(ii) It shall come into force with effect from first day of June, 2017.

2. Amendment of Para in 8 (i):— In Para 8 (i) the following shall be substituted:

(i) For discharging his/her duties in the matters of legal aid, a Legal Aid Counsel shall be paid a consolidated fee of Rs.5000/- per month at District level (District & Sessions Judge/ Addl. District & Sessions Judge/ Special Judge) and Rs.3000/- per month in1834 राजपत्र, हिमाचल प्रदेश, 3 जून, 2017/13 ज्येष्ठ, 1939 other Courts. The Legal Aid Counsel shall not receive any remuneration from accused in any form what so ever.

No.:11-5/99(Lab)ID/2016/Chamba.—It appears to the undersigned that an industrial dispute exists between Shri Koll Singh S/O Shri Chatter Singh, R/O Village Kulal, P.O. Mindhal, Tehsil Pangi, District Chamba, H.P. and the Employer/Branch Manager, H.P. Gramin Bank, Branch Sach, Tehsil Pangi, District Chamba, H.P. on the issue of alleged termination of his services during May, 2015.

As per the report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, he tried his level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under sub section-5 of Section-12 of the Act ibid, the undersigned has decided that this dispute is required to be legally adjudicated by the Labour Court/ Industrial Tribunal.

Guin, Tehsil Sarkaghat, District Mandi, H.P. and (i) the Engineer-in-Chief, H.P.P.W.D. Nirman Bhawan, Shimla, District Shimla, H.P. (ii)the Executive Engineer, H.P.P.W.D., Division Dharampur, District Mandi, H.P. as per demand notice dated 12-05-2015 submitted by the said ex-worker regarding her alleged termination of services.

Whereas, the Labour Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, undersigned while exercising the power vested as provided under sub- section-5 of Section-12 of the Act ibid carefully examined the report and come to the conclusion that above ex-worker had raised the dispute of alleged illegal termination from the services during September, 1999 before the above employer after delay of more than 15 years.

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram (A) 4-9/2006- IV-Loose, Dated 15th February, 2014 and as provided in Sub Section-1 of Section-10 of the Industrial Disputes Act, 1947 (14 of 1947) and keeping in view the latest judgments of the Hon'ble High Court of Himachal Pradesh, Shimla about the declining the references to the Labour Court for adjudication, formed an opinion to refer this dispute to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section-7 of Act ibid, for legal adjudication on following issue/issues:—

श्रीमती जाहिदा बेगम पत्नी स्व0 श्री मुहम्मद इकबाल, निवासी मोहल्ला ढाबों नाहन, तहसील नाहन, जिला सिरमौर, हि0 प्र0 ने इस अदालत में आवेदन पत्र पेश किया है कि पटवार वृत्त नाहन-II के राजस्व कागजात माल अराजी खाता खतौनी नं0 265/425 मौजा ढाबों नाहन में मालिक अराजी है। राजस्व कागजात में प्रार्थिया का नाम इन्तकाल नं0 398 मौला ढाबों नाहन में जवादा बेगम पत्नी स्व0 श्री मुहम्मद इकबाल के नाम से तस्दीक हुआ है जिसका अमल जमाबन्दी 2002-2003 में हुआ है जबकि आधार कार्ड व जायज वारसान प्रमाण पत्र में प्रार्थिया का सही नाम जाहिदा बेगम पत्नी स्व0 मोहम्मद इकबाल है। इस बारे प्रार्थिया ने आधार कार्ड व जायज वारसान प्रमाण पत्र की छायाप्रति प्रस्तुत की है।

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि जिस किसी को प्रार्थिया का नाम श्रीमती जवादा बेगम पत्नी स्व0 श्री मोहम्मद इकबाल के स्थान पर जाहिदा बेगम पत्नी स्व0 श्री मोहम्मद इकबाल, निवासी मोहल्ला ढाबों नाहन, तहसील नाहन, जिला सिरमौर, हि0 प्र0 के दरुस्ती बारे कोई आपत्ति हो तो वह दिनांक 19-06-2017 को प्रातः 10.00 बजे वकालतन व असालतन नामा इस अदालत में हाजिर आकर अपना पक्ष प्रस्तुत कर सकते हैं। गैर हाजरी की सूरत में कार्यवाही एकतरफा अमल में लाई जावेगी। बाद में किसी का कोई भी उजर/एतराज मान्य न होगा।

श्री बीर सिंह पुत्र श्री स्वारू राम, निवासी ग्राम मेहत, ग्राम पंचायत कान्डो कांसर, तहसील ददाहू, जिला सिरमौर, हि0 प्र0 ने इस अदालत में एक दरख्वास्त गुजारी है कि उसका नाम ग्राम पंचायत कान्डो कांसर के रिकार्ड में बीर सिंह दर्ज है। जबकि राजस्व रिकार्ड मौजा मेहत, पटवार वृत कान्डो फागड में बलवीर सिंह दर्ज है। जिसकी पुष्टि हेतु प्रार्थी ने आवेदन पत्र मय हलफा ब्यान, नकल जमाबन्दी, नकल परिवार रजिस्टर, नकल आधार कार्ड प्रस्तुत किया है। जिसे वह अब राजस्व रिकार्ड मौजा मेहत, पटवार वृत कान्डो फागड में बीर सिंह दर्ज करवाना चाहता है।

अतः इस नोटिस द्वारा समस्त जनता ग्राम मेहत व प्रार्थी के समस्त रिश्तेदारों को सूचित किया जाता है कि यदि किसी को बीर सिंह का नाम राजस्व रिकार्ड मौजा कान्डो फागड के रिकार्ड में दर्ज करने बारे उजर व एतराज हो तो वह दिनांक 17-06-2017 को असालतन व वकालतन हाजिर होकर अपना एतराज पेश कर सकता है/सकती है। उसके उपरान्त कोई उजर व एतराज नहीं सुना जाएगा और नियमानुसार प्रार्थना पत्र का निपटारा कर दिया जाएगा।

कु0 वर्षा शर्मा पुत्री श्री सुशील शर्मा, निवासी बरोटीवाला़, तहसील पांवटा साहिब, जिला सिरमौर ने एक प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि आवेदिका किन्हीं कारणों से अपनी जन्म तिथि 28-08-1993 का इन्द्राज निर्धारित अवधि के अन्दर सम्बन्धित ग्राम पंचायत में दर्ज नहीं करवा पाई है। इस बारे आवेदिका द्वारा एक ब्यान हल्फी भी पेश किया गया है तथा इस सम्बन्ध में दो गवाहों के शपथ-पत्र भी आवेदिका ने अपने प्रार्थना-पत्र के साथ संलग्न किये हैं। आवेदिका ने ग्राम पंचायत शिवपुर में अपनी ऊपर वर्णित स्वयं की जन्म तिथि 28-08-1993 को दर्ज करने का अनुरोध किया है।
