No.:11-5/99(Lab)ID/2016/Chamba.—Whereas the Labour Officer-cum-Conciliation Officer, Chamba has submitted a report as provided under Section-12(4) of the Industrial Disputes Act, 1947 stating that there was an alleged industrial dispute in between Shri Ruldu Ram S/O Shri Bir Singh, R/O Village Jhanglehed, P.O. Sihunta, Tehsil Bhatiyat, District Chamba, H.P. and the 51-राजपत्र/2017-12-06-2017 (2051)2052 राजपत्र, हिमाचल प्रदेश, 12 जून, 2017/22 ज्येष्ठ, 1939 Additional Superintending Engineer, Electrical Division H.P.S.E.B.L., Dalhousie, District Chamba, H.P. as per demand notice dated nil received in Labour Office Chamba on 01-05-2015 submitted by the said ex-worker regarding his alleged termination of services.

Whereas, the Labour Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, undersigned while exercising the power vested as provided under sub- section-5 of Section-12 of the Act ibid carefully examined the report and come to the conclusion that above ex-worker had raised the dispute of alleged illegal termination from the services during January, 1990 before the above employer after delay of more than 25 years and has worked from January, 1985 to December, 1989 respectively.

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram (A) 4-9/2006-IV-Loose, Dated 15th February, 2014 and as provided in Sub Section-1 of Section-10 of the Industrial Disputes Act, 1947 (14 of 1947) and keeping in view the latest judgments of the Hon'ble High Court of Himachal Pradesh, Shimla about the declining the references to the Labour Court for adjudication, formed an opinion to refer this dispute to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section-7 of Act ibid, for legal adjudication on following issue/issues:—

"Whether alleged termination of the services of Shri Ruldu Ram S/O Shri Bir Singh, R/O Village Jhanglehed, P.O. Sihunta, Tehsil Bhatiyat, District Chamba, H.P. during January, 1990 by the Additional Superintending Engineer, Electrical Division H.P.S.E.B.L., Dalhousie, District Chamba, H.P. who has worked as beldar on daily wages basis and has raised his industrial dispute vide demand notice dated nil received in Labour Office Chamba on 01-05-2015 after delay of more than 25 years, without complying with the provisions of the Industrial Disputes Act, 1947 is legal and justified? If not, keeping in view of working period from January, 1985 to December, 1989 and delay of more than 25 years in raising the industrial dispute, what amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer/management? "

No.:11-1/85(Lab)ID/2016/Kangra.—Whereas Shri Sahib Singh S/O Shri Garib Dass, R/O Village Samula, P.O. Sadwan, Tehsil Nurpur, District Kangra, H.P. had raised a demand notice dated nil received in Labour Office Kangra at Dharamshala on 13-06-2011 regarding his illegal termination from the services by (i) the Executive Engineer, H.P.P.W.D., Division Nurpur, District Kangra, H.P. (ii) the Executive Engineer, H.P.P.W.D., Division Jawali, District Kangra, H.P.The Labour Officer-cum-Conciliation Officer Kangra at Dharamshala, District Kangra, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he has sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, Himachal Pradesh;

And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Kangra at Dharamshala was considered, examined and the Labour Commissioner, Himachal Pradesh as appropriate Government came to the conclusion that above worker had raised the dispute at a belated stage of about 21 years and therefore declined the reference of the dispute vide order dated 31-08-2013;

And whereas Shri Sahib Singh S/O Shri Garib Dass has agitated the above orders of declining of reference of his industrial dispute to the Ld. Labour Court before the Hon'ble High Court of Himachal Pradesh vide CWP No. 473/2016. The Hon'ble High Court of Himachal Pradesh has disposed off the CWP on dated 17-03-2016 and directed the respondents to consider the case of the petitioners, in terms of the judgment dated 30th December, 2014, delivered by the Hon'ble High Court in C.W.P. No. 9467 of 2014, titled as Pratap Chand Versus Himachal Pradesh State Electricity Board and others. The operative part of the said judgment is reproduced as follows:—

"3. In the given circumstances, we deem it proper to direct the respondents to consider the case of the

petitioners, in terms of the judgment (supra), and make a decision within eight weeks. The said judgment shall

form part of this judgment also.

4. The writ petitions are disposed of accordingly, alongwith pending applications, if any."

Therefore in view of above the undersigned while exercising the powers vested by the Government of Himachal Pradesh vide Notification No.: Shram (A) 4-9/2006-IV-Loose, Dated 15th February, 2014 and as per power vested under Sub Section-1 of Section-10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section-7 of Act ibid, on the following issue/issues for legal adjudication:—

No.:11-5/99(Lab)ID/2016/Chamba.—It appears to the undersigned that an industrial dispute exists between Shri Sarnu Ram S/O Shri Gurmukh, through the General Secretary, District Committee, AITUC, HQ CHEP Stage-II, Karian, P.O. Hardaspura, Tehsil & District Chamba, H.P. and the Divisional Forest Officer, Chamba Forest Division, District Chamba, H.P. on the issue of alleged time to time termination of his services during June, 1997 to March, 2014.

As per the report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, he tried his level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under sub section-5 of Section-12 of the Act ibid, the undersigned has decided that this dispute is required to be legally adjudicated by the Labour Court/ Industrial Tribunal.

Therefore, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram (A) 4-9/2006-IV-Loose, Dated 15th February, 2014 and as per power vested under Sub Section-1 of Section 10 of The Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section-7 of Act ibid, on the following issue/ issues for legal adjudication:—

No.:11-23/84(Lab)ID/2016/Mandi.—Whereas the Labour Officer-cum-Conciliation Officer, Mandi has submitted a report as provided under Section-12(4) of the Industrial Disputes Act, 1947 stating that there was an alleged industrial dispute in between Smt. Soma Devi W/O Shri Thakar Dass, R/O Village Chanjyar, P.O. Dhawali, Tehsil Sarkaghat, District Mandi, H.P. and the Executive Engineer, H.P.P.W.D., Division Dharampur, District Mandi, H.P. as per demand notice dated 12-07-2015 submitted by the said ex-worker regarding her alleged termination of services.

Whereas, the Labour Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, the Labour Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. Haddal, Tehsil Nurpur, District Kangra, H.P. during year, 1990 by (i) the Executive Engineer, H.P.P.W.D., Division Nurpur, District Kangra, H.P. (ii) the Executive Engineer, H.P.P.W.D., Division Jawali, District Kangra, H.P., who had worked on daily wages as beldar and has raised his industrial dispute after about 21 years vide demand notice dated nil received in the Labour Office Kangra at Dharamshala on 13-06-2011, without complying the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, keeping in view delay of about 21 years in raising the industrial dispute, what amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employers/management?"

No.:11-5/99(Lab)ID/2016/Chamba.—Whereas the Labour Officer-cum-Conciliation Officer, Chamba has submitted a report as provided under Section-12(4) of the Industrial Disputes Act, 1947 stating that there was an alleged industrial dispute in between Ms. Toti alias Sonu Kmari D/O Shri Mangal Chand, R/O Village Thandal, P.O. Purthi, Tehsil Pangi, District Chamba, H.P. and the Divisional Forest Officer, Pangi Forest Division, Killar, District Chamba, H.P. as per demand notice dated nil received in Labour Office Chamba on 21-08-2015 submitted by the said ex-worker regarding her alleged termination of services.

Whereas, the Labour Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, undersigned while exercising the power vested as provided under sub- section-5 of Section-12 of the Act ibid carefully examined the report and come to the conclusion that above ex-worker had raised the dispute of alleged illegal termination from the services during August, 2002 before the above employer after delay of more than 6 years and has worked from May, 1995 to July, 2002 respectively.

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram (A) 4-9/2006-IV-Loose, Dated 15th February, 2014 and as provided in Sub Section-1 of Section-10 of the Industrial Disputes Act, 1947 (14 of 1947) and keeping in view the latest judgments of the Hon'ble High Court of Himachal Pradesh, Shimla about the declining the references to the Labour Court for adjudication, formed an opinion to refer this dispute to the Labour Court/Industrial Tribunal Dharamshala, constituted under Section-7 of Act ibid, for legal adjudication on following issue/issues:—

प्रार्थिया श्रीमती रीता देवी पत्नी श्री अशोक कुमार, निवासी गांव मलकाना, डाकघर पराल, तहसील इन्दौरा, जिला कांगड़ा, हि0 प्र0 ने प्रार्थना पत्र प्रस्तुत करते हुए निवेदन किया है कि उसके पुत्र राजीब कुमार का जन्म प्रमाण व परिवार नकल, ग्राम पंचायत सुरड़वां के अभिलेख में गलत दर्ज है। ग्राम पंचायत सुरड़वां के अभिलेख में प्रार्थिया के दोनों पुत्रों का नाम संजीव कुमार दर्ज है। मेरे बड़े बेटे का नाम संजीब कुमार व जन्म तिथि 8-11-1993 सही दर्ज है जबकि छोटे बेटे का नाम राजीब कुमार का जन्म तिथि 17-01-1996 को हुआ है। उसका नाम राजीब कुमार के बजाए संजीब कुमार गलत दर्ज किया गया है। जिसे सही दर्ज किया जाए अतः इस इश्तहार राजपत्र के द्वारा सर्वसाधारण को सूचित किया जाता है कि उक्त जन्म पंजीकरण रजिस्टर व परिवार रजिस्टर में सजीब कुमार के बजाए उसका सही नाम राजीब कुमार दर्ज करने बारे किसी भी व्यक्ति को कोई एतराज हो तो वह असालतन या वकालतन दिनांक 30-06-2017 को प्रातः 10.00 बजे अदालत हजा में हाजिर होकर अपना एतराज पेश कर सकता है। कोई एतराज पेश न होने की सूरत में जन्म पंजीकरण में नाम संशोधन के आदेश पारित कर दिए जाएंगे।

इस कार्यालय में श्री बुध राम पुत्र श्री जानकी, निवासी कोथसेर, फाटी तूनन, तहसील निरमण्ड, जिला कुल्लू, हि0 प्र0 ने उक्त अधिनियम के अन्तर्गत प्रार्थना-पत्र गुजार कर निवेदन किया है कि उसके एक पुत्र जितेन्द्र कुमार का जन्म दिनांक 24-11-1992 को व पुत्री कुमारी सुषमा का जन्म दिनांक 07-03-1998 को हुआ है। इनके नाम व जन्म तिथि अज्ञानता के कारण व इलाका गैर रहने से निश्चित अवधि में दर्ज नहीं करा सका हूं, और जिस विषय उसने अपना शपथ पत्र भी प्रस्तुत किया है। सायल ने ग्राम पंचायत तूनन में उसके परिवार रजिस्टर में नाम दर्ज करने का अनुरोध कर रखा है।

इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी भी व्यक्ति को जितेन्द्र कुमार पुत्र व सुषमा का नाम व जन्म तिथि ग्राम पंचायत तुनन में दर्ज करने के लिए एतराज हो तो वह दिनांक 30-06-2017 तक हमारे कार्यालय में हाजिर होकर लिखित व मौखिक एतराज प्रस्तुत करें उक्त तारीख के बाद कोई भी एतराज मान्य नहीं होगा और समझा जावेगा कि उपरोक्त नाम व जन्म तिथि ग्राम पंचायत तुनन में दर्ज करने बारे किसी का कोई एतराज नहीं है तथा सचिव ग्राम पंचायत तूनन को पंजीकृत नाम व जन्म तिथि दर्ज करने के आदेश पारित कर दिए जायेंगे।
