संख्याःईडीएन-सी-एफ(10)8/2009-(लूज).--हिमाचल प्रदेश के राज्यपाल, निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार अधिनियम, 2009 (2009 का 35) की धारा 38 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्याः ईडीएन-सी-एफ(10)8/09, तारीख 5 मार्च, 2011 द्वारा अधिसूचित और ई-गजट में 74-राजपत्र/2017-12-07-2017 (3705) 3706 राजपत्र, हिमाचल प्रदेश, 12 जुलाई, 2017/21 आषाढ़, 1939 तारीख 8 मार्च, 2011 को प्रकाशित निःशुल्फ और अनिवार्य बाल शिक्षा का अधिकार हिमाचल प्रदेश नियम, 2011 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार हिमाचल प्रदेश (संशोधन) नियम, 2017 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत होंगें।

2. नियम 18 का संशोधन.--निःशुल्क और अनिवार्य बाल शिक्षा का अधिकार हिमाचल प्रदेश नियम, 2011 के नियम 18 के उपनियम (2) के खण्ड (ग) के स्थान पर निम्नलिखित खण्ड रखें जाएगें, अर्थात्‌ः-- ''(ग) सभी प्रारंभिक कक्षाओं के लिए कक्ष-बार, विषय-बार अधिगम परिणाम तैयार करना; और ''(घ) परिभाषित अधिगम परिणमों को प्राप्त करने के लिए सतत्‌ और व्यापक मूल्यांकन को अमल में लाने के लिए दिशा निर्देश तैयार करना''।

No.EDN-C-F(10)-8/09-L.—In exercise of the power conferred by section 38 of the Right of Children to Free and Compulsory Education Act, 2009, (35 of 2009), the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Right of Children to Free and Compulsory Education Rules, Himachal Pradesh 2011, notified vide Notification No. EDN-C-F(10)-8/09 dated 5 t h March, 2011 and published in e-Gazette on 8th March , 2011, namely:—

1. Short title and commencement.—(1) These rules may be called the Right of Children to Free and Compulsory Education Himachal Pradesh (Amendment) Rules, 2017.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Amendment of rule 18.—In rule 18 of the Right of Children to Free and

Compulsory Education Himachal Pradesh Rules, 2011, in sub-rule (2), for clause (c),

the following clauses shall be substituted, namely:—

"(c) Prepare class-wise, subject-wise learning outcomes for all elementary classes;

evaluation, to achieve the defined learning outcomes".

The Governor, Himachal Pradesh is further pleased to order the postings of these officiating Principal (College Cadre) in the Government College(s) shown against their names, subject to terms & conditions mentioned below:—

1. The above Officiating Principals (College Cadre) shall not be entitled for any remuneration for holding the charge of the post of Principal (College Cadre) and shall continue in their existing pay scales.

2. All the above Officiating Principals (College Cadre) are directed to report for duty at the place of postings within 07 days and send their joining reports to this department through proper channel.

3. The above officiating Principal(s) will not be eligible to exercise their option(s) for fixation of pay under the provisions of FR-22(a)(1).

4. The Officiating Principal (s) shall have no right to claim for continuation, seniority and regular promotion etc.

5. No extension in the joining period will be allowed in any case.

शिमला-2, 03 जुलाई, 2017

संख्याः गृह(सतर्कता)ए(3)-22/2016.--हिमाचल प्रदेश केेे राज्यपाल, हिमाचल प्रदेश लोकायुक्त अधिनियम, 2014 (2015 का अधिनियम संख्यांक 23) की धारा 54 द्वारा प्र्र्रदत्त शक्तियों का प्रयोग करतेेे हुए, हिमाचल प्रदेश लोकायुक्त केेे परामर्श से, पूर्र्वोक्त अधिनियम केेे उपबन्धोंंं को कार्यान्वित करनेेे केेे लिए एतद्‌्‌्‌ द्वारा निम्नलिखित नियम बनातेेे है, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमो का सक्षिप्त नाम हिमाचल प्रदेश लोकायुक्त नियम, 2017 है।

(2) ये नियम राजपत्र, हिमाचल प्र्र्र्र्र्र्रदेश मेंंंंंंं प्रकाशन की तारीख से प्र्र्र्र्र्र्रवृत्त होंगे।

2. परिभाषाएं.-- (1) इन नियमोेंेंेंेंेंेंं मेेंेंेंेंेंेंं जब तक कि सन्दर्भ सेेेेेेे अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" सेेेेेेे हिमाचल प्र्र्र्र्र्र्रदेश लोकायुक्त अधिनियम, 2014 (2015 का अधिनियम संख्यांक 23) अभिप्रेत है;

(ख) "शिकायतकर्ता" से ऐसा व्यक्ति अभिप्रेत है जो अधिनियम केे अधीन कोई शिकायत करता है;

(ग) "प्ररूप" से इन नियमोेंेंेंेंेंेंं से संलग्न प्र्र्र्र्र्र्ररूप अभिप्रेत है;

(घ) "अधिकारी" से ऐसा व्यक्ति अभिप्रेत है जो लोकायुक्त, के/की राजपत्रित काडर/ सेवा के लिए नियुक्त या द्वारा धारित है; और

(ङ) "धारा" सेेेेेेे अधिनियम की धारा अभिप्रेत है।

(2) उन समस्त शब्दोंंंंंंं और पदोंंंंंंं के, जो इन नियमोंंंंंंं मेंंंंंंं प्रयुुुुुुुक्त हैं परन्तुुुुुुु परिभाषित नहींंंंंंं हैं, किन्तुुुुुुु हिमाचल प्रदेश लोकायुक्त अधिनियम, 2014, भ्रष्टाचार निवारण अधिनियम, 1988 या हिमाचल प्रदेश विनिर्दिष्ट भ्रष्ट आचरण निवारण अधिनियम, 1983 मे परिभाषित है, वही अर्थ होेंेंेंेंेंेंंगे जो उन अधिनियमो मे क्रमशः उनकेेेेेेेे है।

3. शिकायत.--(1) शिकायत, शिकायतकर्ता (परिवादी) द्वारा हस्ताक्षरित होगी और प्ररूप-1 में की जाएगी तथा इसकी विषय-वस्तु के समर्थन में प्ररूप-2 में शपथ पत्र के साथ की जाएगी।

(2) सचिव, लोकायुक्त को शिकायत व्यक्तिगत रूप में प्रस्तुत की जा सकेगी या रजिस्ट्रीकृत डाक द्वारा या स्पीड पोस्ट द्वारा भेजी जा सकेगी।

4. शपथपत्र.--हिमाचल प्रदेश राज्य में प्रवृत्त किसी अन्य विधि के अधीन पहले से ही सशक्त उन प्राधिकारियों, जिनके समक्ष शपथ-पत्र पर शपथ ग्रहण की जा सकेगी, के अतिरिक्त लोकायुक्त या लोकायुक्त के अधीनस्थ तथा उस द्वारा इस निमित्त प्राधिकृत किसी राजपत्रित अधिकारी के समक्ष शपथ-पत्र पर शपथ ग्रहण की जा सकेगी।

5. शिकायतों की संवीक्षा (जांच) और उनका रजिस्ट्रीकरण.-- (1) परिवाद (शिकायत) की प्राप्ति पर लोकायुक्त का रीडर या इस निमित्त उस द्वारा प्राधिकृत कोई अन्य अधिकारी/पदधारी इसकी विशिष्टियों को प्ररूप-3 में "शिकायत रजिस्टर" में दर्ज करेगा और उसे लोकायुक्त के समक्ष रखेगा। 3712 राजपत्र, हिमाचल प्रदेश, 12 जुलाई, 2017/21 आषाढ़, 1939 (2) यदि लोकायुक्त की यह राय है कि ऐसा परिवाद अधिनियम या तद्‌धीन बनाए गए नियमों के उपबंधों के अनुरूप नहीं है तो वह इसकी प्राप्ति की तारीख से, साधारण अवकाश के दिनों को अपवर्जित करके पन्द्रह दिन की अवधि के भीतर, परिवादी को प्ररूप-4 में नोटिस जारी करेगा कि वह नोटिस में विनिर्दिष्ट अवधि के भीतर, त्रुटि को परिशोधित(सुधार) करे :

परन्तु लोकायुक्त पर्याप्त हेतुक से नोटिस में विनिर्दिष्ट अवधि को बढ़ा सकेगा।

(3) समस्त परिवादो को लोकायुक्त के समक्ष आदेश के लिए रखा जाएगा परन्तु जिन परिवादों की बाबत उप नियम (2) के अधीन कार्रवाई की जा चुकी है, उन्हें नोटिस में नियत समय अवधि या बढ़ाई गई अवधि के अवसान के पश्चात्‌ ही उसके समक्ष रखा जाएगा, चाहे इंगित की गई त्रुटि परिशोधित (सुधारी गई) की गई हो या न की गई हो।

(4) यदि परिवाद पर कोई आगामी कार्रवाई नहीं की जानी है तो उप नियम (1) के अधीन परिवाद करने वाले प्रत्येक व्यक्ति को उप नियम (3) के अधीन पारित आदेश का सारांश सूचित किया जाएगा।

6. साक्षियों की हाजिरी.-(1) यदि किसी प्रारंभिक जांच के समय या अधिनियम के अधीन किसी अन्वेषण का संचालन करते समय या किसी भी समय, लोकायुक्त या उस द्वारा इस निमित्त प्राधिकृत कोई अन्य अधिकारी किसी भी व्यक्ति का साक्षी के रूप में परीक्षण करता है, चाहे साक्ष्य देने के लिए साक्षी के रूप में या उसके कब्जे के किसी दस्तावेज को पेश करने के लिए, और यदि ऐसा व्यक्ति किसी प्राइवेट सेवा में है, तो ऐसा व्यक्ति लोकायुक्त के कार्यालय से, प्ररूप-5 में, इस प्रमाण-पत्र के लिए हकदार होगा कि वह साक्ष्य आदि के प्रयोजन के लिए लोकायुक्त के कार्यालय में हाजिर हुआ था।

स्पष्टीकरणः--इस नियम के प्रयोजन के लिए "प्राइवेट सेवा" से लोक सेवक से अन्यथा कोई नियोजन अभिप्रेत है।

(2) यदि कोई व्यक्ति अपने नियोजक के समक्ष ऐसा प्रमाण-पत्र पेश करता है तो वह ऐसी कार्रवाई/शास्ति, जो कि ऐसी अनुपस्थिति के परिणामस्वरूप की जा सकती, के प्रयोजन के लिए ड्‌यूटी से अनुपस्थित नहीं समझा जाएगा।

(3) यदि ऐसा व्यक्ति लोक सेवक है, जिसे सिविल सेवा नियम या विनियम लागू होते हैं, तो वह भी इस प्रकार का प्रमाण-पत्र प्राप्त करेगा कि उसे इस प्रकार समन किया गया था और वह लोकायुक्त के कार्यालय में हाजिर हुआ है। ऐसे प्रमाण-पत्र के प्रस्तुत किए जाने पर उसे उस दिन या तारीखों को, जिनको वह लोकायुक्त के कार्यालय में हाजिर हुआ था, ड्‌यूटी पर समझा जाएगा।

(4) यदि ऐसा व्यक्ति प्राइवेट सेवा में है या किसी सेवा में नियोजित नहीं है तो उसे लोकायुक्त के साधरण या विशेष आदेश द्वारा नियत दरों पर वास्तविक यात्रा भत्ता और निर्वाह भत्ता संदत्त किया जा सकेगा ।

7. परिसम्पत्तियों और दायित्वों की घोषणा.-- (1) प्रत्येक लोक सेवक, प्ररूप-6 में प्रत्येक वर्ष के 31 जुलाई को या इससे पूर्व अपनी परिसम्पत्तियां और दायित्वों की वार्षिक विवरणी सक्षम प्राधिकारी को प्रस्तुत करेगा। सक्षम प्राधिकारी, लोक सेवक द्वारा फाईल की गई विवरणी की एक प्रति, प्रत्येक वर्ष 30 सितम्बर को या इससे पूर्व लोकायुक्त को अग्रेषित करेगा।

(2) प्रत्येक सक्षम प्राधिकारी, वर्ग-I वर्ग-II वर्ग-III के प्रत्येक कर्मचारी के स्थानान्तरण आदेश की प्रति उनके तैनाती स्थान अभिनिश्चित करने के लिए लोकायुक्त को भेजेगा।

8. वित्तीय शक्तियां.--(1) लोकायुक्त ऐसी वित्तीय शक्तियों का प्रयोग करेगा जो सरकार द्वारा समय-समय पर उसे प्रत्यायोजित की जाएं।3713 राजपत्र, हिमाचल प्रदेश, 12 जुलाई, 2017/21 आषाढ़, 1939 (2) सचिव, लोकायुक्त विभागाध्यक्ष के रूप में ऐसी वित्तीय शक्तियों का प्रयोग करेगा जो सरकार द्वारा समय-समय पर उसे प्रत्यायोजित की जाएं।

9. राज्य सरकार को विवरणियां आदि प्रस्तुत करना.--लोकायुक्त प्रत्येक वर्ष जुलाई और जनवरी मास मेंं, प्ररूप-7 में, राज्य सरकार को रजिस्ट्रीकृत शिकायतों की संख्या, संचालित जाँच/अन्वेषण, प्रदान की गई अभियोजन मंजूरी, विशेष न्यायालय आदि में दायर किए गए आरोप-पत्र के बारे में विवरण देते हुए प्रत्येक अर्धवार्षिक विवरणी प्रस्तुत करेगा ।

10. बजट प्राक्कलनों और व्यय विवरणियों को प्रस्तुत करना.--लोकायुक्त, हिमाचल प्रदेश, वित्तीय वर्ष में, बजट मैनुअॅल, 1971 के उपबन्धों के अनुसार, प्ररूप 8 से 13 में, प्राक्कलित प्राप्तियों और व्ययों तथा व्यय विवरणियों को दर्शाते हुए नियत तारीख और समय पर वार्षिक और संशोधित बजट प्राक्कलन, राज्य सरकार को प्रस्तुत करेगा।

11. लेखों की वार्षिक विवरणी का अनुरक्षण.--लोकायुक्त, क्रमशः हिमाचल प्रदेश वित्तीय नियम, 1971 और हिमाचल प्रदेश वित्तीय नियम, 2009 के उपबन्धों के अनुसार अपने पर््राप्ति और संदायों के लेखों तथा अन्य सुसंगत अभिलेखों का अनुरक्षण करेगा।

12. दण्ड प्रक्रिया संहिता का लागू होना.--अधिनियम के अधीन किसी प्रारंभिक जॉंच और अन्वेषण का संचालन करने के प्रयोजन के लिए दण्ड प्रक्रिया संहिता, 1973 के उपबन्ध लागू होंगेः

परन्तु लोकायुक्त या उस द्वारा प्राधिकृत किसी अधिकारी को, दण्ड प्रक्रिया संहिता, 1973 की धारा 190 की धारा के अधीन समुचित मामलों में अपराधों का संज्ञान लेने की शक्ति होगी ।

13. सिविल प्रक्रिया संहिता का लागू होना.--किसी व्यक्ति को समन करने और हाजिर कराने, किसी दस्तावेज के प्रकटीकरण और पेश करने, शपथ-पत्र पर साक्ष्य प्राप्त करने, लोक अभिलेखाें की अपेक्षा करने, साक्षियों या दस्तावेजों की परीक्षा करने के लिए कमीशन निकालन,े परिसम्पत्तियों आदि की कुर्की के प्रयोजन के लिए, सिविल प्रक्रिया संहिता, 1908 के अध्याय-16 के उपबन्ध, यथावश्यक परिवर्तन सहित, लागू होंगे, जैसा लोकायुक्त द्वारा उचित समझा जाए ।

14. काम के घण्टे और अवकाश.-- लोकायुक्त और उसके कार्यालय के लिए काम के घण्टे और अवकाश ऐसे होंगे जैसे लोकायुक्त द्वारा समय-समय पर घोषित किए जाएं परन्तु अन्यथा ऐसा घोषित के सिवाय, लोकायुक्त और उसका कार्यालय ऐसे उन्हीं सार्वजनिक अवकाशों का, जिनका अनुपालन हिमाचल प्रदेश उच्च न्यायालय द्वारा किया जाता है और ऐसे स्थानीय अवकाशों का, जो समय-समय पर स्थानीय प्राधिकारियों द्वारा घोषित किए जाएं, अनुपालन करेगा ।

15. शिथिल करने की शक्ति.-- जहां राज्य सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहॉं वह कारणों को लिखित में अभिलिखित करके, लोकायुक्त के परामर्श से, आदेश द्वारा इन नियमों के किसी (किन्हीं) उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (यों) या पद (पदों) की बाबत शिथिल कर सकेगी।

16. निरसन और व्यावृत्तियाँ.--(1) हिमाचल प्रदेश लोक आयुक्त (कार्यवाही) नियम,1983 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी, उपरोक्त उप नियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई बात या कार्रवाई इन नियमों के अधीन की गई समझी जाएगी।

No.Home(Vig.)A(3)-22/2016.—In exercise of the powers conferred by section 54 of the Himachal Pradesh Lokayukta Act, 2014 (Act No. 23 of 2015), the Governor of Himachal Pradesh, in consultation with the Lokayukta of Himachal Pradesh, hereby makes the following rules to carry out the provisions of the Act ibid, namely.—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Lokayukta Rules, 2017.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Lokayukta Act, 2014 (Act No. 23 of 2015);

(b) "complainant" means a person who makes a complaint under the Act;

(c) "Form" means a form appended to these rules;

(d) "Officer" means a person appointed to, or borne on the Gazetted Cadre/Service of the Lokayukta;

(e) "section" means section of the Act;

(2) All other words and expressions used in these rules and not defined, but defined in the Himachal Pradesh Lokayukta Act, 2014, the Prevention of Corruption Act, 1988 or the Himachal Pradesh Prevention of Specific Corrupt Practics Act, 1983 shall have the same meanings respectively assigned to them in those Acts.

3. Complaint.—(1) A complaint shall be signed by the complainant and shall be made in form-1 and it shall be accompanied by an affidavit in form-2 in support of its contents.

(2) The complaint may be presented in person or sent by registered post or speed post to the Secretary to the Lokayukta.

4. Affidavit.—An affidavit may be sworn before the Lokayukta or any other Gazetted Officer subordinate to the Lokayukta and authorized by him in this behalf, besides the authorities already empowered under any law in force in the State of Himachal Pradesh before whom affidavit may be sworn.

5. Scrutiny and registration of complaints.—(1) On receipt of a complaint, the Reader to the Lokayukta or other officer/official authorized in this behalf, shall enter the particulars thereof in the "Register of Complaints" in form-3 and place the same before the Lokayukta.

(2) If the Lokayukta is of the opinion that any such complaint is not in conformity with the provisions of the Act or the rules made thereunder, he shall within a period of fifteen days excluding general holidays from the date of its receipt, issue a notice to the complainant in form- 4 to rectify the defect within the time specified in the notice:

Provided that the Lokayukta may extend the time specified in the notice for sufficient cause.

(3) All the complaints shall be placed before the Lokayukta for orders, but complaints regarding which action has been taken under sub-rule (2) shall be placed only after the expiry of the period of time stipulated in the notice or the extended period, whether or not any defect pointed out has been rectified.

(4) Every person making a complaint under sub-rule (1) shall be informed of the gist of the orders passed under sub-rule (3), if no further action on the complaint is to be taken.

6. Attendance of witnesses.—(1) If while making any preliminary inquiry or while conducting any investigation under the Act, or at any time, the Lokayukta or other officer authorized in this behalf, examines any person as a witness, whether as witness to give evidence or, to produce any document in his possession, and if such person is in any private service, such person shall be entitled to a certificate in form-5 that he has attended the office of the Lokayukta for the purpose of evidence, etc. from the office of the Lokayukta.

Explanation.—For the purposes of this rule, "private service" means any employment other than that of a public servant.

(2) If a person produces such certificate before his employer, he shall not be deemed to be absent from duty for the purpose of any action/penalty which would otherwise have been followed in consequence of such absence.

(3) If such person is a public servant to whom Civil Services Rules or Regulations apply, he shall obtain a similar certificate that he was so summoned and has attended the office of the Lokayukta. Upon production of such a certificate, he shall be treated as on duty on the day or dates on which he attended the office of the Lokayukta.

(4) If such person is in private service or is not employed in any service, he may be paid actual travelling allowance and subsistence allowance at the rates fixed by general or special order of the Lokayukta.

7. Declaration of assets and liabilities.—(1) Every public servant shall file with the competent authority an annual return of his assets and liabilities on or before 31st July of every year in form-6. The competent authority shall forward a copy of the return, filed by the public servant to the Lokayukta on or before 30th September every year.

3732 राजपत्र, हिमाचल प्रदेश, 12 जुलाई, 2017/21 आषाढ़, 1939 (2) Every competent authority shall send a copy of transfer order of every Class-I, Class- II and Class-III employee to the Lokayukta to ascertain their station of posting.

8. Financial Powers.—(1) The Lokayukta shall exercise such financial powers as are delegated by the Government from time to time.

(2) The Secretary to the Lokayukta shall exercise such financial powers as Head of Department as are delegated by the Government from time to time.

9. Furnishing of returns etc. to State Government.—The Lokayukta shall furnish every half yearly return to the State Government in form-7 in the month of July and January every year stating therein the number of complaints registered, enquiries/ investigations conducted, prosecution sanction granted, charge-sheet filed in the Special Court etc.

10. Furnishing of Budget Estimates and Expenditure Statements.- The Lokayukta shall furnish in financial year annual and revised budget estimates showing estimated receipts and expenditure and expenditure statements to the State Government in forms-8 to 13 on the scheduled date and time in accordance with the provisions of the Himachal Pradesh Budget Manual, 1971.

11. Maintaining of annual statement of accounts.—The Lokayukta shall maintain its accounts of receipts and payments and other relevant records in accordance with the provisions of the Himachal Pradesh Financial Rules, 1971 and the Himachal Pradesh Financial Rules, 2009 respectively.

12. Application of the Criminal Procedure Code.—The provisions of the Code of Criminal Procedure, 1973 shall apply for the purpose of conducting any preliminary inquiry and investigation under the Act:

Provided that the Lokayukta or the officer authorized by him shall have power to take cognizance of offences in the appropriate cases under section 190 of the Code of the Criminal Procedure, 1973.

13. Application of the Code of Civil Procedure.—For the purpose of summoning and enforcing the attendance of any person, discovery and production of any document, receiving evidence on affidavit, requisitioning any public record, issuing commissions for the examination of witnesses or documents, attachment of assets etc., the provisions of Chapter XVI of the Code of Civil Procedure, 1908 shall apply mutatis mutandis, as deemed fit, by the Lokayukta.

14. Hours of Work and holidays.—The hours of work and holidays for the Lokayukta and his office shall be such as may be declared by the Lokayukta from time to time, but save as otherwise so declared, the Lokayukta and his office shall observe the same public holidays as are observed by the High Court of Himachal Pradesh and such local holidays as are declared by the local authorities from time to time.

15. Powers to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing and in3733 राजपत्र, हिमाचल प्रदेश, 12 जुलाई, 2017/21 आषाढ़, 1939 consultation with the Lokayukta, relax any of the provisions of these rules with respect to any class or category of persons or posts.

16. Repeal and savings.—(1) The Himachal Pradesh Lokayukta (Proceedings) Rules, 1983 are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the rules so repealed under sub-rule (1) shall be deemed to have been done or taken under these rules.
