संख्या एफ0डी0एस-ए (03)-19/2001.--राज्य सरकार ने, भारत सरकार, कृषि मन्त्रालय (खाद्य विभाग) द्वारा प्रकाशित आदेश संख्याः सा.का.नि 800 तारीख 09 जून, 1978 और सा.का.नि. 452 (अ) तारीख 25 अक्तूबर, 1972 के साथ पठित आवश्यक वस्तु अधिनियम, 1955 (1955 का अधिनियम संख्यांक 10) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आदेश संख्या एफ.डी.एस-ए (3)19/2001 तारीख 28-11-2001 द्वारा हिमाचल प्रदेश चावल प्राप्ति (उद्‌ग्रहण) आदेश, 2001 जारी किया है।

98-राजपत्र/2017-10-08-2017 (4885) 4886 राजपत्र, हिमाचल प्रदेश, 10 अगस्त, 2017/19 श्रावण, 1939 हिमाचल प्रदेश राज्य में खाद्यान्नाें का अपर्याप्त उत्पादन होने के फलस्वरूप गत कई वर्षाें से राज्य में धान/चावल का उपापन (प्राप्ति) नगण्य रहा है, इसलिए धान/चावल पर उद्‌ग्रहण अधिरोपित करना अतर्कसंगत होगा। इसके अतिरिक्त भारत सरकार, खाद्य एवं सार्वजनिक वितरण, उपभोक्ता मामले, खाद्य एवं सार्वजनिक वितरण विभाग, कृषि भवन, नई दिल्ली ने, पत्र संख्याः फाईल संख्या 6 (1)/2007-पी0वाई0- ंIII/तारीख 20-2-2015 और 06-1-2007-पी0 वाई-III/322300 तारीख 23-04-2015 द्वारा, पहले ही प्रथम अक्तूबर, 2015 के पश्चात्‌ से कोई उद्‌ग्रहण अधिरोपित न करने के निदेश दिए हैं। इसलिए, राज्य में हिमाचल प्रदेश चावल प्राप्ति (उद्‌ग्रहण) आदेश, 2001 की कोई आवश्यकता नहीं है।

अतः हिमाचल प्रदेश के राज्यपाल, आवश्यक वस्तु अधिनियम, 1955 की धारा 3 के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त आदेश को तुरन्त प्रभाव से प्रत्याहृत करते हैं।

ORDER

Shimla-9, the 3rd August, 2017

No. FDS-A (3)19/2001.—WHEREAS vide order No. FDS-A(3)-19/2001 dated 28-11-2001 the State Government has issued the Himachal Pradesh Rice Procurement (Levy) Order, 2001, in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 (Act No. 10 of 1955) read with Government of India, Ministry of Agriculture (Department of Food) published vide Order No. GSR 800, dated 09th June, 1978 and GSR Oder No. 452 (E), dated, the 25th October, 1972;

WHEREAS the State of Himachal Pradesh being insufficient in production of foodgrains, meaning thereby, the procurement of Paddy/Rice has been negligible for the last many years in the State, the imposition of levy on paddy/rice would be illogical. Moreover, the Government of India, Ministry of Consumer Affairs, Food & Public Distribution Department of Food & Public Distribution, Krishi Bhawan, New Delhi has already directed vide letters Nos. F. No. 6(1)/2007- Py.- III dated 20-02-2015 and 06-01-2007-Py.-III/322300 dated 23-04-2015 not to impose any levy w.e.f. 1st October, 2015 onward. Hence, there is no need of the Himachal Pradesh Rice Procurement (Levy) Order, 2001 in the State.

Now, therefore in exercise of the powers conferred by Section 5 read with Section 3 of the Essential Commodities Act, 1955, the Governor of Himachal Pradesh is pleased to withdraw the said order with immediate effect.

संख्याः गृह-एफ(ए) 3-1/2014.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या होम एफ0 (ए) 3-1-2014, तारीख 20-12-2016 द्वारा अधिसूचित हिमाचल प्रदेश अग्निशमन सेवाएं विभाग में फायरमैन, वर्ग-III (अराजपत्रित) तकनीकी सेवाएं, भर्ती और प्रोन्नति नियम, 2016 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश अग्निशमन सेवाएं विभाग, फायरमैन, वर्ग-III, (अराजपत्रित) तकनीकी सेवाएं, भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2017 है। (2) ये नियम राजपत्र/ई-गजट, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध-"क" का संशोधन.--हिमाचल प्रदेश अग्निशमन सेवाएं विभाग, फायरमैन, वर्ग-III, (अराजपत्रित) तकनीकी सेवाए,ं भर्ती और प्रोन्नति नियम, 2016 के उपाबन्ध-"क" में, अर्थात्‌ :--

(क) स्तंभ संख्या 15, के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, इन नियमों से संलग्न परिशिष्ट-I में यथाविनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा या यदि, यथास्थ्तिि, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/ प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यावहारिक परीक्षण या दक्षता परीक्षण या शारीरिक परीक्षण के अनुसार इन नियमों से संलग्न परिशिष्ट-I में यथा विनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।" ; और

(ख) स्तम्भ संख्या 15क(iv) के सामने विद्यमान उपबन्धों के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात्‌ः--

No. Home-F (A)3-1/2014.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Fire Services Department, Fireman, Class-III (Non- Gazetted)Technical Services, Recruitment and Promotion Rules, 2016, notified vide this Department Notification No. Home-F(B)3-1/2014, dated 20-12-2016, namely :—

1. Short title and commencement.—These rules may be called the Himachal Pradesh, Fire Services Department, Fireman Class-III(Non- Gazetted)Technical Services, Recruitment and Promotion ( First Amendment) Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra/e-Gazette of Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-"A" to the Himachal Pradesh Fire Services Department, Fireman , Class-III (Non- Gazetted) Technical Services Recruitment and Promotion Rules,2016:—

(a) For the Existing provisions against "Column No. 15, the following shall be substituted, namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority, as the case may be, so considers necessary or expedient on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, preceded by a screening test (objective type) or practical test or skill test or physical test, the standard/syllabus, etc. of which, will be determined by the Himachal Pradesh Public Service Commission/other recruiting agency/authority, as the case may be."; and

(b) For the existing provisions against Col.No.15- A(IV), the following shall be substituted, namely:—

"Selection for appointment to the post in the case of contract appointment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if considered necessary or expedient on the basis of merit of written examination followed by evaluation as specified in appendix-I appended to these rules, preceded by a screening test (objective type) or practical test4890 राजपत्र, हिमाचल प्रदेश, 10 अगस्त, 2017/19 श्रावण, 1939 or skill test or physical test, the standard/ syllabus, etc. of which, will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission/ Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency/ authority, as the case may be" .

संख्या गृह-एफबी(बी) 3-7/95.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या होम बी (बी)3-7/95-अग्नि, तारीख 22-06-2017 द्वारा अधिसूचित, हिमाचल प्रदेश अग्निशमन सेवाएं विभाग में चालक एवं पम्प ऑपरेटर वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम 2017 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

यह दरख्वास्त श्री राम कुमार पुत्र स्व0 श्री दीप चन्द, निवासी कस्बा बाजार, रामपुर बुशैहर, तहसील रामपुर बुशैहर, जिला शिमला (हि0 प्र0) ने इस आशय के साथ प्रस्तुत की है कि वादी का नाम मुताबिक नगर परिषद्‌ अभिलेख, आधार कार्ड, फोटो पहचान पत्र, बैंक खाता राम कुमार दर्ज है जो सही व दरुस्त है परन्तु 273/759, वाका चक शिंगला के खाना मालिक में वादी का नाम राज कुमार दर्शाया गया है, जो सही नहीं है। वादी उपरोक्त कागजात माल में अपना नाम राजकुमार के स्थान पर राम कुमार दरुस्त/दर्ज करवाना चाहता है।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त वादी का नाम उपरोक्त अराजी के खाना मालिक में दरुस्त/दर्ज करने बारे कोई आपाि हो तो दिनांक 24-08-2017 को या इससे पूर्व अदालत हजा में हाजिर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार वादी का नाम दरुस्त करने के आदेश पारित किए जाएंगे।
