NOTIFICATION

Shimla-171002, the 1st September, 2017

No. EXN-F(10)-25/2017.—In exercise of the powers conferred by section 164 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh is pleased to hereby make the following rules further to amend the Himachal Pradesh Goods and Services Tax Rules, 2017, namely:—

118-राजपत्र/2017-06-09-2017 (5527) 5528 राजपत्र, हिमाचल प्रदेश, 06 सितम्बर, 2017/15 भाद्रपद, 1939 (1) These rules may be called the Himachal Pradesh Goods and Services Tax (Sixth Amendment) Rules, 2017.

(2) Save as otherwise provided, they shall come into force on the date of their publication in the Official Gazette.

2. In the Rule 138 of the Himachal Pradesh Goods and Services Tax Rules, 2017, (1) The second Para of the sub-rule 5(b) shall be substituted, namely:--

"the registered taxable person or person-in-charge of conveyance making declaration in Form XXVI-A shall deposit Rs. 10/- per Form as service charge electronically through the official website of the Excise and Taxation Department on the e-challan in Form-VAT-II-A as appended to these rules."

(2) The first proviso and explanation to sub-rule (1) shall be omitted.

(3) In the title of "FORM VAT-XXVIII-A", the word "VAT" shall be omitted.

(4) After "FORM XXVIII-A", a new "Form VAT-II-A" shall be inserted, namely:—

सं0 पी0बी0डब्ल्यू0(बी0)एफ(5)31/2015.--यतः हिमाचल प्रदेश के राज्यपाल को यह प्रतीत होता है कि हिमाचल प्रदेश सरकार को सरकारी व्यय पर सार्वजनिक प्रयोजन हेतु उपमहाल धराणू फाटी वशिष्ट, कोशला फाटी वशिष्ट व उपमहाल वहांग फाटी वरूआ, तहसील मनाली, जिला कुल्लू में हिमाचल प्रदेश में 5530 राजपत्र, हिमाचल प्रदेश, 06 सितम्बर, 2017/15 भाद्रपद, 1939 राष्ट्रीय उच्च मार्ग-3 के निर्माण हेतु भूमि अर्जित करनी अपेक्षित है, अतएव एतद्‌द्वारा यह घोषित किया जाता है कि निम्नलिखित विवरणी में वर्णित भूमि उपर्युक्त प्रयोजन के लिए अपेक्षित है।

2. यह घोषणा, भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-19 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों को सूचना हेतु की जाती है तथा उक्त अधिनियम के अधीन भू-अर्जन समाहर्ता लोक निर्माण विभाग, मण्डी को उक्त भूमि के अर्जन करने के आदेश लेने का एतद्‌द्वारा निदेश दिया जाता है।

3. भूमि रेखांक का निरीक्षण भू-अर्जन समाहर्ता, लोक निर्माण विभाग मण्डी, जिला मण्डी के कार्यालय में किया जा सकता है।

संख्या होम-बी(बी) 3-3/95 अग्नि.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से इस विभाग की अधिसूचना संख्याः होम-बी-(बी)3-3/95, अग्नि, तारीख 28-06-2017 द्वारा अधिसूचित, हिमाचल प्रदेश अग्निशमन सेवाएं विभाग में स्थानीय अग्निशमन अधिकारी वर्ग-III, (अराजपत्रित) अलिपिक वर्गीय भर्ती और प्रोन्नति नियम 2017 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश अग्निशमन सेवाएं विभाग, स्थानीय अग्निशमन अधिकारी वर्ग-III (अराजपत्रित) अलिपिक वर्गीय सेवाएं, भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2017 है।

(2) ये नियम राजपत्र/ई-गजट, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध- "क" का संशोधन.--हिमाचल प्रदेश अग्निशमन सेवाएं विभाग, स्थानीय अग्निशमन अधिकारी वर्ग-III (अराजपत्रित) अलिपिक वर्गीय सेवाएं, भर्ती और प्रोन्नति नियम, 2017 के उपाबन्ध -"क" में, (क) स्तंभ संख्या 15, के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, इन नियमों से संलग्न परिशिष्ट-I में यथाविनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा या यदि, यथास्थ्तिि, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण/ प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यावहारिक परीक्षण या दक्षता परीक्षण या शारीरिक परीक्षण के अनुसार इन नियमों से संलग्न परिशिष्ट-I में यथाविनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा ।" ; और

(ख) स्तम्भ संख्या 15क (IV) के सामने विद्यमान उपबन्धों के स्थान पर, निम्नलिखित रखा जाएगा, अर्थात :-

"संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, इन नियमों से संलग्न परिशिष्ट-I में यथाविनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा या यदि, ऐसा करना आवश्यक या समीचीन समझे तो, पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यावहारिक परीक्षण या दक्षता परीक्षण या शारीरिक परीक्षण के अनुसार इन नियमों से संलग्न परिशिष्ट-I में यथाविनिर्दिष्ट के अनुसार मूल्यांकन के पश्चात्‌ लिखित परीक्षा के गुणागुण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती अभिकरण, अर्थात्‌, हिमाचल प्रदेश लोक सेवा आयोग/हिमाचल प्रदेश कर्मचारी चयन आयोग हमीरपुर/अन्य भर्ती अभिकरण/प्रधिकरण द्वारा अवधारित किया जाएगा "।

No. Home-B (B)3-3/95-Fire.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Fire Services Department, Station Fire Officer, Class-III (Non- Gazetted)Non- Ministerial, Recruitment and Promotion Rules, 2017, notified vide this Department Notification No. Home-B(B)3-3/95–Fire, dated 28-6-2017, namely :—

1. Short title and commencement.— (1) These rules may be called the Himachal Pradesh, Fire Services Department, Station Fire Officer, Class-III (Non-Gazetted) Non Ministerial, Recruitment and Promotion (First Amendment) Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra/e-Gazette of Himachal Pradesh.

2. Amendment of Annexure-"A".—In Annexure-"A" to the Himachal Pradesh, Fire Services Department, Station Fire Officer, Class-III (Non- Gazetted) Non Ministerial, Recruitment and Promotion Rules,2017:—

(a) For the existing provisions against Column No. 15, the following shall be substituted, namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if the Himachal Pradesh Public Service Commission or other recruiting agency/authority, as the case may be, so considers necessary or expedient on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, preceded by a screening test (objective type) or practical test or skill test or physical test, the standard/ syllabus, etc. of which, will be determined by the Himachal Pradesh Public Service Commission/other recruiting agency/ authority, as the case may be."; and

(b) For the Existing provisions against col. No. 15–A(iv), the following shall be substituted, namely:—

"Selection for appointment to the post in the case of contract appointment shall be made on the basis of merit of written examination followed by evaluation as specified in Appendix-I appended to these rules, or if considered necessary or expedient on the basis of merit of written examination followed by evaluation as specified in appendix-I appended to these rules, preceded by a screening test (objective type) or practical test or skill test or physical test, the standard/syllabus, etc. of which, will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission/ Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency/ authority, as the case may be. ''
