संख्याःपीसीएच-एचए(1)3/2013.--इस विभाग की समसंख्यक अधिसूचना दिनांक 15 जुलाई, 2017 के अन्तर्गत, जिला शिमला के विकास खण्ड रामपुर की ग्राम सभा 'धराली बधाल' का नाम 127-राजपत्र/2017-18-09-2017 (6065) 6066 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2017/27 भाद्रपद, 1939 बदलकर 'बधाल' रखने हेतु प्रस्तावना पर संबन्धित ग्राम सभा सदस्यों से आक्षेप एवं सुझाव आमंत्रित किए गये थे तथा उपायुक्त, जिला शिमला को इस संबन्ध में, आक्षेप/सुझााव प्राप्त करने और उन पर विचार करने के उपरान्त अन्तिम सिफारिश प्रस्तुत करने के लिए प्राधिकृत किया गया था;
और उपरोक्त प्रस्ताव के सम्बन्ध में कोई भी आक्षेप/सुझाव प्राप्त नहीं हुए हैं। अतः उपायुक्त शिमला ने ग्राम सभा 'धराली बधाल' का नाम बदलकर 'बधाल' रखने की सिफारिश की है;
अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (वर्ष 1994 का 4) की धारा 3 की उप-धारा (2) के खण्ड (घ) द्वारा प्रदत्त शक्तियों के अधीन, जिला शिमला के विकास खण्ड रामपुर की ग्राम सभा 'धराली' का नाम बदलकर ग्राम सभा 'बधाल' घोषित करने के सहर्ष आदेश प्रदान करते हैं।

Shimla-2, 12th September, 2017
No.TCP-F(5)-6/2017.—WHEREAS, the draft Development Plan for Nadaun Planning Area was published by the Director, Town and Country Planning Department, Himachal Pradesh, Shimla under sub-section (1) of section 19 of the Town and Country Planning Act, 1977 (Act No. 12 of 1977) read with rule 11 of the Himachal Pradesh Town and Country Planning Rule 2014 vide Notice No. HIM/TP/PJT/D.P.Nadaun/2004/Vol-II/12-30 dated 01.04.2017 published in the Rajptra, Himachal Pradesh on 20.05.2017 for inviting objection(s) and suggestions(s), which were duly considered and the draft Development Plan was submitted to the Government for approval.
NOW THEREFORE, in exercise of the powers vested under subsection (1) of section 20 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No.12 of 1977), the Governor, Himachal Pradesh is pleased to approve the Development Plan for Nadaun Planning Area, without any modifications and the same is hereby published in the Official Gazette of Himachal Pradesh as required under sub-section (4) of section 20 of the Act ibid. A Notice is hereby given that a copy of the said Development Plan is available for inspection during office hours in the following offices:—
1. The Director, Town and Country Planning Department, Nagar Yojana Bhawan, Block No.32-A, Vikas Nagar, Kasumpti, Shimla, Himachal Pradesh-171009.

The said Development Plan shall come into operation from the date of publication of this Notification in the Official Gazette in terms of subsection (5) of section 20 of the Act ibid and shall be binding on all Development Authorities constituted under the said Act and all local authorities functioning within the Nadaun Planning Area.

संख्या. टी0सी0पी0-एफ(5)-6/2017.--नादौन योजना क्षेत्र के लिए विकास योजना के प्रारूप को हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 के नियम 11 के साथ पठित हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 19 की उपधारा (1) के अधीन, आक्षेप (पों) और सुझाव (वों) को आमंत्रित करने के लिए निदेशक, नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश द्वारा नोटिस संख्या हिम/टीसीपी/पीजेटी/डी.पी.नादौन/2004/वोल्यूम-II/12-30 तारीख 01-04-2017 द्वारा राजपत्र, हिमाचल प्रदेश में तारीख 20-05-2017 को प्रकाशित किया गया था जिन पर सम्यक् रूप से विचार किया गया और विकास योजना सरकार के प्रारूप को अनुमोदन के लिए प्रस्तत किया गया।
अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 20 की उपधारा (1) के अधीन निहित शक्तियों का प्रयोग करते हुए, नादौन योजना क्षेत्र के लिए विकास योजना को बिना किसी उपान्तरण के अनुमोदित करते हैं और इसे पूर्वोक्त अधिनियम की धारा 20 की उपधारा (4) के अधीन यथा अपेक्षित के अनुसार राजपत्र, हिमाचल प्रदेश में एतद्द्वारा प्रकाशित किया जाता है। एतद्द्वारा नोटिस दिया जाता है कि उक्त विकास योजना की एक प्रति निरीक्षण हेतु निम्नलिखित कार्यालयों में कार्यालय समय के दौरान उपलब्ध रहेगी, अर्थात्ः-
1. निदेशक, नगर एवं ग्राम योजना विभाग, नगर योजना भवन, ब्लाक न0 32-ए कसुम्पटी, शिमला, हिमाचल प्रदेश-171009.

NOTIFICATION
Shimla-2, the 15th September, 2017
No. EXN-F(10)-18/2017.—In exercise of the powers conferred by sub-section (1) of section 9, sub- section (1) of section 11, sub-section (5) of section 15 and sub-section (1) of section 16 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on being satisfied that it is necessary in the public interest so to do, hereby makes the following amendments in the notification No.11/2017- STATE TAX (RATE), dated the 30th June, 2017, published in the Gazette of Himachal Pradesh, vide number EXN-F(10)- 14/2017-loose dated 30th June, 2017, namely:—
In the said notification, in the table,-
(i) against serial number 3, for item (iii) in column (3) and the entries relating thereto in columns (3), (4) and (5), the following shall be substituted, namely:—

| "(iii) Composite supply of works contract as defined in clause (119) of section 2 of the Central Goods and Services Tax Act, 2017, supplied to the Government, a local authority or a Governmental authority by way of construction, erection, commissioning, installation, completion, fitting out, repair, maintenance, renovation, or alteration of, — (a) a historical monument, archaeological site or remains of national importance, archaeological excavation, or antiquity specified under the Ancient Monuments and Archaeological Sites and Remains Act, 1958 (24 of 1958); (b) canal, dam or other irrigation works; | 6 | — |
| (c) pipeline, conduit or plant for (i) water supply (ii) water treatment, or (iii) sewerage treatment or disposal. | ||
| (iv) Composite supply of works contract as defined in clause (119) of section 2 of the Central Goods and Services Tax Act, 2017, construction, erection, commissioning, supplied by way of installation, completion, fitting out, repair, maintenance, renovation, or alteration of,— (a) a road, bridge, tunnel, or terminal for road transportation for use by general public; (b) a civil structure or any other original works pertaining to a scheme under Jawaharlal Nehru National Urban Renewal Mission or Rajiv Awaas Yojana; (c) a civil structure or any other original works pertaining to the "In-situ rehabilitation of existing slum dwellers using land as a resource through private participation" under the Housing for All (Urban) Mission/Pradhan Mantri Awas Yojana, only for existing slum dwellers; (d) a civil structure or any other original works pertaining to the "Beneficiary led individual house construction / enhancement" under the Housing for All (Urban) Mission/Pradhan Mantri Awas Yojana; (e) a pollution control or effluent treatment plant, except located as a part of a factory; or (f) a structure meant for funeral, burial or cremation of deceased. | 6 | — |
| (v) Composite supply of works contract as defined in clause (119) of section 2 of the Central Goods and Services Tax Act, 2017, supplied by way of construction, erection, commissioning, or installation of original works pertaining to,— (a) railways, excluding monorail and metro; (b) a single residential unit otherwise than as a part of a residential complex; (c) low-cost houses up to a carpet area of 60 square metres per house in a housing project approved by competent authority in empowered under the 'Scheme of Affordable Housing Partnership' framed by the Ministry of Housing and Urban Poverty Alleviation, Government of India; (d) low cost houses up to a carpet area of 60 square metres per house in a housing project approved by the competent authority under— (1) the "Affordable Housing in Partnership" component of the Housing for All (Urban) Mission/Pradhan Mantri Awas Yojana; (2) any housing scheme of a State Government; (e) post-harvest storage infrastructure for agricultural produce including a cold storage for such purposes; or (f) mechanised food grain handling system, machinery or equipment for units processing agricultural produce as food stuff excluding alcoholic beverages. | ||
| ( vi) Construction services other than (i), (ii), (iii), (iv) and (v) above. | 9 | -"; |
(ii) against serial number 8, for item (vi) in column (3) and the entries relating thereto in columns (3), (4) and (5), the following shall be substituted, namely:—

(B) the Explanation shall be omitted;
(b) for item (ii) in column (3) and the entries relating thereto in columns (3), (4) and (5), the following shall be substituted, namely:—

No. EXN-F(10)-18/2017.—In exercise of the powers conferred by sub-section (1) of section 11 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council, hereby makes the following amendments in the notification of the Government of India, in the Ministry of Finance (Department of Revenue), No.12/2017- STATE TAX (RATE), dated the 30th June, 2017, published in the Gazette of Himachal Pradesh), vide number EXN-F(10)-14/2017-loose dated 30th June, 2017, namely:—
In the said notification,—
(i) in the Table,-
(a) after serial number 9 and the entries relating thereto, the following shall be inserted namely:—

No. EXN-F(10)-18/2017.—In exercise of the powers conferred by sub-section (1) of section 9, sub-section (1) of section 11, sub-section(5) of section 15 and sub-section(1) of section 16 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on being satisfied that it is necessary in the public interest so to do, hereby makes the following amendments in the notification No.13/2017- STATE TAX (RATE), dated the 30th June, 2017, published in the official Gazette of Himachal Pradesh, vide number EXN-F(10)- 14/2017-loose dated 30th June, 2017, namely:—
In the said notification,—
(i) in the Table, against serial number 1, in column (2), after the words and brackets "goods transport agency (GTA)" the words and figure ", who has not paid central tax at the rate of 6%," shall be inserted;
(ii) in the Explanation, after clause (d), the following clause shall be inserted, namely:—
"(e) A "Limited Liability Partnership" formed and registered under the provisions of the Limited Liability Partnership Act, 2008 (6 of 2009) shall also be considered as a partnership firm or a firm.".

In the said notification, in the first paragraph, after clause (ii) the following clause shall be inserted, namely:—
"(iii) services by way of house-keeping, such as plumbing, carpentering etc., except where the person supplying such service through electronic commerce operator is liable for registration under sub-section (1) of section 22 of the said Central Goods and Services Tax Act.".

(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए इस शर्त के6079 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2017/27 भाद्रपद, 1939 अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात् की गई थी :
परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/ काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से उपर रखे जाएंगेः
परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः
परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।
स्पष्टीकरणः--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबीलाईज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैंन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों।
(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा यदि कोई हो, सेवा काल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात् और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः
परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।
12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना.--जैसी सरकार द्वारा समय-समय पर गठित की जाए।
13. भर्ती करने में किन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।
14. सीधे भर्ती किए जाने वाले व्यक्तियो के लिए अनिवार्य अपेक्षा.--लागू नहीं।
15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--लागू नहीं।
16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछडे वर्गों और व्यक्तियों के अन्य प्रवर्ग के लिए सेवा में आरक्षण की बाबत जारी किए गए अनुदेशों के अधीन होगी।
17. विभागीय परीक्षा.--सेवा में प्रत्येक सदस्य को हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा उत्तीर्ण करनी होगी।
18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, और हिमाचल प्रदेश लोक सेवा आयोग के 6080 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2017/27 भाद्रपद, 1939 परामर्श से, आदेश द्वारा, इन नियमों के किन्हीं उपबन्धों को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh, Department of Personnel, Additional Legal Remembrancer-cum-Additional Secretary (Law- English), Class-I (Gazetted) Recruitment and Promotion Rules, 2017.

(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:
Provided that in all cases where a junior person becomes eligible for consideration by virtue of his/her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:
Provided further that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years' or that prescribed in the R&P Rules for the post, whichever is less:
Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him/her shall also be deemed to be ineligible for consideration for such promotion.
6082 राजपत्र, हिमाचल प्रदेश, 18 सितम्बर, 2017/27 भाद्रपद, 1939 Explanation:—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-servicemen recruited under the provisions of Rule-3 of the Demobilized Armed Forces Personnel (Reservation of Vacancies in the Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule- 3 of the Ex-servicemen (Reservation of Vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.
(2) Similarly, in all cases of confirmation continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R& P Rules:
Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.
12. If a Departmental Promotion Committee exists, what is its composition?.—As may be constituted by the Government from time to time.
13. Circumstances under which the Himachal Pradesh Public Service Commission is to be consulted in making recruitment.—As required under the Law.
14. Essential requirement for a direct recruitment.—Not applicable
15. Selection for appointment to post by direct recruitment.—Not applicable.
16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/ Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

प्रार्थी ने इस अदालत में शपथ-पत्र सहित दरख्वास्त गुजारी है कि उसके पिता का नाम तहसील शाहपुर के राजस्व अभिलेख के महाल पोहाड़ा में विलास चन्द पुत्र वजीर सिंह के बजाय विशंबर चन्द पुत्र वजीर सिंह दर्ज है जबकि प्रार्थी के सभी प्रकार के अन्य दस्तावेजों में व महाल झरेड़ में उसके पिता का सही नाम विलास चन्द पुत्र वजीर सिंह दर्ज है। प्रार्थी राजस्व रिकॉर्ड में अपने पिता के सही नाम विलास चन्द उपनाम विशंबर चन्द पुत्र वजीर सिंह का इन्द्राज करवाना चाहता है।

Registration of Marriages Act, 1996 along with an affidavit stating therein that they have solemnized their marriage on 04-09-2015 at Sokni-Da-Kot, but has not been found entered in the rcords of the Registrar of Marriages i.e. Commissioner Municipal Corporation, Dharamshala;
And whereas, they have also stated that they were not aware of the laws of the registration of marriages with the Registrar of Marriages and now, therefore necessary orders for the registration of their marriage be passed so that their marriage is registered by the concerned authority.
Now, therefore, objections are invited from the general public that if anyone has any objection regarding the registration of the marriage of the above named applicants, then they should appear before the court of undersigned on 04-10-2017 at Tehsil Office Dharamshala at 10.00 A.M. either personally or through their authorized agent.
In the event of their failure to do so orders shall be passed exparte against the respondents for the registration of marriage without affording any further opportunity of being heard.
