No. NES-F (1)-1/2009-I.—1. The Govt. of Himachal Pradesh notified a "Policy for setting up of Micro Hydel Projects upto 100KW" in the State on 12 March, 2012. Clause 4 of the Policy deals with sale of power and is as under:—

Clause 9 of the Policy deals with Royalty to be paid to Gram Panchayats and is as under:—
"The royalty rate shall be 6%, 15% and 24% (6% for first twelve years, 15% for next 18yeasrs & 24% for remaining period of 10years) charged form the Micro Hydel Developer (except when owned by concerned Gram Panchayat) which should be payable to the local Panchayat instead of H.P. Govt. If the project falls in more than one Panchayat, the royalty will be shared between the Panchayats in proportion to the project area (weir site to Tail race site) falling in that particular Panchayat".
2. The Govt. of Himachal Pradesh issued a notification according to the Hydro Power Policy, 2006 of Himachal Pradesh vide notification dated 4 March, 2014.
Clause 13 of this notification prescribes the mode of Power purchase by HPSEBL and is reproduced as under:—
"2006 Policy may be followed partially, wherein HPSEBL will buy power form SHPs up to 2 MW if developer so choose, provided that free power to State is also as per 2006 Policy as recommended by Committee, which will reduce tariff by about 10 paise per unit. For SHP above 2 MW to 5 MW, HPSEBL will formulate an objective, prudent and transparent power purchase policy keeping in view load centre, evacuation cost, line losses, hydrology etc."
3. Now, therefore, in order to eliminate the anomalies in the above Policies as mentioned at (1) and (2) above, and to align the Policy for Micro Hydel Projects issued on 12.3.2012 with the policy for Small Hydel Projects upto 2MW as notified on 4.3.2014, the Governor of Himachal Pradesh is pleased to modify the Clause 4 by adding the following sentence in the Clause and Clause 9 of the "Policy for setting up of Micro Hydel Projects upto 100KW" to the following extent:—
(i) Purchase/Sale of power- Clause 4.— HPSEBL shall buy the power form the projects upto 100 KW capacity also in case there is no captive or direct third party sale.
(ii) Royalty-Clause 9.— Royalty rates for 100KW projects shall be 2% for first 12 years, 12% from 13 to 30 years and 18% for 31 to 40 years.
This policy shall come into force from the date of publication in the Himachal Pradesh Rajpatra.
