संख्याः पीईआर (एपी)-सी-ए (3)-2/2017.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, राज्य सरकार के विभिन्न विभागों में हिमाचल प्रदेश अधीनस्थ सहबद्ध सेवाओं/पदों, (वर्ग-III, अराजपत्रित) की परीक्षा और भर्ती की बाबत, निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. (1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश अधीनस्थ सहबद्ध सेवा/पद (वर्ग-III, अराजपत्रित) परीक्षा नियम, 2017 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृा होंगे। 2. परिभाषाएंः--इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,--

(क) "अपैंडिक्स" से इन नियमों से संलग्न अपैंडिक्स अभिप्रेत है;

(ग) "परीक्षा" से, हिमाचल प्रदेश लोक सेवा आयोग द्वारा संचालित परीक्षा अभिप्रेत है;

(घ) "सरकार" से, हिमाचल प्रदेश सरकार अभिप्रेत है;

(ङ) राज्यपाल से का राज्यपाल हिमाचल प्रदेश अभिप्रेत है;

(च) "अन्य पिछड़ा वर्ग" से, राज्य सरकार द्वारा समय-समय पर यथाविर्निदिष्ट नागरिकों के अन्य पिछड़ा वर्ग अभिप्रेत है ;

(छ) "अनुसूचित जाति" से, भारत के संविधान के अनुच्छेद 341 के अधीन हिमाचल प्रदेश राज्य के सम्बन्ध में अनुसूचित जाति के रुप में विनिर्दिष्ट कोई जाति, मूलवंश या जनजाति अथवा ऐसी जाति, मूलवंश या जनजाति का भाग या उसका कोई समूह अभिप्रेत है;

(ज) "अनुसूचित जनजाति" से, भारत के संविधान के अनुच्छेद 342 के अधीन हिमाचल प्रदेश राज्य के सम्बन्ध में अनुसूचित जनजाति के रुप में विनिर्दिष्ट कोई जनजाति, जनजातीय समुदाय अथवा जनजातीय समुदाय का भाग या उसका कोई समूह अभिप्रेत हैं; और

(झ) "राज्य" से, हिमाचल प्रदेश राज्य अभिप्रेत है।

3. (1) आयोग द्वारा निम्नलिखित सेवाओं/पदों की भर्ती के लिए संयुक्त प्रतियोगिता परीक्षा संचालित की जाएगीः--

(1) निरीक्षक (आबकारी एवं कराधान);

(2) निरीक्षक (नागरिक आपूर्ति);

(3) निरीक्षक (पंचायत);

(4) निरीक्षक (सहकारिता);

(5) विस्तार अधिकारी (उद्योग);

(6) निर्वाचन कानूनगो ; और

(7) मुख्य सेविका।

परन्तु सरकार, जैसा समय-समय पर आवश्यक समझे हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, सेवाओं/पदों के किन्हीं अन्य वर्गो को इसमें सम्मिलित कर सकेगी या उपरोक्त किन्हीं सेवाओं/पदों को इसमें से निकाल सकेगी। (2) संयुक्त प्रतियोगिता परीक्षा निम्न प्रकार से दो आनुक्रमिक चरणों की होगीः-

(क) प्रारम्भिक परीक्षा-मुख्य परीक्षा के लिए अभ्यर्थियों के चयन हेतु आयोग द्वारा वस्तुनिष्ठ प्रकार की प्रारम्भिक परीक्षा का संचालन किया जाएगा। परीक्षा की स्कीम और पाठ्‌यक्रम ऐसा होगा जैसा अपैंडिक्स-I में उपबन्धित है।

(ख) मुख्य परीक्षा (लिखित और मूलांकन)-विभिन्न सेवाओं और पदों के लिए अभ्यर्थियों के अंतिम चयन हेतु मुख्य परीक्षा (लिखित और मूल्यांकन) आयोग द्वारा संचालित की जाएगी। परीक्षा की स्कीम और पाठ्‌यक्रम ऐसा होगा जैसा अपैंडिक्स-II में विनिर्दिष्ट है। किसी भी अभ्यर्थी को लिखित परीक्षा में तब तक 6898 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 अर्हित नहीं समझा जाएगा जब तक कि वह समस्त पेपरों में संकलित (कुल मिलाकर) चालीस प्रतिशत अंक और प्रत्येक पेपर में कम से कम पैंतीस प्रतिशत अंक अभिप्राप्त नहीं कर लेता। अभ्यर्थी का मूल्यांकन इन नियमों से संलग्न अपैंडिक्स-III में यथा विनिर्दिष्ट पैरामीटरों पर आधारित होगा।

(ग) परीक्षा फीस ऐसे संदेय होगी जैसा पदों के विज्ञापन के लिए आयोग द्वारा विनिर्दिष्ट की गई हो। 4. (1) प्रारम्भिक परीक्षा में, आयोग द्वारा यथाविनिश्चित न्यूनतम अंक अभिप्राप्त करने वाले अभ्यर्थियों को उनके द्वारा अभिप्राप्त अंकों के अनुसार मैरिट के क्रम में सूचीबद्ध किया जाएगा। इन अभ्यर्थियों में से प्रायः विभिन्न श्रेणियों के अन्तर्गत अभ्यर्थी, जिन्होंने समान अंक अभिप्राप्त किए हैं, यदि कोई हों, को सम्मिलित करने के अतिरिक्त रिक्तियों की कुल संख्या के बीस गुणा को मुख्य परीक्षा के लिए अर्हित समझा जाएगा और प्रारम्भिक परीक्षा का परिणाम तद्‌नुसार घोषित किया जाएगा। मुख्य परीक्षा के लिए अर्हित होने वाले अनुसूचित जाति, अनुसूचित जन जाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक, दिव्यांगजन, स्वतन्त्रता सैनानियों के आश्रितों और आई आर डी पी/बी. पी. एल. से सम्बन्धित अभ्यर्थियों की सूची पृथकतः तैयार की जाएगी और उनका परिणाम तद्‌नुसार घोषित किया जाएगा। प्रारम्भिक परीक्षा, मुख्य परीक्षा हेतु अभ्यर्थियों के चयन के लिए केवल छंटनी परीक्षा होगी और इस परीक्षा में अभिप्राप्त अंको को अभ्यर्थियों के अंतिम चयन के समय विचारा नहीं जाएगा।

(2) (क) इन नियमों से संलग्न अपैंडिक्स-III में यथा विनिर्दिष्ट पैरामीटरों पर आधारित मूल्यांकन के पश्चात्‌ अभ्यर्थियों को लिखित परीक्षा और मूल्यांकन में उनके द्वारा कुल मिलाकर अभिप्राप्त अंकों के अनुसार मैरिट के क्रम में सूचीबद्ध किया जाएगा। अंको की बराबरी की दशा में, मैरिट का क्रम मूल्यांकन में प्राप्त किए गए अधिकतम अंकों के अनुसार विनिश्चित किया जाएगा और यदि मूल्यांकन में भी अभ्यर्थियों के अंक बराबर हो तो मैरिट का क्रम ऐसे अभ्यर्थियों द्वारा लिखित परीक्षा में कुल मिलाकर अभिप्राप्त अधिकतम अंको के अनुसार विनिश्चित किया जाएगा और यदि लिखित परीक्षा के कुल मिलाकर अंको के बराबर होने की दशा में अभ्यर्थी, जो आयु में ज्येष्ठ है, को आयु में कनिष्ठ अभ्यर्थी से ऊपर रखा जाएगा। किसी विशिष्ट सेवा के लिए अभ्यर्थी की संस्तुति करते समय उसके द्वारा अधिमान पत्रक (शीट) में अभिव्यक्त अधिमान (यदि कोई हो) का इन नियमों के अधीन पदों के लिए विज्ञापन के प्रत्युत्तर में आवेदन प्ररुप प्रस्तुत करते समय, निम्नलिखित शर्तो के अध्यधीन, सम्य्‌क्‌ रुप से ध्यान में रखा जाएगाः-

(i) इन नियमों के अन्तर्गत विज्ञापित पदों के लिए अभ्यर्थी द्वारा मुख्य परीक्षा के लिए आवेदन प्ररुप प्रस्तुत करते समय, आवेदन प्ररुप में यथा वर्णित अधिमान क्रम सूची भरा जाएगा/उपदर्भित किया जाएगा और इस अधिमान सूची में दर्शाए गए अधिमान के क्रमानुसार मैरिट के क्रम में अभ्यर्थी का चयन किया जाएगा। एक बार अधिमान सूची प्रस्तुत किए जाने पर तत्पश्चात्‌ उसमें कोई परिवर्तन/संशोधन अनुज्ञात नहीं किया जाएगा और इस सम्बन्ध में किसी अभ्यावेदन पर विचार नहीं किया जाएगा।

(ii) अभ्यर्थियों को केवल उन पदों के लिए और उसी क्रम में, जो उन्होंने अधिमान सूची में दर्शाया है, चयन के लिए विचारा जाएगा। अधिमान सूची में उनके द्वारा वर्ण्ाित नहीं किए गए किसी पद के लिए, इस तथ्य के बावजूद कि मैरिट के क्रम में वे उन पदों के चयन के लिए पात्र हैं, उन पर विचार नहीं किया जाएगा।

(iii) यदि किसी अभ्यर्थी ने अधिमान क्रम सम्य्‌क रुप से भरकर प्रस्तुत नहीं किया है या अधिमान क्रम उसके हस्ताक्षर के बिना प्रस्तुत किया गया है या अधिमान क्रम में कोई विकल्प/अधिमान, जो भी हो, अभिव्यक्त नहीं किया है तो उसे समस्त पदों के लिए उसी क्रम में विचारा जाएगा जैसे वे विज्ञापन में सूचीवद्ध किए गए हैं।

(ख) अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गो, भूतपूर्व सैनिकों, दिव्यांगजनों, स्वतन्त्रता सैनानियों के आश्रितों और आई आर डी पी/बी. पी. एल. से सम्बन्धित अभ्यर्थियों की दशा में प्रत्येक पद के लिए मैरिट सूची, उनके लिए आरक्षित रिक्तियों के विस्तार तक, पृथ्‌कतः उसी प्रकार से तैयार की जाएगी। अभ्यर्थी का परीक्षा परिणाम उसी प्रवर्ग के अधीन घोषित किया6899 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 जाएगा जो उसने आवेदन पत्र में उल्लिखित किया है। यदि अनुसूचित जाति, अनुसूचित जनजाति या अन्य पिछड़ा वर्ग से सम्बन्धित कोई अभ्यर्थी उसके संकलित अंकों के फलस्वरुप सामान्य सूची में स्थान प्राप्त कर लेता है तो उसे सामान्य सूची में दर्शाया जाएगा; परन्तु आयु-सीमा, अनुभव, अर्हता, विचारणीय क्षेत्र में छूट, जो सामान्य प्रवर्ग के अभ्यर्थियों को उपबन्धित से अधिक है, उसके मामले में लागू नहीं है। ऐसे आरक्षित प्रवर्ग के अभ्यर्थियों की गणना अनारक्षित पदो के विरुद्व केवल तभी की जाएगी यदि वे सामान्य प्रवर्ग के अभ्यर्थी की भांति, किसी आयु-सीमा, अनुभव, अर्हता, विचारणीय क्षेत्र में (अर्हता अंको का कट ऑफ) जो सामान्य प्रवर्ग के अभ्यर्थियों को उपबन्धित से अधिक है, किसी शिथिलीकरण के बिना सभी प्रकार से मैरिट प्राप्त कर लेते हैं। ऐसा समायोजन केवल अंतिम चयन परिणामों की घोषणा के समय पर ही किया जाएगा न कि प्रारम्भिक/मुख्य परीक्षा के समय पर अनुसूचित जाति, अनुसूचित जनजाति या अन्य पिछड़ा वर्ग के अभ्यर्थी, जिन्होंने शिथिल स्तरमानों द्वारा आवेदन करके प्रारम्भिक परीक्षा अर्हित की है और उसके द्वारा संकलित प्राप्त अंको के फलस्वरुप सामान्य सूची में स्थान प्राप्त कर लेते है, को सामान्य/अनारक्षित रिक्ति के विरुद्ध नहीं विचारा जाएगा। भूतपूर्व सैनिकों, दिव्यांगजनों, स्वतन्त्रता सैनानियों के आश्रितों और आई. आर. डी. पी./बी. पी. एल. अभ्यर्थियों को, उस श्रेणी, जो उनकी मेरिट को विचार में लाए बिना विज्ञापन में उनके लिए आरक्षित दर्शाई गई हैं, केवल ऐसे पदों के लिए ही चयनित किया जाएगा।

5. आयोग की संस्तुतियां प्राप्त होने पर सरकार अभ्यर्थियों के बारे में यह सुनिश्चित करने के आशय से कि वे सम्बद्ध पदों पर नियुक्ति के लिए उपयुक्त हैं ऐसी जांच करवाएगी जैसी यह उचित समझे। सरकार अभ्यर्थियों को नियुक्ति देने/न देने का अधिकार रखती है।

6. पात्रता शर्तेः--(1) राष्ट्रीयता-अभ्यर्थी भारत का नागरिक अवश्य होना चाहिए।

(2) न्यूनतम शैक्षिक अर्हता.- अभ्यर्थी के पास भारत में केन्द्रीय या राज्य विधान मण्डल के अधिनियम द्वारा निगमित किसी विश्वविद्यालय या संसद के किसी अधिनियम द्वारा स्थापित अन्य शैक्षिक संस्था या विश्वविद्याालय अनुदान आयोग अधिनियम 1956 की धारा 3 के अधीन घोषित डीम्ड विश्वविद्यालय, से स्नातक की उपाधि अवश्य होनी चाहिए या वह इसके समतुल्य अर्हता रखता हो।

टिप्पण.-व्यावसायिक और तकनीकी अर्हताएं, जो राज्य सरकार द्वारा व्यावसायिक या तकनीकी उपाधि के समतुल्य मान्यता प्राप्त है, रखने वाले अभ्यर्थी भी परीक्षा में प्रवेश के लिए पात्र होंगे।

(3) अभ्यर्थी ने उस वर्ष की प्रथम जनवरी, जिसमें पद (पदों) को आवेदन आमन्त्रित करने के लिए विज्ञापित किया गया है, 18 (अठारह) वर्ष की आयु पूर्ण कर ली है किन्तु 45 (पैंतालीस) वर्ष की आयु पूर्ण न की होः

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगी :

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में शिथिलीकरण के लिए पात्र नहीं होगा :

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जन जातियों तथा अन्य वर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उस विस्तार तक शिथिलीकरण किया जा सकेगा, जितना हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय हैः

परन्तु यह और भी कि पब्लिक सेक्टर, निगमोें तथा स्वायत्त निकायों के सभी कर्मचारियों को जो ऐसे पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर निगमों/स्वायत्त निकायोें में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती में आयु सीमा में ऐसी ही रियायत दी जाएगी, जैसी सरकारी कर्मचारियों को अनुज्ञेय है, किन्तु इस प्रकार की रियायत पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के ऐसे कर्मचारिवृन्द को नहीं दी जाएगी, जो पश्चात्‌वर्ती ऐसे निगमों/स्वायत्त 6900 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर, निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत्त निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे।

7. नियम 6(3) में यथा उपबंधित के सिवाय, विहित आयु सीमा किसी दशा में शिथिल नहीं की जाएगी। आयोग केवल वही जन्म तिथि स्वीकार करेगा जो दसवीं या सैकॅण्डरी स्कूल परीक्षा प्रमाण-पत्र या उसके समतुल्य समझी गई किसी परीक्षा के प्रमाण पत्र में अभिलिखित की गई हैं। मुख्य परीक्षा के आवेदन पत्र के साथ हाई स्कूल/हायर सैकॅण्डरी के प्रमाण-पत्र/अंक सूची जिसमें जन्म तिथि स्पष्टतया वर्णित हो अवश्य संलग्न की जानी चाहिए, ऐसा न होने पर, आवेदन पत्र अस्वीकृत किया जाएगा। आयु से सम्बन्धित कोई अन्य दस्तावेज़ जैसे जन्म कुण्डली, शपथ-पत्र, नगर निगम सेवा अभिलेखों से लिए गए जन्म सम्बन्धी उद्धरण और इसी भॉति के अन्य दस्तावेज स्वीकार नहीं किए जाएंगे। आवेदन पत्र में एक बार अभिलिखित की गई जब जन्म तिथि में किसी भी परिस्थिति में उसमें किसी परिवर्तन के लिए अनुरोध विचारणीय नहीं होगा और समस्त ऐसे अभ्यावेदन अस्वीकार कर दिए जाएंगे। प्रारम्भिक परीक्षा और मुख्य परीक्षा के आवेदन पत्र में दी गई जानकारी के बीच भिन्नता पाए जाने पर आवेदन अस्वीकृत किया जा सकेगा।

8. किसी भी व्यक्ति, जिसने अपने पति या पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है या किसी ऐसे व्यक्ति से विवाह किया है, जिसका पति/पत्नी जीवित है, सेवा/पद पर नियुक्ति के लिए पात्र नहीं होगाः

परन्तु यदि सरकार का समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दूसरे पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है तथा ऐसा करने के लिए विधिक आधार भी हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

9. परीक्षा में सफलता नियुक्ति का कोई अधिकार प्रदत्त नहीं करती है जब तक कि सरकार का ऐसी जाँच, जैसी यह आवश्यक समझे, के पश्चात समाधान नहीं हो जाता है कि अभ्यर्थी सेवा में नियुक्ति के लिए सभी प्रकार से उपयुक्त है।

10. परीक्षा में प्रवेश के लिए अभ्यर्थी की पात्रता या अन्य मामलों के बारे में आयोग का विनिश्चय अंतिम होगा। इस विषय पर कोई भी अभ्यावेदन या पत्राचार ग्रहण नहीं किया जाएगा। प्रारम्भिक परीक्षा के लिए प्रवेश अनन्तिम होगा। यदि चयन के किसी प्रक्रम में सत्यापन करने पर यह पाया जाता है कि अभ्यर्थी समस्त पात्रता शर्तो को पूरा नहीं करता है या मिथ्या/गलत जानकारी देता है तो उसकी अभ्यर्थिता रद्‌द कर दी जाएगी। यदि उसका कोई दावा गलत पाया जाता है तो वह आयोग द्वारा इन नियमों के नियम 14 के निबन्धनों के अनुसार अनुशासनिक कार्रवाई के लिए दायी होगा।

केवल इस तथ्य से कि अभ्यर्थी को परीक्षा का प्रवेश कार्ड/पत्र जारी कर दिया गया है यह विवक्षित नहीं होगा कि उसकी अभ्यर्थिता आयोग द्वारा अन्तिम रुप से/अप्रतिसंहरणीय रुप से स्वीकार कर ली गई है या यह कि अभ्यर्थी द्वारा प्रारम्भिक परीक्षा के लिए उसके आवेदन पत्र में की गई प्रविष्टियाँ आयोग द्वारा सही और शुद्ध रुप से स्वीकार कर ली गई हैं। प्रारम्भिक परीक्षा केवल एक छंटनी परीक्षा है इसलिए आयोग प्रारम्भिक परीक्षा के लिए आवेदन पत्र के साथ किसी प्रमाण पत्र की मांग नहीं करता है और परीक्षा के लिए पात्रता की उस स्तर पर जाँच नहीं की जाती है। तद्‌नुसार आवेदकों को बिना अपवाद के प्रारम्भिक परीक्षा में प्रवेश दिया जाएगा किन्तु मुख्य परीक्षा के आवेदन पत्रों की सूक्ष्म जाँच मुख्य परीक्षा का परिणाम तैयार करते समय अर्थात्‌ साक्षात्कार के लिए अभ्यर्थियों की पात्रता का अवधारण करते समय की जाएगी। उन आवेदन पत्रों को, जिनके साथ अपेक्षित प्रमाण-पत्र संलग्न न किए गए हों, अस्वीकृत किया जाएगा। इसलिए अभ्यर्थी आवेदन करने से पूर्व पूर्णतयः सुनिश्चित करेगे कि वे विज्ञापन में अधिकथित अपेक्षाओं/शर्तो को पूरा करते हैं। 11. किसी भी अभ्यर्थी को प्रारम्भिक परीक्षा या मुख्य परीक्षा में तब तक प्रवेश नहीं दिया जाएगा जब तक कि उसके पास आयोग द्वारा जारी किया गया प्रवेश पत्र (कार्ड) न हो । यदि प्रवेश पत्र (कार्ड) में कोई भी त्रुटि ध्यान में आए तो अभ्यर्थी का यह दायित्व होगा कि वह उसके संशोधन के लिए तत्काल आयोग के कार्यालय में सम्पर्क करे।6901 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 12. उस प्राप्त आवेदन पत्र को, जो भागतः भरा गया हो/गलत रुप से भरा गया हो/लिप्तलेखित हो/वांछित स्थानों पर हस्ताक्षरित न हो/जिसमें वांछित संख्या में फोटोग्राफ स्वहस्ताक्षरित न पाए गए हों या जो समुचित बैंक ड्राफ्ट के बिना हो, रद्‌द कर दिया जाएगा।

13. (1) आयु में किसी शिथिलीकरण का या किसी अन्य रियायत का दावा करने वाले अभ्यर्थियों को मुख्य परीक्षा के लिए अपने आवेदन पत्रों के साथ सक्षम प्राधिकारी द्वारा जारी समुचित प्रमाण-पत्र की छाया प्रति संलग्न करनी होगी। अनुसूचित जाति, अनुसूचित जनजाति या अन्य पिछड़ा वर्ग से सम्बन्धित स्थायी जाति प्रमाण-पत्र, उप-मण्डलाधिकारी (नागरिक) जो हिमाचल प्रदेश सरकार द्वारा जाति प्रमाण-पत्र जारी करने के लिए प्राधिकृत है द्वारा जारी आवेदन पत्र के साथ संलग्न करना होगा। विवाहित महिलाओं की दशा में केवल उनके पिता की जाति के आधार पर जारी जाति प्रमाण-पत्र ही स्वीकार किया जाएगा। यदि कोई अभ्यर्थी आवेदन पत्र के साथ स्थायी जाति प्रमाण पत्र और अन्य प्रमाण-पत्र, जो आयोग के साथ-साथ नियुक्ति प्राधिकारी द्वारा और सत्यापन करने के अध्यधीन है, प्रस्तुत करने में असफल रहता हैं तो उसकी अभ्यर्थिता रद्‌द कर दी जाएगी जिसके लिए अभ्यर्थी स्वयं उत्तरदायी होगा। अपेक्षित प्रमाण-पत्र (पत्रों) के अभाव में किसी शिथिलीकरण/छूट के किसी दावे पर विचार नहीं किया जाएगा।

(2) भूतपूर्व सैनिक अभ्यर्थी को मुख्य परीक्षा के समय पर आवेदन पत्र के साथ उन्मोचन प्रमाण-पत्र (डिस्चार्ज सर्टिफिकेट) प्रस्तुत करना होगा।

14. यदि कोई अभ्यर्थी आयोग द्वारा दोषी पाया जाता है-

(1) अपनी अभ्यर्थिता के लिए, चाहे लिखित परीक्षा या साक्षात्कार में, किसी साधन द्वारा सहायता अभिप्राप्त करने, या

(2) प्रतिरुपण करने, या

(3) किसी व्यक्ति से/द्वारा प्रतिरुपण प्राप्त करने, या

(4) जाली दस्तावेज या छेड़छाड़ (बिगाड़े) किए गए दस्तावेज प्रस्तुत करने, या

(5) ऐसे कथन करने जो गलत या मिथ्या है या चयन के किसी प्रक्रम पर सारभूत जानकारी छिपाने, या

(6) परीक्षा में प्रवेश पाने के लिए कोई अन्य अनियमित या अनुचित साधन अपनाने, या

(7) परीक्षा हॉल में अनुचित साधनों का उपयोग या उसका उपयोग करने का प्रयास करने, या (8) परीक्षा का संचालन करने में लगाए गए कर्मचारिवृन्द का उत्पीड़न करने, धमकी देना या शारीरिक क्षति कारित करने, या

(9) अभ्यर्थियों को उनके प्रवेश पत्र में दिए गए किसी अनुदेश या परीक्षा संचालन करने में लगाए गए केन्द्र पर्यवेक्षक या अन्य कर्मचारिवृन्द द्वारा दिए गए मौखिक निर्देशों सहित अन्य निर्देशों का उल्लंघन करने, या

(10) परीक्षा हॉल या साक्षात्कार में किसी अन्य रीति में दुव्र्यवहार करने के लिए स्वयं को दंडित अभियोजन के लिए दायी बनने के अतिरिक्त वह निम्न के लिए भी दायी होगा/होगी- (क) आयोग द्वारा उसे उस परीक्षा से, जिसके लिए वह अभ्यर्थी है, निरर्हित करने, और/या (ख) या तो स्थायी रुप से या विनिर्दिष्ट अवधि के लिए उसे-

(i) आयोग द्वारा आयोजित किसी परीक्षा से या उसके द्वारा किए गए चयन से,

(ii) राज्य सरकार द्वारा उसके अधीन नियोजन से, विवर्जित किए जाने; और6902 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 (ग) यदि वह पहले से ही सरकार की सेवा में है तो उपयुक्त नियमों के अधीन अनुशासनिक कार्रवाई के लिए; किन्तु इस नियम के अधीन कोई शास्ति,- (i) अभ्यर्थी को लिखित में ऐसा अभ्यावेदन करने का अवसर दिए बिना जो वह इस निमित्त देना चाहे, और

(ii) अभ्यर्थी द्वारा उसे अनुज्ञात अवधि के भीतर प्रस्तुत किए गए आवेदन, यदि कोई है, पर विचार किए बिना अधिरोपित नहीं की जाएगी।

15. मुख्य परीक्षा के लिए विहित तारीख के पश्चात्‌ प्राप्त आवेदन पत्रों पर विचार नहीं किया जाएगा। आयोग, आवेदन पत्रों के डाक/कुरियर सेवा के दौरान देरी से प्राप्त होने, विकृत होने या गुम हो जाने की दशा में उत्तरदायी नहीं होगा। एक लिफाफे में केवल एक ही आवेदन पत्र स्वीकार किया जाएगा। प्रत्येक ऐसा आवेदन, जो आयोग के कार्यालय में काउन्टर पर या तो डाक से प्राप्त हुआ हो, की अभिस्वीकृति दी जाएगी और आवेदन पत्र की प्राप्ति के प्रतीक के रुप में अभ्यर्थी को रजिस्ट्रीकरण नम्बर जारी किया जाएगा। इस तथ्य का, कि अभ्यर्थी को रजिस्ट्रीकरण नम्बर जारी कर दिया गया है, स्वतः यह अर्थ नहीं लगाया जाएगा कि आवेदन सभी प्रकार से पूर्ण है और इसे आयोग द्वारा स्वीकार कर लिया गया है। आवेदन पत्र के विलम्ब से प्राप्ति के सम्बन्ध में कोई पत्र व्यवहार या अभ्यावेदन स्वीकार नहीं किया जाएगा। परीक्षा में प्रवेश हेतु अभ्यर्थी की पात्रता की बाबत या अन्यथा आयोग का विनिश्चय अंतिम होगा।

16. आयोग को आवेदन पत्र में अभिलिखित अधिमान के दृष्टिगत परीक्षा के लिए अभ्यर्थी को केन्द्र आंबटित करने का अधिकार है। आयोग के लिए अभ्यर्थी को वाँछित परीक्षा केन्द्र आबंटित करना आवश्यक और वाध्यकारी नहीं है। आयोग द्वारा परीक्षा केन्द्रों का आबंटन परीक्षा केन्द्रों की क्षमता और प्रशासनिक सुविधा के दृष्टिगत किया जाता है। केन्द्र या आवेदन पत्र में किसी अन्य प्रविष्टि के परिवर्तन के लिए कोई अभ्यावेदन ग्रहण नहीं किया जाएगा।

17. यदि कोई अभ्यर्थी अपने आवेदन पत्र में दिए गए पते से भिन्न पते पर आयोग से कोई संसूचना प्राप्त करना चाहता है तो पते में ऐसा परिवर्तन 11.5 सै0 मी0 x 27.5 सै0 मी0 आकार के दो स्वयं के पते के पर्याप्त स्टांपित लिफाफों सहित यथाशीघ्र आयोग को संसूचित करेगा जिसमें वह अपना रजिस्टी्रकरण नम्बर और परीक्षा का नाम अभिलिखित करेगा। आयोग ऐसा परिवर्तन करने की बाबत हर सम्भव प्रयत्न करेगा। 18. आयोग प्रारम्भिक परीक्षा की बाबत अंक तालिकाएं नहीं भेजेगा क्योंकि यह केवल एक छंटनी परीक्षा है। इसलिए इस सम्बन्ध में कोई पत्राचार ग्रहण नहीं किया जाएगा। प्रारम्भिक परीक्षा एवं मुख्य परीक्षा में उपस्थित हुए अभ्यर्थियों के अंक अंतिम चयन परिणामों के प्रकाशन के पश्चात्‌ आयोग की वैबसाइट पर अपलोड किए जाएंगे। आयोग द्वारा संचालित परीक्षाओं के पुनर्मूल्यांकन के लिए कोई प्रावधान नहीं होगा। 19. आयोग में दस्तावेजों के सत्यापन के समय उपस्थित होने वाले हिमाचल प्रदेश के अधिवसित आरक्षित प्रवर्गो (अनुसूचित जाति और अनुसूचित जनजाति) दिव्यांगजन के बेरोजगार अभ्यर्थियों को अपने दावों के संदर्भ में आवश्यक दस्तावेज प्रस्तुत किए जाने पर उनके निवास स्थान से और वापसी तक का यात्रा व्यय आयोग के कार्यालय द्वारा संदत्त किया जाएगा।

अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गो के अभ्यर्थियों के लिए विज्ञापन मे दी गई विभिन्न रियायतें केवल उन्हीं अभ्यर्थियों को लागू हाेंगी जो हिमाचल प्रदेश के स्थायी निवासी हैं और जिन्हें हिमाचल प्रदेश सरकार द्वारा अनुसूचित जातियों और अनुसूचित जनजातियों के रुप में अधिसूचित किय गया है तथा हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त अन्य पिछड़ा वर्गो, से सम्बन्ध रखते हैं। अन्य राज्यों के अनुसूचित जाति, अनुसूचित जनजाति और अन्य पिछड़े वर्ग के अभ्यर्थियों को अनारक्षित प्रवर्ग से सम्बन्धित समझा जाएगा। हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त अन्य पिछड़ा वर्गो के समुन्नत वर्ग (क्र्रीमी लेयर) से सम्बन्धित अभ्यर्थियों को आरक्षण, आयु सीमा में छूट और अन्य प्रसुविधाएं अनुज्ञात नहीं की जाएंगी। 20. किसी विशिष्ट सेवा के लिए अंतिम रूप से चयनित अभ्यर्थियों को ऐसा प्रशिक्षण प्राप्त करना होगा और ऐसी विभागीय परीक्षा उतीर्ण करनी होगी जैसी सरकार द्वारा विहित की जाए। उनसे हिमाचल प्रदेश में किसी भी स्थान पर सेवा करना और प्रस्थापित की गई किसी नियुक्ति को तत्काल लेना अपेक्षित होगा।6903 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 21. इन नियमों के निर्वचन से सम्बन्धित यदि कोई प्रश्न उत्पन्न होता है तोे उसे सरकार द्वारा आयोग के परामर्श से विनिश्चित किया जाएगा ।

22. इन नियमों से तुरन्त पूर्व प्रवृत हिमाचल प्रदेश अधीनस्थ सहबद्ध सेवा/पद (वर्ग-II/III, अराजपत्रित) परीक्षा नियम, 2016 का इन नियमों के अन्तर्गत आने वाले मामलों की बाबत एतद्‌द्वारा निरसन किया जाता है।

परन्तु इस प्रकार निरसित नियमों के अधीन किया गया कोई आदेश या की गई कोई कार्रवाई, इन नियमों के तत्स्थानी उपबन्धों के अधीन की गई समझी जाएगी।

APPENDIX-I Standard/Syllabus of Preliminary Examination

The recruiting Agency shall limit/shortlist the number of eligible candidates to be called for written examination by subjecting them to a screening test (objective Type) of three hours duration. In the objective type screening test there will be 200 multiple choice questions of one mark each on the basis of the following syllabus. The marks obtained by the candidates who are declared qualified for admission to written examination will not be counted for detaining their final order of merit. The number of candidates to be admitted to the written examination will be 20(Twenty) times the total approximate number of vacancies to be filled.

1. History, geography and socio economic development of Himachal Pradesh.

60 Marks

2. Knowledge of current events of the national international importance and such matters of every day observation and experience in their scientific aspects as may be expected of an educated person who has not made a special study of any scientific subject.

60 Marks 3. Modern History(From 1857 onwards) of India, Indian Culture, Indian Polity, Indian Economy, Geography of India, disaster management, Environment and Gender issues and teaching of Mahatma Gandhi.

80 Marks.

Note:— There will be negative marking for incorrect answers (as detailed below) for all questions:

(a) There are four alternatives for the answers to every question. For each question for which a wrong answer has been given by the candidate, on fourth (0.25) of the marks assigned to that question will be deducted as penalty.

(b) If a candidate gives more than one answer, it will be treated as wrong answer even if one of the given answers happen to be correct and there will be same penalty as above for that question.

Standard/Syllabus of Main Examination

1. Paper –I English (Conventional -03 Hours)

Candidates will be required to answer questions designed to test their understanding of English and workmen like use of words. Some of the questions will be devised to test also their reasoning power, their capacity to perceive implications their ability to distinguish between the important and the less important and to write an essay. Passage will usually be set for summary or précis. Credit will be given for concise and effective expression.

2. Paper –II Hindi (Conventional (03 Hours)

(i) Translation of an English passage into Hindi. (ii) Explanation of Hindi passage in Prose and Poetry in same language. (iii) Composition (Essay, Idioms, correction etc.)

Maximum Marks-150 3. Paper-III(General Knowledge(03 Hours)

History, geography and socio economic development of Himachal Pradesh Knowledge of current events of National and International importance and of such matter of every day observation and experience in their scientific aspects as may be expected of an educated person who has not made a special study of any scientific subject. No. Per (AP)-C-A(3)-2/2017.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor of Himachal Pradesh, in consultation with the 6906 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 Himachal Pradesh Public Service Commission, is pleased to make the following rules in respect of examination and recruitment to the Himachal Pradesh Subordinate Allied Services/Posts (Class- III, Non-Gazetted) born on various departments of the State Government, namely:—

1. (1) These rules may be called the Himachal Pradesh Subordinate Allied Services /Posts (Class-III, Non-Gazetted) Examination Rules, 2017.

(2) These rules shall come into force from the date of their publication in the Rajpatra(e- Gazette),Himachal Pradesh.

2. Definitions.—In these rules, unless the context otherwise requires,—

(a) "Appendix" means appendix appended to these rules;

(b) "Commission" means Himachal Pradesh Public Service Commission;

(c) "Examination" means examination conducted by the Himachal Pradesh Public Service Commission;

(d) "Government" means Government of Himachal Pradesh;

(e) "Governor" means Governor of Himachal Pradesh;

(f) "Other Backward Classes" means the Other Backward Classes of citizens as specified by the State Government from time to time;

(g) "Scheduled Castes" means any caste, race or tribe or part of or group within the caste, race or tribes specified as Scheduled Castes with respect to the State of Himachal Pradesh under article 341 of the Constitution of India;

(h) "Scheduled Tribes" means any tribe, tribal community or part of or group within a tribe, tribal community specified as Scheduled Tribes with respect to the State of Himachal Pradesh under article 342 of the Constitution of India; and

(i) "State" means State of Himachal Pradesh.

3. (1) A combined competitive examination for recruitment to the following services/posts will be conducted by the Commission:—

1. Inspector(Excise & Taxation);

2. Inspector(Civil Supplies);

3. Inspector (Panchayat);

4. Inspector (Co-operative);

5. Extension Officer(Industries);

6. Election Kanungo; and

7. Mukhiya Sevikas.

Provided that the Government, in consultation with the Himachal Pradesh Public Service Commission, may add any other category(s) of services/ posts or delete any of the above services /posts as considered necessary from time to time.

(2) The combined competitive examination shall consist of two successive stages as under:—

(a) Preliminary Examination- For selection of candidates for the Main Examination, an objective type preliminary examination shall be conducted by the Commission. The scheme of examination and syllabi shall be as provided under Appendix-I.

(b) Main Examination(written and evaluation)- For final selection of candidates for the various services and posts main examination (written and evaluation) shall be conducted by the Commission. The scheme of examination and syllabi shall be as specified in Appendix II. No candidate would be considered to have qualified the written test unless he obtains 40% marks in aggregate in all papers and atleast 35% marks in each paper. The evaluation shall be based on the parameters as specified in Appendix-III appended to these rules.

(c) Examination Fees shall be payable as specified by the Commission in the advertisement of the posts.

4. (1) The candidates obtaining minimum marks in the preliminary examination, as decided by the Commission, shall be listed in the order of merit according to marks obtained by them. Out of these candidates at the most as many as equal to twenty times the total number of vacancies under various categories besides including those, if any, who obtained equal number of marks will be deemed to qualify for the Main Examination and the result of the Preliminary Examination shall be declared accordingly. The list of candidates belonging to Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-serviceman, Differently Abled, Wards of Freedom Fighters and IRDP/BPL qualifying for the Main Examination, shall be prepared separately and their results declared accordingly. Preliminary Examination will serve only as a screening test for selecting candidates for the Main Examination and the marks obtained in this examination will not be considered at the time of the final selection of the candidates.

(2) (a) After the evaluation based on the parameters as specified in Appendix-III to these rules, the candidates will be listed by the Commission in the order of merit, according to the aggregate of marks obtained by them in the Written Test and the evaluation taken together. In the event of tie, order of merit shall be determined in accordance with highest marks secured in the evaluation and if the marks in evaluation of the candidates are also equal, then the order of merit shall be decided in accordance with the highest marks obtained by such candidates in the aggregate of the written examination and in case the marks in aggregate of written examination tie, then candidate who is senior in age will be placed above the candidate junior in age. While recommending a candidate for a particular service, due consideration will be given to the preference, (if any), expressed by him/her in the preference sheet, at the time of submission of Application Form in response to the advertisement for the posts under these rules, subject to the following conditions:—

(i) Preference list for the posts advertised under these rules, as mentioned in the Application Form shall be filled in/indicated by the candidate at the time of submission of application form for the main examination and the candidate will be selected in the order of merit according to the order of preference list. Once the preference list has been submitted, no change/amendment therein shall be permitted and no representation will be considered in this regard.

(ii) The candidates will be considered for selection only for those posts and in the order as indicated by him/her in the preference list. They will not be considered for any post not mentioned by them in the preference list, irrespective of the fact that in the order of merit they are eligible for selection to those posts.

6908 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 (iii) If a candidate has not submitted the preference list duly filled in, to the Commission, or has submitted the preference list without his/her signature or has not expressed any choice/ preference whatsoever in the preference list, will be considered for all posts in the order in which these have been listed in the advertisement.

(b) Merit list for each post in the case of candidates belonging to Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-Servicemen, Differently Abled, Wards of Freedom Fighters and IRDP/BPL, will be similarly prepared separately, to the extent of vacancies reserved for them. The result of the candidate will be declared under the category mentioned by him/her in the application form. If a candidate belonging to Scheduled Castes, Scheduled Tribes or Other Backward Classes, by virtue of his aggregate marks, finds a place in the general list; he/she shall be shown in the general list; provided that relaxation in the age limit, experience, qualification, zone of consideration larger than what is provided for general category candidates is not applied in his/her case. Such reserved category candidates shall be counted against unreserved posts only if they secure merit in all respects like a candidate of a general category, without any relaxation in the age limit, experience, qualification, zone of consideration (cut off qualifying marks) larger that what is provided for general category candidates. Such adjustment will be made only at the time of declaring the final selection results and not at the time of preliminary/main examination. The Scheduled Castes, Scheduled Tribes or Other Backward Classes candidates who qualify the preliminary examination by applying relaxed standard and by virtue of his aggregate marks finds a place in the general list, shall not be considered against general/un-reserved vacancy. Ex- Servicemen, Differently Abled, wards of freedom fighters and IRDP/BPL candidates will be selected only for such posts, under the class, as has been shown reserved for them in the advertisement irrespective of their merit.

5. On receiving the recommendations of the Commission, the Government shall make such enquiries about the candidates, as it may deem fit, in order to ensure that they are suitable in all respects for appointment to the posts concerned. The Government reserves the right to offer/decline appointment to the candidates. 6. Eligibility Conditions:—

(1) Nationality—The candidate must be a citizen of India.

(2) Minimum educational qualification— A candidate must hold a bachelor degree of any of the universities incorporated by an Act of the Central or State Legislature in India or other Educational Institutions established by an Act of Parliament or declared to be a deemed university under section 3 of the University Grants Commission Act, 1956 or possesses an equivalent qualification.

Note:—Candidates possessing professional and technical qualifications, which are recognized by the State Government as equivalent to professional or technical degree, would also be eligible for admission to the examination.

(3) Age—A Candidate must have attained the age of 18 (eighteen) years and must not have attained the age of 45 (forty five) years on the first of January in which the post(s) are advertized for inviting applications:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over-age on the date he /she was appointed as such he/she shall not be eligible 6909 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 for any relaxation in the prescribed age limit by virtue of his/her such adhoc or contract appointment:

Provided further the upper age limit is relaxable for Scheduled Castes, Scheduled Tribes, Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government Servants before absorption in the Public Sector Corporations/autonomous bodies at the time of initial constitutions of such Corporations/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government Servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/Autonomous Bodies who are/were subsequently appointed by such Corporations/ autonomous Bodies and who are /were finally absorbed in the service of such Corporations/autonomous Bodies after initial constitution of the Public Sector Corporations/ Autonomous Bodies.

7. Save as provided in rule 6 (3), the age limits prescribed shall in no case be relaxed. The Commission shall accept only such date of birth as is recorded in the matriculation or secondary school examination certificate or certificate of an examination treated equivalent thereto. High School/Higher Secondary Certificate/Mark sheet, clearly mentioning the date of birth, must be attached with the application form of the Main Examination, failing which the application form shall be rejected. No other document relating to age such as horoscope, affidavit, birth-related extracts from Municipal Corporation service records and the like, shall be accepted. Once a date of birth has been recorded in the application form, request for any change therein shall not be considered under any circumstances and all such representations will be rejected. The application may be rejected on finding any dissimilarity between the information provided in the application form of the Preliminary Examination and that of the Main Examination.

8. If a person, having a spouse living has entered into or contracted a marriage with any person or entered into or contracted a marriage with a person having spouse living, shall not be eligible for appointment to the service/post:

Provided that the Government may, if satisfied that such marriage is permissible under Personal Law applicable to such person and the other party to the marriage and there are other legal grounds for so doing, exempt any person from the operation of this rule.

9. Success in the examination confers no right to the appointment unless the government is satisfied after such inquiry as may be deemed necessary that the candidate is suitable in all respects for appointment to the service.

10. The decision of the Commission as to the eligibility of a candidate for admission to the examination or other matters shall be final. No representation or correspondence shall be entertained on this point. The admission to the preliminary examination shall be provisional. If on verification at any stage of selection, it is found that a candidate does not fulfil all the eligibility conditions, or gives false/erroneous information, his candidature shall be cancelled. If any of his claims is found to be incorrect, he may render himself liable to disciplinary action by the Commission in terms of rule 14 of these rule.

The mere fact that an admission card/letter to the examination has been issued to a candidate, shall not imply that his candidature has been finally/irrevocably accepted by the Commission, or that the entries made by the candidate in his application form for the preliminary examination have been accepted by the Commission as true and correct. Preliminary examination is just a screening test, hence the Commission doesn't ask for any certificate to accompany the 6910 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 application form for the preliminary examination and eligibility for the examination is not inquired into at that stage. Accordingly applicants shall be admitted to the preliminary examination without exception, but a close scrutiny of the application forms of the Main Examination will be done at the time of preparing the results of the Main Examination, that is, at the time of determining the eligibility of the candidates for interview. Application forms with which required certificates are not enclosed shall be rejected. Therefore, the candidates shall thoroughly ensure before applying, that they fulfil the requirements/ conditions laid down in the advertisement.

11. No candidate shall be admitted either to preliminary examination or Main Examination unless he/she holds an admission card issued by the Commission. If any error is observed in the admission card, it shall be the liability of the candidate to immediately contact the Commission's office for correction thereof.

12. Application form, filled partially/erroneously/found with over writting/not signed at desired spaces/having missing self signed desired number of photographs or found without appropriate Bank Draft of requisite amount, shall be rejected.

13. (1) The candidates claiming any relaxation in age or any other concession shall attach, with their application forms for the Main Examination, a photocopy of the appropriate certificate issued by the competent authority. A permanent caste certificate relating to Scheduled Castes, Scheduled Tribes or Other Backward Classes, issued by a Sub-Divisional Officer (Civil), who is authorized by the Government of Himachal Pradesh to issue caste certificate, shall be attached with the application form. In case of married women, the caste certificate issued on the basis of the caste of their father alone will be accepted. If a candidate fails to produce permanent certificate of caste and other certificates, with the application form which are subject to further verification by the Commission as well as appointing authority, his candidature shall be rejected for which the candidate himself shall be responsible. In the absence of the required certificate(s), claim to any relaxation/concession shall not be considered.

(2) Ex-Serviceman candidate shall produce the discharge certificate alongwith the application form at the time of main examination.

14. A candidate who has been found by the Commission to be guilty of;

(1) obtaining support for his candidature whether in the written examination or interview by any means, or

(2) impersonating, or

(3) procuring impersonation by any person, or

(4) submitting fabricated documents or documents which have been tampered with, or (5) making statements which are incorrect or false or suppressing therein material information at any stage of selection, or

(6) resorting to any other irregular or improper means for obtaining admission to the examination, or

(7) using or attempting to use unfair means in the examination hall, or

(8) harassing, threatening or causing physical injury to the staff engaged in the conduct of examination, or

(9) violating any of the instructions given to the candidates in their admission card or other directives including oral instructions given by the centre supervisor or other staff engaged in the conduct of examination, or6911 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 (10) misbehaving in any other manner in the examination hall or in the interview, may, in addition to rendering himself/herself liable to criminal prosecution, be liable ;

(a) to be disqualified by the Commission from the examination for which he is a candidate, and/or

(b) to be debarred either permanently or for a specified period-

(i) by the Commission from an examination held or a selection made by it;

(ii) by the State Government from employment under it; and

(c) if he is already in service under the government, to a disciplinary action under appropriate rules; provided that no penalty under this rule shall be imposed except after-

(i) giving the candidate an opportunity of making such representationinwriting as he may wish to make in that behalf, and

(ii) taking the representation, if any, submitted by the candidate within the period allowed to him, into consideration.

15. The application forms for Main Examination received after the prescribed date shall not be considered. The Commission shall not be responsible in the event of forms getting late, mutilated or lost during postal/courier services. Only one application form will be accepted in one envelope. Every such application form received in Commission's office, either at the counter or by post, shall be acknowledged and a registration number shall be issued to the candidate as token of the receipt of application form. The fact that the application registration number has been issued to the candidate shall not ipso facto mean that application is complete in all respects and has been accepted by the Commission. No correspondence or representation will be entertained in respect of late receipt of application form. The decision of the Commission as to eligibility or otherwise of a candidate for admission to the examination shall be final.

16. The Commission reserves the right to allocate the centre, for examination to the candidate, keeping in view the preference recorded in the application form. It is not necessary and binding for the Commission, to allocate the desired examination centre to candidate. Examination centres are allocated by the Commission, keeping in view the capacity of examination centres and administrative convenience. No application for change of centre or any other entry in the application form shall be entertained.

17. If a candidate wants to receive any communication from the Commission on an address different from the one given in his application form, such a change in address shall be communicated to the Commission at the earliest, alongwith two self-addressed sufficiently stamped envelopes of 11.5 cm x 27.5 cm size, in which he shall note down his registration number and the name of the examination. The Commission shall make every effort to take account of such change.

18. The Commission shall not supply mark sheets in respect of preliminary examination as it is only a screening test. As such, no correspondence shall be entertained in this connection. The marks of the candidates who appeared in the Preliminary and Main Examinations shall be uploaded on the website of the Commission after the publication of the final selection results. There shall be no provision for revaluation of the examinations conducted by the commission.

19. Unemployed candidates of reserved categories (Scheduled Caste and Scheduled Tribe) domiciled in Himachal Pradesh/ Differently Abled Persons, presenting themselves on the day of 6912 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 verification of the documents in the Commission, will be paid travelling expenses by the office of the Commission from their place of residence and back on production of necessary documents in support of their claims.

Various concessions given in the advertisement, for the candidates of Scheduled Castes, Scheduled Tribes and Other Backward Classes shall be applicable only to those who are domiciled in Himachal Pradesh and belong to Scheduled Castes and Scheduled Tribes notified as such by the Government of Himachal Pradesh and to Other Backward Classes recognized by the Himachal Pradesh Government. Scheduled Caste, Scheduled Tribe and O.B.C. candidates of other States will be considered as belonging to unreserved category. Reservation, relaxation in age limit and other benefits will not be allowed to the candidates belonging to the 'creamy layer' of the Other Backward Classes recognized by the Government of Himachal Pradesh.

20. The candidates finally selected for a particular service will have to undergo such training and pass such departmental examination as may be prescribed by the Government. They will be required to serve at any place in Himachal Pradesh and shall take immediately an appointment when offered.

21. If any question arises, relating to the interpretation of these rules, the same shall be decided by the Government in consultation with the Commission.

22. The Himachal Pradesh Subordinate Allied Services/Posts (Class-II/III, Non-Gazetted) Examination Rules, 2016 in force immediately before the commencement of these rules are hereby repealed in respect of matters covered by these rules. Provided that any order made or action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules.

APPENDIX-I Standard/Syllabus of Preliminary Examination

The recruiting Agency shall limit/shortlist the number of eligible candidates to be called for written examination by subjecting them to a screening test (objective Type) of three hours duration. In the objective type screening test there shall be 200 multiple choice questions of one mark each on the basis of the syllabus specified hereunder. The marks obtained by the candidates who are declared qualified for admission to written examination will not be counted for determination of their final order of merit. The number of candidates to be admitted to the written examination will be 20(Twenty) times the total approximate number of vacancies to be filled.

(b) If a candidate gives more than one answer, it will be treated as wrong answer even if one of the given answers happen to be correct and there will be same penalty as above for that question.

हिमाचल प्रदेश हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास अधिनियम, 1984 (1984 का अधिनियम संख्यांक 18) का और संशोधन करने के लिए अध्यादेश।

हिमाचल प्रदेश विधान सभा सत्र में नहीं है और हिमाचल प्रदेश के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं जिनके कारण उनके लिए तुरन्त कार्रवाई करना आवश्यक हो गया है;

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अध्यादेश प्रख्यापित करते हैं :--

1. संक्षिप्त नाम.--इस अध्यादेश का संक्षिप्त नाम हिमाचल प्रदेश हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास (संशोधन) अध्यादेश, 2017 है।

2. धारा 2 का प्रतिस्थापन.--हिमाचल प्रदेश हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास अधिनियम, 1984 (जिसे इसमें इसके पश्चात्‌्‌ ''मूल अधिनियम'' कहा गया है) की धारा 2 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌्‌ :--

''2. परिभाषाएं.--इस अध्यादेश में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो.--

(ज) ''हिन्दू सार्वजनिक धार्मिक संस्था'' से, मठ, मन्दिर, समाध, समाधि, डेरा और उससे सम्बद्ध विन्यास या सार्वजनिक प्रयोजनार्थ धार्मिक उद्देश्य से स्थापित विनिर्दिष्ट विन्यास अभिप्रेत है और इसके अन्तर्गत निम्नलिखित भी हैः--

(i) किसी मठ या मन्दिर, समाध, समाधि या डेरा में पूजा के लिए या उसमें रख-रखाव या सुधार, परिवर्धन के लिए उनसे सम्बन्धित किसी सेवा या पूर्त कार्य के लिए दी गई या विन्यस्त सम्पूर्ण जंगम या स्थावर सम्पत्ति;

(ii) मठ या मन्दिर, समाध, समाधि या डेरा में स्थापित मूर्तियां, कपड़े, आभूषण और अलंकरण की अन्य वस्तुएं आदि; और

(iii) राज्य सरकार के सीधे नियन्त्रणाधीन धार्मिक संस्था किन्तु इसके अन्तर्गत ऐसे प्राइवेट धार्मिक मठ या मन्दिर सम्मिलित नहीं हैं जिनमें लोग हितबद्ध नहीं हैं :

परन्तु किसी भी सार्वजनिक धार्मिक संस्था में श्रद्धालुओं या किसी अन्य व्यक्ति द्वारा नकद या वस्तु रूप में कोई चढ़ावा ऐसी धार्मिक संस्थाओं की सम्पत्ति समझा जाएगा;

(झ) ''संयुक्त आयुक्त (मन्दिर)'' से, धारा 3 के अधीन नियुक्त संयुक्त आयुक्त (मन्दिर) अभिप्रेत है ;

(ञ) ''मठ'' से, हिन्दू विधि के अधीन मठ के रूप में समझा गया मठ अभिप्रेत है;

(ट) ''अन-आनुवंशिक न्यासी'' से, ऐसा न्यासी अभिप्रेत है जो आनुवंशिक न्यासी नहीं है और इसके अन्तर्गत मन्दिर न्यास में इस प्रकार नियुक्त सरकारी अधिकारी या कर्मचारी भी है;

(ठ) ''अधिकारी'' से, इस अध्यादेश के अधीन नियुक्त कोई अधिकारी अभिप्रेत है और इसके अन्तर्गत मुख्य आयुक्त (मन्दिर), अतिरिक्त मुख्य आयुक्त (मन्दिर), आयुक्त (मन्दिर), संयुक्त आयुक्त (मन्दिर), मन्दिर अधिकारी और सहायक आयुक्त (मन्दिर) भी है;

(ड) ''विहित'' से, इस अध्यादेश के अधीन बनाए गए नियमों द्वारा विहित अभिप्रेत है;

(ढ) ''पुजारी'' के अन्तर्गत पण्डा या अन्य व्यक्ति अभिप्रेत है जो पूजा या अन्य धार्मिक कृत्य करता है या उसका संचालन करता है;

(ण) ''अनुसूची'' से, मूल अधिनियम से संलग्न अनुसूची अभिप्रेत है;

(थ) ''राज्य'' से, हिमाचल प्रदेश राज्य अभिप्रेत है;

(द) ''मन्दिर'' से, किसी भी नाम से ज्ञात ऐसा स्थान अभिप्रेत है जिसका उपयोग सार्वजनिक धार्मिक पूजा स्थल के रूप में किया जाता हो और जो सार्वजनिक धार्मिक पूजा स्थल के रूप में हिन्दू समुदाय या उसके किसी वर्ग द्वारा अधिकार स्वरूप उपयोग में लाया जाता हो;

(ध) ''मन्दिर न्यास'' से, धारा 5 के अधीन आयुक्त (मन्दिर) द्वारा गठित न्यास अभिप्रेत है;

(न) ''मन्दिर अधिकारी'' से, सरकार द्वारा मन्दिर के दिन-प्रतिदिन के प्रबन्धन हेतु नियुक्त अधिकारी अभिप्रेत है; और

(प) ''न्यासी'' से, किसी भी पदनाम से ज्ञात ऐसा व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है, जिसमें हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास का प्रशासन निहित है और इसके अन्तर्गत ऐसा कोई व्यक्ति या व्यक्तियों का निकाय भी है जो वैसे ही दायी है मानो कि ऐसा व्यक्ति या व्यक्तियों का निकाय ही न्यासी है।

3. धारा 3 का प्रतिस्थापन.--मूल अधिनियम की धारा 3 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः--

''3. मुख्य आयुक्त (मन्दिर) और अन्य अधिकारियों की नियुक्ति.--(1) सरकार के भाषा, कला एवं संस्कृति विभाग का प्रशासनिक सचिव सम्पूर्ण राज्य के लिए इस अध्यादेश के अधीन या द्वारा उसे प्रदत्त शक्तियों का प्रयोग करने और सौंपे गए कृत्यों का पालन करने के लिए मुख्य आयुक्त (मन्दिर) होगा।

(2) निदेशक, भाषा, कला एवं संस्कृति हिमाचल प्रदेश या सरकार द्वारा नियुक्त कोई अन्य अधिकारी, सम्पूर्ण राज्य के लिए, विहित शक्तियों का प्रयोग और कृत्यों का पालन करने के लिए अतिरिक्त मुख्य आयुक्त (मन्दिर) होगा।

(3) सरकार, उपायुक्त या किसी अन्य अधिकारी को सम्पूर्ण राज्य या उसके विभिन्न भागों के लिए इस अध्यादेश के अधीन या द्वारा उसे प्रदत्त शक्तियों का प्रयोग करने के लिए या सौंपे गए कृत्यों का पालन करने के लिए आयुक्त (मन्दिर) के रूप में नियुक्त कर सकेगी।

(4) सरकार, उप-मण्डल अधिकारी (नागरिक) या किसी अन्य अधिकारी को, सम्पूर्ण राज्य या उसके विभिन्न भागों के लिए, विहित शक्तियों का प्रयोग करने और कृत्यों का पालन करने के लिए संयुक्त आयुक्त (मन्दिर) के रूप में नियुक्त कर सकेगी।

(5) सरकार, राजस्व विभाग के तहसीलदारों में से या किसी समतुल्य अधिकारी को प्रत्येक मन्दिर के लिए उसके कार्य की देख-रेख करने हेतु मन्दिर अधिकारी के रूप में नियुक्त कर सकेगी। (6) सरकार, जिला भाषा अधिकारी या किसी अन्य अधिकारी को, सम्पूर्ण राज्य या उसके विभिन्न भागों के लिए, विहित शक्तियों का प्रयोग करने और कृत्यों का पालन करने के लिए सहायक आयुक्त (मन्दिर) के रूप में नियुक्त कर सकेगी।

(7) सरकार समय-समय पर आयुक्त (मन्दिर) की सहायता करने के लिए ऐसे अन्य अधिकारियों और कर्मचारिवृन्द, जो वह उचित समझे, की नियुक्ति कर सकेगी।

(8) प्रत्येक मन्दिर न्यास के कर्मचारियों के लिए भर्ती और प्रोन्नति नियम तथा सेवा की अन्य शर्तें ऐसी होंगी जो मुख्य आयुक्त (मन्दिर) द्वारा अनुमोदित की जाएं :

परन्तु मन्दिर न्यास के कर्मचारियों को संदेय उपलब्धियां और अन्य धनीय प्रसुविधाएं मन्दिर न्यास की आय को ध्यान में रखते हुए विहित की जाएंगी और इस प्रयोजन के लिए सरकार मन्दिरों को, उनके संसाधनों पर आधारित, दो या अधिक वर्गों में वर्गीकृत कर सकेगी। सरकार, यदि उचित समझे, तो6918 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 मन्दिर न्यास कर्मचारियों की सेवा के निबन्धनों के सम्बन्ध में अनुसरित किए जाने वाले साधारण नियमों को अनुमोदित कर सकेगी और उन्हें इस अध्यादेश के अधीन राज्य के मन्दिर न्यासों के प्रत्येक भर्ती और प्रोन्नति नियमों में सम्मिलित किया गया समझा जाएगा।''।

4. धारा 4 का प्रतिस्थापन.--मूल अधिनियम की धारा 4 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌्‌ः--

''4. अध्यादेश के अधीन अधिकारी का हिन्दू होना.- इस अध्यादेश के अधीन नियुक्त कोई अधिकारी हिन्दू धर्म को मानने वाले व्यक्तियों में से होगा ।''।

5. कतिपय शब्दों का प्रतिस्थापन.-- मूल अधिनियम में,--

(क) धारा 12, 14, 16, 19, 22 और 28 में ''वित्त आयुक्त'' शब्द जहां-जहां आते हैं, के स्थान पर ''मुख्य आयुक्त (मन्दिर)'' शब्द और चिन्ह रखे जाएंगे; और

(ख) धारा 5, 6, 7, 8, 9, 10, 11, 12, 14, 16, 18, 19, 21, 22, 23, 25, 27, 30 और 34 में ''आयुक्त'' शब्द जहां-जहां आता है, के स्थान पर ''आयुक्त (मन्दिर)'' शब्द और चिन्ह रखे जाएंगे।

6. धारा 12-क का प्रतिस्थापन.--मूल अधिनियम की धारा 12-क के स्थान पर निम्नलिखित रखा जाएगा अर्थात्‌ः--

''12-क. हिन्दू सार्वजनिक धार्मिक संस्थाओं और पूर्त विन्यासों के सोने और चाँदी का अन्यसंक्रामण.- अनुसूची-1 में यथा सम्मिलित प्रत्येक हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास में श्रद्धालुओं से सोने और चाँदी की विभिन्न किस्मों (प्रकारों) के रूप में प्राप्त चढ़ावे को ऐसी रीति में अन्यसंक्रान्त किया जाएगा, जो विहित की जाए।''।

7. धारा 15 का संशोधन.--मूल अधिनियम की धारा 15 की उपधारा (2) में, ''आयुक्त'' शब्द के स्थान पर ''आयुक्त (मन्दिर) स्वयं या उसके द्वारा प्राधिकृत किसी अधिकारी के माध्यम से'' शब्द और चिन्ह रखे जाएंगे।

8. धारा 18 का संशोधन.--मूल अधिनियम की धारा 18 की उपधारा (5) में, ''बीस'' शब्द के स्थान पर ''पच्चीस'' शब्द रखा जाएगा।

9. धारा 23 का संशोधन.--मूल अधिनियम की धारा 23 की उपधारा (4) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌्‌ः--

''(4) हिन्दू सार्वजनिक धार्मिक संस्थाओं और पूर्त विन्यासोंं की वार्षिक संपरीक्षा भाषा, कला एवं संस्कृति विभाग के अनुभाग अधिकारी (राज्य लेखा सेवाएं) द्वारा या स्थानीय लेखा परीक्षा विभाग के अधिकारियों द्वारा या मुख्य आयुक्त (मन्दिर) द्वारा सम्यक्‌ रूप से प्राधिकृत किसी चार्टड एकाउंटेण्ट द्वारा संचालित की जाएगी।''।

10. धारा 29 का संशोधन.--मूल अधिनियम की धारा 29 की उपधारा (1) में, ''पूर्त विन्यास'' शब्दों के पश्चात्‌ ''या मन्दिरों का समूह, यथा स्थिति'', शब्द और चिन्ह अन्तःस्थापित किए जाएंगे।

THE HIMACHAL PRADESH HINDU PUBLIC RELIGIOUS INSTITUTIONS AND

CHARITABLE ENDOWMENTS (AMENDMENT) ORDINANCE, 2017

Promulgated by the Governor of Himachal Pradesh in the Sixty-eighth Year of the Republic of India.

AN ORDINANCE further to amend the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984 (Act No. 18 of 1984).

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the Governor of Himachal Pradesh is satisfied that circumstances exist which render it necessary for him to take immediate action;

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following Ordinance:— 1. Short title.—This Ordinance may be called the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments (Amendment) Ordinance, 2017.

2. Substitution of section 2.— For section 2 of the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984 (hereinafter referred to as the "principal Act"), the following shall be substituted, namely,—

"2. Definitions.—In this Ordinance, unless the context otherwise requires.—

(a) "Additional Chief Commissioner (Temple)" means the Additional Chief Commissioner (Temple) appointed under section 3;

(b) "Assistant Commissioner (Temple)" means the Assistant Commissioner (Temple) appointed under section 3;

(c) "Charitable endowment" means all property given or endowed for the benefit of, or used as of right by, the community or any section thereof for the support or maintenance of objects of utility to the community or section, such as sarais, rest- houses, pathshalas, schools and colleges, houses for feeding the poor and institution for advancement of education, medical relief fund and public health or other objects of like nature and includes the institution concerned;

(d) "Chief Commissioner (Temple)" means the Chief Commissioner (Temple) appointed under section 3 and include every officer, who for the time being exercises the powers and perform the functions of a Chief Commissioner (Temple) under this Ordinance;

(e) "Commissioner (Temple)" means the Commissioner (Temple) appointed under section 3 and includes every officer, who for the time being exercises the powers and performs the functions of a Commissioner (Temple) under this Ordinance;

(f) "Government" or "State Government" means the Government of Himachal Pradesh;

(g) "Hereditary trustee" means the trustee of a religious institution succession to whose office devolves by hereditary right or by nomination by the trustee for the time being6920 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2017/19 आश्विन, 1939 in office or is regulated by custom, or is specifically provided for by the founder, so long as such scheme of succession is in force;

(h) "Hindu public religious institution" means a math, temple, smadh, smadhi, dera and endowment attached thereto or a specified endowment, established with a religious object for a public purpose and includes ,—

(i) all property movable or immovable belonging to or given or endowed for worship in, maintenance or improvement of, additions to, a math or temple, smadh, smadhi or dera for the performance of any service or charity connected therewith;

(ii) the idols installed in the math or temple, smadh, smadhi or dera clothes, ornaments andthings for decoration etc.; and

(iii) religious institution under the direct control of the State Government, but does not include such private religious maths or temples in which the public are not interested:

Provided that any offering, whether in kind or in cash, made by the pilgrims or by any other person in any Hindu public religious institutions shall be deemed to be the property of such religious institutions;

(i) "Joint Commissioner (Temple)" means the Joint Commissioner (Temple) appointed under section 3;

(j) "Math" means a math as understood under the Hindu Law ;

(k) "Non-hereditary trustee" means a trustee who is not a hereditary trustee and includes a Government Officer or Officials so appointed in the temple trust;

(l) "Officer" means an officer appointed under this Ordinance and shall include the Chief Commissioner (Temple), Additional Chief Commissioner (Temple), Commissioner (Temple), Joint Commissioner (Temple), Temple Officer and Assistant Commissioner (Temple) ;

(m) "prescribed" means prescribed by rules made under this Ordinance;

(n) "pujari" includes a panda or any other person who performs or conducts puja or other rituals;

(o) "Schedule" means the schedule appended to the principle Act;

(p) "Section" means section of this Ordinance;

(q) "State" means the State of Himachal Pradesh;

(r) "Temple" means a place, by whatever name known, used as a place of public religious worship, and dedicated to, for the benefit of, or used as of right by the Hindu community or any section thereof as a place of public religious worship;

(s) "Temple Trust" means the trust constituted by the Commissioner (Temple) under section 5 of this Act;

to day management of the Temple; and

(u) "Trustee" means any person or body of persons, by whatever designation known, in whom or in which the administration of a Hindu religious Public institution and charitable endowment is vested, and includes any person or body of persons who or which is liable, as if such person or body of persons were a trustee.".

3. Substitution of section 3.—For section 3 of the principal Act, the following shall be substituted, namely:—

"3. Appointment of the Chief Commissioner (Temple) and other officers.—(1) The Administrative Secretary of the Language, Art and Culture Department of the Government shall be the Chief Commissioner (Temple) for the whole of the State to exercise the powers and perform the functions conferred upon or entrusted to him by or under this Ordinance.

(2) The Director, Language, Art and Culture, Himachal Pradesh or any other officer appointed by the Government shall be the Additional Chief Commissioner (Temple) for the whole of the State to exercise the powers and functions, as may be prescribed.

(3) The Government may appoint Deputy Commissioner or any other officer as Commissioner (Temple) for the whole or different parts of the State to exercise the powers and functions conferred upon, or entrusted to him by or under this Ordinance.

(4) The Government may appoint the Sub Divisional Officer (Civil) or any other officer as the Joint Commissioner (Temple) for the whole or different parts of the State to exercise the powers and functions, as may be prescribed.

(5) The Government may appoint from amongst the Tehsildars of Revenue Department or any equivalent officer as Temple Officer for each Temple to look after its work.

(6) The Government may appoint the District Language Officer or any other officer as the Assistant Commissioner (Temple) for the whole or different parts of the State to exercise the powers and functions, as may be prescribed.

(7) The Government may, from time to time, appoint such other officers and staff to assist the Commissioner (Temple) as it may deem fit.

(8) The Recruitment and Promotion Rules and other conditions of service for the employees of each temple trust shall be such as may be approved by the Chief Commissioner (Temple):

Provided that the emoluments and other monetary benefits payable to the employees of temple trust shall be prescribed taking into account the income of the temple trust and for this purpose the Government may classify the temples into two or more categories based on their resources. The Government, may, if deemed fit, approve general rules to be followed regarding the terms of service of the temple trust employees and that would deem to be incorporated in each Recruitment and Promotion Rules of the temple trusts of the State under this Ordinance.".

4. Substitution of section 4.—For section 4 of the principal Act, the following shall be substituted namely :—

"4. The Officer under Ordinance to be a Hindu.- An officer appointed under the Ordinance shall be out of the persons professing the Hindu Religion.".

a. for the words "Financial Commissioner", wherever occur in section 12,14,16,19,22 and 28, the words and signs "Chief Commissioner (Temple)" shall be substituted ; and b. for the words "the Commissioner", wherever occur in section 5, 6, 7, 8, 9, 10, 11, 12, 14, 16, 18, 19, 21, 22, 23, 25, 27, 30 and 34, the words and signs " the Commissioner (Temple)" shall be substituted.

5. Substitution of section 12-A.- For section 12-A of the Principal Act, the following shall be substituted, namely:—

"12-A. Alienation of gold and silver of the Hindu Public Religious Institutions and Charitable Endowments.– The offerings received from the devotees in the shape of various varieties of gold and silver in every Hindu Public Religious Institution and Charitable Endowment, as included in the Schedule-I, shall be alienated in the manner, as may be prescribed."—.

7. Amendment of section 15.—In section 15 of the principal Act, in the sub - section 2, for the words "Commissioner may," the words and signs "Commissioner (Temple) may himself or through any officer authorized by him" shall be substituted.

8. Amendment of section 18.—In Section 18 of the principal Act, in sub- section (5), for the word "twenty" the words "twenty five" shall be substituted.

9. Amendment of Section 23.—In Section 23 of the principal Act, for sub- section (4), the following shall be substituted, namely:—

"(4) The annual audit of the Hindu Public Religious Institutions and Charitable Endowments shall be conducted by the Section Officer (State Accounts Services) of the Language and Culture Department or by the officers of the Local Audit Department or any Chartered Accountant, duly authorised by the Chief Commissioner (Temple).".

10. Amendment of section 29.—In Section 29 of the principal Act, in sub- section (1), after the words "Charitable Endowment", the words and sign" or group of temples, as the case may be" shall be inserted .

विषय.--प्रार्थी के बच्चे का नाम व जन्म तिथि ग्राम पंचायत सरांह के जन्म पंजीकरण रजिस्टर में दर्ज करवाए जाने बारे। अधीन धारा 13(3) जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 के अन्तर्गत जन्म पंजीकरण बारे।

हर खास व आम जनता को बजरिया इश्तहार सूचित किया जाता है कि प्रार्थी श्री जय लाल झरटा पुत्र श्री किरपा राम, गांव डिमो, डाकघर सरांह़, तहसील चौपाल, जिला शिमला, हि0प्र0 ने अधोहस्ताक्षरी के न्यायालय में एक आवेदन पत्र प्रस्तुत किया है कि उसके बच्चे का नाम व जन्म तिथि ग्राम पंचायत सरांह के जन्म पंजीकरण रजिस्टर में दर्ज नहीं करवाया है। अब प्रार्थी अपने बच्चे का नाम व जन्म तिथि ग्राम पंचायत सरांह के जन्म पंजीकरण रजिस्टर में दर्ज करवाना चाहता है जो कि इस प्रकार से हैः-

अतः आम जनता को बजरिया इश्तहार सूचित किया जाता है कि किसी व्यक्ति को उपरोक्त जन्म पंजीकरण बारे कोई आपाि हो तो वह दिनांक 16-10-2017 को या इससे पूर्व असालतन या वकालतन हाजिर अदालत आकर अपनी आपाि प्रस्तुत करें अन्यथा आवेदन-पत्र पर जन्म पंजीकरण आदेश पारित करके सचिव, ग्राम पंचायत सरांह को आगामी कार्यान्वयन हेतु भेज दिया जायेगा।

श्री निर्मल सिंह बनाम आम जनता दरख्वास्त जेर धारा 13(3) जन्म एवं मृत्यु रजिस्ट्रीकरण अधिनियम, 1969.

श्री निर्मल सिंह पुत्र श्री बलदेव सिंह, निवासी 768 आदर्श नगर, अरनियाला अप्पर, डा0 कोटला कलां, तहसील ऊना़, जिला ऊना ने इस अदालत में दरख्वास्त दी है कि उसके पुत्र ईशान ठाकुर का जन्म गांव अरनियाला अप्पर में दिनांक 19-10-1995 को हुआ था, परन्तु इस बारे पंचायत के रिकॉर्ड में पंजीकरण नहीं करवाया जा सका। अब पंजीकरण करने के आदेश दिए जाएं।

अतः इस नोटिस के माध्यम से सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त जन्म के पंजीकरण होने बारे कोई उजर/एतराज हो तो वह दिनांक 27-10-2017 को प्रातः दस बजे अधोहस्ताक्षरी के समक्ष असालतन/वकालतन हाजिर आकर पेश कर सकता है अन्यथा उपरोक्त जन्म का पंजीकरण करने के आदेश दे दिए जाएंगे।
