2. यह घोषणा, भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 (2013 का 30) की धारा-19 के उपबन्धों के अधीन इससे सम्बन्धित सभी व्यक्तियों को सूचना हेतु की जाती है तथा उक्त अधिनियम के अधीन भू-अर्जन समाहर्ता लोक निर्माण विभाग, विन्टर फिल्ड शिमला को उक्त भूमि के अर्जन करने के आदेश लेने का एतद्‌द्वारा निदेश दिया जाता है।

3. पूर्वोक्त धारा द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्यपाल हिमाचल प्रदेश इस समय इस उपक्रम में कार्यरत सभी अधिकारियों उनके कर्मचारियों और श्रमिकों को इलाके की किसी भी भूमि में प्रवेश करने और सर्वेक्षण करने तथा उप धारा द्वारा अपेक्षित अथवा अनुमतः अन्य सभी कार्यों को करने के लिए सहर्ष प्राधिकार देते हैं।

4. कोई भी हितबद्ध व्यक्ति जिसे उक्त परिक्षेत्र में कथित भूमि के अर्जन पर कोई आपत्ति हो तो वह इस अधिसूचना के प्रकाशित होने के साठ दिन की अवधि के भीतर लिखित रुप में भू-अर्जन समाहर्ता, लोक निर्माण विभाग, मण्डी, (हि0 प्र0) के समक्ष अपनी आपत्ति दायर कर सकता है।

Shimla, the 13th October, 2017

No. HPERC-B(3)-1/2011-705-Vol-VI.—WHEREAS the Commission in exercise to the powers conferred by sub-section (2) and (3) of Section 91 of the Electricity Act, 2003, with prior approval of the State Government notified the Regulations i.e. Himachal Pradesh Electricity Regulatory Commission (Terms and Conditions of Service of Staff) Regulations, 2013 (hereinafter referred as "HPERC Staff Regulations, 2013") in the Rajpatra, Himachal Pradesh on 22nd April, 2013, to specific the terms and conditions of service of the employees of the Commission.

WHEREAS the first proviso of Regulation 5 of HPERC Staff Regulations, 2013, provides that Commission may identify certain posts and specify such posts to be filled up by promotion along with terms and conditions of promotion from amongst its officers/employees appointed on regular basis and while specifying terms and conditions for such promotions, the essential qualifications, experience etc. shall not be less than those prescribed for similar non-technical7219 राजपत्र, हिमाचल प्रदेश, 18 अक्तूबर, 2017/26 आश्विन, 1939 categories of posts in the State Govt. Departments and technical categories of posts in the Himachal Pradesh State Electricity Board Ltd.

WHEREAS as per the aforesaid provisions, the post of Director (Technical Analysis), has been identified, to be filled through promotion from the feeding categories of Dy. Director(s)/Joint Director(s) of the technical wing in the Commission. Accordingly, a proposal was forwarded to the State Government for their approval, to fill the post of Director (Technical Analysis) through promotion mode.

WHEREAS the Dept. of MPP & Power, GoHP has conveyed the approval of the State Government vide letter No. MPP-A (7)-1/2000-III dated 4th October, 2016, to fill up the post of Director (Technical Analysis) through promotion from the eligible incumbent subject to condition that incumbent should fulfill all other service conditions of the post of Director (Technical Analysis) in relaxation of the mode of filling of the post of Director (Technical Analysis) as specified in Regulation 13 of the HPERC (Terms and Conditions of service of Staff) Regulations, 2013.

WHEREAS it necessitates the Commission, to specify the terms and conditions to fill the post of Director (Technical Analysis) through promotion as per the provisions of 1st proviso of Regulation 5 of HPERC Staff Regulations, 2013.

NOW, THEREFORE, in exercise to the powers conferred by 1st proviso of Regulations 5 and Regulation 13 of HPERC Staff Regulations, 2013, the Commission, hereby specify the following terms and conditions, to fill the post Director (Technical Analysis) through promotion.

1. Short title and commencement.—(1) These terms and conditions may be called the Himachal Pradesh Electricity Regulatory Commission Director (Technical Analysis) (Class-I, gazetted) promotion Rules, 2017.

(2) These Rules shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Promotion Rules for the post of Director (Technical Analysis).— In addition to the existing modes of appointment for the post of Director (Technical Analysis) i.e. secondment/re- employment/by absorption, the following provisions/rules shall be applicable, to fill the post of Director (Technical Analysis) through promotion:—

From amongst the Joint Director(s) having degree in Engineering and having 8 years of service as joint Director/or 8 years service experience, in the regulatory affairs of power sector, in the equivalent pay scale of Joint Directors i.e. ` 15600-39100+7600 Grade Pay.

Or From amongst the Deputy Directors/Joint Director(s) having degree in Engineering and having 20 years of service/ experience as Class-1 officer in the entry scale of ` 2200- 4000/7880-13500 (pre-revised) out of which 8 years service experience shall be in the equivalent pay scale of Joint Directors i.e. `15600-39100+7600 Grade Pay. Out of total service experience of 20 years, 8 years service experience shall be in the regulatory affairs of power sector.

अतः दर्शना देवी तथा रचना देवी को बजरिया इश्तहार सूचित किया जाता है कि यदि उन्हें उपरोक्त तकसीम भूमि में कोई उजर-एतराज हो जो वह दिनांक 2-11-2017 को असालतन या वकालतन आकर अपना उजर-एतराज दर्ज कर सकते हैं। हाजिर न आने की सूरत में उसके खिलाफ एकतरफा कार्यवाही अमल में लाई जाएगी।
