After creation of Forest Circle at Solan, the position of Bilaspur, Nahan and Solan Circles will be as under:—

The Governor, HP is further pleased to order closing of the offices of CF (Working Plan South) Solan and CCF (Forest Protection and Fire Control) Bilaspur respectively with immediate effect. Due to shortage of staff at all levels, the staff posted in the above offices on their closure will be utilized in the newly created circle at Solan and in PCCF office Shimla as per requirement as most of the work of office of CCF (Forest Protection & Fire Control) Bilaspur has been transferred to PCCF office Shimla. The requirement of staff in new Circle office Solan shall be managed as under:—

Also, the work of CF (WP-South) Solan upon its closure shall be divided between CF (Working Plan- Central) Mandi and CF (Working Plan-North), Palampur as per details given as under:—

The newly created Forest Circle shall become functional from the date of its establishment.

No. FFE-A(A)1-2/2016-Loose.—The Governor, Himachal Pradesh is pleased to create a New Forest Range namely Khundian in Forest Division Dehra, Distt. Kangra, HP by carving out this Block from Jawlamukhi Range. After re-organization/creation of Khundian Range, there would be three Blocks namely Khundian Block, Majheen Block and Lagroo Block (new creation).

The Governor, HP is further pleased to create one new Block at Bharoli in Jawalmukhi Range and one at Lagroo in Khundian Range and also two Beats one in Jawalmukhi Range namely Adhwani Beat and one in Khundian Range namely Pihri Beat. At present there are four forest ranges in Dehra Forest Division and after reorganisation/creation of Khundian Forest Range, the Dehra Forest Division will have 5 Ranges 16 Blocks and 58 Beats. The status of Dehra Forest Division after reorganisations creation of Khundian Forest Range will be as under:—

For making functional the new Range Khundian, the requirement of staff, the detail which is given below, may be adjusted within the allotted strength of HP Forest Department:—

No.FFE-B-F(14)-29/2013.—Whereas the nature and extent of the rights of the Government and of private persons in or over the Forest Land/Waste Land specified in the schedule inserted to this Notification have been enquired into and recorded as required under Sub-Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

And whereas the Forest Land/Waste Land shown in the said schedule is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the Forest Produce therein;

Now, therefore, in exercise of the powers conferred by Sub-Section (1) of Section-29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the Act shall apply to the said Forest Land/Waste Land and shall hereafter be called as "Protected Forests" under the provisions of Sub-Section (2) of Section-29 of the Act ibid.

No.Per(Trg.)B(2)-1/90-IV.—The Governor, Himachal Pradesh is pleased to create 01 (One) post of Research & Documentation Officer, Class-I (Gazetted) in the pay scale of Rs. 10300- 34800+5000 Grade Pay in HIPA Establishment by conversion/transfer from the post already created under Disaster Management Centre at HIPA.

The expenditure will be debitable to the Head of Account: 2070-Other Administrative Services, 003-Training, 03-H.P. Institute of Public Administration (Non Plan)-SOON-(01)-Salaries during the current financial years 2017-18.

This issues with the prior concurrence of the Finance Department (Expenditure Control-II) and Revenue Department (Disaster Management) obtained vide their U.O.No.53326510-Fin- F/2015 dated 13-8-2015 & U.O.No. Rev (DMC) (F) 11-45/2015 dated 13-2-2017 respectively.

NOTIFICATION

Shimla-171001, the 16th January, 2017

No.: 11-6/85(Lab) ID/2017/Shimla.—It appears to the undersigned that an industrial dispute about the following issue exist between General Secretary, State HRTC Conductor Union, Himachal Pradesh, H.Q. Mandi C/O HRTC Mandi with The Managing Director, Himachal Road Transport Corporation, Shimla.

As per report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, he tried his level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under Sub- Section 5 of Section 12 of the Act ibid, the undersigned has decided that this dispute is required to be legally adjudicated by the Labour Court/ Industrial Tribunal.

Therefore, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: 19-8/89-Shram (Loose), Dated 7th September, 1992 and as per power vested under Sub Section-1 of Section 10 of The Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court/Industrial Tribunal Shimla constituted under Section-7 of Act ibid, on the following issue/issues for legal adjudication:—

"Whether miscellaneous demands raised by the General Secretary, State HRTC Conductor Union, Himachal Pradesh, H.Q. Mandi vide demand notices dated- 22.11.2011 & 05.10.2012 (Copies-Enclosed) before and to be fulfilled by the Managing Director, Himachal Road Transport Corporation, Shimla are legal and justified? If yes, what relief, monetary and other service benefits in terms of demand notices dated-22.11.2011 & 05.10.2012, the concerned workmen are entitled to from the above employer/ management?"

No.11-1/10(Lab) ID/2017/Theog.—It appears to the undersigned that an industrial dispute about the following issue exist between Sh. Gopal Sharma S/O Sh. Chiranji Lal, Village- Janajan, P.O. Deothi, Tehsil Theog, Distt. Shimla, H.P. and i) The Director, M/s Him Agri Fresh Pvt. ltd. 518, J.P. Nagar, Jalandhar, Punjab. ii) The Manager, M/s Him Agri Fresh pvt. ltd. Village & P.O. Balghar, Tehsil Theog, Distt. Shimla, H.P.

Whereas, the Labour Inspector-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts7917 राजपत्र, हिमाचल प्रदेश, 16 नवम्बर, 2017/25 कार्तिक, 1939 for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, undersigned while exercising the power vested as provided under sub section 5 of Section 12 of the Act ibid carefully examined the report and come to the conclusion that there exist an industrial dispute between the above parties which requires legal adjudication.

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram(A) 7-9/201, dated- 17.01.2017 and as per power vested under Sub Section-1 of Section 10 of The Industrial Disputes Act, 1947 (14 of 1947), formed an opinion to refer this dispute to the Labour Court/Industrial Tribunal Shimla, constituted under Section-7 of Act ibid, for legal adjudication on the following issue/issues:—

"Whether termination of services of Sh. Gopal Sharma S/O Sh. Chiranji Lal, Village- Janajan, P.O. Deothi, Tehsil Theog, Distt. Shimla, H.P. w.e.f. 01.01.2016 by the Employer/ Managing Director, i) The Director, M/s Him Agri Fresh Pvt. ltd. 518, J.P. Nagar, Jalandhar, Punjab. and ii) The Manager, M/s Him Agri Fresh pvt. ltd. Village & P.O. Balghar, Tehsil Theog, Distt. Shimla, H.P. without complying with the provisions of the Industrial Disputes Act, 1947 is legal and justified? If not, what relief including reinstatement, amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer?"

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No.: Shram(A) 7-9/201, dated- 17.01.2017 and as per power vested under Sub Section-1 of Section 10 of The Industrial Disputes Act, 1947 (14 of 1947), formed an opinion to refer this dispute to the Labour Court/Industrial Tribunal Shimla, constituted under Section-7 of Act ibid, for legal adjudication on the following issue/issues:—
