Whereas, the Labour Officer Officer-cum-Conciliation Officer, has incorporated in the report that during the course of conciliation proceedings for the purpose of bringing about a legal and amicable settlement, all matters affecting the settlement were investigated and has made all efforts for the purpose of inducing the parties to come to legal, fair and amicable settlement of the said dispute. However, no such settlement could be arrived at in between the parties to the industrial dispute.

Whereas, undersigned while exercising the power vested as provided under sub-section 5 of Section 12 of the Act ibid carefully examined the report and come to the conclusion that there exist an industrial dispute between the above parties which requires legal adjudication.

Therefore, in view of the above facts and circumstances, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No. Shram(A) 4-9/2006-IV- Loose, dated 15-2-2014 and as per power vested under Sub-Section 1 of Section 10 of The Industrial Disputes Act, 1947 (14 of 1947), formed an opinion to refer this dispute to the Ld. Labour Court/Industrial Tribunal Shimla, constituted under Section 7 of Act ibid, for legal adjudication on the following issue/issues:—

"Whether termination of services of Sh. Dev Raj s/o Late Sh. Lagan Dass, r/o Village Bamnhol, P.O. Dharogra, Tehsil Sunni, Distt. Shimla, H.P. by the Deputy Director, Horticulture, Shimla-2 (H.P.) w.e.f. 31-1-2016 allegedly without complying with the provisions of the Industrial Disputes Act, 1947 is legal and justified? If not, what relief including reinstatement, amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer?"

No. 11-2/93(Lab)ID/2017/Solan/Ramesh.—It appears to the undersigned that an industrial dispute exists between Sh. Ramesh Sharma s/o Sh. Bhoop Singh Sharma, r/o Ward No. 7, Kotli, Rajgarh, P.O. & Tehsil Rajgarh, Distt. Sirmaur (H.P.) and The Factory Manager, M/s Venus Remedies Limited Plot No. 51-52 Phase-I, Indl Area Panchkula (Haryana) on the issue of alleged termination of his services.

As per the report under section 12(4) of the Industrial Disputes Act, 1947 submitted by the Conciliation Officer, he tried his Level best to settle the dispute during conciliation proceedings but could not succeed. The report so received has been considered by the undersigned and as per power vested under sub-section 5 of Section 12 of the Act ibid, the undersigned has decided that this dispute is required to be legally adjudicated by the Labour Court/ Industrial Tribunal.

Therefore, the undersigned while exercising the powers vested by the Govt. of Himachal Pradesh vide Notification No. Sharm (A)4-9/2016-IV-Loose, Dated 15th February, 2014 and as per power vested under sub-section 10 of the Industrial Disputes Act,1947(14 0f 1947) this Industrial dispute is referred to the Labour Court/Industrial Tribunal Shimla, constituted under Section 7 of Act ibid, on the following issue for legal adjudication:—

1. They will be paid retainer-ship fee, on monthly basis as per terms and condition laid down in Government Notification No. Home-B (B)2-1/97, dated 11-8-2010.

2. They will be whole time Government servant and will not accept any case against the State Government.

3. Their services being purely on tenure basis and can be terminated at any time without any notice and without assigning any reasons.

4. They will do all criminal, quasi criminal court cases entrusted to them by the Advocate General, H.P. H.P. Government and Legal Remembrance and no payment will be given for this purpose.

5. In the matter of leave and travelling allowance, they will be governed by the Rules applicable to the State Government employees.

6. Their services will be purely on tenure basis and as such, they will not be entitled to any other service benefits viz pension, gratuity and encashment of leave etc.

1. Trade Short title, and commencement.—(1) This Order may be called the Himachal Pradesh Articles (Licensing and Control) Amendment Order, 2017.

(2) It shall come into force from the date of its publication in the Rajpatra, Himachal Pradesh and shall remain in force till 31-12-2017 in respect of "Onion" and 28-04-2018 in respect of "Sugar" or till any further order issued by the Government of India in this behalf, whichever is earlier.

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी भी व्यक्ति को परनीत सिंह की जन्म तिथि ग्राम पंचायत भंगानी, तहसील पांवटा साहिब में दर्ज करने बारे कोई एतराज हो तो वह मिति 04-03-2018 को या इससे पूर्व हमारे न्यायालय में हाजिर होकर लिखित अथवा मौखिक एतराज पेश कर सकता है। उक्त निश्चित तिथि के बाद कोई भी एतराज मान्य नहीं होगा और समझा जायेगा कि उक्त परनीत सिंह की जन्म तिथि को सम्बन्धित ग्राम पंचायत में दर्ज करने बारे किसी को कोई एतराज नहीं है तथा नियमानुसार जन्म तिथि पंजीकरण के आदेश जारी कर दिये जायेंगे।
