उपाबन्ध-क हिमाचल प्रदेश अधीनस्थ लेखा सेवा परीक्षा (स्थानीय लेखा परीक्षा विभाग) भाग-I और भाग-II के लिए नियम
1. स्ंक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश अधीनस्थ लेखा सेवा (स्थानीय लेखा परीक्षा विभाग) परीक्षा नियम, 2018 है।
(2) ये नियम राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होगें। 2. परिभाषाएं.--इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो--
(क) ''परिशिष्ट'' से इन नियमों में संलग्न परिशिष्ट अभिप्रेत है;
(ख) ''आयोग'' से हिमाचल प्रदेश लोक सेवा आयोग अभिप्रेत है;
(ग) ''विभाग'' से हिमाचल प्रदेश सरकार का स्थानीय लेखा परीक्षा विभाग अभिप्रेत है;
(घ) ''परीक्षा'' से हिमाचल प्रदेश अधीनस्थ लेखा सेवा (स्थानी लेखा परीक्षा विभाग) भाग-I और भाग-II परीक्षा अभिप्रेत है;
(ङ) ''सरकार'' से हिमाचल प्रदेश सरकार अभिपे्रत है;
(च) ''स्नातक'' से ऐसा व्यक्ति अभिप्रेत है जो किसी मान्यता प्राप्त विश्वविद्यालय से स्नातक उपाधि रखता हो; और
(छ) ''मान्यता प्राप्त विश्वविद्यालय'' से भारत में केन्द्रीय या राज्य विधि द्वारा स्थापित कोई विश्वविद्यालय अभिपे्रत है।
3. पात्रता.--(1) इन नियमों में विहित अन्य शर्ताें के अध्यधीन सरकार के स्थानीय लेखा परीक्षा विभाग के समस्त नियमित कनिष्ठ लेखा परीक्षक, लिपिक और कनिष्ठ कार्यालय सहायक (आई टी) जो स्नातक हैं और जिन्होंने विभाग में कम से कम एक वर्ष की सेवा कर ली है, परीक्षा मे बैठने के लिए पात्र होगें। इन प्रवर्गों के पदधारी, जो दस जमा दो पास हैं, भी परीक्षा में बैठने के पात्र होगें परन्तु उन्होनें विभाग में कम से कम चार वर्ष की सेवा पूर्ण कर ली हो।
(2) कोई अभ्यर्थी, परीक्षा के भाग-I के किसी एक या एक से अधिक विषयों (पेपरों) में एक बार बैठने या परीक्षा के भाग-I में प्रवेश के लिए आवेदन करने के पश्चात् परीक्षा के भाग-II में बैठने के लिए पात्र होगा, परन्तु पश्चात्वर्ती मामले में भाग-I परीक्षा, प्रश्नगत परीक्षा के भाग-II के आरम्भ होने से पूर्व आयोजित की गई हो।10677 राजपत्र, हिमाचल प्रदेश, 22 फरवरी, 2018/03 फाल्गुन, 1939 4. पास प्रतिशतता.--(1) अभ्यर्थी द्वारा परीक्षा के प्रत्येक विषय (पेपर) के लिए न्यूनतम अंक चालीस प्रतिशत होगें और परीक्षा में समस्त विषयों (पेपरों) में लिए गए कुल मिलाकर संकलित अंक पैंतालीस प्रतिशत होगें।
(2) कोई अभ्यर्थी जिसने भाग-I और भाग-II परीक्षा के कुछ विषयों (पेपरों) में कम से कम चालीस प्रतिशत अंक अभिप्राप्त किए है,ं को उन विषयों (पेपरों) में बैठने से छूट दी जाएगी।
(3) कोई अभ्यर्थी जिसने परीक्षा के भाग-I और भाग-II के समस्त विषयों (पेपरों) में कम से कम चालीस प्रतिशत अंक प्राप्त करके पास अंक अभिप्राप्त किए हैं किन्तु जो संकलित अंकों में असफल हो जाता है तो वह पांच अवसरों का उपयोग करके अपेक्षित संकलित अंकों को प्राप्त करने के लिए उन विषयों (पेपराें) में पुनः बैठ सकेगा :
परन्तु यदि किसी अभ्यर्थी ने समस्त अवसरों को निःशेष कर दिया है तो उसे भाग-I और भाग-II परीक्षा के समस्त विषयों (पेपरों) में नए सिरे से बैठना होगा और जहां तक अवसरों की संख्या का सम्बन्ध है, उसे एक नए अभ्यर्थी के रूप में समझा जाएगा।
5. आवेदन प्रारूप और परीक्षा का (के) स्थान.--आयोग द्वारा परीक्षा ऐसे स्थान (स्थानों) और ऐसी तारीखों को आयोजित की जाएगी जैसी आयोग निर्धारित करें। परीक्षा में प्रवेश के लिए आवेदन आयोग द्वारा ऐसे प्रारूप मे आंमन्त्रित किए जाएंगे जैसा इस द्वारा विनिर्दिष्ट किया जाए। किसी अभ्यर्थी को जो आयोग द्वारा अधिसूचित की जाने वाली आवेदन की प्राप्ति के लिए अन्तिम दिन तक विहित परीक्षा फीस नहीं भेजता है, परीक्षा में बैठने की अनुज्ञा से इन्कार किया जा सकेगा। एक बार निक्षिप्त परीक्षा फीस को किन्ही भी परिस्थितियों में प्रतिदत नहीं किया जाएगा या पश्चात्वर्ती परीक्षा के लिए धारित नहीं किया जाएगा।
6. परीक्षा का भाग-I हिमाचल प्रदेश अधीनस्थ लेखा सेवा (सामान्य शाखा) परीक्षा के भाग-I के साथ संयुक्त होगा। तद्नुसार कोई अभ्यर्थी जो उस परीक्षा का भाग-I पूर्णतः या भागतः अर्हित करता है, तो उसे हिमाचल प्रदेश अधीनस्थ लेखा सेवा (स्थानीय लेखा परीक्षा विभाग) परीक्षा के सुसंगत विषयों (पेपरों) में भी उत्तीर्ण किया गया समझा जाएगा।
7. परीक्षा के लिए फीस.-- परीक्षा में प्रवेश के लिए फीस ऐसी होगी जैसी आयोग द्वारा समय-समय पर निर्धारित की जाए।
8. पाठ्यक्रम.--परीक्षा के भाग-I और भाग-II के लिए पाठयक्रम ऐसा होगा जैसा परिशिष्ट में विनिर्दिष्ट है।
9. अभ्यर्थी केवल उन विषयों में परीक्षा में अपनी पुस्तकें ला सकेंगे जिनमें परिशिष्ट के अनुसार ऐसी पुस्तकों की सहायता अनुज्ञात है। ये पुस्तकें केवल सन्दर्भ पुस्तकें होगीं और इन पर कोई व्याख्या या अन्य विषयवस्तु मुद्रित टंकित या हस्तलिखित अन्तर्विष्ट नहीं होगी।
10. निरसन और व्यावृतियांः--(1) अधिूसचना संख्या II-12/75 फिन (टी एण्ड ए) तारीख 21-04-1977 द्वारा अधिसूचित दि हिमाचल प्रदेश सबोर्डिनेट अकाउन्टस सर्विस (लोकल ऑडिट डिपोर्टमेन्ट) एग्जामिनेशन रूल्ज, 1976 का एतद्द्वारा निरसन किया जाता है।

Dated, the 6th February, 2018
No.1-267/74-Fin (LA)-Vol-14(part)-879.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with 10684 राजपत्र, हिमाचल प्रदेश, 22 फरवरी, 2018/03 फाल्गुन, 1939 the Himachal Pradesh Public Service Commission is pleased to make the Himachal Pradesh Subordinate Accounts Service (Local Audit Department) Examination Rules, 2018, as per Annexure-A appended to this notification.

ANNEXURE-A
Rules for the Himachal Pradesh Subordinate Accounts Service Examination
(Local Audit Department) Part-I and Part-II
1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Subordinate Accounts Service (Local Audit Department) Examination Rules, 2018.
(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gezette), Himachal Pradesh.
2. Definitions.—In these rules, unless the context otherwise requires;
(a) "Appendix" means the appendix to these rules;
(b) "Commission" means the Himachal Pradesh Public Service Commission;
(c) "Department" means the Local Audit Department of the Himachal Pradesh Government;
(d) "Examination" means the Himachal Pradesh Subordinate Accounts Service (Local Audit Department) Part-I and Part-II Examination;
(e) "Government" means the Government of Himachal Pradesh;
(f) "Graduate" means a person possessing a bachelor degree of a recognized University;
and
(g) "Recognized University" means a University established by a Central or State Law in India.
3. Eligibility.—(1) Subject to other conditions prescribed in these rules all regular Junior Auditors, Clerks and Junior Office Assistants (IT) of the Local Audit Department of the Government who are graduate and have put in at least one years' service in the Department will be eligible to appear in the Examination. Officials of these categories, who are 10+2, will be eligible to appear in the Examination provided they have put in at least four years service in the department. (2) A candidate shall be eligible to appear in Part-II of the Examination after he has once appeared in one or more than one papers of Part-I of the Examination or applied for admission to Part-I examination provided, in the latter case, the Part-I examination is to be held before the commencement of Part-II of the Examination in question.
10685 राजपत्र, हिमाचल प्रदेश, 22 फरवरी, 2018/03 फाल्गुन, 19394. Pass Percentage.—(1) The minimum marks for each paper of the Examination shall be 40% and 45% in aggregate for all the papers taken together in the Examination by the candidate.
(2) A candidate who obtains atleast 40% in some of the papers of Part-I and Part-II Examination shall be exempted from appearing in those papers.
(3) A candidate, who obtains pass marks in all papers of Part-I and Part-II of the Examination by securing atleast 40% but fails in the aggregate, may reappear in those papers for securing required aggregate of marks by availing five chances:
Provided that, a candidate who has exhausted all the chances shall have to appear afresh in all papers of Part-I and Part-II Examination and will be treated as fresh candidate as far as number of chances are concerned.
5. Application form and place (s) of Examination.—The Examination will be held by the Commission at such place (s) and on such dates as the Commission may determine. The application for admission to the Examination shall be invited by the Commission on such form as may be specified by it. Permission to sit at the examination shall be refused to a candidate who does not, by the closing day for receipt of application to be notified by the Commission, send the prescribed examination fee. Examination fee once deposited will in no circumstances, be refunded or held over for a subsequent examination.
6. Part-I of the Examination shall be combined with Part-I of the Himachal Pradesh Subordinate Accounts Service (Ordinary Branch) examination. Accordingly, a candidate who qualifies in Part-I of that examination in whole or in part will also be deemed to have passed the relevant papers of the Himachal Pradesh Subordinate Accounts Services (Local Audit Department) Examination.
7. Fee for Examination.—The fee for admission to the examination shall be such as may be determined by the Commission from time to time.
8. Syllabus.—The syllabus for Part I and Part II of the Examination will be as specified in the Appendix.
9. The candidates may bring their own books in the examination in those subjects only in which the aid of such books is allowed as per Appendix. These books shall be bare reference books and shall not contain any annotations or other matter, printed, typed or hand written.
10. Repeal and Savings.—(1) The Himachal Pradesh Subordinate Accounts Service (Local Audit Department) Examination Rules, 1976 notified vide Notification No. II-12/75- Fin(T&A), dated 21.04.1977 are hereby repealed.
(2) Notwithstanding such repeal, anything done, or any action taken under the rules so repealed, shall be deemed to have been done or taken under the corresponding provisions of these rules.

(2) ये नियम राजप़त्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. रुल 56 का संशोधन.--फण्डामेंटल रुल्ज के रुल 56 में क्लॉज (ई) के द्वितीय प्रवाइज़ो के पश्चात् निम्नलिखित तृतीय प्रवाइज़ो अन्तःस्थापित किया जाएगा, अर्थात्ः-

No. Fin (C)-A (3)-2/2013-L.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, the Governor, Himachal Pradesh is pleased to make the following rules further to amend the Fundamental Rules, in their application to the State of Himachal Pradesh, namely:—
1. Short title and commencement.—(1) These rules may be called Fundamental (in their application to the State of Himachal Pradesh) First Amendment, Rules, 2018.
(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.
2. Amendment of rule-56.—In rule-56 of the Fundamental Rules, after the second proviso to clause (e), the following third proviso shall be inserted, namely:—
"Provided further that a Class-IV Government servant appointed on part-time/daily wages basis prior to 10-05-2001 and regularized on or after 10-05-2001 shall retire from service on the afternoon of the last day of the month in which he attains the age of 60 years."

संख्या पब-ए (3)-1/2014.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की सम संख्यांक अधिसूचना तारीख 29-10-2014 द्वारा अधिसूचित हिमाचल प्रदेश सूचना एवं जन सम्पर्क विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सूचना एवं जन सम्पर्क विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2018 है। (2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध-''क'' का संशोधन.--हिमाचल प्रदेश, सूचना एवं जन सम्पर्क विभाग, निजी सचिव, वर्ग-I (राजपत्रित) भर्ती और प्रोन्नति नियम, 2014 के उपाबन्ध-''क'' में स्तम्भ संख्याः 11 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
''11. निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका निजी सहायक और वरिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः चौदह वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौदह वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी, दोनों के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक और कनिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः उन्नीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके उन्नीस वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी, समस्त के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिनका निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक, कनिष्ठ वेतनमान आशुलिपिक और आशुटंकक के रूप में संयुक्ततः चौबीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौबीस वर्ष का नियमित सेवाकाल हो, जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी।
(1) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, प्रोन्नति के लिए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अधीन रहते हुए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात् की गई थीः परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई तदर्थ सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां अपने-अपने प्रवर्ग/पद/काडर में उससे वरिष्ठ सभी व्यक्ति विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः 10694 राजपत्र, हिमाचल प्रदेश, 22 फरवरी, 2018/03 फाल्गुन, 1939 परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः
परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।
स्पष्टीकरण.-अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपर्व सैनिक है जिसे डिमोबीलाईज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज,1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और इनके अन्तर्गत वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए गए हों।
(2) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात् और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः
परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात् जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

No. Pub-A(3)-1/2014.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh, Department of Information & Public Relations, Private Secretary, Class-I (Gazetted) Recruitment and Promotion Rules, 2014 notified vide this department's notification of even number dated 29th October, 2014, namely:—
1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh, Department of Information and Public Relations, Private Secretary, Class-I (Gazetted) Recruitment and Promotion (First Amendment) Rules, 2018.

2. Amendment of Annexure-"A".—In Annexure-"A" to the Himachal Pradesh, Department of Information and Public Relations, Class-I (Gazetted) Recruitment and Promotion Rules, 2014, against column No.11, for the existing provisions, the following shall be substituted, namely:—
"11. By promotion from amongst the Personal Assistant(s) possessing 05 (five) years' regular service or regular combined with continuous adhoc service, if any, in the grade, failing which by promotion from amongst the Personal Assistant(s) possessing 14(fourteen) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant and Senior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing both by promotion from amongst the Personal Assistant(s) possessing 19 (nineteen) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer & Junior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant failing all by promotion from amongst the Personal Assistant(s) possessing 24 (twenty four) years' regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer, Junior Scale Stenographer & Steno Typist combined which shall also include 02 (two) years' essential service as Personal Assistant.
(1) In all cases of promotion, the continuous adhoc service rendered in the feeder post, if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:
Provided that in all cases where a junior person becomes eligible for consideration by virtue of his / her total length of service (including the service rendered on adhoc basis, followed by regular service/appointment) in the feeder post in view of the provision referred to above, all persons senior to him/her in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:
Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years' or that prescribed in the R&P Rules for the post, whichever is less:
Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him / her shall also be deemed to be ineligible for consideration for such promotion;
Explanation.—The last proviso shall not render the junior incumbent(s) ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-Servicemen recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.
10696 राजपत्र, हिमाचल प्रदेश, 22 फरवरी, 2018/03 फाल्गुन, 1939 (2) Similarly, in all cases of confirmation, adhoc service rendered on the feeder post, if any, prior to the regular appointment / promotion against such post shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the R&P Rules:
Provided that inter-seseniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

संख्या : एफ.एफ.ई-बी-एफ(14)213/2014.--इस अधिसूचना में अन्तःस्थापित अनुसूची में विनिर्दिष्ट वन भूमि/बंजर भूमि में या उस पर, सरकार तथा प्राइवेट व्यक्तियों के अधिकारों के स्वरूप और विस्तार की जांच कर ली गई है और उन्हें भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) की धारा 29 की उपधारा (3) के अधीन यथा अपेक्षित अभिलिखित कर लिया है;
उक्त अनुसूची में दर्शित वन भूमि/बंजर भूमि, सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;
अतः हिमाचल प्रदेश के राज्यपाल, पूर्वोक्त अधिनियम की धारा 29 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि/बंजर भूमि को लागू होंगे और जो एतद्पश्चात् पूर्वोक्त अधिनियम की धारा 29 की उपधारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी ।

NOTIFICATION
Shimla-2, the 29th January, 2018
No. FFE-B-F(14)-213/2014.—Whereas the nature and extent of the rights of the Government and of private persons in or over the Forest Land/ Waste Land specified in the schedule inserted to this Notification have been enquired into and recorded as required under Sub- Section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);
And whereas the Forest Land/ Waste Land shown in the said schedule is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the Forest Produce therein;
Now, therefore, in exercise of the powers conferred by Sub- Section (1) of Section-29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the Act shall apply to the said Forest Land/ Waste Land and shall hereafter be called as "Protected Forests" under the provisions of Sub-Section (2) of Section-29 of the Act ibid.

उपरोक्त मामला में प्रार्थीगण उपरोक्त ने दिनांक 08-01-2018 को इस अदालत में प्रार्थना-पत्र मय शपथ पेश किया है कि उन्होंने दिनांक 25-01-2014 को शादी कर ली है और तब से दोनोें पति-पत्नी के रूप में रहते चले आ रहे हैं। परन्तु प्रार्थीगण ने अपनी शादी का इन्द्राज सम्बन्धित ग्राम पंचायत मोहल, तहसील भुन्तर, जिला कुल्लू, हि0 प्र0 में दर्ज नहीं करवाया है।
अतः सर्वसाधारण व आम जनता को इस इश्तहार द्वारा सूचित किया जाता है कि किसी भी व्यक्ति को उपरोक्त प्रार्थीगणों की शादी से सम्बन्धित पंचायत के अभिलेख में दर्ज करने बारे एतराज हो तो वह दिनांक 06-03-2018 को सुबह 10.00 बजे या इससे पूर्व असालतन या वकालतन हाजिर अदालत पेश होकर अपना एतराज पेश कर सकता है। इसके उपरान्त कोई भी एतराज प्राप्त न होने की सूरत में नियमानुसार शादी दर्ज करने के आदेश पारित कर दिए जाएंगे।

उपरोक्त मामला में प्रार्थीगण उपरोक्त ने दिनांक 12-07-2017 को इस अदालत में प्रार्थना-पत्र मय शपथ पेश किया है कि उन्होंने दिनांक 18-02-2013 को शादी कर ली है और तब से दोनोें पति-पत्नी के रूप में रहते चले आ रहे हैं। परन्तु प्रार्थीगण ने अपनी शादी का इन्द्राज सम्बन्धित ग्राम पंचायत शिलीराजगिरी, तहसील भुन्तर, जिला कुल्लू, हि0 प्र0 में दर्ज नहीं करवाया है।
अतः सर्वसाधारण व आम जनता को इस इश्तहार द्वारा सूचित किया जाता है कि किसी भी व्यक्ति को उपरोक्त प्रार्थीगणों की शादी से सम्बन्धित पंचायत के अभिलेख में दर्ज करने बारे एतराज हो तो वह दिनांक 06-03-2018 को सुबह 10.00 बजे या इससे पूर्व असालतन या वकालतन हाजिर अदालत पेश होकर अपना एतराज पेश कर सकता है। इसके उपरान्त कोई भी एतराज प्राप्त न होने की सूरत में नियमानुसार शादी दर्ज करने के आदेश पारित कर दिए जाएंगे।

उपरोक्त मामला में प्रार्थीगण ने दिनांक 29-03-2017 को इस अदालत में प्रार्थना-पत्र मय शपथ पेश किया है कि उन्होंने दिनांक 07-08-2012 को शादी कर ली है और तब से दोनोें पति-पत्नी के रूप में रहते चले आ रहे हैं। परन्तु प्रार्थीगण ने अपनी शादी का इन्द्राज सम्बन्धित ग्राम पंचायत मंझली, तहसील भुन्तर, जिला कुल्लू, हि0 प्र0 में दर्ज नहीं करवाया है।
अतः सर्वसाधारण व आम जनता को इस इश्तहार द्वारा सूचित किया जाता है कि किसी भी व्यक्ति को उपरोक्त प्रार्थीगणों की शादी से सम्बन्धित पंचायत के अभिलेख में दर्ज करने बारे एतराज हो तो वह दिनांक 06-03-2018 को सुबह 10.00 बजे या इससे पूर्व असालतन या वकालतन हाजिर अदालत पेश होकर अपना एतराज पेश कर सकता है। इसके उपरान्त कोई भी एतराज प्राप्त न होने की सूरत में नियमानुसार शादी दर्ज करने के आदेश पारित कर दिए जाएंगे।

उनवान मुकद्दमा प्रार्थना-पत्र जेर धारा 13(3) जन्म व मृत्यु अधिकार 1969 के अन्तर्गत इस कार्यालय मेें श्री रमेश चन्द शर्मा पुत्र रामा नन्द, गांव शिशवी फाटी निरमण्ड, तहसील निरमण्ड, जिला कुल्लू, हि0प्र0 ने उक्त अधिनियम के अन्तर्गत प्रार्थना-पत्र गुजार कर निवेदन किया है कि उसकी माता स्व0 श्रीमती रूकमणी का देहान्त दिनांक 27-12-2013 को हुआ है। उसका नाम अज्ञानता के कारण व इलाका गैर रहने से निश्चित अवधि में काट नहीं कर सका है जिस विषय उसने अपना हल्फिया भी प्रस्तुत किया है। सायल ने ग्राम पंचायत निरमण्ड में उसके परिवार रजिस्टर में नाम काटने का अनुरोध कर रखा है।
इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी भी व्यक्ति को श्री रमेश चन्द शर्मा पुत्र रामा नन्द शर्मा की माता स्व0 श्रीमती रूकमणी का नाम ग्राम पंचायत निरमण्ड में काटने के लिए एतराज हो तो वह दिनांक 12-03-2018 तक हमारे कार्यालय में हाजिर होकर लिखित व मौखिक एतराज प्रस्तुत करें उक्त तारीख के बाद कोई भी एतराज मान्य नहीं होगा और समझा जावेगा कि उक्त नाम पंचायत निरमण्ड से काटने बारे किसी का कोई एतराज नहीं है तथा सचिव ग्राम पंचायत निरमण्ड को पंजीकृत नाम काटने के आदेश पारित कर दिए जाएंगे।
