संख्या इन्ड-ए(ए) 3-2/2016.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश उद्योग विभाग में निजी सचिव, वर्ग-I (राजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध ''क'' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात :-

1. संंिक्षप्त नाम और प्र्रारम्भ.--(1) इन नियमों का संंिक्षप्त नाम हिमाचल प्रदेश उद्योग विभाग, निजी सचिव, वर्ग-I (राजपत्रित), भर्ती और प्रोन्नति नियम, 2017 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगेे।

2. निरसन और व्यावृत्तियां.--(1) अधिसूचना संख्याः इन्ड-ए(बी)5-3/2000, तारीख 24-05-2003 द्वारा अधिसूचित हिमाचल प्रदेश उद्योग विभाग, निजी सचिव वर्ग-I, राजपत्रित पद के भर्ती एवं प्रोन्नति नियम, 2003 का एतद्‌द्वारा निरसन किया जाता है। 11136 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (2) ऐसे निरसन के होते हुए भी उपरोक्त नियम 2(1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

9. परिवीक्षा की अवधि, यदि कोई हो.--(क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दे।

10. भर्ती की पद्धति-भर्ती सीधी होगी या प्रोन्नति/सैकेण्डमैंट/प्रोन्नति/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शत प्रतिशत प्रोन्नति द्वारा, ऐसा न होने पर सैकेण्डमैंट आधार पर।11137 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 11. प्रोन्नति/सैकेण्डमैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (गे्रड) जिनसे प्रोन्नति/सैकेण्डमैंट/स्थानान्तरण किया जाएगा.--निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिसका (जिनका) पांच वर्ष का नियमित सेवाकाल या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर उन निजी सहायक (सहायकोंं) में से प्रोन्नति द्वारा जिसका (जिनका) निजी सहायक और वरिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः चौदह वर्ष का नियमित सेवाकाल या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौदह वर्ष का नियमित सेवाकाल हो, जिसमें निजि सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी, उपरोक्त दोनों के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिसका (जिनका) निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक एवं कनिष्ठ वेतनमान आशुलिपिक के रूप में संयुक्ततः उन्नीस वर्ष का नियमित सेवाकाल हो या गे्रड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके उन्नीस वर्ष का नियमित सेवाकाल हो जिसमें निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगी, उपरोक्त समस्त के न होने पर निजी सहायक (सहायकों) में से प्रोन्नति द्वारा जिसका (जिनका) निजी सहायक, वरिष्ठ वेतनमान आशुलिपिक, कनिष्ठ वेतनमान आशुलिपिक एवं आशुलिपिक टंकक के रूप में संयुक्ततः चौबीस वर्ष का नियमित सेवाकाल या की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके चौबीस वर्ष का नियमित सेवाकाल हो जिसमें से निजी सहायक के रूप में दो वर्ष की अनिवार्य सेवा भी सम्मिलित होगीः (I) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगी :

परन्तु यह और कि उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष की या उससे कम की सेवा शेष रही हो। तथापि ऐसे पदधारियों को, उनकी प्रोन्नति पर, दूरस्थ/ग्रामीण क्षेत्रों में तैनात/स्थानान्तरित किया जा सकेगा :

परन्तु यह और भी कि उस अधिकारी/कर्मचारी को, जिसने जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, उसके अपने संवर्ग (काडर) में सर्वथा उसकी वरिष्ठता के अनुसार स्थानान्तरित किया जाएगा।

स्पष्टीकरण I.—उपर्युक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में ''कार्यकाल'' से, प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण II.--उपर्युक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगे :-

1. जिला लाहौल एवं स्पिति 2. चम्बा जिला का पांगी और भरमौर उप-मण्डल 3. रोहड़ू़ उप-मण्डल का डोडरा क्वार क्षेत्र 4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनीश, दरकाली और ग्राम पंचायत काशापाट।

5. जिला कुल्लू का पन्द्रह बीस परगना 6. कांगडा़ जिला के बैजनाथ उप-मण्डल का बड़़ा भंगाल क्षेत्र 7. जिला किन्नौर 8. सिरमौर जिला में उप-तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में करसोग तहसील का खनयोल-बगड़ा पटवार वृत्त, बाली चौकी उपतहसील के गाडा़ गुशैणी, मठियानी, घनयाड,़ थाची, बागी, सोमगाड और खोलानाल पटवार वृत्त, पद्धर तहसील के झारवाड,़ कुटगढ़, ग्रामन, देवगढ़, ट्रैला, रोपा, कथोग, सिलह-भडवानी, हस्तपुर, घमरेहर और भटढे़ पटवार वृा, थुनाग तहसील के चिउणी, कालीपार, मानगढ़, थाच-बगड़ा, उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त। 11138 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 स्पष्टीकरण III.--उपर्युक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगे :-

(i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना अपने गृह नगर या गृह नगर क्षेत्र के साथ लगती 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्त से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

(i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएगें और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगे :

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगी :

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे ।

स्पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन आफ वैकेन्सीज इन हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन आफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबंधों के अनुसार की गई थी :

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ स्थाईकरण के फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो, तो उसकी संरचना.--जैसी सरकार द्वारा समय- समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।11139 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--लागू नहीं। 15. सीधी भर्ती किए जाने वाले व्यक्तियों के लिए अनिवार्य अपेक्षा.--लागू नहीं।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछडे़ वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिये सेवा में आरक्षण की बाबत जारी किये गये आदेशों के अध्यधीन होगी।

17. विभागीय परीक्षा.--सेवा में प्रत्येक सदस्य को समय-समय पर यथा संशोधित, हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा पारित करनी होगी ।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

No. Ind.-A(A)3-2/2016.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Private Secretary, Class-I (Gazetted) in the Department of Industries, H.P. as per Annexure-"A" attached to this Notification, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Department of Industries, Private Secretary, Class-I (Gazetted) Recruitment and Promotion Rules, 2017.

(2) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Repeal & savings.—(1) The Himachal Pradesh, Industries Department, Private Secretary (Class-I Gazetted) Recruitment and Promotion Rules, 2003 notified vide Notification No. Ind.-A(B)5-3/2000 dated 24-05-2003 are hereby repealed.

(2) Notwithstanding such repeal any appointment made or anything done or any action taken under the rules so repealed under rule 2 (1) supra shall be deemed to have been validly made or done or taken under these rules.

In case of recruitment by promotion/secondment/transfer, grade(s) from which promotion/secondment/transfer is to be made.—By promotion from amongst the Personal Assistant(s) possessing 05 (five) years regular service or regular combined with continuous adhoc service, if any, in the grade, failing which by promotion from amongst the Personal Assistant(s) possessing 14 (fourteen) years regular service or regular combined with continuous adhoc service, if any, as Personal Assistant and Senior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, failing both by promotion from amongst the Personal Assistant(s) possessing 19 (nineteen) years regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer and Junior Scale Stenographer combined which shall also include 02 (two) years essential service as Personal Assistant, falling all by promotion from amongst the Personal Assistant(s) possessing 24 (twenty four) years regular service or regular combined with continuous adhoc service, if any, as Personal Assistant, Senior Scale Stenographer, Junior Scale Stenographer and Steno Typist combined which shall also include 02 (two) years essential service as Personal Assistant :

(I) Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult/ Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas :

Provided further that the proviso (I) supra, shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbents may be posted/transferred to remote/rural areas in their promotion :

Provided further that Officer/Official who has not served atleast one tenure in Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/ convenience.

Explanation II.—For the purpose of proviso (I) supra, the Tribal/Difficult Areas shall be as under :—

1. District Lahaul & Spiti 2. Pangi and Bharmour Sub Division of Chamba district 3. Dodra Kawar Area of Rohru Sub-Division 4. Pandrah Bis Pargana, Munish Darkali and Gram panchayat Kashapat of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District 6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District 7. District Kinnaur. 8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil in Sirmour district.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub-Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sundernagar Tehsil in Mandi district.

Explanation III.—For the purpose of proviso (I) supra, the Remote/ Rural Areas shall be as under :

(i) All stations beyond the radius of 20 Kms. from Sub-Division/Tehsil headquarter. (ii) All stations beyond the radius of 15 Kms. from State headquarter and District head quarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

11142 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be ex-servicemen recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of the Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(i) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition.—As may be constituted by the Government from time to time.

13. Circumstances under which the Himachal Pradesh Public Service Commission

(HPPSC) is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—Not applicable.

15. Selection for appointment to post by direct recruitment.—Not applicable.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribes/Other Backward Classes /other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time.

18. Powers to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

शिमला-2, 12 मार्च, 2018

संख्या यू.डी.-ए(3)-5/2012.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 (1994 का अधिनियम संख्यांक 13) की धारा 279 के साथ पठित धारा 305 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाने का प्रस्ताव करते हैं तथा इन्हं,े उक्त अधिनियम की धारा 279 की उपधारा (5) की अपेक्षा के अनुसार जनसाधारण की सूचना के लिए राजपत्र में, एतद्‌द्वारा प्रकाशित किया जाता है;

इन प्रारुप नियमों से संभाव्य प्रभावित होने वाले किसी व्यक्ति के यदि इन प्रस्तावित नियमों के सम्बन्ध में कोई सुझाव या आक्षेप है/हैं तो वह उसे/उन्हें इनके राजपत्र में प्रकाशित होने की तारीख से पन्द्रह दिन की अवधि के भीतर, अतिरिक्त मुख्य सचिव (शहरी विकास), हिमाचल प्रदेश सरकार, शिमला-2 को भेज सकेगा ;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप(पों) या सुझाव (वों), यदि कोई है/हों, पर इन्हें अन्तिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम और लागू होना.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगरपालिका कार्यकारी अधिकारी/सचिव (भर्ती, प्रोन्नति और सेवा की अन्य शर्तें) नियम, 2018 है ।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगें ।

(3) ये नियम, उपाबन्ध-I के स्तम्भ संख्या 2 में विनिर्दिष्ट पदों को लागू होंगे ।

2. परिभाषाएं.--(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 अभिप्रेत है;

(ख) ''उपाबन्ध'' से, इन नियमों से संलग्न उपाबन्ध अभिप्रेत है;

(ग) ''नियुक्ति प्राधिकारी'' से ऐसा प्राधिकारी अभिप्रेत है जिसे सेवा के प्रवर्ग की बाबत इन नियमों के उपाबन्ध -'II' में नियुक्ति प्राधिकारी निर्दिष्ट किया गया है;

(घ) ''निदेशक'' से, निदेशक, शहरी विकास विभाग, हिमाचल प्रदेश अभिप्रेत है;

है;

(च) ''सरकार'' से हिमाचल प्रदेश सरकार अभिप्रेत है;

(छ) ''नगरपालिका'' से-

(i) हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 के अधीन गठित नगर पंचायत और नगरपालिका परिषद्‌ अभिप्रेत है; और

(ii) हिमाचल प्रदेश नगर निगम अधिनियम,1994 के अधीन गठित नगर निगम अभिप्रेत है ;

(ज) ''सदस्य'' से, सेवा का सदस्य अभिप्रेत है; और

(झ) ''सेवा" से हिमाचल प्र्रदेश नगरपालिका सेवा अधिनियम,1994, हिमाचल प्रदेश नगर निगम अधिनियम, 1994 और हिमाचल प्रदेश नगरपालिका अधिनियम 1994, के उपबन्धों के अधीन सरकार द्वारा, इन नियमों के अधीन विनिर्दिष्ट रीति गठित, नगरपालिका सेवा अभिप्रेत है ;

स्पष्टीकरण.--सेवा के अन्तर्गत परिवीक्षाधीन व्यक्ति या शिक्षु (अप्रेन्टिस) के रुप में की गई सेवा है किन्तु ऐसी सेवा बिना किसी कार्यभंग के स्थायीकरण के अनुसरण में है और जिसके अन्तर्गत कार्यग्रहण अवधि भी है।

(2) अन्य समस्त शब्दों और पदाें के, जो इन नियमों में प्रयुक्त है किन्तु परिभाषित नहीं हैं, वही अर्थ होंगें जो अधिनियम में क्रमशः उनके हैं ।

3. सेवा के लिए नियुक्त किए जाने वाले व्यक्तियों की राष्ट्रीयता, अधिवास और चरित्र.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है ।

4. पदों की संख्या, वर्गीकरण और वेतनमान.—(1) विभिन्न पदों के लिए, पदों की संख्या और वेतनमान उपाबन्ध-1 के स्तम्भ (3) और (4) में यथा विनिर्दिष्ट होंगे या जैसे सरकार द्वारा समय-समय पर अधिसूचित किए जाएं।

(2) पदों का वर्गीकरण निम्नानुसार होगा -

5. भर्ती और प्रोन्नति.--(1) भर्ती, प्रोन्नति और अन्य सम्बद्ध मामलों की पद्धति इन नियमों के उपाबंध-I के स्तंभ (5) से (9) में यथा विनिर्दिष्ट होगी ।

(2) सीधी भर्ती उप-नियम (3) के अधीन गठित चयन समिति की सिफारिशों पर नियुक्ति प्राधिकारी द्वारा की जाएगी ।

(3) सरकार, समय-समय पर अधिसूचना द्वारा, कम से कम तीन सदस्यों वाली चयन समिति का गठन कर सकेगी ।

(4) उप नियम (2) के अधीन भर्ती करते समय, अनुसूचित जाति, अनुसूचित जनजाति, पिछड़े वर्गों के सदस्यों और इसके अधीन सेवाओं के सम्बन्ध में किसी अन्य प्रवर्ग के लिए सेवा में आरक्षण की बाबत सरकार के साधारण अनुदेश सेवाओं को लागू होंगे। 11154 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (5) किसी भी पदधारी को, जो प्रोन्नति छोड़ देता है, दो वर्ष की अवधि के लिए प्रोन्नति से विवर्जित कर दिया जाएगा और उसे उन सभी से पंक्ति में नीचे रखा जाएगा जिन्हें इस अवधि के दौरान प्रोन्नत किया गया है।

(6) सेवा में नियुक्त किसी भी व्यक्ति को राज्य सरकार के अधीन किसी भी सिविल पद के लिए नियुक्त किया गया नहीं समझा जाएगा ।

(7) संविदा के आधार पर भर्ती उपाबन्ध-II और III में किए गए उपबन्धों के अनुसार की जाएगी । 6. प्रवेश की आयु.--किसी भी व्यक्ति को सीधी भर्ती द्वारा सेवा के लिए नियुक्त नहीं किया जाएगा यदि वह 18 वर्ष से कम आयु का है और 45 वर्ष से अधिक आयु का है या ऐसी आयु का है जो सरकारी सेवा में समतुल्य पदों के लिए समय-समय पर सरकार द्वारा विनिर्दिष्ट की जाए :

परन्तु अनुसूचित जाति, अनुसूचित जनजाति और अन्य पिछड़े वर्गों से सम्बंधित अभ्र्यर्थियों की दशा में अधिकतम आयु सीमा, ऐसी होगी जैसी सरकार द्वारा समय-समय पर नियत की जाए ।

7. शारीरिक उपयुक्तता.--सीधी भर्ती द्वारा सेवा के लिए नियुक्त व्यक्ति, सेवा में कार्यग्रहण करने से पूर्व, सरकारी चिकित्सा व्यवसायी से शारीरिक उपयुक्तता का प्रमाण-पत्र प्रस्तुत करेगा । ऐसा व्यक्ति परीक्षण करवाने से पूर्व, सरकारी सेवकों के लिए विनिर्दिष्ट प्ररुप में घोषणा करेगा और उसे हस्ताक्षरित करेगा और चिकित्सा अधिकारी उसका परीक्षण करेगा और सरकारी सेवकों के लिए विनिर्दिष्ट प्ररूप में प्रमाण-पत्र प्रस्तुत करेगा ।

8. निरर्हताएं.—कोई भी व्यक्ति जिसनेे,--

(कंं) जीवित पति या पत्नी के रहते हुए विवाह किया है ;

(ख) जीवित पति या पत्नी के रहते हुए किसी अन्य व्यक्ति के साथ विवाह किया है ; किसी सेवा पर नियुक्ति के लिए पात्र नहीं होगा :

परन्तु यदि सरकार का समाधान हो जाता है समाधान हो जाने पर कि ऐसा विवाह ऐसे व्यक्ति को लागू स्वीय विधि के अधीन या किसी अन्य उचित आधार पर, अनुज्ञेय है तो यह किसी व्यक्ति को इन नियम के प्रर्वतन से छूट दे सकेगी ।

9. स्थानांतरण का दायित्व.--सेवा का सदस्य हिमाचल प्रदेश राज्य के किसी भी स्थान पर सेवा करने के लिए दायी होगा ।

10. परिवीक्षा.--(1) सेवा में किसी पद पर नियुक्त कोई व्यक्ति दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा और संविदा पर नियुक्त व्यक्ति के लिए कोई परिवीक्षा नहीं होगी यदिः-

(क) ऐसी नियुक्ति के पश्चात्‌ कोई अवधि तत्स्थानी या उच्चतर पद पर सैकेण्डमैंट पर बिताई गई हो तो उसकी गणना परिवीक्षा की अवधि में की जाएगी; और

(ख) किसी स्थानन नियुक्ति की अवधि परिवीक्षा पर बिताई गई अवधि के रूप में गणना में ली जाएगी किन्तु ऐसा व्यक्ति, जिसने इस प्रकार स्थानन नहीं किया है, परिवीक्षा के लिए विनिर्दिष्ट अवधि के पूर्ण हो जाने पर स्थायीकरण के लिए हकदार नहीं होगा जब तक कि उसकी नियुक्ति स्थायी पद के विरुद्ध न की गई हो ।

(2) यदि नियुक्ति प्राधिकारी की राय में, सेवा में किसी भी पद पर नियुक्त व्यक्ति का कार्य या आचरण परिवीक्षा की अवधि के दौरान संतोषजनक नहीं है, तो वह-11155 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (क) उसे उसकी सेवाओं से अभियुक्ति दे सकेगा, यदि ऐसा व्यक्ति सीधी भर्ती द्वारा नियुक्त हुआ है; (ख) यदि ऐसा व्यक्ति प्रोन्नति द्वारा नियुक्त हुआ है, तो वह-

(i) उसे उसके पूर्व पद पर प्रतिवर्तित कर सकेगा; या

(ii) उसके साथ ऐसा व्यवहार कर सकेगा जैसा पूर्ववर्ती नियुक्ति के निबन्धन और शर्तों में इसके लिए उपबन्धित हाें, या

(iii) उसकी परिवीक्षा की अवधि को एक वर्ष के लिए बढ़ा सकेगा और तत्पश्चात्‌ ऐसा आदेश पारित कर सकेगा जो पहली परिवीक्षा की अवधि के अवसान के पश्चात्‌ पारित किया गया होताः

परन्तु परिवीक्षा की कुल अवधि, यदि कोई है, तीन वर्ष से अधिक नहीं होगी।

(3) व्यक्ति की परिवीक्षा की अवधि के पूर्ण होने पर, नियुक्ति प्राधिकारी, की राय में यदि उसका कार्य और आचरण संतोषजनक रहा है, तो वह

(i) ऐसे व्यक्ति का उसकी नियुक्ति की तारीख से स्थायीकरण करेगा, यदि वह स्थायी रिक्ति के विरुद्ध नियुक्त हुआ है ; या

(ii) ऐसे व्यक्ति को स्थायी नियुक्ति के, होने की तारीख से स्थायी करेगा यदि वह अस्थायी रिक्ति के विरुद्व नियुक्त हुआ है; या

(iii) ऐसी घोषणा करेगा कि उसने परिवीक्षा की अवधि संतोषजनक रूप से पूर्ण कर ली है यदि कोई स्थायी रिक्ति नहींं है ।

11. सेवा के सदस्यों की वरिष्ठता.--सेवाओं के सदस्यों की पारस्परिक वरिष्ठता प्रत्येक प्रवर्ग के लिए उक्त प्रवर्ग में, पद पर उनके लगातार सेवाकाल द्वारा पृथक्‌तया अवधारित की जाएगी :

परन्तु सीधी भर्ती द्वारा नियुक्त सदस्यों की दशा मेंं, उनकी पारस्परिक वरिष्ठता, यथास्थिति, सेवा चयन समिति या किसी अन्य भर्ती प्राधिकरण द्वारा अवधारित योग्यताक्रम में होगी।

परन्तु यह और कि एक ही तारीख को दो या अधिक सदस्यों की नियुक्ति की दशा में सीधी भर्ती द्वारा नियुक्त सदस्य अन्यथा नियुक्त सदस्य से वरिष्ठ होगा ।

12. दण्ड और अपीलें.--इन नियमों के प्रयोजन के लिए अनुशासन प्राधिकारी और अपील प्राधिकारी वह होगा जो इन नियमों के उपाबंध-II में विनिर्दिष्ट किया गया है।

13. विभागीय परीक्षा.--सरकार राजपत्र, हिमाचल प्रदेश में अधिसूचना द्वारा निदेश दे सकेगी कि किसी पद या पदों के प्रवर्ग पर इसमें विनिर्दिष्ट नियुक्त व्यक्ति(व्यक्तियों) को विभागीय परीक्षा उत्तीर्ण करनी अपेक्षित होगी, जिसके लिए ब्योरा और पाठ्‌यक्रम, और इसे उत्र्तीण करने में असफल रहने के परिणाम भी उक्त अधिसूचना में विनिर्दिष्ट किए जाएंगे ।

14. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, आदेश द्वारा, कारणों को लिखित में अभिलिखित करके, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्तियों के प्रवर्ग की बाबत शिथिल कर सकेगी ।

15. निर्वचन.--यदि नियमों के निर्वचन की बाबत कोई शंका उत्पन्न होती है, तो इसे सरकार को निर्दिष्ट किया जाएगा जिसका विनिश्चय इस पर अंतिम होगा । 11156 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 16. निरसन और व्यावृत्तियां.--(1) अधिसूचना संख्या एल.एस.जी.-ए(3)-5/96-ए,तारीख 19-8-1997 द्वारा अधिसूचित और तारीख 1-9-1997 को राजपत्र (असाधारण), हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश नगरपालिकाएं, कार्यकारी अधिकारी/सचिव (भर्ती, प्रोन्नति और सेवा की अन्य शर्तें) नियम, 1997 और इन नियमों के ठीक प्रारम्भ से पूर्व इन नगरपालिकाओं में प्रवृा नगरपालिका सेवाओं की बाबत कोई अन्य नियम, विनियम या किन्हीं उपविधियों का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपरोक्त उप नियम (1) के अधीन इस प्रकार निरसित नियमों, विनियमों और उपविधियों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी ।

संविदा के आधार पर सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयनः

इन नियमों में किसी बात के होते हुए भी, पद पर संविदात्मक नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगी :-

(I) संकल्पनाः

(क) इस पॉलिसी के अधीन शहरी विकास विभाग, हिमाचल प्रदेश में कार्यकारी अधिकारी/सचिव को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगा :

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए निदेशक (शहरी विकास), हिमाचल प्रदेश यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। 11158 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (ख) पदों की भर्ती : सचिव (शहरी विकास), हिमाचल प्रदेश सरकार रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ रिक्त पदों के ब्योरे कम से कम दो अग्रणी समाचार-पत्रों में विज्ञापित करवाएगा और विर्निदिष्ट अर्हताएं रखने वाले तथा इन नियमों में यथाविहित अन्य पात्रता शर्तें पूर्ण करने वाले अभ्यर्थियों से आवेदन आमंत्रित करेगा। (ग) चयन इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा ।

(II) संविदात्मक उपलब्धियां :

संविदा पर नियुक्त कार्यकारी अधिकारी/सचिव को ''सुसंगत पे बैण्ड में नियमित आधार पर नियुक्त/ कार्यरत कर्मचारियों के तत्स्थानी संवर्ग को लागू पे बैण्ड का न्यूनतम जमा ग्रेड पे के बराबर समेकित नियत संविदात्मक रकम संदा की जाएगी''। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष (वर्षों), के लिए संविदात्मक उपलब्धियों में 15100 (कार्यकारी अधिकारी) और 14900 (सचिव) रुपए (पद के पे बैण्ड के न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) की रकम वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी ।

(III) नियुक्ति/अनुशासन प्राधिकारी :

सचिव (शहरी विकास), हिमाचल प्रदेश सरकार नियुक्ति और अनुशासन प्राधिकारी होगा। (IV) चयन प्रकियाः

संविदा नियुक्ति की दशा में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि ऐसा करना आवश्यक या समीचीन समझा जाए तो लिखित परीक्षा के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, सम्बद्ध भर्ती अभिकरण द्वारा अवधारित किया जाएगा। (V) संविदात्मक नियुक्तियों के लिए चयन समिति :

जैसी सम्बद्ध भर्ती अभिकरण द्वारा समय-समय पर गठित की जाए ।

(VI) करार :

अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-'क' के अनुसार करार हस्ताक्षरित करना होगा ।

(VII) निबन्धन और शर्तें :

(क) संविदा पर नियुक्त व्यक्ति को ''सुसंगत पे बैण्ड में नियमित आधार पर नियुक्त/कार्यरत कर्मचारियों के तत्स्थानी संवर्ग को लागू पे बैण्ड का न्यूनतम जमा ग्रेड पे के बराबर नियत संविदात्मक रकम संदत्त की जाएगी और कोई अन्य सहबद्ध प्रसुविधाएं जैसे की वरिष्ठ/चयन वेतनमान आदि नहीं दिया जाएगा। यदि संविदा में एक वर्ष से अधिक की बढ़ौतरी की जाती है तो पश्चात्‌वर्ती वर्ष (वर्षों), के लिए संविदात्मक उपलब्धियों में 15100 (कार्यकारी अधिकारी) और 14900 (सचिव) रुपए (पद के पे बैण्ड के न्यूनतम जमा ग्रेड पे का तीन प्रतिशत) की रकम वार्षिक वृद्धि के रूप में अनुज्ञात की जाएगी ।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी । यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी ।11159 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (ग) संविदा पर नियुक्त व्यक्ति, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश का हकदार होगा/होगी । तथापि संविदा पर नियुक्त कर्मचारी एक सौ अस्सी दिन के प्रसूति अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश के लिए भी हकदार होगा/होगी । संविदा पर नियुक्त व्यक्ति चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञेय नहीं होगा :

परन्तु अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हाें तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगा :

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधारों पर अपेक्षित हो।

(च) चयनित अभ्यर्थी को सरकारी/ रजिस्ट्रीकृत चिकित्सा व्यवसायी से अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। बारह सप्ताह से अधिक गर्भवती महिला अभ्यर्थी प्रसव होने तक अस्थायी तौर पर अनुपयुक्त समझी जाएगी। ऐसी महिला अभ्यर्थी का किसी प्राधिकृत चिकित्सा अधिकारी/व्यवसायी से उपयुक्तता के लिए पुनः परीक्षण करवाया जाएगा।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कत्र्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0 आर0-एस0 आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों आदि के लिए हकदार होंगे।

4. नियन्त्रक प्राधिकारी के अनुमोदन के बिना कत्र्तव्य (डयूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

URBAN DEVELOPMENT DEPARTMENT

NOTIFICATION

Shimla-2, the 12th March, 2018

No.UD-A(3)-5/2012.—In exercise of the powers conferred by sub-section 1 of section 305 read with section 279 of the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994), the Governor of Himachal Pradesh proposes to make the following rules and the same are hereby published in the Official Gazette for the information of the public as required under sub-section (5) of section 279 of the said Act;

If any person likely to be affected by these draft rules, has any objection(s) or suggestion(s) to make in relation to the proposed rules, he may send the same to the Additional Chief Secretary (Urban Development) to the Government of Himachal Pradesh, Shimla-2, within the period of 15 days from the publication of the same in the Official Gazette;

Objection(s) or suggestion(s), if any, received within the above stipulated period shall be taken into consideration by the State Government before finalizing the same, namely:—

1. Short title and application.— (i) These rules may be called the Himachal Pradesh Municipalities Executive Officer/Secretary (Recruitment, Promotion and other conditions of Services) Rules, 2018.

(iii) These rules shall apply to the posts specified in Column No. 2 of Annexure-I.

2. Definitions.—(1) In these rules unless the context otherwise requires,—

(a) 'Act' means the Himachal Pradesh Municipal Act, 1994 ;

(b) 'Annexure' means an Annexure appended to these rules ;

(c) 'Appointing Authority' means the authority indicated as the Appointing Authority in Annexure-II of these rules in respect of the category of service ;

(d) 'Director' means the Director, Urban Development Department, Himachal Pradesh ;

(e) 'direct recruitment' means an appointment by selection other than by promotion/transfer/secondment;

(f) 'Government' means the Government of Himachal Pradesh ;

(g) 'Municipality' means.—

(i) a Nagar Panchayat and Municipal Council constituted under the Himachal Pradesh Municipal Act, 1994; and

(ii) a Municipal Corporation constituted under the Himachal Pradesh Municipal Corporation Act, 1994 ;

(h) 'member' means a member of the service ; and

(i) 'Service' means a municipal service constituted by the Government under the provisions of the Himachal Pradesh Municipal Services Act, 1994, the Himachal Pradesh Municipal Corporation Act, 1994 and the Himachal Pradesh Municipal Act, 1994 in the manner specified under these rules.

Explanation.—–Service includes the service as a probationer or apprentice provided that such service is followed by confirmation without any break and shall also include joining time.

(2) All other words and expressions used herein but not defined shall have the same meanings respectively as assigned to them in the Act.

3. Nationality, Domicile and Character of persons to be appointed to a service.—The candidate for appointment to any service or post must be a citizen of India.

4. Number of posts, Classification and scales of pay.—(1) The number of posts and scales of pay of various posts shall be as specified in Column (3) & (4) of Annexure-I or as may be notified by the Government from time to time.

(2) The classification of the posts shall be as under :—

5. Recruitment and Promotion.—(1) The method of recruitment, promotion and other matters connected therewith shall be as specified in Columns (5) to (9) of Annexure-I of these rules.

(2) The direct recruitment shall be made by appointing authority on the recommendations of a Selection Committee constituted under sub-rule (3).

(3) The Government may, from time to time, by notification, constitute a Selection Committee consisting of at least three members.

(4) While making recruitment under sub–rule (2) the general instructions of the Government regarding reservation in service for members of the Scheduled Castes, Scheduled Tribes, Backward Classes and for any other category in relation to the services under it shall be applicable to the services.

(5) An incumbent who foregoes promotion, shall be debarred from promotion for a period of 2 years and shall rank junior to all those who may have been promoted during this period.

(6) A person appointed to the service shall not be deemed to have been appointed to any civil post under the State Government.

(7) Recruitment on contract basis shall be made in accordance with the provisions made in the Annexure–II and III.

6. Age on entry.—No person shall be appointed to a service by direct recruitment if he is less than 18 years of age and more than 45 years of age or as specified by the Government for the equivalent posts in Government service from time to time :

Provided that in the case of candidates belonging to the Scheduled Castes, Scheduled Tribes and other Backward Classes, the maximum age limit shall be such as may be fixed by the Government from time to time.

7. Physical Fitness.—A person appointed to the service by direct recruitment shall produce a certificate of physical fitness from a Government Medical Practitioner before joining the service. Such person shall, before being examined, make and sign declaration in Form specified for Government servants and Medical Officer shall examine him and furnish a certificate in Form specified in the case of Government servants.

8. Disqualifications.— No person.—

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living has entered into or contracted a marriage with any other person;

shall be eligible for appointment to a service :

Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person or on the basis of any other justified grounds, exempt any person from operation of this rule.

11164 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 9. Liability to transfer.—Member of the service shall be liable to serve at any place in the State of Himachal Pradesh.

10. Probation.—(1) A person appointed to any post in a service shall remain on probation for a period of two years and there will be no probation period for a contract appointee:

provided that—

(a) any period, after such appointment, spent on secondment on a corresponding or a higher post shall count towards the period of probation; and

(b) any period of officiating appointment shall be reckoned as the period spent on probation, but no person who has so officiated shall, on the completion of the specified period of probation, be entitled to be confirmed, unless he has been appointed against a permanent vacancy.

(2) If, in the opinion of the Appointing Authority, the work, or conduct of a person appointed to any post in the service during the period of his probation, is not satisfactory, it may – (a) if such person is appointed by direct recruitment, dispense with his services ;

(b) if such person is appointed by promotion—

(i) revert him to his former post ; or

(ii) deal with him in such a manner as the terms and conditions of the previous appointment provide for ; or

(iii) extend his period of probation for one year and thereafter pass such order as it would have passed on the expiry of the first period of probation :

Provided that the total period of probation including extension, if any, shall not exceed three years.

(3) On the completion of the period of probation of person, the Appointing Authority may, if his work or conduct has, in its opinion, been satisfactory.—

(i) confirm such person from the date of his appointment if appointed against a permanent vacancy ; or

(ii) Confirm such person from the date from which a permanent vacancy occurs, if appointed against a temporary vacancy ; or

(iii) declare that he has completed his probation satisfactorily, if there is no permanent vacancy.

11. Seniority of the members of the service.—The seniority inter-se of the members of the services shall be determined separately for every category by the length of their continuous service on a post in the said category :

Provided that in the case of members appointed by direct recruitment, their inter-se- seniority shall be in the order of merit determined by the service selection committee or any other recruiting authority, as the case may be:—

Provided further that in the case of two or more members appointed on the same date, a member appointed by direct recruitment shall be senior to a member appointed otherwise.

12. Punishment and Appeals.— The Disciplinary Authority and Appellate Authority for the purpose of these rules Annexure-III shall be as specified in Annexure-II to these rules.

13. Departmental Examination.—The Government may by a notification published in the Rajpatra(e-Gezette), Himachal Pradesh direct that the person(s) appointed to a post or category of posts as may be specified therein shall be required to pass a departmental examination, the details and syllabus for which and consequences for failure to pass it, shall also be specified in the said notification.

14. Power to relax.—Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

15. Interpretation.—If any doubt arises relating to the interpretation of the rules, it shall be referred to the Government whose decision thereon shall be final.

16. Repeal and savings.—(1) The Himachal Pradesh Municipalities Executive Officer/ Secretary (Recruitment, Promotion and other conditions of Services) Rules, 1997, notified vide Notification No. LSG.A(3)-5/96-A, dated 19-8-1997 and published in the Rajpatra, Himachal Pradesh (extraordinary) dated 1-9-1997 and any rules, regulations and bye-laws relating to the municipal services in force in the municipalities immediately before the commencement of these rules, are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or any thing done or any action taken under the rules, regulations or bye-laws so repealed under sub-rule (1) supra, shall be deemed to have been validly made or done or taken under these rules.

Selection for appointment to the post by direct recruitment on contract basis Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below :—

(I) CONCEPT.—(a) Under this policy the Executive Officer/Secretary in the Department of Urban Department, Himachal Pradesh will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extention/renewal of contract period on year to year basis, the Director (Urban Development) Himachal Pradesh shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(b) Filling up of posts.—

The Secretary (Urban Development) to the Government of Himachal Pradesh after obtaining the approval of the the Government to fill up the posts on contract basis will advertise the details of the vacant posts in atleast two leading newspapers and invite applications from candidates having the specified qualifications and fulfilling the other eligibility conditions as prescribed in these rules.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these rules.

(II) CONTRACTUAL EMOLUMENTS.—The Executive Officers/ Secretaries appointed on contract basis will be paid consolidated fixed contractual amount "equal to the minimum of the pay band plus grade pay, applicable to the corresponding cadre of employees, appointed/working on a regular basis, in the relevant pay band". An amount of Rs. 15,100 (Executive Officer) or 14,900 (Secretary) (3% of minimum of pay band plus grad pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed, if contract is extended beyond one year.

(III) APPOINTING/DISCIPLINARY AUTHORITY:—The Secretary (Urban Development) to the Government of Himachal Pradesh will be appointing and disciplinary authority.

(IV) SELECTION PROCESS:—Selection for appointment to the post in the case of Contract Appointment will be made on the basis of viva-voce test or if considered necessary or expedient by a written test or practical test the standard/syllabus etc. of which will be determined by the concerned recruiting agency.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.— As may be constituted by the concerned recruiting agency.

(VI) AGREEMENT.—After selection of a candidate, he/she shall sign an agreement as per Annexure-A.

11168 राजपत्र, हिमाचल प्रदेश, 13 मार्च, 2018/22 फाल्गुन, 1939 (VII) TERMS & CONDITIONS.—(a) The contractual appointee will be paid fixed contractual amount equal to the minimum of the pay band plus grade pay, applicable to the corresponding cadre of employees, appointed/working on a regular basis, in the relevant pay band and no other allied benefits such as senior/selection scales etc. will be given. An amount of Rs. 15,100 (Executive Officer) or 14,900 (Secretary) ( 3% of minimum of pay band plus grad pay of the post) as annual increase in contractual emoluments for the subsequent year(s) will be allowed, if contract is extended beyond one year.

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/conduct of the contract appointee is not found satisfactory.

(c) Contract Appointee will be entitled for one day casual leave after putting one month service. However, the contract employee will also be entitled for 180 days of maternity leave, 10 days medical leave and 5 days special leave. He/she will not be entitled for medical Reimbursement and LTC etc. No leave of any kind except above is admissible to the contract appointee:

Provided that the un-availed casual leave, medical leave and special leave can be accumulated up to the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from the duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for the contractual amount for this period of absence from duty :

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) Contractual Appointee on contract basis who have completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness from a Government Medical Practitioner. Women candidate pregnant beyond 12 weeks will stand temporally unfit till the confinement is over. The women candidate will be re-examined for fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart officials at the minimum of pay scale.

(h) Provisions of service rules like FRSR, Leave Rules, GPF Rules and Conduct Rules as are applicable in case of regular employees will not be applicable in case of contract appointee. They will be entitled for emoluments etc. as detailed in this column.
