No. Rev.Stamp(M)1/2017.—In exercise of the powers conferred by Rule 12 and 13 of the Himachal Pradesh Court Fee (e-stamping) Rules, 2015, the Chief Controlling Authority Financial 266-राजपत्र/2018-27-03-2018 (11569) 11570 राजपत्र, हिमाचल प्रदेश, 27 मार्च, 2018/6 चैत्र, 1940 Commissioner (Revenue), Government of Himachal Pradesh authorise all the stamp vendors in Himachal Pradesh, as "Authorized Collection Centres" (ACCs) of the Central Record Keeping Agency to act as an intermediary between the Central Record Keeping Agency and the court fee payer, for collection of court fee and issuing the e- Court fee certificate on the following terms and conditions :—

1. As per the Himachal Pradesh Court Fee (e-stamping) Rules, 2015, concerned Deputy Commissioner of the District on the behalf of Authorised stamp vendors shall make an agreement with the Central Record Keeping Agency i.e. the Manager, Stock Holding Corporation of India Limited (SHCIL). However, before entering into agreement, the Deputy Commissioner concerned shall call for applications from all the stamp vendors and on receipt of such applications from interested stamp vendors shall proceed to enter into the said agreement.

2. The service charges or commission or fee etc. payable to the Authorized Collection Centres shall be decided between the Central Record Keeping Agency and the Authorized Collection Centres. The Central Record Keeping Agency will decide/pay uniform commission to the stamp vendors through concerned Deputy Commissioner on monthly basis.

3. Other terms and conditions will also be applicable as per the Himachal Pradesh Court Fee (e-Stamping) Rules, 2015.

(R&R) C (B) 11-4/2016.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consulation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Kanungo, Class-III (Non-Gazetted) in the Himachal Pradesh, Relief & Rehabilitation Department as per Annexure "A" attached to this notification namely :—

1. Short title and Commencement.—(i) These Rules may be called the Himachal Pradesh Relief and Rehabilitation Department, Kanungo, Class-III (Non-Gazetted) Recuitment and Promotion Rules, 2017.

(ii) These rules shall come into force from the date of publication in the Rajpatra, Himachal Pradesh.

2. Repeal and savings.—(i) The Himachal Pradesh, Relief & Rehabilitation Department (Class-III services) Recruitment and Promotion Rules, 1999, notified vide this Department Notification No. Rev.(RR)A(3) 1/83 dated 19-07-1999 amended from time to time are hereby.

(ii) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule (1) supra shall be deemed to have been validly made or done or taken under these rules.

ANNEXURE 'A' RECRUITMENT AND PROMOTION RULES FOR THE POST OF KANUNGO CLASS-III (NON-GAZTTED) IN THE DEPARTMENT OF RELIEF AND REHABILITATION HIMACHAL PRADESH

1. Name of the post.—Kanungo

2. Number of posts.—Two (2)

3. Classification.—Class-III (Non Gazetted)

4. Scale of pay.—Pay band Rs.10300-34800+Rs. 4200 Grade Pay.

5. Whether "Selection" post or "Non-Selection" post.—Non-selection.

6. Age for direct recruitment.—Not applicable.

7. Minimum Education and other qualification required for direct recruit (s).—(a) Essential Qualification (s).—Not applicable.

(b) Desirable Qualification (s):—Not applicable.

8. Whether age and Educational qualification (s) prescribed for direct recruit (s)

will apply in the case of promotee(s).—Age.—Not applicable.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/ secondment/transfer and the percentage of post(s) to be filled in by various methods.—(a) 50% by promotion failing which on secondment basis.

In case of recruitment by promotion/secordment/transfer grade for which promotion/secondment/transfer is to be made.—(i) 50% by promotion from amongst Patwari who have qualified the departmental examination of Kanungo, with six years regular service or regular combined with continues adhoc service, if any in the grade falling which on second basis from amongst the Kanungos of other department in the Sate working in the identical pay scale.

(ii) 50% secondment basis/by transfer basis from amongst the Kanungos of other Departments in the State working in the identical pay scale.

Every member of the service shall be required to undergo one year Department training as prescribed under H.P. Land Record manual within two years of selection.

Provided that for filling up the posts of Kanungo the following 02 points "post" based roster shall be followed :—

Note.—As and when the representation by both the categories is achieved as per given percentage, the vacancy shall be filled up from category which vacates the post :

Explanation III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as under :

(i) All stations beyond the radius of 20 Kms. From Sub-Division/Tehsil Headquarter.

(ii) All station beyond the radius of 15 Kms. From the State headquarter and District Headquarters where bus service is not available and on foot journey is more than 3 (Three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(I) In all cases of promotion the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken in to account forwards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration;

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules or the post whichever is less.

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also bbe deemed to be ineligible for consideration for such promotion.

Explanation:—The last proviso shall not render the junior incumbents ineligible or consideration for promotion if the senior ineligible persons happened to be Ex-servicemen recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies State Non-Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of Rule-3 of the Ex-servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of sonority thereunder.

(i) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any prior to the regular appointment against such posts shall be taken into account towards the length of service if the adhoc appointment/promotion had been made after

(1) Provided that for the purpose of promotion every employee shall have to serve at-least one term in the Tribal/Difficult/Hard areas and remote/rural areas subject to adequate number of post (s) available in such areas:

Provided further that the proviso (1) supra shall not be applicable in the case of those employees who have five years of less service, left for superannuation. However, such incumbents may be posted/transferred to remote/rural areas in their promotion.

Provided further that Officer/Official who has not served at least one tenure in Tribal/Difficult/Hard areas and remote/ rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso (1) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

1. District Lahaul & Spiti.

2. Pangi and Bharmour Sub Division of Chamba District.

3. Dodra Kawar area of Rohru Sub-Division.

4. Pandrah Bis Pargana Munish Darkali and Gram panchayat Kashapat of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District.

6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District.

7. District Kinnaur.

8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and sangna patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmour District.

13. Circumstances under which the Himachal Pradesh Public Service commission

(HPPSC) is to be consulted in making recruitments.—As required under the Law.

14. Essential requirement for a correct recruitment.—Not applicable.

15. Selection for appointment to post by direct recruitment.—Not Applicable.

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled caste Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh government from time-to time.

17. Departmental Examination.—Every member of the service shall pass a departmental Examination as prescribed in the H.P. Departmental Examination Rules, 1997 as amended from time to time.

18. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing and in consultation with the H.P. Public service Commission relax any of the provisions of these Rules with respect to any class or category of person(s) post(s).
