HIMACHAL PRADESH ELECTRICITY REGULATORY COMMISSION, SHIMLA

NOTIFICATION

No. HPERC/428.—WHEREAS, the Himachal Pradesh Electricity Regulatory Commission (hereinafter referred as "the Commission") formulated the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2017 (hereinafter referred as "RE Tariff Regulations, 2017"), published in the Rajpatra, Himachal Pradesh, dated 23rd November, 2017;

AND WHEREAS the RE Tariff Regulations, 2017, specify that the said regulations shall remain in-force upto 31st March, 2020 and control period thereunder for SHPs shall end on 31st March, 2020;

¹¹⁶²⁸ राजपत्र, हिमाचल प्रदेश, 31 मार्च, 2018/10 चैत्र, 1940 AND WHEREAS the Commission observes that the stakeholders including SHP developers, State Government are in favour of reviewing the Hydro Policy of the State Government and the Commission is also not averse to such review by the State Government;

AND WHEREAS the State Government i.e. Department of MPP & Power vide letter No. MPP-F(1)-1/2005–IV, dated 12-02-2018 had conveyed that as per the deliberation in the meeting with Bonafide Himachali Power Producers Association on 09-02-2018, many issues and grievances have been raised by the Power Producers on which State Government intends to take holistic view by way of re-examining the State Power Policy, 2006 and has further requested to pend the tariff determination process or start the process denovo in due course of time;

AND WHEREAS the Commission, after having understood that the State Government intends to re-examine the State Hydro Policy on priority, finds it appropriate to restrict the period of applicability as well as control period under the RE Tariff Regulations, 2017 suitably so as to provide indication to all the stakeholders from which the Commission intends to put in place the new regulations to be formulated after duly taking into the account the provision of the amended/new hydro policy of the State;

NOW, THEREFORE, in exercise of the powers conferred under sub-section (1) of section 61, sub-section(1) of section 62, clauses (a), (b) and (e) of sub-section (1) of section 86 and clause (zd) of sub-section (2) of section 181, of the Electricity Act, 2003 (36 of 2003), read with section 21 of the General Clauses Act,1897 (10 of 1897), and all other powers enabling it in this behalf, the Commission proposes to amend the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) Regulations, 2017 and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the draft amendment regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft amendment regulations will be taken into consideration after the expiry of thirty (30) days from the date of publication of this notification in the Rajpatra, Himachal Pradesh, together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Promotion of Generation from the Renewable Energy Sources and Terms and Conditions for Tariff Determination) (First Amendment) Regulations, 2018.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

31 मार्च, 2018 को समाप्त होने वाले वित्तीय वर्ष के लिए हिमाचल प्रदेश राज्य की संचित निधि में से सेवाओं के लिए कतिपय और धनराशियों के संदाय को प्राधिकृत करने और उनका विनियोग करने के लिए अधिनियम ।

भारत गणराज्य के उनहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :--

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग अधिनियम, 2018 है । 2. हिमाचल प्रदेश राज्य की संचित निधि में से वित्तीय वर्ष 2017-2018 के लिए ` 33,27,47,34,196 की और राशि जारी करना.--हिमाचल प्रदेश राज्य की संचित निधि में से अनुसूची के तृतीय स्तम्भ में विनिर्दिष्ट से अनधिक धनराशियां, जिनका योग केवल ` 33,27,47,34,196 (तीन हजार तीन सौ सत्ताईस करोड़, सैंतालीस लाख चौंतीस हजार एक सौ छियानवे रुपए) हैं, संदत्त और उपयोजित की जाए, जिनका वित्तीय वर्ष 2017-2018 की अवधि में अनुसूची के द्वितीय स्तम्भ में विनिर्दिष्ट सेवाओं और प्रयोजनों से सम्बन्धित विभिन्न प्रभारों कोे चुकाने के लिए उपयोग किया जाएगा।

to authorise payment and appropriation of certain further sums from and out of the

Consolidated Fund of the State of Himachal Pradesh for the services for the financial year ending

on the 31st day of March, 2018.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation Act, 2018.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be further appropriated for the services and purposes expressed in the Schedule in relation to the period specified under section 2 of this Act.

AN

ACT

to authorise payment and appropriation of certain sums from and out of the Consolidated

Fund of the State of Himachal Pradesh for the services for the financial year 2018-2019.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation (No. 2) Act, 2018.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be appropriated for the services and purposes expressed in the Schedule in relation to the said year.

Fund of the State of Himachal Pradesh for the services for the financial year 2018-2019.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation (No. 2) Act, 2018.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be appropriated for the services and purposes expressed in the Schedule in relation to the said year.

STATEMENT OF OBJECTS AND REASONS

This Bill is introduced in pursuance of clause (1) of Article 204 of the Constitution of India to provide for the appropriation from and out of the Consolidated Fund of the State of Himachal Pradesh of the moneys required to meet the expenditure charged on the Consolidated Fund and other expenditure as voted by the Legislative Assembly in respect of the estimated expenditure of the Government of Himachal Pradesh for the financial year 2018-2019.

सर्वसाधारण को सूचित किया जाता है कि भीमा देवी पत्नी श्री तेजा सिंह, निवासी गांव देहुरी, डा0 कनौन, उप-तहसील सैंज, जिला कुल्लू, हिमाचल प्रदेश ने अधोहस्ताक्षरी की अदालत में एक दरख्वास्त गुजारी है कि प्रार्थिन का नाम विद्यालय रिकार्ड में प्रीतमा देवी दर्ज है जबकि प्रार्थिन के ग्राम पंचायत कनौन के रिकार्ड में प्रार्थिन का नाम भीमा देवी दर्ज है जो कि दोनों नाम इसी के हैं। ग्राम पंचायत कनौन के परिवार रजिस्टर, जन्म रजिस्टर में प्रार्थिन का नाम भीमा देवी के स्थान पर भीमा देवी उर्फ प्रीतमा देवी दुरुस्त कर दर्ज करवाने बारे दिया गया शपथ-पत्र भी संलग्न है ग्राम पंचायत कनौन के रिकार्ड में उक्त दुरुस्ती की जावे।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि इस सम्बन्ध में किसी भी व्यक्ति को किसी प्रकार की आपत्ति हो तो वह असालतन या वकालतन अपनी आपत्ति इस न्यायालय में दिनांक 16-04-2018 या इससे पूर्व प्रस्तुत कर सकता है अन्यथा इसका इन्द्राज ग्राम पंचायत तलाड़ा, उप-तहसील सैंज, जिला कुल्लू के रिकार्ड में करवा दिया जाएगा।
