4. गैर सरकारी सदस्यों का यात्रा भत्ता उक्त बोर्ड द्वारा वहन किया जाएगा।

अनुबन्ध-"क" श्री रेणुका विकास बोर्ड, जिला सिरमौर, हिमाचल प्रदेश अपने कार्यकाल के दौरान निम्न कार्य करेंगेः- 1. रेणुका तीर्थ को पर्यटन विकास की दृष्टि से विकसित करना

2. रेणुका तीर्थ के भू-दृश्य सहित मन्दिर का जीर्णोद्धार, रेणुका झील, परशुराम ताल तथा देव स्थलों आदि की मुरम्मत और विकास पूर्ण रूप से करने हेतु प्रावधान करना।

3. इस क्षेत्र में यात्रियों हेतु यात्री भवन, शालाओं तथा कुटियाें का निर्माण और पर्यटन का विकास करना।

4. बोर्ड के अधीन सभी पवित्र संस्थानों जैसे रेणुका झील, परशुराम ताल, मेला ग्राउंड और देव स्थल आदि के सौंदर्यकरण हेतु रख-रखाव रखना।

5. रेणुका मेला और अन्य उत्सवों जैसे परशुराम जयन्ती आदि के समारोहों का आयोजन 6. रेणुका तीर्थ के आस-पास पूर्व निर्मित मंदिरों/बनाए जाने वाले मंदिरों का प्रबंध करना 588 राजपत्र, हिमाचल प्रदेश, 16 अप्रैल, 2018/26 चैत्र, 1940 7. बोर्ड के कार्यों के सचांलन हेतु नियम तथा उप-नियम बनाना और सरकार की स्वीकृति प्राप्त करने के पश्चात समय-समय पर उनमें नए नियम/उप-नियम शामिल करना तथा संशोधन करना।

8. बोर्ड के लेखों का ठीक प्रकार से हिसाब अन्य सम्बन्धित अभिलेखों के साथ करना

9. बोर्ड के लिए कर्मचारी वर्ग की नियुक्ति करना और कर्मचारी वर्ग को वेतन, मानदेय आदि प्रदान करना।

No. 11-1/85(Lab) ID/2014-Kangra.—Whereas Shri Ashok s/o Shri Billu, r/o Village and Post Office Sulyali, Tehsil Nurpur, District Kangra, H.P. had raised a demand notice dated 23-07-2011 regarding his illegal termination from the services by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P. The Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, H.P.; And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. was considered, examined and Deputy Labour Commissioner, H.P. as589 राजपत्र, हिमाचल प्रदेश, 16 अप्रैल, 2018/26 चैत्र, 1940 appropriate Government came to the conclusion that above worker had raised the dispute at a belated stage of nearly 24 years and therefore declined the reference of the dispute vide order dated 13-11-2014;

And whereas Shri Ashok s/o Shri Billu agitated the above orders of declining of reference before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 422/2016. The Hon'ble High Court of Himachal Pradesh has disposed off the civil writ petition on 03-03-2016 and directed the respondents to consider the case of the petitioner, in terms of the judgment, dated 30th December, 2014 delivered by Hon'ble High Court of H.P. in a batch of writ petitions, CWP No. 9467 of 2014 case titled Pratap Chand versus Himachal Pradesh State Electricity Board and others within eight weeks. The operative part of the judgment is reproduced as follows;

"3. In the given circumstances, we deem it proper to direct the respondents to consider the

cases of the petitioners, in terms of the judgment (supra), and make a decision within

eight weeks. The said judgment shall form part of this judgment also.

4. The writ petitions is disposed of accordingly, alongwith pending applications, if any."

Therefore, in view of above the undersigned while exercising the powers vested in me vide Himachal Pradesh Government Notification No. Shram(A) 4-9/2006- IV-Loose, dated 15th February, 2014 and as per power vested under sub section 1 of Section 10 of the Industrial Dispute Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court-cum- Industrial Tribunal, Dharamsala, constituted under Section-7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether alleged termination of services of Shri Ashok s/o Shri Billu, r/o Village and Post Office Sulyali, Tehsil Nurpur, District Kangra, H.P. during October, 1987 by the Executive Engineer, H.P.P.W.D. Division, Jawali, District Kangra, H.P., who had worked on daily wages as beldar and has raised his industrial dispute after nearly 24 years vide demand notice dated 23-07-2011, without complying the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, keeping in view of delay of nearly 24 years in raising the industrial dispute, what amount of back wages, seniority, past service benefits and compensation the above ex-worker is entitled to from the above employer/ management?"

Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H.P. was considered, examined and the Labour Commissioner, Himachal Pradesh vested with the powers of appropriate Government came to the conclusion that above worker had raised the industrial dispute at a belated stage after period of nearly 10 years from the date of her alleged illegal termination and therefore declined the reference of the dispute vide order dated 11-12-2012 for adjudication;

And whereas Smt. Beena Devi W/O Shri Dharam Pal agitated the above orders of declining of reference for adjudication of her industrial dispute to the Ld. Labour Court before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 2646/2013. The Hon'ble High Court of Himachal Pradesh has dismissed the civil writ petition on 18-06-2013. Thereafter, Smt. Beena Devi w/o Shri Dharam Pal agitated the Judgment of the Hon'ble High Court dated 18-06-2013 before the Hon'ble Supreme Court of India vide Civil Appeal No. 18012-18013 of 2017 [Special Leave Petition (C) Nos. 30103-30104 of 2017]. The Hon'ble Supreme Court of India has decided the Civil Appeal (above) on 06-11-2017. The operative part of the judgment is reproduced as follows;

"5. Therefore, these appeals are allowed with a direction to respondent No.-1 that the

cases of the appellants shall also be considered for reference, ignoring the objection in

the matter of delay.

6. Needful be done within two months from the date of production of a copy of this

judgment."

The Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, H.P.; And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Dharamshala, District Kangra, H.P. was considered, examined and Deputy Labour Commissioner, H.P. as appropriate Government came to the conclusion that above worker had raised the dispute at a belated stage of after 23 years and therefore declined the reference of the dispute vide order dated 13-11-2014;

And whereas Shri Bir Singh s/o Shri Kishan Chand agitated the above orders of declining of reference before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 402/2016. The Hon'ble High Court of Himachal Pradesh has disposed of the civil writ petition on 01-03-2016 and directed the Labour Commissioner, H.P. to make reference to the Industrial Tribunal-cum-Labour Court within six weeks. The operative part of the judgment is reproduced as follows :

"3 In the given circumstances, we deem it proper to quash the impugned orders in the writ

petitions and direct the Labour Commissioner, H.P. to make reference to the Industrial

Tribunal-cum-Labour Court within six weeks from today. Ordered accordingly. The

writ petitions are disposed of, as indicated hereinabove, along with all pending

applications, if any."

Therefore, in view of above the undersigned while exercising the powers vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006-IV-Loose, dated 15th February, 2014 and as per power vested under Sub Section-1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) this industrial dispute is referred to the Labour Court-cum- Industrial Tribunal, Dharamshala, constituted under Section-7 of Act ibid, on the following issue/issues for legal adjudication;

The Hon'ble High Court of Himachal Pradesh has disposed off the civil writ petition on 02-03-2016 and directed the respondents to consider the case of the petitioner, in terms of the judgment, dated 30th December, 2014 delivered by Hon'ble High Court of H. P. in a batch of writ petitions, CWP No. 9467 of 2014 case titled Pratap Chand Versus Himachal Pradesh State Electricity Board and others within eight weeks. The operative part of the judgment is reproduced as follows:

"3. In the given circumstances, we deem it proper to direct the respondents to consider the

cases of the petitioners, in terms of the judgment (supra), and make a decision within

eight weeks. The said judgment shall form part of this judgment also.

4. The writ petitions is disposed of accordingly, alongwith pending applications, if any."

Salogra, Tehsil & District Solan, Himachal Pradesh have filed an application alongwith affidavits in the court of undersigned that they have solemnized their marriage on 07-04-2016 according to Hindu custom at Shoolini Temple Solan. Hence their marriage may be registered under the H.P. Registration of marriages Act, 1996.
