संख्या ईण्ड-ए(एफ)19-21/2005-वोल्यूम-I.—हिमाचल प्रदेश के राज्यपाल, सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, 2006 (2006 का 27) की धारा 21 के साथ पठित धारा 30 द्वारा प्रदत्त शक्तियों का 18-राजपत्र/2018-26-04-2018 (853) 854 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 प्रयोग करते हुए, पूर्वोक्त अधिनियम के उपबंधों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सूक्ष्म और लघु उद्यम सरलीकरण परिषद्‌ नियम, 2018 है।

(2) इन नियमों का विस्तार सम्पूर्ण हिमाचल प्रदेश राज्य पर होगा।

(3) ये नियम राजपत्र, हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. परिभाषाएं.--(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से सूक्ष्म, लघु और मध्यम उद्यम विकास अधिनियम, 2006 (2006 का 27) अभिप्रेत है;

(ख) ''माध्यस्थम्‌ और सुलह अधिनियम'' से, माध्यस्थम्‌ और सुलह अधिनियम, 1996 (1996 का 26) अभिप्रेत है;

(ग) ''परिषद्‌'' से, अधिनियम की धारा 20 के अधीन सरकार द्वारा गठित हिमाचल प्रदेश सूक्ष्म और लघु उद्यम सरलीकरण परिषद्‌ अभिप्रेत है;

(घ) ''अध्यक्ष'' से, अधिनियम की धारा 21 की उपधारा (1) के खण्ड (i) के अधीन नियुक्त परिषद्‌ का अध्यक्ष अभिप्रेत है;

(ङ) ''सरकार'' से, हिमाचल प्रदेश सरकार अभिप्रेत है;

(च) ''संस्था'' से, अधिनियम की धारा 18 की उपधारा (2) और (3) में उल्लिखित आनुकल्पिक विवाद निपटान सेवा प्रदान करवाने वाली कोई संस्था या केन्द्र अभिप्रेत है;

(छ) ''सदस्य'' से, परिषद्‌ का सदस्य अभिप्रेत है; और

(ज) ''धारा'' से, अधिनियम की धारा अभिप्रेत है।

(2) उन शब्दों और पदाें के जो इन नियमाें में प्रयुक्त हैं और जो इन नियमों में परिभाषित नहीं हैं, किन्तु अधिनियम में परिभाषित हैं, के वही अर्थ होंगे जो क्रमशः अधिनियम में उनके हैं।

3. परिषद्‌ के सदस्योेंं की नियुक्ति और रिक्तियोेंं के भरने की रीति.--(क) परिषद्‌ का गठन अध्यक्ष सहित कम से कम तीन और अधिक से अधिक पांच सदस्यों से होगा ।

(ख) सरकार अधिनियम की धारा 21 की उपधारा (1) के खण्ड (ii), (iii) और (iv) के अनुसार सदस्यों की नियुक्ति करेगी।

(ग) धारा 21 की उपधारा (1) के खण्ड (ii), (iii) और (iv) के अधीन नियुक्त कोई सदस्य परिषद्‌ का सदस्य नहीं रहेगा यदि वह उस प्रवर्ग, जिससे वह इस प्रकार नियुक्त किया गया/की गई है, का प्रतिनिधित्व नहीं करता है/करती है।

(घ) यदि परिषद्‌ के किसी सदस्य की मृत्यु हो जाने पर या त्यागपत्र देने पर या त्यागपत्र दिया गया समझे जाने पर या पद से हटाए जाने पर या सदस्य के रुप में कार्य करने में असमर्थ होने पर, सरकार उस रिक्ति को भरने के लिए किसी अन्य व्यक्ति को नियुक्त कर सकेगी।855 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 (ङ) परिषद्‌ का कोई सदस्य सरकार को लिखित में एक मास का नोटिस देकर परिषद्‌ से त्यागपत्र दे सकेगा।

(च) सरकार किसी सदस्य को पद से हटा सकेगी -

(i) यदि वह वि—तचित्त है और सक्षम न्यायालय द्वारा इस प्रकार घोषित किया गया है; या (ii) यदि वह शोधाक्षम या दिवालिया हो गया है या उसने लेनदारों का संदाय नहीं किया है; या (iii) यदि वह ऐसे किसी अपराध का सिद्धदोष ठहराया गया हो जो भारतीय दण्ड संहिता, 1860 (1860 का अधिनियम संख्यांक 45) के अधीन दण्डनीय है; या

(iv) यदि वह अध्यक्ष की अनुमति के बिना परिषद्‌ की लगातार तीन बैठकों से अनुपस्थित रहता है, और किसी भी दशा में चाहे अध्यक्ष की अनुज्ञा से भी लगातार पांच बैठकों से अनुपस्थित रहता है; या

(v) ऐसे वित्तीय या अन्य हित अर्जित करता है जो सरकार की राय में उसके सदस्य के रूप में —त्यों को संभाव्य प्रतिकूलतः प्रभावित करते हैं।

4. परिषद्‌ के —त्यों के निर्वहन मेंं अनुसरण की जाने वाली प्रक्रिया.--(i) कोई असंतुष्ट सूक्ष्म और लघु उद्यम इकाई इन नियमाें की अनुसूची-1 में यथा उपबंधित प्रपत्र में क्षेत्र की अधिकारिता रखने वाली परिषद्‌ को सन्दर्भ भेज सकेगी। संदर्भ में असंतुष्ट सूक्ष्म और लघु उद्यम इकाई का उद्योग आधार ज्ञापन (उ0आ0ज्ञा0) नम्बर, मोबाईल नम्बर और ई-मेल पता अन्तर्विष्ट होगा।

(ii) ऐसे सन्दर्भ, सरकार द्वारा यथा अधिसूचित फीस या प्रसंस्करण प्रभार, असंतुष्ट सूक्ष्म और लघु उद्यम इकाई से वचनबंध कि उसने उसी विवाद में सिविल न्यायालय के समक्ष कोई संदर्भ नहीं किया है, सहित किए जाएंगे ।

(iii) आपूर्तिकर्त्ता सूक्ष्म और लघु उद्यम इकाई से सन्दर्भ की प्राप्ति पर परिषद्‌ इस प्रयोजन के लिए बनाए गए वैब/पोर्टल में डाटा दर्ज (अपलोड) करेगा।

(iv) डाटा दर्ज (अपलोड) करने के पश्चात्‌ आवेदक सूक्ष्म और लघु उद्यम इकाई को सन्दर्भ की प्राप्ति की अभिस्वी—ति ई-मेल द्वारा भेजी जाएगी।

(v) परिषद्‌ प्रारम्भिक स्तर पर सन्दर्भ को दर्ज करने के लिए सूक्ष्म और लघु उद्यम इकाई की फीस या समर्थता की बाबत जांच करने के लिए संदर्भ का परीक्षण कर सकेगी।

(vi) किसी मामले में, यदि संदर्भ या इसमें दर्ज ब्यौरे परिषद्‌ के समाधानप्रद नहीं पाए जाते हैं तो वह उसे वापिस कर सकेगी।

(vii) परिषद्‌ मामले में या जो स्वयं सुलह करवा सकेगी या सुलह करने के लिए किसी संस्था की सहायता ले सकेगी और यदि वह ऐसा करने का विनिश्चय करती है तो संस्था के लिए पक्षकारों को निर्दिष्ट कर सकेगी।

(viii) संस्था, जिसको मामला निर्दिष्ट किया गया है, सुलह करवाने के बारे में प्रयास करेगी और वह यथाशक्य शीघ्र, परिषद्‌ को निर्दिष्ट संदर्भ की तारीख से सामान्यतः पन्द्रह दिन के भीतर परिषद्‌ को उसकी रिपोर्ट प्रस्तुत करेगी। 856 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 (ix) जहां सुलह सफल नहीं होती है और पक्षकारों के बीच बिना किसी समझौते के निरस्त हो जाती है तो परिषद्‌ या तो विवाद पर स्वयं आगामी कार्रवाई अर्थात्‌ माध्यस्थम्‌ कर सकेगी या उसे इस प्रयोजन के लिए किसी संस्था को निर्दिष्ट करेगी।

(x) परिषद्‌ पंचाट को अंतिम रुप देने के पश्चात्‌ या संस्था से पंचाट प्राप्त होने के पश्चात्‌ मामले पर विचार करेगी और मामले में समुचित अन्तिम आदेश पारित करेगी।

5. परिषद्‌ की बैठक और गणपूर्ति.--(i) परिषद्‌ की बैठक सामान्यतः सात दिन के नोटिस देने के पश्चात्‌ आयोजित की जाएगी।

(ii) तथापि अत्यावश्यकता के मामले में बैठक, ऐसे अल्प अवधि के नोटिस, जो अध्यक्ष उचित समझे, बुलाई जा सकेगी।

(iii) बैठक के लिए समस्त नोटिस/संसूचना याचिकाकर्त्ता को अल्प संदेश सेवा (एस0एम0एस0) और ई-मेल द्वारा सूचित की जाएगी।

(iv) परिषद्‌ एक मास में नियमित रूप से कम से कम एक बैठक आयोजित करेगी।

(v) बैठक की गणपूर्ति, यदि सदस्यों की संख्या तीन या चार होने की दशा में, दो से और यदि सदस्यों की संख्या पांच होने की दशा में, तीन से होगी।

6. परिषद्‌ के विनिश्चय.--(i) परिषद्‌ का कोई भी निर्णय परिषद्‌ की बैठक में उपस्थित इसके सदस्यों के बहुमत द्वारा किया जाएगा।

(ii) धारा 18 के अधीन किया गया प्रत्येक सन्दर्भ ऐसे सन्दर्भ के किए जाने की तारीख से 90 दिन की अवधि के भीतर किया जाएगा।

(iii) परिषद्‌, परिषद्‌ की प्रत्येक बैठक की कार्यवाहियां, प्रयोजन के लिए बनाए गए वैब पोर्टल पर अपलोड करवाएगी।

(iv) परिषद्‌ द्वारा या तो स्वयं या आनुकल्पिक विवाद समाधान सेवाएं उपलब्ध करवाने वाली किसी ऐसी संस्था या केन्द्र, जिसे परिषद्‌ द्वारा सन्दर्भ निर्दिष्ट किया गया है, द्वारा पारित की गई किसी डिक्री, पंचाट या अन्य आदेशों के अपास्त करने के लिए कोई आवेदन किसी न्यायालय द्वारा तब तक ग्रहण नहीं किया जाएगा जब तक कि अपीलार्थी (जो प्रदायकर्ता नहीं है) ने ऐसे न्यायालय द्वारा निदेशित रीति में, यथास्थिति, डिक्री, पंचाट या अन्य आदेश के निबंधनों के अनुसार उस रकम का पचहार प्रतिशत उसके पास जमा न कर दिया हो।

7. प्रगति रिपोर्ट.--(i) परिषद्‌, परिषद्‌ की वार्षिक प्रगति रिपोर्ट सहित आधारभूत सूचना, प्रयोजन के लिए बनाए गए वैब पोर्टल पर अपलोड करवाएगी।

(ii) परिषद्‌, अधिनियम में यथा परिभाषित रीति में राष्ट्रीय सूक्ष्म, लघु और मध्यम उद्यम बोर्ड के सदस्य-सचिव को समय-समय पर अपेक्षित रीति और प्ररूप में, सूचना उपलब्ध करवाएगी।

8. निरसन और व्यावृत्तियां.--(1) हिमाचल प्रदेश सूक्ष्म और लघु उद्यम सुगमीकरण (सरलीकरण) परिषद्‌ नियम, 2007 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित नियमों के अधीन की गई कोई बात या कार्रवाई इन नियमों के तत्स्थानी उपबंधों के अधीन की गई समझी जाएगी।857 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 अनुसूची-I हिमाचल प्रदेश सूक्ष्म और लघु उद्यम सरलीकरण परिषद्‌ को देरी से भुगतान के संदर्भ हेतु प्रपत्र सेवा में अध्यक्ष, हिमाचल प्रदेश सूक्ष्म और लघु उद्यम सरलीकरण परिषद्‌, ...............................................................................................................................

NOTIFICATION

Shimla-2 the 16th April, 2018

File No. Ind-A(F)19-21/2005-Vol-I.—In exercise of the powers conferred by section 30 read with section 21 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the Governor of Himachal Pradesh is pleased to make the following rules for carrying out the provisions of the Act ibid, namely:—

1. Short title, extent and commencement.—(1) These rules may be called the Himachal Pradesh Micro and Small Enterprises Facilitation Council Rules, 2018.

(2) They shall extend to the whole of the State of Himachal Pradesh.

(3) They shall come into force from the date of their publication in the Official Gazette.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006);

(b) "Arbitration and Conciliation Act" means the Arbitration and Conciliation Act, 1996 (26 of 1996);

(c) "Council" means the Himachal Pradesh Micro and Small Enterprises Facilitation Council, established by the Government under section 20 of the Act;

(d) "Chairperson" means the Chairperson of the Council appointed under clause (i) of sub-section (1) of section 21 of the Act;

(e) "Government" means the Government of the Himachal Pradesh;

(f) "Institution" means any institution or centre providing alternate dispute resolution service referred to in sub-section (2) and (3) of section 18 of the Act; (g) "member" means a member of the Council; and

(h) "Section" means a section of the Act.

(2) The words and expressions used and not defined in these rules, but defined in the Act shall have the meanings respectively as assigned to them in the Act.

3. Manner of Appointment of Members and filling up of vacancies of the Council,—(a) The Council shall consist of minimum three and maximum five members, including the Chairperson.

(b) The Government shall appoint the Members as per clause(ii), (iii) and (iv) of sub- section (1) of section 21 of the Act.

(c) A member appointed under clauses (ii), (iii) and (iv) of subsection (1) of section 21 shall cease to be a member of the council, if he or she ceases to represent the category in which he or she was so appointed.

(d) When a member of the council dies or resigns or is deemed to have resigned or is removed from office or becomes incapable of acting as a Member, the Government may appoint another person to fill that vacancy.

(e) Any Member of the Council may resign from the Council by tendering one month's notice in writing to the Government.

(f) The Government may remove any member from office—

860 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 (i) If he is of unsound mind and has been so declared by a competent court; or (ii) If he becomes bankrupt or insolvent or does not make payment to his creditors; or (iii) If he is convicted of any offence which is punishable under the Indian Penal Code (Act XLV of 1860), or

(iv) If he abstains himself/herself from three consecutive meetings of the Council without the leave of the Chairperson, and in any case from five consecutive meeting even with the permission of the Chairperson; or

(v) Acquires such financial or other interest as is likely, in the opinion of the Government, to affect prejudicially his functions as a Member.

4. Procedure to be followed in the discharge of functions of the Council.—(i) An aggrieved Micro and Small Enterprise unit can move a reference to the Council having jurisdiction of the area in the format as provided in the Schedule-I of these rules. The reference shall contain the Udyog Aadhar Memorandum (UAM) number, mobile number and email address of aggrieved Micro and Small Enterprise unit.

(ii) Such references shall be attached with fee or processing charges as notified by the Government and with an undertaking from aggrieved Micro and Small Enterprise unit that it has not moved a reference before the Civil Court in the same dispute.

(iii) Upon receipt of reference from the supplier Micro and Small Enterprise unit, the Council shall enter the data in the web/portal created for this purpose.

(iv) After entering the data, acknowledgement of the receipt of reference shall be issued to the applicant Micro and Small Enterprise unit through email.

(v) The Council may examine the reference at preliminary stage to check regarding the fee or competency of Micro and Small Enterprise unit to file the reference.

(vi) In case, if the reference or the particulars entered in it are not found to the satisfaction of Council, the same may be returned.

(vii) The Council shall either itself conduct conciliation in the matter or seek the assistance of any institution for conducting the conciliation and if, it decides to do so, shall refer the parties to the Institution.

(viii) The Institute to which the issue is referred makes efforts to bring about the conciliation and it shall submit its Report to the Council as soon as possible, usually within 15 days from the date of reference referred to the Council.

(ix) Where the conciliation is not successful and stands terminated without any settlement between the parties, the Council shall either itself take up the dispute for further action, i.e. arbitration or refer it to an ' institution' for the same.

(x) The Council, after finalizing the award or receiving the award from the Institution, shall consider the case and pass an appropriate final order in the matter.

5. Meeting of the Council and Quorum.—(i) The meeting of the Council shall be ordinarily held after giving seven days notice.

(ii) However, in case of urgency, it can be called at such short notice as the Chairperson may find suitable.

(iii) All the notices /communication for the meeting shall be informed to the petitioner including through Short Message Service and email.

(iv) The Council shall hold regular meetings, at least once a month.

(v) The quorum of meeting will be two, in case, if the number of members is three or four and it will be three if the number of members is five.

6. Decisions of the Council.—(i) Any decision of the Council shall be made by a majority of its members present at the meeting of the Council.

(ii) Every reference made under section 18 shall be decided within a period of ninety days from the date of making such reference.

(iii) The Council shall upload the proceedings of every meeting of the Council on the web portal created for the purpose.

(iv) No application for setting aside any decree, award or other orders made either by the Council itself or by any institution or centre providing alternate dispute resolution services to which a reference is made by the Council, shall be entertained by any court, unless the appellant (not being a supplier) has deposited with it seventy five percent of the amount, in terms of the decree, award or, as the case may be, the other order in the manner directed by such court.

7. Progress Report.—(i) The Council shall upload the basic information including the annual progress report of the Council on the web portal created for the purpose.

(ii) The Council shall provide information to the Member-Secretary of National Board for Micro, Small and Medium Enterprises as defined in the Act in the manner and form required from time to time.

8. Repeal and Savings.—(1) The Himachal Pradesh Micro and Small Enterprises Facilitation Council Rules, 2007 is hereby repealed.

(2) Notwithstanding such repeal any action taken or anything done under the rules so repealed shall be deemed to have been taken or done under the corresponding provisions of these rules.

Shimla-171001, the 1st March, 2018

No. 11-23/84(Lab) ID/2012-Mandi.—Whereas Shri Daler Khan s/o Shri Nazir Khan, r/o Village Bhadyar, P.O. Brang, Tehsil Sarkaghat, District Mandi, H.P. had submitted his demand notice dated 04-10-2009 regarding his illegal termination from the services by the Executive Engineer, H.P.P.W.D. Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. The Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H.P. tried to settle the industrial dispute amicably, but the same could not be settled during the course of conciliation proceedings, where after he sent a report under Section 12(4) of the Industrial Disputes Act, 1947 to the Labour Commissioner, Himachal Pradesh;

And whereas the report sent by the Labour Officer-cum-Conciliation Officer, Mandi, District Mandi, H.P. was considered, examined and the Labour Commissioner, Himachal Pradesh vested with the powers of appropriate Government came to the conclusion that above worker had raised the industrial dispute at a belated stage after period of more than 11years from the date of his alleged illegal termination and therefore declined the reference of the dispute vide order dated 16- 03-2012 for adjudication;

And whereas Shri Daler Khan s/o Shri Nazir Khan agitated the above orders of declining of reference for adjudication of his industrial dispute to the Ld. Labour Court before the Hon'ble High Court of Himachal Pradesh vide C.W.P. No. 2646/2013. The Hon'ble High Court of Himachal Pradesh has dismissed the civil writ petition on 18-06-2013. Thereafter, Shri Daler Khan s/o Shri Nazir Khan agitated the Judgment of the Hon'ble High Court dated 18-06-2013 before the Hon'ble873 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 Supreme Court of India vide Civil Appeal No. 18012-18013 of 2017 (Special Leave Petition (C) Nos. 30103-30104 of 2017). The Hon'ble Supreme Court of India has decided the Civil Appeal (above) on 06-11-2017. The operative part of the judgment is reproduced as follows;

"5. Therefore, these appeals are allowed with a direction to respondent No.-1 that the

cases of the appellants shall also be considered for reference, ignoring the objection in

the matter of delay.

6. Needful be done within two months from the date of production of a copy of this

judgment."

Therefore, in view of above Judgment /directions of the Hon'ble Supreme Court of India, the undersigned while exercising the powers of appropriate Government vested in me vide Himachal Pradesh Government Notification No. Shram(A)4-9/2006- IV-Loose, Dated 15th February, 2014 and as per power vested under sub-section-1 of Section 10 of the Industrial Disputes Act, 1947 (14 of 1947) make a reference to the Labour Court-cum-Industrial Tribunal, Dharamsala, constituted under Section-7 of Act ibid, on the following issue/issues for legal adjudication;

"Whether termination of the services of Shri Daler Khan s/o Shri Nazir Khan, r/o Village Bhadyar, P.O. Brang, Tehsil Sarkaghat, District Mandi, H.P. by the Executive Engineer, H.P.P.W.D. Division, Dharampur, Tehsil Sarkaghat, District Mandi, H.P. w.e.f. 07-07-2005 without complying with the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, what amount of back wages, seniority, past service benefits and amount of compensation the above aggrieved worker is entitled to from the above employer?"

Jandru, Tehsil Sujanpur, District Hamirpur, H.P. and Shankutla Devi aged 63 years, d/o Juana alias Jivan Singh r/o Village Gubbher, P.O.Bherda,Tehsil Tauni Devi (Bamsan) Distt. Hamirpur, H.P.) have filed an application alongwith affidavits in this court under Section 16 of Special 874 राजपत्र, हिमाचल प्रदेश, 26 अप्रैल, 2018/06 वैशाख, 1940 Marriage Act, 1954 (Central Act) as amended by the Marriage Laws (Amendment Act 01, 49 of 2001) that they have solemnized their marriage ceremony on 08-03-1972 at Village Gubbher, P.O.Bherda, Tehsil Tauni Devi (Bamson) District Hamirpur, Himachal Pardesh as per Hindu Rites and Customs and they are living together as husband and wife since then. Hence their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that any person who has any objections regarding this marriage can file the objections personally or in writing before this court on or before 07-05-2018. After that no objections will be entertained and marriage will be registered accordingly.
